Malawian Judge Lovemore Chikopa sued by the suspended judges

SUSPENDED High Court judges Nigel Mutuna and Charles Kajimanga have applied for an order to commence contempt proceedings against Malawian Judge Lovemore Chikopa for allegedly disobeying the court order that stayed the tribunal proceedings.

The duo stated that the stay was ordered on June 5, this year but notwithstanding the order of the court, Mr Chikopa had continued to engage in acts contrary to the Court’s order by issuing letters requesting witnesses to appear before the tribunal.

“With full knowledge of the Order of Stay of the proceedings of the said tribunal duly issued by the Higher Court, justice Chikopa continued to sit and chair the tribunal and conducted hearings in the month of July whereat evidence relating to the applicants was received from witnesses,” they said.

In their statement verifying ex-parte summons for an order for leave to commence committal proceedings against Mr Chikopa as chairperson of the tribunal and his secretary Chipili Magayane, the duo indicated that the alleged contemnors’ conduct of proceeding with the hearings notwithstanding the order for a stay was disobedience of court proceedings.

  1. Judges firing shots in the air to scare away a fellow judge. This is aimed at sending him back to Malawi because he seems not wanting to go back, so legal battles may send him by force. Watching closely while events unfold. Judges against judges, and lawyers against lawyers.

    • Perhaps they are scared of a kangaroo court beholden to the executive that has already made its mind up without regard for due process or the law itself?

And someone should sue him for overstaying in the country – more than one year, without a substantive job and proper permits is not allowed, even if the labour was imported by the President, because he is not law unto himself. And what of the cost to the nation for his upkeep and luxury. And his career – unless he is working behind doors as conultant to the old woman – the rejected and expired CJ!

    • sometimes it’s nice to pretend you are educated. In your case that would have meant keeping quiet or saying something like ‘Ndelolesha fyye, something in those lines.

  7. Sue the bagar. Let him not run away. Give him a contempt of court charge for a start so that he spends a night at woodland police station. Chikopa and Amsterstand must realise that as much as we have fulls running the govt, ZAMBIA IS BIGGER than these fulls. Where is FAT albert to comment.?

    I believe we have a problem in Zambia where the Judiciary sounds divided. What is so special about Mmembe that made the president to call Chikopa when we have our own people who can solve the problems. Is the government solving the Issue of Mmembe 14 billion kwacha scandal or the misbehaviour of the Judges. Personally I want to know the fracas which led to all this wastage of Zambian resources and to make matters worse it is like Chikopa is acting as Chief justice of Zambia

      You have hammered one thing on the head..”all this is because of Fred M’membe”. It is indeed and then to that we can add his cohorts like Nchito and Kabimba. But the question, as you rightly put it, is what is so special about M’membe? Well the answer lies in the power of the media and his flagrant betrayal of the trust that the Zambian people had bestowed upon M’membe’s post newspaper. He knew his influence on the people of Zambia and he took us all for granted, including Sata, in order to advance his personal interests. We all know (and those that didnt, should now know) that Sata could not have won the Sept 2011 without the support of the post.   14. Time will come when Sata will be held to account over his unilateral and illegal decision to bring Chikopo to Zambia to drain Zambia’s meager financial resources. Why for example are we not told how much was ‘budgeted’ for Chikopo’s holiday in Zambia? Chikopo himself has no morals at all. When this whole thing is brought to the surface it will be far worse than the trumped up charges against RB.

  20. This is an occasion for Judge Chikopa to face the true mechanisms relating to the processes in the administration of the Rule of Law which is well rooted in Zambia’s legal system. The outcome will expose the grave limitations of Malawi’s legal brains relative to other states in the SADC and AU.

    Had the Malawian Law Society been endowed with genes to interpret the due processes of Law, Malawi should have long counselled Chikopa to return to Malawi. In future we shall assess Malawins’ law training and comprehension of judicial systems with a pinch of salt.
