Kaizer Zulu’s case still active – Katanga

The Zambia Police says the decision whether or not to pursue the matter in Court in which Presidential Political Advisor Kaizer Zulu has been charged with Threatening Violence following a shooting incident at Chrismar Hotel, will depend on the complainant Enock Kavindele Junior formally withdrawing the complaint.

Lusaka province Police Commissioner Charity Katanga has told QFM News in a telephone interview that no formal withdrawal of the matter has been made so far by Mr Kavindele Junior.

Ms Katanga says it is therefore too early to state whether the matter will be withdrawn from the court.Katanga

She says Police have been waiting to hear from the Kavindele brothers from last Friday after indicated that they had reconciled with Mr Zulu following a bar altercation which resulted in the Presidential Aide discharging his firearm .

Ms Katanga explains that the fact that Mr. Zulu was bonded for up 7th October the day he is scheduled to appear in Court, it cannot be assumed that the criminal complaint against him might not be withdrawn.

And the Zambia Youths Association in the Fight Against Corruption (ZYAFAC) says the intended withdrawal of the criminal complaint against the Presidential political advisor is a mockery to the Police.

ZYAFAC Executive Director Rickson Kanema says the move amounts to taking the Zambia Police for granted.

Mr Kanema says it does not augur well for anyone to file a complaint and withdraw it two days later when the Police have other serious matters to deal with in the country.
Mr. Kanema has since called on the Police not to entertain the withdrawal of the complaint against Mr. Zulu.

He has told QFM News that Police should ensure the matter is pursued to its logical conclusion.

  1. I’m not a lawyer, but can a criminal case be withdrawn from court. Or phrased it the other way, which case can be withdrawn from court by the complainant? Gun related violence is a serious case in my view

  3. My question is: is it okay for someone to withdraw a case where a muntu is charged with discharging a fire arm in public. Because I believe there is the issue of the fight/assault which is one thing and discharging the fire arm which is another. I stand to be corrected.

    • @mwebantu….you are right, discharging a fire arm in public is an offence against the state. Which can not be withdrawn by any individual as it is against the state. However in Kaizer’s case, he was given a different charge, that of threatening violence. This case is more like a civil case and the aggrieved is free to withdraw it. I still dont understand why the police charged him with this case instead of the one for discharging a fire arm. So as things stand, and according to the case he was charged with, that of threatening violence, the Kavindele’s are very much in order to withdraw.

    • You committed an offense by discharging a firearm in public,so coz you broke the law,even if the complainant withdraws the complaint,the police should still charge Zulu for “Discharging a firearm in public” which calls for a fine…Case closed

  5. I think this country has gone to the dogs. There is no way Charity Katanga can say that the police have been waiting to hear from the Kavindele brothers whether the case must continue or not. The truth of the matter here is that the police are supposed to take keen interest in the case because a fire arm was discharged in a public place thereby endangering people’s lives. This is a criminal act and must be taken up by the state and not individuals. The state has a duty to protect its citizens and therefore any threat on life is an offence against the state. Now here the Chief Kapokola for Lusaka says “the police is waiting for the Kavindeles to determine the destiny of the criminal case”. Where on earth! This shows how incompetent and compromised Charity Katanga is. We all know, even…

  6. wat do you expect when this girl was promoted because she was being banged by minister of home affairs. She was my course mate and she was mother christmas. Thats why she only thinks of wrong things with emotions.

  8. Just who sued here,Was it the Kivindele or the police? Why did the search KZ’s house if the case was about a fight at the bar. I think this Katanga is embarrassing the police profession. By the way, why is it that Katanga is suddenly mor vocal than the IG? Is there something we need to know here?

    • @ME. The fact of the matter is that a fire arm was fired in a public place and could have killed somebody. The Kavindeles can only withdraw a civil case against little hitler. The state should have a case against him for the act of firing a gun in a public place.
