UPND goes to Court to stop release of Results, wants ECZ to suspend three officials

THE United Party for National Development (UPND) on Saturday evening filed an urgent Court matter to stop the release of the final results and sought to have 3 officials suspended.

The three officials are the Chief Electoral Officer Priscilla Isaac Mulenga, Deputy IT Director Brown Kasaro and IT Specialist Theresa Phiri.

The Lusaka High Court refused to grant a stay to stop the release of results but set Wednesday next week as a day of inter-party hearing.

The petition against the Electoral Commission of Zambia was filed by Martha Mushipe, Lukona Chambers, and Jack Mwiimbu.

They sought Judicial Review Proceedings on Saturday night.

Earlier in the day the UPND wrote a letter claiming that 3 officers it cited in the letter should be suspended by the Commission. in the letter the party also petitioned the ECZ to stop the transmission of election results electronically.

In a letter to the ECZ signed by secretary-general Stephen Katuka, the UPND sought to stop the transmission of results alleging that they were manipulated by unauthorised people

When the Electoral Commission of Zambia(ECZ) did not respond to their letter, the party sought a court order for a judicial review.

The party also sought to stop the 3 officials to act in their capacity.

The party also sought that the release of results be halted until the petition was heard.

But Judge Florence Lengalenga has allowed by the court to hear the matter but refused to stay or grant an Order to have them leave the Commission.

Judge also refused any Order to stop the release of results.

Judge Lengalenga has stated that their should be no interruption in the release of results.

The ECZ has continued to give and release results to the country.

Meanwhile, Patriotic Front (PF) deputy spokesperson Frank Bwalya has wondered why the opposition party is always jittery, especially when results favour the ruling party.

And PF Secretary General Davies Chama has said that it was shocking that the opposition United Party for National Development (UPND) is already planning to petition the general elections even before the winner is declared.

Mr Chama said in an interview yesterday that the PF cannot stop the UPND from taking court action over the presidential elections because the Electoral Commission of Zambia (ECZ) and the ruling party will defend themselves.

“It is unfortunate that someone is already planning that ‘I will go to court’ even before the announcement of final results. We cannot stop them but the courts will look at the merits of the case,” he said

The latest results after 52 constituencies have UPND leader Hakainde Hichilema in the narrow lead with 514,816 and PF candidate Edgar Lungu with 511,386 in the second place. FDD candidate Edith Nawakwi has 7,440

THE Electoral Commission of Zambia (ECZ) has dismissed reports circulating on social media that director Priscilla Isaac has been suspended.

ECZ spokesperson Crispin Akufuna said in an interview yesterday that contrary to the reports, Ms Isaac remains at the helm of the commission.

    • UPND are complaining that it is taking too long to release the results by the ECZ but at the same time HH is busy interfering at every stage of verification and announcement….so far UPND have only won 44 MPs (PF 93), they have no single MP on the CB and Lusaka (but Chilanga) and STILL THINK that their HH will win….!     • If ECZ is compromised at by high ranking officials especially in the IT Dept then this party has every right to ask for the named officials to be suspended. Their survival–and those of their minions–rests on keys to national resources via crooked politics. So do or die. In the West , politics is a status symbol. Almost every politician has a strong economic base before ascending to politics. With our tin-pot incompetent Lungus, end of political “career” almost shortens life expectancy. Le,t the results be announced. If not satisfied, petition the results as per new constitution. This would put on hold the inauguration process for 14 day as the CONCOURT decides.

    • The court system is compromised. You want to work with the process, point out what’s going wrong at every stage. Build the case if the issues don’t get resolved. Wrong doing in Zambia is exalted while being upright and ethical is unrewarded.

By the way, the UPND lost in Luapula because forward in Luapula Lingua (usi) means going backwards. That’s why ushis go backwards when they dance along to the chorus of their songs which go “foward mama … forward”, while reverse means the opposite. PF knew this so they slotted in reverse in the dununa song knowing the Luapulans will understand it as going front, and it worked as can be seen from the good vote from there. Muziganiza, ba UPND. Apa so ni zee for another 5 yrs, hoping you survive the destructive traits of those PF rejects u accommodated at your own peril.

  12. No re-run necessary, there was no strong “third party” to help split the votes into three ways because MMD was completely destroyed. Therefore, this was a clear 2 horse race and 50% + 1 vote was achieveable. Going by the current trend, ECL has taken this as projected by the Daily Nation. This is the time for HH to concede and act like a statesman. He will gain more than he will lose if he follows this advice.

  53. Politicians to some extent are like marketers, they look at the weaknesses of their customers, the electorate, and tailor their message to suit. For example in 1991 people used to go to political rallies to listen to real staff not to listen to music, dance and drink because most of the people then were educated enough. 25 years later we have a generation of mostly uneducated youngsters who know nothing about the past. Those days it was rear to find a Zambian in town who could not speak English. My point is, this mediocrity is here to stay as long as free Education continues to be suppressed.   63. You can be surprised….. PF has already worn this election. HH please temper down. its not the end of the road. Concentrate on the future elections other than crying over spilled milk. Show Zambians that you are a credible leader by not issuing alarming statements. Reflect on what has made you tumble again in this election. And my fellow Zambians, please lets not mock the loosing camp. We are brothers no need to fight or celebrate in a manner that will provoke the loosing camp. A real man is seen in the way he handles a defeat.

  64. If Bembas are thieves as claimed by UPND supporters, why have you tolerated GBM, second in command, Nevers Mumba, Miles Sampa etc.
    Petition is fine and welcome, but do you think recount in Kanyama will give HH more than 100,000 VOTES,
    Why is it that you did not claim Form 12 when HH was leading in Southern, Western and North Western?
