Police in Lusaka last night arrested Post News Editor Fred M’membe and his wife Mutinta including Deputy News Editor Joseph Mwenda.

This was after the trio gained entry to the Post Newspapers Head Office on Bwimjimfumu road around 01 Hours this morning following a stay that restrained Zambia Revenue Authority from seizing the newspaper’s property. 

Armed Police officers also brutally beat up Mr M’membe, his wife Mutinta and Mr Mwenda before bundling them in a police van which drove off to Lusaka Central Police where they have been locked up.

Post Newspapers Lawyer Nchima Nchito was also beaten when he tried to reason with police when they were beating up the trio.

Police later started towing cars of Post employees away from Bwinjimfumu road who had gone back to their offices following a court order restraining ZRA from seizing Post property.

    • Order is defective. It says that Appellant pays to the Respondent by 11th July 2015, a date that has already gone a year ago.
      Notwithstanding that the Post shall be allowed to operate while they are given time to pay in court all disputed amount.

I’ve seen videos on YouTube of the police in Zambia brutally kicking and beating up suspects as they arrest them. The President needs to intervene as this is tarnishing Zambia’s image as a democracy and undermining investor confidence. Arrest the culprits without violence.       Secondly the date for the appellant to pay the respondent is indicated as 11 July 2015 hence defective.
      It is useless to publish a defective document in the hope of enlisting some overzealous peoples’ sympathy!

  4. This proves beyond any doubt that the closure of the Post is not a tax collection issue but political. Even if the Post had paid all its taxes to ZRA it will still remain closed to ensure that Lungu’s election rigging manoeuvres remain undercover. Lungu is determined to retain power thru violence and rigging. Lungu knows he cannot win these elections without violence and rigging. By ignoring the court order ZRA and Lungu’s govt has shown clearly that it does not respect the rule of law and the Zambian Constitution.   5. I have a question can the Revenue Appeals tribunal stay the matter already decided upon by the Supreme Court? In my view it can’t and I think The post should have first taken the matter to the Revenue Appeals Tribunal b4 they took it to the High Court and by them taking the matter to the High Court and the Supreme Court, the post finished the legal avenue and them going back is forum shopping and abuse of legal process. Furthermore deamining the supreme Court.

    • What you have said is set to be argued on July 11, 2016. Courts do not work on a trajectory commensurate with human emotion necessarily.

    ZRA and the Courts have done everything to facilitate him to settle this bill for more than 10yrs.

The Supreme Court judgement cannot be questioned by anyone and I think the tribunal should be cited for contempt for issuing contradictory orders. The fact that the word ‘Supreme’ is used for a court of last resort does not mean ALL cases end their lifetimes there. This is now why Zambia itself is losing direction because its citizenry are not keen to work out simple lines of English in their own statutes. This is why even the President is maneuvering gingerly because he knows there are precipices on either side of his argument even to the distinguished excellencies he was addressing. Awe mwe!

  17. Well tried Mr Nchoti, very interesting but case cannot go anywhere. Court processes do not start from top to bottom and lower legal organs cannot overrule higher legal organs. If that was so and the lower organ erred at law who would apeal to who? Have you ever heard a court telling the defendant to pay what he feels he wants to pay, a proper revenue appeals court for that matter? How does a proper revenue appeals court “…order the appellant to handover trucks, trailers and other property to the tune of K53m….”? How can broken down and cannibalised trucks and trailers be worth K53m? What do tgey mean by other property if that does not include the bwinjimfumu offices and industriall area? Or does the so called tribunal intend to allow Post to operate only up to 11 July and thereafter…

  18. Can someone educate us please: It says the respondent hands over back the premises of the appellant on condition that they give trucks and properties to the tune of K53m. Before doing this why did he go to the office. Does it mean he didn’t read what this document was saying. I think our man must learn to be humble. The only way out f this Mr Mmembe should also conduct himself with humility. He has been preaching about a lot of virtues in his editorials. As much as we would not want government to suppress press freedom, we expect press people not to steal tax monies and also when found guilty, they show remorsefulness as expected from every citizen. Give ZRA trucks, properties and other items to make up K53m then you can gallantry enter your office. Simple!

  22. ZRA just keep the Post shut until they pay. It is not the duty of courts or tribunals to open loopholes for thieves to escape. Also check the authenticity of all documents word by word and check signatures. This is a high stakes game and culprits are fighting matters of life and death. To me I can see that the Post’s offices or books may contain incriminating documents or references to the DBZ/ Zambian airways matter. This so called stay is designed to hide or remove . Nchoti and fellow defendants must have realised that incriminating document remained in the those offices.
    Anyway police just keep the three under lock and key. Lock up the forgerer too.

  23. The people at the tribunal have a problem and they should be removed from their. When last did they do this for any company ZRA closed on. Is it right for someone to deduct PAYE from employees and not submit it since 2009. Even HH or Nawakwi or Sinkamba was the president I don’t think so they would allow any company do that. Why can’t Mmembe take a route of liquidating the debt as opposed to being confrontational. People are saying Lungu is not humble, what about Mmembe is he humble? Zambians lets look at this issue objectively, Is Mmembe right with what he has done and keep doing. Is Tax evasion not stealing?

    Am not an economist and will never be one because its a very basic subject, as it is underpinned on simple and straight forward dimensions: demand and supply.
    Now what is TAX? Tax is money a consumer pays to Government based on some percentage on goods and services procured, and the selling entity, organisation or institution ONLY collects it on behalf of Government to be remitted in the the stipulated time period. If one doesnt remit this tax, its a serious offence because thats openly stealing…

  36. This exparte injunction is a document born in corruption. I don’t understand how an injunction can super-cede a supreme court order. Can someone explain how this works otherwise the blatant disregard of the law drives countries into disarray.

  37. The Revenue Incomes Tribunal is not above the Supreme Court . The courts have rules and regulations.
    When you get a court order it is not your duty to execute that order but law enforcement agencies.

  42. The Police officers at the Post offices acted unruly and illegally. Lungu and his govt should respect Court Orders in terms of Zambian Constitution. We are now dealing with a President who believes in the law of the jungle in a Constitutional Dermocracy. In Lungu we now have a violent and lawless President. If we don’t stop Lungu then Zambia will become another dictatorship and a failed state. Thank God in 38 days Zambians have another chance to get rid of dictator Lungu.   55. The TaxAppeals Tribunal is equivalent to the High Court. So if you are not satisfied by the decision of the tribunal you appeal to supreme court.
    The function of the tribunal is to preside over the decisions made by:
    1. The ZRA commissioner
    2. The Minister
    But not the decision made by the supreme court. That registrar from the tribunal has questions to answer.

Hate it or not, this event started by the unbridled raid and subsequent confiscation of assets is but a tip of an avalanche to unfold. (a) This is a defective order vis para.2 (b) The Registrar of the RAT does not have the powers that she has exercised she needed to call the Tribunal to sit to determine the matter she is ex-officio to the Tribunal (c) This application is irregular in that it is seeking to introduce a fresh prepayment order that fell apart once the Supreme Court Ruled as it did and (d) This is mischief on the part of Nchima he wants to restart appeal upon appeals in clear abuse of the process of the law? that’s why his brother the ex-dpp fired him, law must have its finality (e) Who goes to reopen his premises at 01.00 am suppose they had been shot? believing they were thieves….just go lie down

    The people will never forget what is going on now and one day, no matter how long it will take to come someone will be made to answer and defend himself over the misrule that is being unleashed so brutally. Time will tell.

  69. How about arresting the people that beat up and undressed a woman on the video that’s circulating in Zambia. I’ve heard that in fact died of the beatings. What Zambia do we have. Why allow such a crime linger and deal with something that has injusticeness attached. Where are police.
