State defies court order and blocks Former President Rupiah Banda from boarding plane to Kenya

Former President Rupiah Banda is said to be stranded at Kenneth Kaunda International airport because he has been blocked from boarding a Kenyan Airways plane to Nairobi where he was invited to attend the innauguration ceremony of newly elected Kenyan President Uhuru Kenyatta.

This is despite a court order that allows Rupiah Banda to travel abroad in view of his passport being in custody of the state after it was taken following his arrest on graft charges.
Kennedy Limwanya, the assistant administrator to Rupiah Banda said immigration officials at the airport said they received instructions from ‘higher authorities’ not to allow the former president’s travel to Kenya.

There were strong moves by the state through Director of Public Prosecutions Mutembo Nchito to block Mr. Banda from flying to Nairobi by refusing to release his passport.However Mr. Banda’s lawyers made a quick application to the Magistrate that forced the state to release the passport.

Rupiah Banda was invited by the Kenyan government to attend the inauguration ceremony of that country’s fourth President Uhuru Kenyatta.
President Banda,was the leader of the Carter Centre international election observer mission at the Kenyan elections.

Former President Rupiah Banda, received international recognition for his role in the Carter Centre election observer mission.The Carter Centre vice-president for peace programmes Dr John Stremlau said his team was happy to have President Banda as its leader, a pointer to how African problems were capable of being solved by Africans.

  3. I think the PF government is running out of its senses. There is nothing ‘wrong for RB to travel. Dont be jealousy of RB. He served Zambia as a Head of State, and he deserves respect. He is innocent until proven quilty. Its totally silly behavior of the PF government to behave in this manner. Time will tell. Chiluba mistreated Kaunda, and he got what he wanted. President Sata may also pay for doing wrong things one day. Dont worry RB…. its a days event.

  11. We warned Zambians that PF govt will not make any mark of pride in Zambia and at international level. We again warned you that Sata is a dictator without any regard of rule of law. Sata was evacuated to South africa for treatment by RB as opposition leader demonstrating RB was above politics. RB has earned internation recognition and he deserves it. To prove that RB despite weaknesses and allegations leveled against is a better leader and well placed in international circles as a statesman, it is of necessity that Sata MUST BAR HIM TO TRAVEL AND WITNESS FRUITS OF HIS EFFORTS to bring about good governance in another African state.   16. These are the reasons why African leaders never leave power. We are indeed setting a very bad example after setting a good one when RB stepped down. I think we need level mindedness when dealing with issues of such magnitude. As leader of the Carter Centre team, he should have been allowed to go. This is to say the least appalling and lets start respecting all our former Presidents.

He and his inviters believe they can always ignore government when they invite him… Now let them reflect and consider involving government next time they want to invite him.     Correction, RB didn’t step down he was defeated in an election. Infact we must change the law on presidential retirement benefits.
    Only those presidents that completely serve two terms or die in office, or do not seek reelection at the end of first term will be deemed as retired, and entitled to full benefits.

    Defeated ones like RB will get housing, security, office. Giving full benefits to a defeated president is like rewarding a fired employee, giving them separation package including pension.

    If not then lets extend the same package to all workers

    It seems all this is based on personal hatred and petty jealousy and it is setting a dangerous precedent. It will not end with RB.
    My other view is that if I were RB with the ongoing court case I would personally put on hold all these other engagements and concentrate on the case.

  38. Indeed this is being petty and the Acting President must be seen to act in favour of the law. For crying out loud Ex President Banda is no danger for running away as the old man is deep rooted in Zambia and would be miserable to live overseas. Besides, he would automatically lose his freedom once extradited back to Zambia since he would have proved not to be reliable if at all he decided not to return. RB is highly regarded for the smooth turn out of the Kenyan elections and that is not only his success but the country as a whole. Let the man go attend the inauguration.

  39. Some postings are completely devoid of any serious thinking or analysis. RB is out on bail and one of his bail conditions is that he is not allowed to leave the jurisdiction of Zambia. Robert Amsterdam has been advising RB using the example of jailed Russian billionaire Mikhail Borisovich Khodorkovsky who ignored Amsterdam’s advice and returned to Russia only to be jailed. The same advice Amsterdam has given to Henry Banda who is now a fugitive in South Africa. State prosecutors know that there is a chance RB could be a potential flight risk.

  40. Bwana Mwape (and others). The court only released his diplomatic passport that had been withheld by the state. It did not rule that he be allowed to travel, that is a separate immigration issue all together. May be the heading on this article is misleading. RB should have thought of the consequences of his actions such as denying knowledge of the whereabouts of his son Henry; discrediting the government on foreign soil; fighting the removal of his immunity; holding a secret meeting with the South African Embassy officials. All these things show that he is desperate and is a flight risk.

This is no different from the late President Chiluba when he was allowed to travel for medical attention in South Africa.   57. I am watching Uhuru Kenyatta’s inaugural address. Very uplifting. Wonder why Gay Scott, Kaunda etc are even there. Permission for any citizen or visitor to enter or exit Zambia rests with Immigration which is different from DPP and courts. They deserve the right to stop any body at any time including RB, you and me to preserve security of the nation. He is forgetting that immigration knows that Henry has got genes of running away which he got from his father and you do not need any DNA tests to prove it.   71. Bail conditions have to be fulfilled regardless of his former status. The immigration dept also reserve the right to refuse/stop the exit from Zambia by a citizen or a person who is a holder of a Zambian passport. This is so especially if the individual is facing serious charges in court.

  76. RB Lawyers should cite the immigration chap for Court Contempt for disobeying a legitimate court order not like the one Mutembo Nchito forged.If I were the court,I would jail this immigration rascal for six months to serve as a warning to others who obey illegal commands.

  78. @78 MANO it’s not my principle to attack other bloggers contributions because I learn from others what I don’t know and they learn from me what they don’t know. If you hold visa or passport whch RB was crying about, you do not need permission from the court or any body to travel. You just have to declare and clear yourself at entry or exit point. There are so many authorities at point of entry/exit who as well work independently like ZRA, Customs & Immigration whom you have to clear with. As far as current immigration laws stand he is neither the first nor the last. Chiluba’s case was emergency treatment which needed personal travel. Banda’s is ceremonial which can be delegated as President Sata / Lungu did. Fight for the laws to be changed but not sympathy or goodwill expectation.

  81. @INDIGENOUS ZAMBIAN, I dont know how many times you have to make the point very clear on the functions or the courts and immigration. It is a pity some bloggers here dont get it or they just have total ignorance on Civic Education. Various government departments have different duties vis a vis, education ministry to look at education, Home affairs for internal matters, foreign for matters that boarder foreign relations, Judiciary for justice and laws.The work of a a judge who is a member of Judiciary can not supervise the work of who goes and comes in the country this is the work of the immigration. These guys who lacks civic knowledge should not spread their ignorance anyhow – well freedom of speech right, ye, but separate fiction from real.

  83. Of all the good things the pf is doing such as increasing the electricity capacity, building roads and bridges, why tarnish all that with rb. Let the man leave, if he were a flight risk he could have left long time ago, I am sure he knew charges against him were in the pipeline. Zambia is such a huge country that if he really wanted to sneak out of the country, it would be very easy ask xavier or kofi those guys had no problem at all. For those who say rb should be treated like everybody else, well he is not everybody else but on the other hand i also blame his advisors for not clearing things up before heading to the airport.
