LUSAKA business woman sentenced to death for killing husband’s love appeals the sentence

LUSAKA business executive Beatrice Hangwende and her three accomplices in the murder of her husband’s lover have appealed against the death penalty slapped on them by the Lusaka High Court.

Beatrice who was sentenced to death along with her elder brother, John, and Joseph Banda and Charles Mwanza lodged their appeal notice in the Supreme Court on grounds that they were not satisfied with the outcome of the judgment.

The quartet was facing one count of murder of Chabmoe Enterprises chief executive officer Monica Chabwera Phiri contrary to section 200 of the Penal Code on April 22, 2007 and attempted murder of her driver, Benny Banda.

The duo is also appealing against the life imprisonment for attempted murder of Mr Banda.

In their notice of appeal, the four contended that upon perusal of the case record the appellants desired to appeal against the whole judgment saying both sentences slapped on them were too harsh.

“We are appealing against both the conviction and sentence of both counts where the court convicted us of murder and sentenced us to hang until pronounced dead by a medical doctor and life imprisonment for attempted murder,” they said.

Supreme Court Judge Gregory Phiri sitting as High Court Judge slapped the death sentence on the quartet last week after finding them guilty of murdering Ms Phiri in cold blood and dumped her body in the bush in Chisamba area.

Justice Phiri said his hands were tied and could not hand down any sentence apart from that of murder and attempted murder as required by Law.

    • Ludicrous, jail them for life, no person deserves a death sentence

      This is not the medieval, this country remains backwards
      I don’t condone what they have done, but the death penalty should be abolished altogether

      I had a boyfriend who cheated on me once and me and the other girl beat the crap out of the dude for playing with our hearts and I dumped him after that.

  3. I read this article with extreme disdain asking myself, how? No one has any right to rob, destroy or kill someone because their ego is bruised, absolutely not! Granted the perpetrators have been reflecting for the last 6 years, the law is the law, and its clear they value and appreciate being alive, that poor lady murdered wasn’t given an opportunity to appeal being spared at the hands of this psychotic woman. Trouble is most believe because of the challenges in the justice system, cases don’t finally come to a close -it does, believe it or not, and no one is above the law. The old cliche comes to mind,”If you are willing to do the crime, you must be ready to do the time”. I’m appalled by their sheer audacity and arrogance! Albeit, our constitution permits us all to a free and fair…

  4. looking at this case at either point of view the made a dead mistake in life but no1 has the right to take any1z life even if they killed. a life sentence would make more sense with hard labour.
    some of these things let the Lord charge them, u have no right to charge them what so ever, the court will be as good as the lady if they hanged her.

    the giver of life is God himself and he is the taker too.
    am not saying what they did is Good but lets wait for Gods time which is always the best.

  5. Gregory Phiri, you are also going to die anyway! Give the poor woman a life sentence instead. She was protecting her most prized possession! She picked Jonathan Mwala from the gutter and cleaned him up and then someone comes along and says it’s me who should be with him atase!!

    • You should learn to “please” your hubby so that he does not go to other women. We will continue servicing them if you fail to do so. Or better still, get yourself a man too. That is the only way you can tame a man, not by killing.

    • Zambian men are very adulterous !!! If the hubby cheats on you, get some red hot sexy lingerie and seduce his boss or best friend in order to heal your heartache !!!! It works wonders !!!!

      There is no such thing as making your man not stray by using sex or anything else. Those that think so, have never been truly loved and are in for a great disappointment.

      No one is ever the best at anything. There is always someone somewhere better than you. Beauty, sex, intelligence, wealth, power, you name it. If you base your love on any of these, it’s based on sand and will crumble.

      As for beating the other woman, what a waste of one’s time.

Philip, am appalled too that they described their sentences to be too harsh instead of asking for forgiveness and asking the court of law to have mercy upon them by just giving them life sentence instead of death sentence. they deserve death sentence but life imprisonment with no parole is what they need.

    • I agree with you,the should have asked for forgiveness so that the sentence is reduced from death to life sentence with hard labor.

      From the human perspective these people deserve to be hanged for the meditated murder but from God’s perspective they deserve to be saved like everyone of us.

    • pliz give me a break………i dont sympathise with monica, she deserved it. The woman made a mistake to involve other people. Such cases you have to research and follow the enemy closely and when you are 100% sure do it yourself. there are so many single men out there why should u grab the only husband/boyfriend your friend has? it really hurts and drives nuts. Men will owaz go after women weather married or not, it is up to a woman to refuse. Women be content with what you have. If it is s*x you want get a single man and teach him how you want to b f******d

      You are placing the blame on your fellow women. They don’t owe you anything. Your boyfriend/husband does.
      If he values you so much he won’t risk losing you. Don’t involve yourself with cheating lying lowlifes. You’ll find that most women are actually nice and supportive of other women’s relationships.

She was also just a beautiful person experiencing love and it was not her fault that you drove your husband to a beautiful, kind and generous woman. You are a cold blooded killer and you can do it again. You are too dangerous for the country so stop talking and accept the sentence and remember the mailoni brothers, what they did to others happened to them..your husband was probably scared of you way before he met Monica. We know your story and how you got married to him

  13. Nobody has been executed in Zambia since KK left state house.
    The death sentence is simply a pronouncement and she will have to spend the rest of her life in jail.
    How can she be so stupid as to organize her whole family to murder this one woman who was going out with her husband?
    Those of us who know both Beatrice & Jonathan, they were never meant to be together as she is very basic and he is very handsome with a degree in engineering, real mismatch.
    Secondly Jonathan’s insatiable appetite for beautiful women was never going to be curtailed, but with someone’s daughter’s blood, in this case Monica Chabwera. She was young, beautiful, enterprising and from a good family. It is such a shame she lost her life in such terrible circumstances, when she had so much to live for.

  15. Even criminals have a right to appeal their sentences. The judges speak for the dead like Monica. I think a life sentence will be more punishing than a death sentence. Death will be a few seconds and no more pain. Give her and her friends life sentnces.

Madam Mwala you just have to accept this because everything has got time and from the Christianity point of you hope do understand that you have to do to others whatever you want them to do to you, and whatever the amount of measure you use to them shall be used back to you. So everyone is gonna ripe what they are sowing now and as for you I totally conclude to say that this is what you sewn.

  17. She is just scared of the ‘death’ in ‘death sentence’. In Z, people get such sentences only because the Law permits. Otherwise even the judge knew that she would spend the rest of her miserable life behind bars and occasionally going kumulima chipuba….where she deserves to be.
