
Government has directed mining giant Konkola Copper Mines (KCM) management not to go ahead with their plan to deduct money from their employees’ salaries in a bid to correct the anomaly of under paying Pay As You Earn (PAYE) for its workers for many years to the Zambia Revenue Authority.
Addressing a media briefing in Lusaka today, Labour Minister Fackson Shamenda said that no employee will be adversely affected through back dated deductions of PAYE by KCM.
Mr. Shamenda added that if the company has already deducted from its employees, workers should be refunded immediately.
He noted that KCM has a legal obligation to deduct the appropriate and correct tax from employees’ emoluments and remit such tax to the tax authority.
Mr. Shamenda has since summoned KCM Management and Mine Unions to his office for a meeting to chat a way forward on the matter.
It has been reported that KCM has effective this month, started deducting different amounts of money from selected workers.
Zambia Revenue Authority (ZRA) undertook a tax audit on KCM Plc covering period 2006 to 2011 financial year.

Lusaka — I AM prepared to name some ministers who are corrupt, Patriotic Front (PF) president Michael Sata has said.
Commenting on Zambia’s 39th independence celebrations at State House on Friday, Sata said he could not join plunderers in celebrating the country’s independence.
“If they challenge me I will name some of the ministers who are corrupt,” Sata said.
He said he would not submit to President Mwanawasa’s arrogance because of the independence celebrations. Sata said there was too much deceit and trickery under President Mwanawasa’s leadership.
He said it would be a mockery for the opposition parties to attend the celebrations at State House because President Mwanawasa didn’t recognise them as equal stakeholders…

My boy learn to think before you yap..don’t talk like a chicken being chased for a slaughter. KCM under deducted PAYE from its employees due to errors in its own payroll system in the financial years in question. if you have had a chance to study Tax law you would have had the knowledge that if such happens the employer has the legal obligation to remit such differences to the revenue authority.
Who pays teachers if miners doesn’t pay Tax?
Do a bit of research if you have limited knowledge on a subject than exposing your illiteracy like this. its dangerous.
Its KCM as the employer with a legal mandate to deduct PAYE from employees, hence if they dont its them to be pernalized, read the income tax act you and you will be guided accordingly.

One of the actvities was to hold meetings with these mine owners so they could start deducting these long standing PAYE arreers from miners. HH’s intention was to create an harvoc on the copperbelt and noise among the miners.
But as usual, Sata is always ahead of HH. His moves were immediately thwarted.

Let the law be followed and if it says as most people seem to be saying, then KCM must pick up the tub. However, since it was by error and hopefully not intentional, ZRA should agree with them a payment plan that will not adversely affect the employer and employees.

KCM should pay the tax from their profits and not on “the backs”of their employees. The error in failing to deduct the appropriate tax from employees was made by KCM and not the employees. Shame on the government for not holding KCM accountable.

Anomalies czn be accepted if it is for a year or some months. It doesn’t take one who has studied accounting or any related courses to justify such a serious mistake. People do not bring your academic gymnastics in the matter. What is wrong is wrong. I can attribute mediocrity to such a recurring anomaly. No learned person should even defend such. This is very shameful. How can such a thing really be there for many years when other government ministries like education and health correct such anomalies within three months? This is unacceptable. One can suspect a lot. Let government correct it so that jsutice prevails in Zambia. Such a thing should not even be repeated.

PAYE is emblematic of the fact that neoliberal economics takes the tax burden away from the corporations, and hands it over to what is or should be the middle class.
The mines need to pay up big, they need to pay at least 20% of their revenues to the state, or face nationalisation.
People like to forget this, but the mineral resources of Zambia already belong to the people of Zambia collectively. See UN General Assemby Resolution 1803 from 1962, which deals with Mineral Sovereignty.

Thank you Minister for coming into this issue. KCM needs to be investigated further. What about other taxes? I find this issue unacceptable. Workers are very innocent because it was not their fault. ZRA also could have picked it from the P18 forms submitted at the end of the financial year. The problem with ZRA personnel is that they don’t conduct workshops to educate Employers about Direct Taxes but are good at penalizing people for late submission. Shame on KCM management and ZRA

i commend hon Fackson Shamenda on this subject. KCM has got competent Accountants who could have known what they were doing. Its not the employees falut and so KCM should shoulder the burden for its incomptence. What were its auditors doing all along. It shows thare has bin a lot of fraud at KCM. Let ZRA penalise KCM 100% for submitting false returns on P.A.Y.E from 2006 to 2011.
You cannot expect a blank minded leadership to manage sophisticated investors such as those we find in the mining sector of Zambia. Our woes are of our own making by turning carrots into spoons!!
This is pay as you earn and not pay the back log. I greed with Muwelewele the liability belongs to KCM, they should fire their incompetent accountants instead and absorb the cost which will not be allowable in its final tax computation.
The question to ask is whether KCM is able to pay without deducting workers’ taxes.
