Deputy Speaker orders Minister to explain why Emmanuel Mwamba appointed himself as board chairman of IBA

DEPUTY speaker of the National Assembly Mukondo Lungu yesterday ordered the minister of Information and Broadcasting Services to issue a ministerial statement as to why the Permanent Secretary (PS) in his ministry should appoint himself as chairman for the Independent Broadcasting Authority (IBA).

Mr Lungu has also ordered Transport, Works, Supply and Communications minister to issue a ministerial statement next week Tuesday on why the Road Development Agency (RDA) has continued to operate without a board but had a board chairman.

This follows the Point of Order raised by United Party for National Development (UPND) Monze Member of Parliament who wanted to know why Information and Broadcasting Services PS Emmanuel Mwamba had appointed himself the chairman of the board contrary to the laws of Zambia.

Mr Mwiimbu said it was an irregularity that Mr Mwamba should be the chairman of the IBA, when the board members are supposed to report to him as the controlling officer just like any other boards for public institutions.

“Mr Speaker no Permanent secretary chairs a board of parastatal, it an irregularity and the ministry of Justice is quiet about it, Is this Government in order to abrogate the laws, who will the board report to when the PS himself is the chair, Mr Speaker I need serious ruling,” Mr Mwiimbu said.

This promoted the deputy speaker to order the minister to issue the ministerial statement to clarify the matter raised by Monze MP.

Later Mr Mwiimbu rose on another point of order question Transport, Works Supply and Communications minister Yamfwa Mukanga why the RDA had no board but with a chairman only.

Earlier, Mr Mukanga told Parliament that the Zambia Railways Limited (ZRL) would need K18.6 million to replace the coaches that were burnt last week following a electrical fault.

Mr Mukanga also told Parliament that the coaches were not insured and that Government is working on measures to ensure that the locomotives were insured.

On Friday last week, the ZRL North bound train 602 with 9 coaches and two baggage vans caught fire twenty kilometres from Livingstone.

    • This is what it means to criticize govt objectively.

      I am not a UPND supporter but the issues raised by Monze MP are significant and keeps govt excesses in check.

    • Hon Mwiimbu this is what we mean by opposition providing checks and balances! Keep it up…don’t be like your president HH who is calling on Zambians to shun independence celebrations – we are free to speak because we got the freedom to do so for ourselves and you have just demonstrated how nice our independence is.

      Hon Mwiimbu next time you rise on the point of order please ask on our behalf “when will we have the final constitution ?” – demand a ministerial statement with that will provide a date and time – not a political answer such as “it will be completed when it will be completed…” We need to press for a new constitution and you guys in parliament can help us a lot on this point. Organise others to rise on points of order on the constitution issue on a daily basis!!

    • Why not appoint himself? But that is the new PF culture:
      – Kabimba has appointed himself has life-Secretary General of PF, and next president. Only Sata can say something not Zambians.
      – Chikwelete appointed himself to some post in their PF.
      – Chishimba Kabwili appointed himself as dictator of Immigration and commanded to arrest some good citizens who kick the ball.

      Yes, Mwamba learnt that from Barotseland where people appoint themselves has prime ministers.

    • @Chiwanagala, there are laws that need to be followed in these things. From time in memorial the PS is a member of the Board but not a Chairperson. This is all part of the anarchy we are continually seeing from the PF government.

  1. This dochi kubeba slogan goes a lot deeper than meets the ordinary eye. This is all but part of management style, which seems to be normal to do things outside the laws of the land. How can an institution have a chair without a board? who have elected the chair of then non existing board? Only Dochi Kubeba style of management can provide answers.

  2. Why is this government always disregarding the law? Ever since the PF came into power, our constitution has been breached many times, most times by the president himself. No wonder cadres act the way they want because they have seen it from their leaders – no respect for the law. This is why PF must be voted out by all means. We are currently being ruled by vigilantes. What a shame! We cry for mother Zambia; it has gone to the dogs.

    Let other people speak. You know very well what is going on between Mwamba and Wynter. Mwamba has been hired to destroy certain people.

  6. This is very interesting a PS appointing himself Board Chairman. Power is sweet. No regard for the laws of the land. Where ba Mwansa Kapeya and his deputy plus directors to advise our PS. H e is very fast. As RDA so the Chairman chairs meetings alone and then reports to who? Very interesting indeed.

  7. it is not at iba and rda only, there are many others. where the ps’s sit as board members and reporting to themselves. if you were to check many statutory bodies this very common from days of mmd unfortunately. secretary the cabinet should sit up.

  8. There’s a lot of criminality at RDA. The RDA is now based at State House. The Board Chairman Nsanda gets a monthly salary. He is the highest paid ’employee’ at RDA. He reports directly to the President. There are no other Board members. There are only Directors all from the usual chosen ethnicity. It is sad what these people are doing to the country!

  11. I know this tribalist who wanted to wipe out all non Bemba speaking in Kasama when he was PS. He is known for suspension of civil servants without following administrative procedures. Emmanuel Mwamba’s day is coming and coming very fast. He will meet his type soon.

The only thing PF has achieved with it’s ascendance to power is to embarrass themselves.Sata is not even supposed to appoint the Board Chairman it is the duty of the Minister.And this talkative Mwamba should know his limits.He has an army of lawyers at his disposal in the ministry of justice whom he obviously does not bother to consult.He will remember them when he will be standing in the dock.

  13. Congratulations are in order to the learned lawyer. We have been so engrossed in politics as the PF who is in the driving seat has set the tone of its agenda in politics (even their own internal wrangles) rather than in governance and economics. These are I am sure a tip of the iceberg of the massive misgovernance of these simple-minded charlatans. Let us look further on not only raising these issues but ensuring and follwing up their correction. These are serious issues that should not be ignored.

    • I agree with you my brother, we have a problem in PF. I ‘m doudting the calibre and competence of our Minister of Justice and our Attoney General. These are basics such that even me who is not a lawyer know that the current status quo is wron and illegal.

  15. I’m PF But to be honest, Jack Mwiimbu is one of the Best MPs’in that parliament. I love the way he debates and His sensible Points of orders. However, most PF MPs’are a disappointment as they do not know how to debate and mostly raise on useless points of orders which are in most cases ignored by Mr Speaker.

    • But what do you expect from Kambwili,GBM,and Kabimba.As for Kabimba his nomination to Parly has added no value whatsoever.Dont they see these shortcomings?Sometimes i fell sorry for Sata one would have thought pipo like Kabimba would be advising him in how to go about business but Kabimba is too busy entrenching himself and politiking.

    • I remember someone in parly probably Jack Mwimu making the observation that ERB Board had !! members and not the mandatory statutory 7.Kabimba in his response started whitch hunting and ended up firing the chief executive.

  16. jack Mwimbu don’t be dull. IBA, ZNBC, RDA have no statutory boards as they have not been appointed by the ministers. By law, the Permanent Secretary and CEO are the board in the absence of the appointed board. By law they can transact. Dull….dull lawyer. So Mwamba can transact board matters including convening a license meeting. But in this country we comment ignorance, form opinions in ignorance and conclude. Fools Paradise. And I thought Jack Mwimbu was a lawyer who should know minimum basic company law (especially parastatals and govt agencies)

  17. Impunity. It seems that the pf Gvt does not know the word impunity which is shameless actions done without fear of embarrassment. That is why within two years all the gains of the past decade are under a serious threat

  18. Tax payers to pay K18.6 because the ZR coaches were not insured……and no one is held accountable for such poor decision? Such expensive assets should honestly be insured.

  20. althoug mwamba is excellent when it comes to projects execution he has a deep rooted tendency of being a law unto himself.if he does nt change course this will soon land him in trouble.

  21. Don’t tell lies in parliament. Rolling stock of ZRLwas insured all this time. What did Attanga do the insurances? He shall be made to pay for the loss as he is the one took a decision not to insure them.

  23. i didnt know jack mwiimbu was useless as well. Hasnt he known this has been the practice in zambia. How many PSs ve been chairmen of boards for ministries they manage since 1991 MMD acscendance to power. Our MPs ve become so narrow minded.

  24. Too many irregularities. Why is the boardless RDA operating from State House? The Chairman should also provide minutes of the meetings they have had so far with the patron ulyanji kwite. Governance by confusion.
