Former president Frederick Chiluba may stand trial for corruption by video link due to ill health, a spokesman for the ex-leader said on Friday.
Chiluba, who is due to travel to South Africa for medical treatment, has been told by a Zambian court to return home by August 13 to resume his protracted trial the next day, spokesman Emmanuel Mwamba said.
Mwamba said Chiluba was due to inform the court whether he would stand trial by video link after Zambian doctors advised that he was too ill to be present in person.
“Dr Chiluba will inform his lawyers what they should tell the court after the court gave him an option to stand trial by video link or to be present in court whatever the circumstances,” Mwamba told Reuters.
Chiluba’s graft trial involving allegations of theft of $488,000 in Treasury funds during his decade-long rule which ended in 2001 has created major controversy between state prosecutors and his lawyers.
Prosecutors want the former president to stand trial despite having a cardiac problem, while Chiluba and his lawyers had earlier argued that he cannot be forced to appear via video link as it would impinge on his right to be physically present in court.
Last week, doctors advised him to seek immediate medical treatment in South Africa after he became weaker, but the court only allowed him to travel on Friday following earlier objections from state prosecutors.
Chiluba is simultaneously fighting a London court judgement which ordered him to pay back $58 million it said he stole from the national Treasury in a civil case Zambian authorities lodged in Britain.
Chiluba has argued that the British case was essentially fraudulent and promoted by former British Prime Minister Tony Blair and Zambian President Levy Mwanawasa in an attempt to make a point about graft in Africa.

I have been advising this Kama-Chap KaKafupi to start attending court cases instead of pretending to be too ill to answer to the charges. Kafupi’s heart condition is chronic and therefore should not deter him from normal activities as long as he gets his intervention medication.
The trips he makes to RSA are just routine checks like what every other patient with such condition would be required to do.

Currently Zambia has three Major Fixed Land line Serv and Wireless providers, namely Celtel, Zamtel and MTN. There interest on Fiber is to increase there switching capability between their BTS-Sites and the Core Switching network. This will improve Quality of Service in both Voice, data, and make it possible to introduce the long awaited IP based services like IPTV.
My many worry in Zambia is the lack of genius or intention by Operators, Vendor and Consumers to push the technology to the limit and get the benefit of every drop, hence breeding people like SAGE who feel uncomfortable or become pessimistic on some investment.
Certainly Fiber and Wireless are far and Fiber in the front by just comparing outer limits. The commercial benefit are incomparable. The Challenges of operations can not be used as deterrant

I agree with #26 Anonymous. During the first term, the Chiluba administration grasped the nettle and brought in unpopular but necessary changes. Some of us remember the pseudo-socialist economy as it existed in Zambia before 1991. Setting up and succeeding in business then was considered decadent by Kaunda and his cronies. Successful Zambian businessmen were persecuted and often accused of being traitors. In ZCCM, expatriates were paid ten times more than Zambians. Expatriate nurses put Zambian specialist doctors to shame when it came to pay. Shortage of essential commodities was also the order of the day. When Chiluba came to power, he liberalised the economy and sold off unprofitable businesses. The result was the birth of Zambia’s economic rescue. I know it did not seem like that at the time but it is what was needed. Unfortunately, Chiluba lost his way somewhere towards the end of his first term and made a lot of deliberate mistakes. He is now paying for those mistakes.

The government had to carry out deeply unpopular measures. Unfortunately, those who ignore the pre-MMD era always judge Chiluba too harshly. Ba Chitapankwa you sound more like an FTJ sympathiser. Upon FTJ assuming office yes saw commodities buck in the shelfs and there where no lines. 2 things fundamentally happened that brought about the availability of goods.
1. Smagoling stopped because all of a sudden a zambian produced product was 200% more expensive than a product imported from europ or china. countries like Tanzania, burundi DRC only bought products like cement and agricultural products like ubunga.
2.While there was 300% rise in comodity prices ,there was a massive los of jobes due to un pllanned privatization. These are the two negative factors that led to stopping the lines at the shops.
The principle of liberalising the economy is a good idea, but you have to know what you are doing in order to mitigate the side effects of the exercise. As much as people can argue that FTJ made hard decisions that is now bearing fruit. Many people can also argue that in whatever he did he was soomehow a beneficiary.
You guys talking about cash lying idle in commercial banks as a sign of economic boom are misinterpreting events. Here are some incontrovertible data whether you choose to hate FTJ or not;
1) At 1991, Zambia was basically bankrupt and public services were moribund. I argue no exaggeration in comparing it to the current Zimbabwean situation. FTJ left Zambian better than he found it(am not talking about the 1970s-80s). KK left poverty at 71% and FTJ left it at 69%, so no major change there. But if you look at public services (health, education, transportation), FJT scored better. Those who worked at UTH or travelled by UBZ will be lying to deny this.
2) FTJ presided over a radical economic reform program that reduced inflation from 200% to 26%. Exchange rate was controlled and it failed.
3)KK tried and failed to implement these reforms. Remember 1986 riots and Luchembe coup
4) FTJ privatized all the companies that were a source of inflation and declining national productivity
Comparison with LPM;
1)Inflation down further from 26% to 12%
2) Much stable exchange rate, largely because of HIPC and mines. But remember the critical milestones for HIPC and the IMF PRGF were all achieved before 2002.
3) Money is lying idle at commercial banks because of HIPC. Before 2004, GRZ used to borrow cash from banks to settle external debt and our domestic debt ballooned. Its nothing to do with real economic expansion.
4) The new mines and a good policy on agriculture have boosted national economy.
5) Massive growth in global aid have boosted GRZ coffers and helped service delivery. Virtually all programs in Health are funded by Global Fund, PEPFAR and others.
Point is, the climate is far more conducive after HIPC.
Finally, we give LPM credit, but to suggest FTJ did nothing is simply unintelligent. Lets see if teh FTJ haters can give us facts not emotional outbursts, as we dont know why they hate him.
Guys before we make comments i suggest we do a bit of reading on the subject. There were never empty coffers when FTJ come into power. They coined that term in order to hoodwink us from holding them accountable for their failures. Goverments operate on cash flow ok, when they are making a budget they base their badget on projected income from TAXES. If the projected income equals the budget you have a balanced budget. if your budget is less than the projected revenue you have a supplas. GRZ collects money everyday. So how does someone tell you that the coffers are empty and you believe? Folks this is the definition of inflation: A persistent increase in the level of consumer prices or a persistent decline in the purchasing power of money, caused by an increase in available currency and credit beyond the proportion of available goods and services. If you have more than 80% of the population un employed with no purchasing power, of course you will have goods in the stores.but at that CTN
In Zambia the terms inflation, GDP, Interest rate etc dont mean anything they are just academic figures. The dollar exchange rate in Zambia is far more inportant than the inflation rate and the GDP.

SAGE, I hear your point this is definitely a complex subject. My intention was to put factual context to the debate about KK, FTJ and LPM presidency. And the most common approach is to quote official economic indicators. Am not claiming that these are the only criteria by which we make judgement. But I would like to hear an alternative framework of comparison from the other side.
Secondly, I dont understand why you think GDP and inflation dont mean anything. Why do you prefer the exchange rate which refers to a narrower segment of our economy namely traded sector?
The fact that GRZ reached HIPC means that they dotn have to spend $300,000 each month to settle debt. This has proved significant in giving GRZ extra funds to give agriculture, transportation, health, education, etc. Facts on the grounds indicate that this has been crucial for reducing domestic borrowing and lowering interest rates and inflation, and of course a downward pressure on the exchange rate. Hopefully we get more real improvements in the economy over time.
CSO stats show that Levy’s plan on agriculture is already bearing fruit. Not just the bumper maize harvest but also total growth in agricultural investment
I’m glad you pointed out my reference to exchange rate. right now the Zambian economy swings by the ER. If the rate to dollar increase from K4.5M to K6M. the whole economy shakes prices increase and jobs are lost. Yet all the other factors my flactuate up or down with ZERO effect on the economy. The most importatnt thing to remember is that there is a disconnect between GDP, Inflation and all the important economic indicators. Thats why i said they are “academic” because they do not reflect the true picture of the economy. For example wether the APR goes up or down it does not matter because less than one percent of the population can get a loan. and those that can dont need it. My point all these indeces are academic because they are “fabricated”

I also agree that an unstable exchange rate can distort an economy. All exchange rates fluctuate. But they fluctuate even more disastrously if they are in high values as teh case in Zambia. And if the policy makers tinker with them! All economic variables become more volatile when they assume higher orders of magnitude. (e.g. ZMK4000 to $1)
However, I dont agree that we should substitute a conceptually relevant variable with an irrelevant one just because the right variable is measured with great error. My professinal inclination is to rather have a slightly poorly measuerd GDP than a perfectly measured wrong variable.
Infact the argument of the exchange rate goes the other way. We adjust GDP in US$ figures by assuming that US$1 can buy exactly the same bundle of goods or services (Purchasing Power Parity). Because of the distorting effect of official exchange rate
Iam sorry SAGE and Francis you are misleading and missing the point. Inflation cannot only be indicated by the flactuation of exchange rate,norrow the more available goods in shelves and increase in monies on the capital. Inflation is when you get a Bag of funds to buy a banana, when people have no jobs and starving to death in thier homes. What causes this? clear its the increase in the prices of essential comodities like fuel or when their is a shortage. This is the weapon of the west they use firms like BP, Total etcs. Do you understand what makes up a budget, its not just the income and as such can not compare the income to budget, the budget is run on Income Vs Expenditure, any excess is as a result of Income being greater than Expenditure and vice versa.Penza adopted a cash budget as a means to bring fiscal discipline to govt resources, hence you cannot effect and expense unless you are a corresponding income to cover it. Fighting inflation always implies loss of employment (and increase in poverty) in the shortterm. But its a worthy infact inevitable sacrifice (FTJ told you this but its all over elementary economics text books).
What we have done now is to ‘cool’ the economy. This is why there are now signs of growth.
All these other indicators you are talking about are children of inflation. Nothing ever happens at inflation over 40%, let alone 200%. Everybody from investors, workers, unemployed, suffers (i.e. loses money) when inflation is high. So to belittle this achievement is just unfair.

Once we take care of inflation, we start to see some of the people getting back jobs or being re-directed to new opportunities in the transforming economy.
I agree that we havet done a good job at mitigating the effects of unemployment. This is because FTJ had a pathetic job at agriculture. BUT, we already had 70% poverty with 200% inflation in 1991! So we cant lump it all at the FTJ reforms. We inherited much of the poverty and poor infrastructure from big Ken. ZCCM was already retrenching and not employing from the 1989.

Now, the UNDP compiles the HDI to try to address some of SAGE’s valid points that economic indicators can be misleading. And we know how Zambia ranks on those welfare based indicators. However, you will see that its not a coincidence that poorer countries by HDI standard are also poor by the traditional GDP score (the correlation is over 70%). So GDP are other economics variables still tell you something.

GETTING CONVICTION AT ALL COSTS: A CASE OF FTJ ZAMBIA’S EX-PRESIDENT

Kaela B. MulengaWhen the Zambian government went full throttle to try and get the corruption conviction of Fredrick T Jacob Chiluba (FTJ) – a former Zambian president in a London court, many people including myself, raised some objections.
In our view, we did not see the necessity of using UK courts given that Zambia was still at peace and that there was nothing wrong – competence-wise, with our Zambian judges and the judicial system.
But in spite of these concerns, and regardless of the eventual consequences this approach might cause, the Zambian government went ahead with its plans. In their view, this was a good and popular move to take – because it would pin down Chiluba in a corner. Indeed, a judgement was meted out by Justice Peter Smith, who convicted FTJ.
The State Media, joined in by The Post – lauded this judgement as phenomenal. And certainly after that, FTJ faced the darkest day of his life.
But here is the problem: which has clearly surfaced during Chiluba and cohorts’ appeal. First, it is not only established that – important procedural steps were skipped, probably due to too much emotion and anger interfering with the administration of justice – but also that the reputation of the Ministry of Justice has been damaged considerably.
Second, the superiority of the Zambian Judicial System, once praised by Oxford University law school as ‘the best legal model on the African continent’, is diminished. Strangely, this is happening under the watch of a lawyer President. Strange!
To try and ignore the “preliminary issue†raised by the respondents’ defence – that Part 11 of the Foreign Judgement Act chapter 76 of the laws of Zambia was violated, is belligerence of the highest degree. There is nothing unconventional or misconception about wanting to apply the Zambian laws as stipulated in the Penal Code.
In fact, the President is and should be the custodian and guard of the Zambian constitution and its laws – whose government by nature, bears a fiduciary responsibility and is charged with the duty of serving the interests of the people. And that every Zambian is supposed to be equal in the eyes of law.
Moreover, when a country is at peace – such as Zambia has been, there is no point rushing to try Zambians (especially ex presidents) in foreign lands and then hope to transfer judgements back to Zambia. It is even worse when we discover that some parts of law were not upheld.
It can be understood, that those countries ravaged by war or civil strife, such as Democratic Republic of Congo (DRC), can begin by seeking judgements in foreign countries then legitimizing them later in their own countries as soon as peace was restored. Since Zambia boasts of being peaceful, it is a mockery to revert to former colonial masters for guidance on matters which are straight forward. It would have been better to wait at least until after the Zambian judicial system was exhausted, and then pursue other avenues.
The fact that the government went ahead regardless, has other implications as well. No matter how you look at it, this approach will end up blunting our judicial system in the sense that once a precedent is set – psychologically, our judges will continue to feel somehow incapable compared to the British ones. This is because, for no good reason, British judges were found to be preferable (or technically more competent), to handle such complex cases. Otherwise, why would our government shift Chiluba’s case hearings to UK?
In some sense, this is also usurping the powers due to the Zambians courts. This is not a small matter.
On the other hand, should Judge Japhet Banda agree – technically or otherwise, with the government prosecutors’ arguments, it will be viewed by many, at least international legal and human rights observers – as an activist judgement. An activist judge is one, who directly or indirectly, tends to side with government fudging the true or correct interpretation of the law.
Good judges are those who pass judgement fairly, aided by irrefutable evidence and correct interpretation of statutes. What comes to mind as an example is the famous J. Simpson’s trial, when his lawyer John Cochrane snapped in court that – “if the gloves can’t fit, you cannot convict – you must acquitâ€.
By the same token, if Part 11 of the Foreign Judgement Act, chapter 76, was not abided by – no matter how strong the technicalities or semantics raised by Attorney General may be, Chiluba’s gang must be given the benefit of doubt in the court of law. After all, even before the trial began, FTJ did adamantly refuse to appear in foreign courts. Whether we like it or not, in the name of fairness, courts must now be guided by the principles of fair justice.
Failure to do so will put Zambia on a wrong course. In a “just societyâ€, whether you are short or tall, black or white, poor or rich, old or young, and man or woman – you must be entitled to fair justice. That is, every Zambian should be automatically entitled to this fair treatment principle.
Had the constitution been framed sufficiently to protect the rights of people – this mental exercise we’re going through would not be necessary. In fact it can be argued that – some of the grounds for seeking a new constitution in Zambia are derived from the following:
Due to the immense powers vested in the Office of the President, opposing him even on matters harmful to the progress of the country could end up a scary affair. As a result, you end up with a coterie of presidential worshippers, including cultivation of a compliant set of judges. The later leaves society members, especially those on lower class ranks, vulnerable. No country prospers under a “yes Sir†environment.
In addition since the President’s Office, controls just about every prestigious job portfolios in Zambia and Foreign Service – every Zambian want to be identified with the ruling class. Those who don’t toll the line are often subject to intimidation of all sorts including prison terms – often delivered through party functionaries such as cadres and other out bursts.
But we know that anytime when people are not free to say their minds – everybody loses in the end. In societies where, democratic rights or principles are fully anchored, citizens’ insecurity is minimized. That ought to be the society that we strive for.
Thus, without fear or favour, let me say that – unless Chiluba’s case will be treated fairly and the law interpreted correctly, people might start losing confidence in the law itself. Neither can we say that, unless Chiluba is convicted, the war against corruption would be lost. But if Chiluba’s case will be concluded fairly, it could act as a deterrent against corruption. Because then, the message will go out – that if you dip your finger in the till, you risk going to jail.
But the calamity in Chiluba’s case is that from inception, the New Deal government’s agenda has been to convict at all costs. Consequently government officials and mostly lawyers have been acting to protect the interests of government, instead of the people.
This has been possible because the awareness of ordinary people, about their rights, is not yet robust. As soon as this improves, government will be held accountable and be forced to act within their limits.
Until then, government’s behaviour will continue to depend on the whims and wishes of the President – who commands considerable power. This is why Zambian people cannot wait to see the day when a more protective constitution will be in place. But that day cannot come about by itself. It is every Zambian’s duty to do something about it. The Kaunda’s wrestled the country from imperialists; we should not slumber and let it disintegrate due to lack of care.

I told you that KK left poverty at 75% and FTJ increased it slightly to 79% 1998 before bringing it down to 67% as he handed over power in Jan 2002. So whats your point here, friend?
Go check the doctor and teacher to population ratios in 1990 and 2002 and lets discuss. Pupils were learning under a tree in 2001 while KK in 1990 had them at home. We had the worst road infrastructure in 1990 than ever.

Chiluba refuses to pay K1.5bn demanded by Mulenga’s family
FORMER president Frederick Chiluba has refused to pay the K1.5 billion demanded by the family of the late Benson Mulenga for the K10, 000 he is alleged to have obtained from Mulenga’s group life insurance over 20 years ago. However, Chiluba has offered to help the family with some money, though the help may not be substantial as he is “also financially strugglingâ€.In an interview yesterday, Mulenga’s son, Buselic Mfula, demanded that Chiluba pays the K1.5 billion for the K10, 000 he obtained from his late father’s group life insurance at Zambia State Insurance Corporation (ZSIC).Buselic contended that Chiluba was on July 9, 1983 unlawfully paid K10, 000 belonging to his father’s group life insurance benefits from the ZSIC on a bank certified cheque number 215575 drawn on Barclays Bank of Zambia Limited, Zomba Road, Kitwe from National Union of Buildings Engineering and General Workers (NUBEGW) of Zambia Congress of Trade Union. Chiluba was at the time national chairman of NUBEGW.Buselic warned that should Chiluba fail to pay the K1.5 billion, he would take him to court demanding K12 billion.According to a letter from Buselic’s lawyer Paul Pandala Banda and company, Chiluba insisted that he never obtained the money in question but offered to help the family in kind.“We write to inform you that we were accorded an opportunity to meet and discuss this matter with the second president Mr FTJ Chiluba on the 10th November, 2006 at 16:00 hours at No. 23 (2b) Serval Road, Kabulonga , Lusaka. Like him or hate him, FTJ has changed Zambia for good. Whether the policies were his or not, at least he provided the leadership for those policies to materialise.
