Late FTJ Chiluba’s property forfieted to the State

The Anti-Corruption Commission (ACC) has forfeited properties of late second Republican President Dr. Frederick Chiluba to the State.

The properties are valued at over K40 million.

ACC Public Relations Manager (PRM) Timothy Moono confirmed in a statement to ZANIS today.

Mr. Moono said the properties in question have been on rent to various tenants from the time the Commission seized them and the rentals have been kept by the Commission pending the outcome of the Supreme Court proceedings.

The rentals accrued so far amount to over K14 million of which over K4million in the Kwacha Account while over $1.2 million in the Dollar Account.

“Dr. Chiluba did not make any claim for the property when the investigations were proceeding and at the time the gazette notice was issued.

” The current estimated market value of these properties is K40m and the judgment of the Supreme Court is that these properties and the money have been forfeited to the State,” he said.

Mr. Moono said the case involved Tedworth Properties Incorporation whose matter had been in the public domain and has over the years, attracted significant public interest.

In 2002, the ACC instituted investigations into suspected corruption in the manner Tedworth Properties Incorporation Limited, a company incorporated in Panama, acquired properties in Zambia.

The property acquired by Tedworth Properties are Plot No. 4828, Alberg Court, located along Addis Ababa Drive, Longacres, Lusaka which also comprises 21 residential flats.

Others are Plot No. F/488a/26/C, Horizon House, located along Leopards Hill Road, in Kabulonga, Plot No. F/488a/26/D, Chibote House, located along Leopards Hill Road, in Kabulonga in the Capital City, Lusaka.

The ACC public relations officer said the properties were suspected proceeds of crime and thus in the course of investigations, recovered and seized by the Commission.

He revealed that during investigations, it was established that the properties were being managed by local property managers namely Access Financial Services Limited and S.P Mulenga and Associates.

“On 30th September 2010, the High Court ruled in favour of Tedworth Properties Incorporated but the Commission appealed the judgment of the High Court but the Supreme Court overturned the judgement.

On 29th December 2016 the Supreme Court awarded with Costs to the State.

Mr. Moono however, regretted that the matter had taken long to reach conclusion.

Mr. Moono said fighting corruption requires a lot of commitment, patience, courage and professionalism in the face of adversity.

“The Commission will continue and has placed a lot of emphasis on prosecuting and recovery of ill-gotten wealth, regardless of the persons or entities involved,” he said.

PRESS BRIEFING

SUPREME COURT AWARDS TEDWOTH PROPERTIES TO THE STATE

I wish to thank you all for coming to this Press Briefing. The briefing has been called to highlight one of the major cases that the Anti-Corruption Commission has been pursuing and which has now been concluded by virtue of a Judgement in its favor, by the Supreme Court of Zambia. The case involves Tedworth Properties Incorporation which matter has been in the public domain and has over the years, attracted significant public interest.

In 2002, the Commission instituted investigations into suspected corruption in the manner Tedworth Properties Incorporation Limited, a company incorporated in Panama, acquired properties in Zambia. The Acquisition of these properties was done before Tedworth Properties Incorporation was duly registered with the Patents and Companies Registration Agency (PACRA) as a foreign company in Zambia, contrary to the law.

The properties that Tedworth Properties acquires included the following:

  1. Plot No. 4828, Alberg Court, located along Addis Ababa Drive, Longacres, Lusaka. This property comprises 21 residential flats.

  2. Plot No. F/488a/26/C, Horizon House, located along Leopards Hill Road, in Kabulonga, Lusaka.

  3. Plot No. F/488a/26/D, Chibote House, located along Leopards Hill Road, in Kabulonga, Lusaka.

During investigations, it was established that the properties were being managed by local property managers namely Access Financial Services Limited and S.P Mulenga and Associates. However, the said property managers were unable to disclose the real beneficiaries of the said properties and it was suspected that they were unlawfully acquired using public funds disguised as a loan. The properties were therefore suspected proceeds of crime and thus in the course of investigations, recovered and seized by the Commission. A Gazette Notice was issued on 4th February 2002 to Tedworth Properties Incorporation informing the company that the properties would be forfeited to the state within three (3) months from the date of the publication of the Notice if there was no claim to the properties.

Three months elapsed and no claim was made on the properties hence the Commission issued an Order for the Properties to be forfeited to the State pursuant to the Corrupt Practices (Disposal of Recovered Property) Regulations of 1986.

After the Order was issued, Tedworth Properties Incorporated through its lawyers commenced an action in the High Court seeking a declaration that:

  1. It was the rightful owner of the properties in issue

  2. That the declaration that the Notices Issued pursuant to the Corrupt Practices (Disposal of Recovered Property) Regulations were illegal

  3. That there be an order reversing the Notices issued by the Director General of the Anti-Corruption Commission for the forfeiture of the said properties and costs.

On 30th September 2010, the High Court ruled in favour of Tedworth Properties Incorporated. An order was also issued for the Commission to hand back the Properties to Tedworth Properties Incorporation and to also render an account of the management of the same properties.

The Commission appealed the judgement of the High Court to the Supreme Court of Zambia.

On 29th December 2016, the Supreme Court delivered its judgement allowing the appeal with Costs to the State. The decision of the High Court was overturned and it was stated as follows:

  1. That the Corrupt Practices Regulations were legal

  2. That the Gazette Notices Issued pursuant to the Corrupt Practices Regulations were legally issued

  3. The disputed properties were effectively and legally forfeited to the State.

You may wish to note that although the property managers refused to disclose the details of the persons who were claiming ownership of the properties in question, the lawyers for Tedworth Properties Incorporated later and in Court, disclosed that the purported beneficial owner was the late Republican President Dr. Frederick Chiluba. However, it was noted that Dr. Chiluba did not make any claim for the property when the investigations were proceeding and at the time the gazette notice was issued.

The current estimated market value of these properties is over K40 million. The said properties have been on rent to various tenants from the time the Commission seized them and the rentals have been kept by the Commission pending the outcome of the Court Proceedings.

The rentals accrued so far amount to over K14 million broken down as follows:

  • Over K4million in the kwacha account

  • Over $1.2 million in the dollar account.

The import of the Judgment of the Supreme Court is that these properties and the money have been forfeited to the State.

The matter has admittedly taken long to reach conclusion. Fighting corruption requires a lot of commitment, patience, courage and professionalism in the face of adversity. The Commission will continue and has placed a lot of emphasis on prosecuting and recovery of ill-gotten wealth, regardless of the persons or entities involved.

The Commission would like to thank all the stakeholders who were involved in assisting to bring this matter to finality and these are the Drug Enforcement Commission, the Zambia Police Service, the Security wings and you the media for keeping the matter alive in the public domain.

The Commission would also like to take this opportunity to once again call upon members of the public with information on any persons involved in corrupt activities to report them the Commission. The Commission values the support it continues to receive from the public and all stakeholders and will continue to execute its mandate for the benefit of all in Zambia.

    • Report someone corrupt to the Commission? How about you start with Lungu? He never disclosed how he got the increase in assets, from K10 million to K23 million in 16 months. Why don’t you start with him? And recently he announced that his ministers were already looting the national coffers. Get to them too. Check their bank accounts. Check their salaries and double check with what’s in their bank accounts. If you see that their bank accounts are getting fatter than their salaries, then you’ll know they’re up to no good. Drill them till they disclose where they’re getting the extra monies from. If they can’t explain seize their accounts, and have them arrested and prosecuted for corruption. And there were people saying Levy was wasting resources as if fighting crime is a profit making cause …I feel sorry for us the Government has been noticeably quiet about this significant ruling. ECL was quick to say ACC are not working, well if you leave them to do their work they will deliver…you are just corrupt boss

The UK Serious Crime Department already confiscated properties of Nigerians who bought them from stolen monies.       It was Mwanawasa, instructing Magande, who gave Mmembe and Mtembo Nchito illegal tax breaks, cases of which RB began to follow up in 2009, but which were promoted by Sata, and now have seen the post liquidated

      These are facts, whether people are blinded or not, facts don’t change. People can only be deceived but facts won’t change.

      Even if you and I may choose to agree wrongly and apeace ourselves and smile the widest we can, all will be futile if we are not in tandem with facts.

      So what is the use of arguing if a choice has already been made to…

The proof is there so why are we delaying? How long does it take to go to court? There is something Kambwili knows that Lungu is fearful of. Lungu went to the Copperbelt but just to show he has muscle but in fact he is a scaredy cat. Even a kid can put two and two together in this case. How much is Kambwili’s salary and what are his expenses and what is remaining (net income). All those properties combined plus other assets, how did he get them?   18. Chiluba was Zambia’s greatest con man. Declared Zambia a christian nation and while people closed their eyes in prayer he looted. But Zambians are naturally stup!d, they never learn anything. Another thief, Lungu, has burst on the scene, with a track record of dishonesty, a shameless thief, and this is public knowledge, but that’s who they have allowed to govern them.   21. Just a question from a layman. If Chiluba was acquitted by the same Supreme Court of theft, how come the same properties in question are then forfeited to the state. Were the same properties not part of the Criminal case? Can some learned person please clarify for me.

  22. The court fortified the assets to the state ,this means that the have just fortified them to another blunder,from chiluba to lungu,

  23. If forfeited to the state, what will happen to them? Will they be sold? Can the money be given back to tax payers in the form of say a 1% tax shield? Etc, many questions to be answered.

    2. RESTOCK SKILLS CENTRES THAT ARE CURRENTLY STRUGGLING WITH EQUIPMENT
    3.SPONSOR GENUINE VULNERABLE STUDENTS AT UNIVERSITIES AND COLLEGES WITHIN ZAMBIA
    4. KEEP THOSE PROPERTIES FOR INCOME GENERATION FOR CONTINUED SPONSORSHIP TO OTHER NEEDY AREAS OF EDUCATION, SKILLS CENTRES AND HEALTH CENTRES.
