Leading opposition leader Hakainde Hichilema has charged that the amended republican constitution is a sham and a disgrace to the Zambian people.
And Mr Hichilema has stated that the UPND which has two serving Vice Presidents is not bothered by the passing of the 50+1 clause in the amended constitution.
He said it is shameful that President Lungu choose to sign the Bill to amend the constitution at Heroes Stadium in an attempt to hoodwink Zambians that he was delivering a new constitution.
The UPND leader was speaking in Lusaka Wednesday afternoon when he featured on a special programme on Hot FM.
‘This is not a new constitution. This is deception as usual from the PF. They are doing a Don’t Kubeba on Zambians by cheating them that they have passed a new constitution. This is a PF constitution,’ Mr Hichilema stated.
He charged that the amended constitution was a complete departure from the wishes of the majority of Zambians as contained in the draft constitution.
‘PF denied Zambians a chance to give themselves a new constitution. PF rejected most of the clauses contained in the draft constitution and allowed about 110 MPs to defeat the will of Zambians,’ he said.

Mr Hichilema cited a number of clauses from the draft constitution which were rejected by Parliament by justifying his sentiments that the amended constitution fell short of the people’s expectations.
‘The PF rejected the appointment of cabinet outside Parliament, they also rejected Proportional Representation, the PF also rejected the clause on Provincial Assemblies, the Provincial Assemblies could have in a way helped resolve the Barotseland issue by promoting actual devolution of power and equitable allocation of resources,’ he said.
He added, ‘this amended constitution has not dealt with separation of powers. You still have a very powerful Executive controlling all other arms of Government. What kind of a constitution that fails to give citizens their rights? This is a total sham and a disgrace.’
Mr Hichilema charged that President Lungu signed his exit from State House the day he appended his signature on the draft bill.
‘We were watching and laughing as this man signed the Bill because he was signing his exit papers out of State House,’ he said.
Mr Hichilema cautioned that President Lungu should not take credit for passing some popular clauses such as the 50+1, the running mate and dual citizenship because he was merely fulfilling the wishes of the people.
‘This is a man who has failed. Look at the economic mess, he found the Kwacha to a dollar around 5.7 and takes it to 15 Kwacha to a dollar, he brings it down to 11.3 and he starts celebrating, this is a man who has never run anything successfully in his life apart of eating his client’s money and you expect him to effectively manage the economy?’
On the issue of nominating his running mate, Mr Hichilema said the matter is a non-issue in the UPND.
He said the party is not bothered about the choice of a running mate even if it currently has two serving Vice Presidents.
‘For us this is a non-issue. We will sit as the party’s National Management Committee to table the issue at an appropriate time. For now we are serving the Zambian people and the issue of running mate does not bother us.’
Mr Hichilema also paid tribute to the two Vice Presidents Geoffrey Mwamba and Canisius Banda for their contribution to the party.
‘Remember these are voluntary works in service of Zambians but the two men have been exceptional. They have done very well for the party. I know there are rumours been circulated by the PF about the running mate situation in our party but that should not worry our members,’ he said.
Mr Hichilema said the UPND is an organised political party which believes in doing things in a systematic manner.
‘We are very methodical in our approach, we are very organised and this is why we don’t have squabbles in our party, so even the issue of running mate, we shall handle is efficiently at the right time.’

HH always seems to find himself in the wrong foot on national matters. He was against the National Prayer, only to rush to church in the last minutes to save his embarrassing outcry after calling the prayers as a mockery to God.
The constitution has been amended. It means it has been Altered, Modified, Adjusted, Corrected, Changed.
Therefore, it’s not the same.
How the hell can you have a new Constitution. It’s not possible for a country that has been independent for more than 50 Years.

An Executive driven Constitution. There are merits in his arguments other than the personal attack on the President.
This under 5 political failure is a shameless and jealous hypocrite. PF has achieved what failed to be realised since 2003. The rest of clauses he mentions will be dealt with later. 80% of the draft has been implemented as approved by 2/3 of MPs, that’s democracy. Provincial assemblies would cost a lot of money at this stage.

I don’t get it. The constitution has been signed using the existing system. It has it’s failings, but totally disrespecting the government structure as we have it now is total rural id.iocy. Isn’t this the process of enacting laws in Zambia; parliament votes on it. True not every proposal was accepted. But that is because the representatives voted into power by the people rejected it. That is the process and yes the process is not prefect. But we have to make baby steps. Amendments will be made over the coming years. And why would anyone refuse to attend the signing of a sacred document as a national leader?

Clauses killed off by PF would have ensured that Zambia is ruled by consesus where by every corner of the country has a say on how resources are shared. Unlike the current system where the only time people are consulted is during election .Devolution would have endured all citizens at local level have a strong voice on matters that affect their communities continously.

@ Nono, there’s a difference between ‘laws’ and the constitution. The latter is the supreme law from which the former are derived. Yes parliament makes the laws and the ‘people’ (we the people) make the constitution. In most civilised countries with mature enough constitution, changing even one sentence, let alone many clauses, would require a referendum.
HH is right on the omitted clauses, but he can’t ‘eat with both hands’ on the other clauses that were included. He should give Lungu credit on accepting those few items.
I don’t understand this ‘we will change this, but leave the rest to referendum’ argument. Just enact everything by one method, and pick and choose.
Maverick the Constitution is very clear on the mode of its amendment. Only Part III which contains a bill of human rights require a referendum whereas the rest can be done by the stipulated numbers in Parliament. I may be wrong but peruse the Constitution in its entirety.

No Zambian govt so far has amended the constitution for the benefit of Zambians. So PF has just added clauses that can cause confusing in the opposition camp and also bar some potential opponents. Thus this is a PF amended constitution. Some MMD MPs like Mutati supported it because they think there is in it for them. Shame on Zambian politicians.

Exactly my thinking. But at the end of the interview the message was that HH excepted whatever has been done and he is busy preparing for elections. Including finding a running mate methodically! The constitution has been amended. Anything amended is not the same as the old one but new. Of course it is not brand new. The USA constitution has been amended in an ongoing process for over 200 years. Yes there are clauses that would have not cost us much that should have been included = i.e. choosing Ministers from outside cabinet instead of making cadres Cabinet Ministers. It is working well in Kenya.

It would have been better to build mining colleges in N/W province.

In many countries like our nation Zambia. Political leaders use emotions which are driven by hate, envy and selfishness. What comes first for some is the I and not others. Leadership is about people and we have only one country with one citizenry. These citizens are looking for leadership from each and every person in position and all those seeking it.
It is that element of looking for leadership that makes people to start buying into our ideologies and politics. This is not only for those in government but also for those in opposition. The biggest problem I see is that people in opposition parties are just there to cause divisions and make a country hard to govern. Africa is not developed partly because we don’t have that political coexistence…
Even when the ruling party offers to work with other them, opposition political parties always see it as a loss for them and not a gain for the country. This we have seen in Zambia too. It is not everyone though. Some opposition leaders have been very good at reading our political and democratic process.
Despite being in opposition or not agreeing with whatever the Patriotic Front government is doing. Some political leaders have given support on or in issues and things that go beyond politics. I can point out Dr Nevers Sekwila Mumba of the Movement for Multiparty Democracy(MMD). The opposition leader has had his own issues with his party in the past one year or so. But I have seen that Dr Mumba is growing in his political maturity. He has been in government as Vice President before…

I saw Mumba at the day of prayer and reconciliation last October. I saw him embrace the man who probably costed him many votes-former President Rupiah Banda. I saw him speak with a lot of political and religious leaders. People called the day of prayer a political platform for President Lungu. Mumba did not see that. He saw a platform where misunderstandings and disagreements between many intra or inter party individuals and groups can be buried. If not to call that political maturity then I don’t know what to call it. People like Hakainde Hichilema politicised the event but Mumba joined other Zambians in prayer.

Sometime HH should sit down and evaluate his actions. He has to look at those around him. Are they giving him enough or good counsel. This is important in politics. HH has to take a leaf from the conduct of other opposition leaders. Dr Mumba is one example. On this one I think Ba Mumba is seeking good counsel from himself and those around him. If UPND and HH think they are the smart ones they will realise that people are smarter than they are. They have to move with the wind. Now that this year’s elections will be held under the new constitution I want to see if they will boycott too. Let us see how consistent they are. People will defend HH as much as they want. I have said many times that you don’t need to be in government for you to add value to a nation. What you ought to do is to be there when your country needs you. Dr Mumba as one of the leading opposition leaders taught us something. We may disagree on some issues but that does not mean we can not support matters which are important for our people.
Leaders must lead and emotions must not be allowed to win otherwise we are doomed. We only have one Zambia. Save for 4 clauses you mentioned GRZ has facilitated the enactment of a document that has been in the making for a long time as desired by Zambians even before PF was formed. It is a misrepresentation to say the new constitution is a PF Constitution. Don’t reproduce in the mass media what your party cadres tell you. Read the new constitution sir. It is one of the most progressive constitutions not just in Africa. It is certainly not sham or a disgrace. I am wondering whether or not the President of the UPND has read the amended constitution. He ignorantly states that the amended constitution does not have the provincial assemblies when actually Articles 151 and 153 talk about the establishment of such assemblies……………What sort leaders do we have in the opposition?

@Harold Muna, Senzo and etc company, get it from me, the majority of voters do not see uPMD as an alternative government or HH as a viable alternative President. Despite the people’s desire for change, even the economic turmoil in the country will not change their perception of HH which he is busy reinforcing through his ill advised actions including insulting his opponents. You should know the reasons better than the rest of us: HH is arrogant, lacks humility, his leadership was born out of a tribal convention in 2005 (remember Chejani?), looks down upon everyone else as imbeciles, and worst of it all he does not even hide any of those facts but still expects to win elections.

Let me make a confession. In 2011, I had developed a sympathy for uPMD, because I thought that they spoke sense and stood for the truth. But boy am I glad that I quickly came back to my senses and never voted for them. I am now convinced beyond any measure of doubt that any party in Zambia is a better bet than uPMD. Even on a scale of non-viable alternative parties, uPMD would not be an option at all. We all come to our senses at one time or another, so I am sure GBM, Dr Banda and others will come to their senses in their own time. When they do, they will realise how much time they have wasted and out of frustration they may wish to go (back) to PF and MMD respectively.
By the way, those who advise HH, please tell him that sometimes he needs to be delegating official party statements to his shadow cabinet representative. Otherwise voters will grow tired and fatigued by his constant statements. For example, he could have given his legal party representative to issue this statement and legally argue what the implications are to the average voter.
Take a leaf from how your friends conduct their campaigns overseas… I believe you watch international media.

If you are a Kaponya you can’t recognize that what the opposition and the Grande Coalition is doing will help you. Its amazing. Someone says lets have cabinet appointed from outside parliament to improve separation of powers, proportional representation so that minorities, women the disabled can be included in decision making, provincial assemblies so that locals in Mongu, Kasama, Chipata, Solwezi, Ndola etc can decide for themselves what their priorities are and you are arguing. Fine hate the man but at least say these things make sense. If you don’t, my conclusion is you are a Kaponya, a cadre because these people don’t reason.
