Regazetting Bill 10 is unprocedural-LAZ

The Law Association of Zambia says the publication in the Government Gazette of the Constitution Amendment Bill No. 10 of 2019 on 12th June 2020 is a breach of procedures for making laws in Zambia.

LAZ President Eddie Mwitwa said in a statement the newly published amendments do not form part of the Bill as introduced at first reading in Parliament by Government.

Mr. Mwitwa said the publication of the bill in the gazette may only serve to sway public opinion on the bill without guaranteeing its enactment and its re-publication is not supported by law.

He said there is no procedure which permits Government to publish in the Govemment Gazette different texts of a Bill to amend the Constitution which is already going through the stages as established by Standing Orders under the Constitution of Zambia.

Mr. Mwitwa said Government cannot cherry pick what it considers desirable proposals of a Committee and reject numerous others and publish the same purporting to form part of the Bill.

The regazzeted Bill contains numerous proposed amendments to the Republican Constitution which are different from the original Bill published in Gazette Notice No. 660 of Friday, 21st June, 2019 preceding its presentation in Parliament for First reading on Friday, 2nd August, 2019.

    push against president, procedures, ignore court orders, issue fake cover up stories when his corruption is dug up…….issue an apology , keep silent or pretend not to see issues bothering the nation that need a briefing , Look for more corruption, get mentioned in international corruption scandels, associate with unsavoury characters, order his thugs to attack opposition, keep silent on wanton PF thuggery , Look for more corruption, single out independent madia to shut, get the begging bowl ready for any international day………..

  3. If you trowel through LT archives , you will see that I have repeatedly said Zambians will not get rid of lungu, lungu will want stay in power forever.

    I was right. The only way you will get rid of this crook is to offer him amnesty to chew the money he has stolen. Other wise forget.

    I wrote that the damage done to Zambia by lungu will be so great that future aspiring leaders will center their campains on a promise to jail lungu and his gang….

  4. I don’t understand why Patrick Mvunga and Luduig Sunday Sondashi are quiet on such an important topic, even Julius Sakala ought to say something. Edgar doesn’t respect any Law. He signed a Constitution which says if you petition him he’ll handover power to the Speaker but did he do it? All these are signs of a failed administration.

  5. LAZ doesn’t seem to understand the very laws that it’s supposed to promote. How do u say only a Committee can propose amendments to the Bill when every Member of Parliament, Cabinet through Minister of Justice can also propose Amendments to the Bill. The failure to read by LAZ or u have deliberately become political instead of looking at the law objectively.

  6. LAZ has lost credibility and most stakeholders will not believe what they are saying. From Mwanawasa’s presidency, LAZ became a tool for hegemony. It was captured by the hyenas of the cartel with the Nchitos and their friends and associates in charge. Since MCS’s death, their legacy has been to fight Edgar Lungu’s PF and support the regime change agenda that seeks to install hh in state house. No surprise here.

    Lubinda is not even a lawyer to bulldoze this Bill 10 as though he is Alpha and Omega in the justice system.

    This another way of decampaigning Lungu at all cost. Edgar Lungu is surrounded by treacherous people.

  8. The very nature of LAZ members often implies they are politically inclined and world over they play a crucial role in safeguarding the legal side of governance in a nation, If regazetting-bill 10 is unprocedural, then bill 10 goes no where. “He who seeks equity, must come in equity” – BID.

  9. Did our President REALLY graduate from UNZA Law school? Could we be having an impostor in the name of a deceased Edgar Lungu, or even a relative? Could it be that Edgar Lungu died and a close relative called Chagwa Lungu left the army and took his place? Ever since the putative Edgar Chagwa Lungu became President he has demonstrated a terrible ignorance of the laws of Zambia. He allowed ministers to remain in office during elections, he refused to hand over power to the Speaker during the petition, and now he presents two bill 10s to parliament! When he went to Kitwe’s Mukuba Secondary School, he looked lost. He may look confident but that is the con in conmen.

  10. While a reputed radio professional said that the youth are pace setters, then let them set the pace under the leadership of President Edgar Chagwa Lungu. It is extremely disheartening and dismal that due to a section of politically motivated population, Zambia will inch closer towards anarchy. Apart from the government’s continual assurances about the Bill 10 not subverting democracy and dissolving constitution, the opposition and the so-called anti-establishment faction has made it into a burning non-issue and made the lives of all Zambians and the working of the government even tougher during such rough times of the national health emergency of COVID-19. Therefore, I implore the government to fast-track the process of enacting the bill and take considerable action against these…

  11. Wrong person to head ministry of justice. You need a lawyer there who understands procedure not this one who gets beaten by his own cadres when visiting kabwata market.

  12. I think what must now be considered important and relevant on this bill is the credibility of its morality and NOT credibility of the procedure. The question must then be on the quality of its content: is it what is desired and required to be now tabled for debate? If yes, then let it be debated so that we as a country achieve what is correct and desired to be in our constitution.

  13. LAZ and all reputable lawyers believe that it is unprocedural and illegal for the Amended Bill 10 of 2020 to substitute Bill 10 of 2019 during the Second Reading in Parliament. Is Hon Lubinda more legally knowledgeable in these legal matters than these Professional Lawyers. There is more to this than what meets the eye. Are we being dribbled by this canning Govt? Time will tell.
