I have no political ambitions, I just love my country-Linda Kasonde

Law Association of Zambia President Linda Kasonde has defended the Association’s perceived strong anti-government stance saying the Association is not being controlled by anyone.

And Ms. Kasonde has wondered why Kasama Member of Parliament Kelvin Sampa, a non-lawyer is interested in the affairs of the association by even sponsoring a private member motion to Parliament to dissolve LAZ.

Speaking Thursday morning when she featured on Hot FM’s Hot Seat radio programme, Ms. Kasonde said she has no political ambitions adding that she does not even have any relationship with opposition leader Hakainde Hichilema.

“There is a very strong perception out there that LAZ is cartel and that LAZ is anti-government but that perception has been largely created by misinformation by putting bits of information together that is not entirely true,” she said.

Ms Kasonde said, “The other day, somebody told me I used to work for HH, it was shocking because I have never worked for H.H. I don’t have any relationship with HH whatsoever. Personally I don’t have any political agenda. My role as leader of the association is to follow the mandate under Section 4 to protect the rule of law, constitutionalism, social justice and good governance, that is all we are trying to do.”

She added, “I don’t have political ambitions. I just love my country as any good citizen should do.

Ms. Kasonde also revealed that LAZ will soon meet to consult its members over the move by Mr Sampa to take a Private Members Bill to Parliament aimed at dissolving LAZ.

“When I first saw it (Bill), i think my first reaction was to wonder as to what the interest of a non-Lawyer is in the affairs of the Law Association. Obviously, we are not perfect as an Association because nobody is but if there are any reforms to take place in the association, I believe those reforms should take place within the association and the association will be consulting its members over these issues in the coming weeks,” Ms. Kasonde said.

Asked on whether she feels some LAZ members including President Edgar Lungu are secretly sponsoring the Bill, Ms. Kasonde said she could not speculate.

“I can’t speculate on whether some LAZ members including President Lungu are supporting the bill but what I can say is that Lawyers are members of society and therefore hold divergent views.”

She continued, “As LAZ, we think that we are just doing our job, unfortunately that is not perceived as such. When Jesus was on earth, he had one mission and that was to save humanity from sin, a very simple and noble cause and he did so by telling the truth, unfortunately as a result he was insulted, forsaken and even killed for expressing those views. Unfortunately telling the truth in many societies is seen as a rebellious act, so unfortunately, we seem to have become a victim of that.”

Ms. Kasonde said LAZ is working according to the law as it understands it.

“There is old English saying that nobody kicks a dead dog, I think our leadership is very strong so strong that when we choose not to speak, people start weaving placards and chanting saying why aren’t you speaking, so strong that a non-lawyer has seen it fit to challenge the existence of the association, so I don’t think this is a sign of weak leadership, infact, it’s a sign of strength,” she said.

“We live in a democracy where there is freedom of association, freedom of conscience, freedom of expression, in a democracy, ideally, divergent views should be able to co-exist side by side, like someone put it, when a snake enters the hut, you don’t burn down the hut to get rid of the snake.”

She also stated that the decisions in the association are collectively made by the Council.

“I have in the Council since 2013 and even beyond that to my knowledge LAZ has always chosen when to comment, we comment on law and constitutional issues, good governance, rule of law issues, social justice issues and we do so as a Council, it’s not anyone one individual, we have 16 member Council made up of men and women and we sit and deliberate on these issues and we also consult members on these issues, it’s not fair to say that we are unnecessarily selective and in any case, if we choose to talk about every issue, we would be issuing statements every day because there are many issues that happen in society.”

She continued, “No one individual controls the association, the association is governed by a Council who are made of people with different opinions and beliefs.”

      You were asked regarding the request made by Dr Chishimba to the chief justice to form a tribunal to probe Dora Siriya in connection with the Malawian maize gate scandal.

      Your answer was that you do not know of any reason why the Chief Justice would not form the said tribunal once a request is made.

      You created an impression that she was wrong to refuse to form the tribunal and that her move was likely unjustified.

      But look, on one hand you complained of the negative perception held against LAZ and you as a person by the public, which you said was not true…

    • Suppose I based that wide perception being held against LAZ and yoursrlf, and called for a tribunal to be formed to probe you, Linda.

      Would you still say, “I see no reason why the requested tribunal should not be formed since it has been requested”?

      Is merely requesting for a tribunal sufficient and complete reason to form such tribunal.

      Don’t you think that we may end up with a situation where tribunals become the day -to-day operations of the Chief Justice, if the only merit is simply ‘making a request’ by a member of the public?

      Doesn’t the Chief Justice have a duty to weigh the merit of my request, based on some criteria (which you say you see reason)?

      I raise this matter because I wouldn’t like you to create unjustified negative perceptions in the public…

      The way you handled that question (which is likely to create mistrust in the operations of the Chief Justice) may raise speculation that maybe even the said perceptions against LAZ may have arisen because of the manner you speak and carry yourself about national matters.

      Are you then in the same vain saying that that much talk by LAZ and some sections of the public against the government are a sign the government has done very well?

    • To talk of MPs that they have no interest because they are not lawyers is dull thinking. LAZ itself was acted by the same non lawyers. In a democracy they make the laws. It is you the educated that play it dull at times. After several years in schools and colleges I find it crazy that you seem not to agree (lawyers) how to count 14 days.

  4. What justice does Linda stand for when she has plainly shown the bias. She refuses to comment when the law supports govt and misinterprets plain law language saying there many ways laws can be interpreted.

  5. First of all, l would want to find out from the LAZ President if it is an offence for a person who is not a lawyer to have interest in the activities happening in the association. Secondly, there’s a lawyer who complained to you about the way you are handling cases affecting your members. He requested for support when he needed it most but LAZ declined and the LAZ has offered free services to Nchima Nchito who is facing charges in the courts of law. Is that not segregation. This is where the problem is coming from…

  7. The Project that Linda Kasone is executing within the structure of LAZ is owned by the CARTEL in which Mmembe, Musa Mwenye, the two Nchito brothers, Wynter Kabimba etc are prominent. Since all Lawyers exist to serve ordinary Zambian Citizens, Mr. Kelvin Sampa is simply responding to the political path that the inner circle of LAZ has plunged itself into.

    If LAZ attempts to disrupt national agricultural programs some farmers will react to protect their agricultural industries. But since LAZ has chosen to delve into the political arena, then it is appropriate for the Hon. Kelvin Sampa to respond to the Cartel’s political machinations which dates back to the Presidency of Levy Mwanawasa and Sata. Besides, Ms. Linda Kasonde’s reaction sounds political indeed.

    – Chief Justice Ngulube fell off wagon for his bias in FTJ Kafupi case & was later found to be a recipient of Zamtroop funds from FTJ.
    – Chief Justice Mambilima has fallen off the wagon for her bias towards LUNGU, by swearing him in using a Court Clerk & her refusal to investigate Dora’s Maizegate scandal.
    – Constitutional Court embarrassed Zambia’s Justice system after biased handling of presidential election petition.

  12. Well said Linda.The problem is that the Illegitimate Lungu govt sees LAZ as an obstacle to achieving their One Man Party Dictatorship. Lungu has been using the AG as his Personal Legal Adviser in some Petitions and LAZ has enjoined in these cases to protect Rule of Law,Constitutionalism,Social Justice and Good Governance. This has angered Lungu and PF. The other issue is that LAZ has remained quiet on the UPND Presidential Petition. Lungu has interpreted LAZ’s silence to mean it is in Agreement with the Petitioners. Since the Petition is a Constitutional issue it is obvious that Lungu has abrogated the Constitution by failing to have the Petition Heard.     • Whether one likes it or not, you can not be LAZ president without being inclined to any political party whether you have announced it or not but the way you argue your case will show on which side you are. The woman is intelligent but she is not clever. She has exposed herself alot by the way she rushes to issue press releases when govt does something perceived wrong compared to the black out when a certain opposition party insulted some constitutional court judges.
      Another case is when a member of Laz requested help from it and the request was turned down but turned around and did exactly the same thing to another member with perceived connection to a certain political party.

  14. The truth of the matter is that the law has degenerated under the stewardship of Edgar Lungu. That is no secret. Of course, these PF people do not see that fighting an organization like LAZ says a lot about yourselves, you want to dictate what laws should be so that they favor you. It is funny where the ambitions of members in the PF have gone, no one aspires to be president, no one even aspires to take over Inonge Wina’s position regardless her frailties and delicate age. Lungu is now surrounded by “yes men”. Look at the amended constitution- most of it was just made to enhance Edgar Lungu’s position. The clauses that were meant to enhance people’s rights were “risked” to the mechanisms of the referendum.

      Is HH’s thinking contagious? I am shocked because all his supporters, even his lawyers expected Lungu to prove that he won the elections.

      By law the accused does not need to prove his innocence, he remains innocent until proven guilty.

      HH failed to prove that Lungu lost until time was up, so Lungu remained the winner – that is why he was sworn in as president.

  25. Linda Kasonde and her LAZ never cease to amaze me. According to her, a wrong-real or perceived-is one that is attributable to the PF. Up to now, she has never castigated Hallucination Honcho (HH) for insulting and dishonour the judiciary, especially the justices that have passed judgements that have not been in favour of the UPND. More recently, he insulted the Speaker of the National Assembly, but Madam Kasonde and her cohorts have decided to be mute over the matter. We know that she is dating HH’s cousin, so she finds it very difficult to criticize him or his party. Moreover, Sashi Nchito, who happens to be her vice or something like that, is the sister to Mutembo and Nchima Nchito. Clearly, she is part of the cartlel, and is pushing their agenda.

    We have had LAZ presidents before Linda, she must not mistake the huge criticism shes under to be a sign on her hard work. She has been very selective on her reactions to national issues and thats the bone of all criticisms against her LAZ. The interviewer should have helped her understand the source of those critics and further outlined the so called cartel members behind. The latest decision by LAZ of representing their member in a private matter against LAZ’s own regulations. These are the issues that put you my dear Linda in a hot seat and by that you are giving ammunition to the politicians to attack and threaten LAZ’s existance.

They were established only in 1973 when LAZ act came into being to replace the Law Societies act in Zambia.at that Time one only needed to apply to the Chief Justice to gain a Practising certificate but now ZIALE has been made so tough so that a cartel is established. People forget that before ZIALE we had the LPI which used to induct lawyers and train to provide the practicing certificates.

Here in Zambia at some points in our history we only had one political party, one trade union one university etc. All these were created by parliament and very legal.     • True terrible, Mushipe’s case was lodged last year, yet it has become cold. Makebi Zulu, Hobday Kabwe and Anna Mwitwa have sued LAZ over their summoning. They have contended that LAZ did not avail them the minutes from the disciplinary meeting which resolved to summon them. Strange indeed, seems Ms. Kasonde is making decisions on her own and choosing who to discipline.
