The Post newspaper has issued an appology over the pictures of the woman who gave birth outside UTH. Following the protest by NGOCC, Ms Chansa Kabwela who is the Post news editor and chairperson of the Press Freedom Committee of the Post,on June 15, 2009 wrote a response letter where she apologized for having offended the women’s movement by sending the pictures.
“Our action was not intended to offend you as an organisaton championing the cause of women. We sincerely apologize for offending you and the women you represent by sending you those pictures,” she said.
“And for that we are extremely sorry. We have learnt our lesson and we will know how to conduct ourselves in future over issues of this nature. Please excuse and forgive our ignorance, we are not polymath,” she said.
Ms Kabwela said the pictures were not taken by The Post but by the husband of the same woman who complained that it should not happen to another woman.
The letter was copied to Vice-President George Kunda, Secretary to the Cabinet Joshua Kanganja, Minister of Health Kapembwa Simbao, Women for Change (WfC) and the Catholic Archbishop of Lusaka.
In a letter dated June 10, 2009 to Mr Kunda and copied to Mr Kanganja, Mr Kapembwa, the NGOCC, WfC and the archbishop, Ms Kabwela enclosed the pictures urging the Government to take action on the strike by health workers.
“I write you to bring to your attention images that we have difficulty publishing in our newspaper of the very desperate situation at our hospitals arising from the on-going strike.
“Enclosed are the very disturbing pictures from the University Teaching Hospital (UTH) in Lusaka that have been brought to our newsroom,” she said.
She said she had sent the pictures in the hope that they would move the Government to take quick action and end the strike by health workers.

I take it to be grossly unfair that the whole office of the President should take all his might and dignity to comment endlessly on this issue and make it subject of a Press briefing. Chansoni sana, there are no other officers who could have diplomatically handled this issue with the Press on the President’s behalf? Siliya’s attempts to stop the abuse of state resources by Ngandu Magande and others in that were keen to keep afloat a fledgling and bankrupt airline, her refusal to award corrupt telecommunication tenders to a firm promoted by Maureen Mwanawasa, and her quest to expose these corrupt vices attracted vicious political attacks and schemes that threaten President Rupiah Banda’s government.
Siliya is now at the centre of political and judicial feud that has engulfed the President, the Chief Justice, Ernest Sakala and opposition leaders Michael Sata (King Cobra) and his new side kick, Hakainde Hichilema (Prince Cobra).
BRIEF BACKGROUND
W
hen accepting the report of the tribunal findings on the petition against Minister of Communications and Transport, Dora Siliya, from Justice Dennis Chirwa, President Rupiah Banda had glowing words for the Judiciary praising it for keeping peace and stability in Zambia. He praised it for resolving disputes in a manner that promotes unity and peace in the country.
He was mistaken!
Instead, the findings of the tribunal were fuel for an ugly debate that ensued. Events leading to the court process against Siliya had caused a fractious debate in the country that people hoped that only the findings of the Court would rest the matter. The findings didn’t rest the matter but instead escalated political tension.
Whilst stating that Siliya had been cleared of all three allegations brought against her under the Ministerial and Parliamentary Code of Conduct, the tribunal report however stated that she had breached the Republican Constitution by not following or ignoring the advice of the Attorney General.
The report further warned that had it been the Republican President, who had breached the Constitution; he would be subject of an impeachment motion against him in Parliament!
The findings were so controversial that they raised a furore that took up acres of newspaper space and predictably caused the resignation of Dora Siliya from her position.
WHAT IS THE MOTIVE OF THE TRIBUNAL FINDINGS
I
t was clear that the Tribunal’s findings that Dora Siliya breached provisions of the Constitution were in excess of its mandate and jurisdiction.
The Tribunal erred in law when it when it adjudicated upon constitutional matters and pronounced itself on the provisions of the Constitution. This is an exclusive preserve and power of the High Court (and on appeals the Supreme Court).
Magistrate, other lower courts, and tribunals are barred from interpreting the Constitution.
The Tribunal however sought to interpret the Constitution when it alleged that Siliya breached the Article 54(3) when she awarded a Contract to RP Capitals without advice or regard of the Attorney General.
I have now read the whole appology story. Surprising to note that the letter was even written to kunda and many gvt authorities including the WfC and NGOCC but still these chaps could not bother to inform their boss on the matter. Not surprising that RB could not bother to ask from his henchmen for up-to-date information as he is pre-occupied with himself. Prof. Clive Chirwa is very right to say MMD is a laughing stoke to the outside world as they are liars. Now, this is even worse-for the whole lot of the president to call for a press conference and tell more lies as well as market his ignorance on porn in the presence of ambassadors on tax payers’ money.
Tribunals have a limited mandate and jurisdiction. In this case the tribunal was constituted under the Parliamentary and Ministerial Code of Conduct Act of 1994 and is tasked to investigate breach(es) of the Code, make findings and recommend to the President measures to be taken against a Member of Parliament or serving Minister.
The Tribunal also broke principles of Natural Justice as it pronounced itself on matters that were not subject of proceedings and therefore gave no opportunity to Siliya to be heard and defend herself.
The tribunal also seemed lost as to who was the client of the Attorney General between Dora Siliya and the Ministry of Transport and Communications.

How could the learned members of the tribunal choose to ignore the tribunal’s limited jurisdiction and mandate under the law? How could they comment and seek to interpret the Constitution when they sat as a mere tribunal and usurp the exclusive powers of the High Court to interpret the provisions of Constitution? ust when Banda’s government had reigned in the empire when it brought serious allegations of theft, corruption and fraud charges against Fred Mmembe, Mutembo Nchito and Peter Ngandu Magande in the Zambian Airways Saga, it made a surprising silly mistake. It relaxed!
Way to go! You deserve a pat on the bums!
But the empire went to work. They embarked on a fierce campaign and schemes against Banda. Banda’s government and his family were accused of corruption, inefficiency, neglect of duty and were also accused of failure.
Dora Siliya was the immediate target. She was accused of corruption and was arraigned before a tribunal constituted by the Chief Justice, Ernest Sakala under the Parliamentary and Ministerial Code of Conduct of 1994. The findings threatened both her ministerial job and her seat as Member of Parliament for Petauke Constituency.

Chief Justice Sakala sealed Siliya’s fate when he appointed 2 Supreme Court justices to sit on the tribunal. How could he appoint senior judges to a process that could be a subject of appeal in the High Court? How could he expect juniors to differ with the findings of a tribunal which constitutes senior men? Was it to undermine any dissenting appeal?
Although the mischief appears to be in the law which prescribes the composition by stating that the tribunal shall consist of persons qualified to hold or have held office of the High Court or Supreme Court, the Chief Justice is expected to appoint persons who are of High Court status so that in the event of an appeal or review against the tribunal’s findings, embarrassment would not be caused when the High Court overturns the findings.

It is difficult to understand how the Supreme Court justices were expected to apply themselves to the proceedings. As men lower than the High Court? Isn’t Sakala aware of the saying that ‘’ where a Judge is, so is the court?
Haven’t Judges signed orders in strange places and venues? Wasn’t the late David Lewanika known to sign court orders from terraces of stadiums? How could he therefore expect Chirwa and Chitengi to act?
Or was the intention to make the findings of the Tribunal on Siliya virtually final? That if the findings were a subject of appeal, High Court judges would be intimidated or be reluctant to make a contrary view fearing to contradict eminent and senior men?
Now, can the Zambian president (Rupiah Banda) appologise for misinforming the world that giving birth or labour is sexually stimulating. It could be stimulating to him. But, definitely, not to the mother in labour or any other normal human being. Even the money spent on the press conference. Doesn’t he think it could have gone a long way towards paying the striking health workers?
Was the intention to place and sit these senior judges in a tribunal, but a thorough scheme to satisfy the empire?
How was the tribunal against Dr. Peter Machungwa, Dr. Katele Kalumba and Golden Mandandi comprised when Dean Namulya Mungomba, Bwalya Kanyanta Ngandu and the Anti-Corruption Commission (ACC) petitioned the Chief Justice Mathew Ngulube to investigate breaches under Parliamentary and Ministerial Code of Conduct by the trio in the K2billion scandal?
When that tribunal acquitted Katele and found Machungwa and Mandandi liable, didn’t they seek a judicial review in the High Court?

aureen Mwanawasa has pumped in huge funds in Opposition activities against Banda’s government.
On her recent visit to the Copperbelt, Maureen issued a statement supporting the wild-cat strikes by nurses calling them legitimate. She implored government to make assurances to the striking workers and urged government to obtain resources and pay the salary demands of striking workers. She also chided newly appointed Minister of Education Dora Siliya urging her to apologise to the people of Zambia for her wrongs she committed as this was the only way Siliya could serve with dignity!

Maureen also refused to confirm if she was campaigning for presidency stating that leadership comes from the people. This is an old assertion that leaders practice when they wish to satisfy their ambitions for political office lying that ‘people want me to stand’.
It is ironical that Maureen should be the one to request government to pay striking nurses their pay demands at the height of a K27billion scandal at Ministry of Health. Maureen, Darlington Mwape and Simon Miti are deeply involved in the theft of these huge funds (up-to K64billion since 2006).
Maureen is associated with Pharco a company owned by Italians which was given permission to manufacture ARVs. Pharco as Sunrise also ran Medical Stores.
Simon Miti’s failure to account for billions of kwacha paid to Interhealth Technologies of South Africa for managing medical treatment of evacuated patients was only settled when Maureen and Levy intervened on Miti’s behalf.
The Auditor General’s office implicated Miti, Zambia’s High Commissioner to South Africa, Leslie Mbula and Dr. Patrick Nyendwa (late) in this scam running for years where the Ministry of Health pays inflated medical bills to Interhealth technologies. Interhealth Technologies was brought to Zambia by Dr. Kashiba Bulaya and Dr. Patrick Nyendwa.
Miti and Mbula took this corrupt relation to a new level with Interhealth technology chief, Kelvin Thomas paying them huge amounts of money in kickbacks for every patient evacuated.
Recently there was an audit query regarding the inflated bills of the late PF Member of Parliament for Kanyama, Henry Mtonga. Miti settled the medical bill that significantly differs with what the family was paying.
Miti and former Executive Chairman of the Task-force on Corruption Mark Chona replaced Pharco with Crown Agents in the running of the multi-billion industry of procuring and distributing medicine in Zambia through Medical stores.
The Auditor General Anna Chifungula on her recent tour of duty of border areas and Western Province insisted that K27billion was stolen at Ministry of Health in 2008 alone. She also bemoaned the continued loss of vital accounting documents at the ministry.
Ms Chifungula has always expressed alarm at the extent and abuse of huge amounts of money at the ministry but no particular attention has been paid to her cries.
In April 2007, she exposed a scandal at the ministry where Medical Stores had disposed off drugs worth K24Billion. She demanded that Miti explain why he had allowed a system that resulted in such a huge and costly wastage. She also complained that Ministry of Health officials led by Miti always frustrated the work of her audits and showed little or no cooperation.
Minister of Health Dr. Brian Chituwo defended the disposal of the K24billion worth of drugs defending Miti that he followed all procedures required for the disposal of government assets! He attributed the wastage to the dissolution Central Board of Health and arguing that most of the expired drugs were ‘unplanned donations’ from service clubs, churches and NGO’s!
Chifungula stated that it was shocking that while the constant cry of Zambians was that Hospitals, Clinics and Health Centres lacked medicines, the Ministry of Health had the luxury to allow drugs expire on the shelf and then dispose them as waste!
Crown Agents Country Director Misheck Kaoma, promised to run Medical Stores in a more professional manner to avoid the recurrence of such costly wastage.
One wonders why authorities are keen to pursue Henry Kapoko and other officials at the Ministry by charging them with numerous counts that are all related to a single transaction of K1.9Billion. What about the huge monies stolen since 2006? And what about the difference between K1.9 billion and K27billion? Who is liable?

agande who has kicked off his campaign in the MMD and has embarked on country-wide tour was recently called for police interrogations over the abuse of state resources to support a private business in Zambian Airways.
Magande justified his ‘intervention’ as legal citing the Loans and Guarantee Act as foundation for his intervention. He stated that he has authority as Minister of Finance to intervene in Parastatals debts and loans including that of National Airports Corporation.

THE ELECTORAL PACT

n 4th June 2009, a surprising announcement was made. Two leading opposition parties of the country the Patriotic Front (PF) and the United Part for National Development (UPND) would form a formidable alliance against the MMD.
In a press statement signed by PF leader, Michael Sata and UPND leader Hakainde Hichilema, the duo announced that they had come together in an electoral alliance to unseat the MMD.
They promised to offer stringent checks and balances against the ‘corrupt’ government of Banda. They demanded for early Presidential and Parliamentary elections.
The two parties have since embarked on political activities aimed at promoting the alliance.

A startling revelation has been Hakainde Hichilema who has emerged with vitriolic political attacks against Banda and his ministers. He lampooned Education Minister Professor Geoffrey Lungwanga as a big man with ‘a small brain’.
He further accused Minister of Information, Ronnie Shikapwasha of intimidation describing him; ‘’your body mass does mean that you have more power and can intimidate me!’’
After Siliya was re-appointed as Minister, Hakainde held a press conference to denounce Banda’s decision demanding the immediate revocation of Siliya’s appointment and resignation of President Banda. He has accused Banda of having a special relation with Siliya.
Hichilema was known to practice clean modern politics. His politics were likened to Barack Obama promising a fresh, young start to the current rot in politics. However Hichilema has abandoned his quest for clean politics and language for dirty politics and crude language.
Probably his two electoral failures in 2006 and 2008 have taught him a sad lesson that has left him desperate to achieve a total transformation.
But to morph into a little Cobra spewing enormous amount of venom against everyone, Hichilema has embarked on a dangerous journey. Many saw Hichilema as a softer alternative to the ‘madness’ of Sata or as a cleaner image against the ‘corruption’ of the MMD.
Hichilema was known to practice clean modern politics. His politics were likened to Barack Obama, promising a fresh, young start to the current rot in politics.
However, Hichilema has abandoned his quest for clean politics and language for dirty politics and crude language.
Probably his two electoral failures in 2006 and 2008 have taught him a sad lesson

HISTORY OF POLITICAL ALLIANCES, PACTS AND MERGERS

he first known political and electoral alliance was the Africa National Congress (ANC) and the United National Independence Party (UNIP) when Harry Mwaanga Nkumbula and Kenneth David Kaunda joined forces against the United Federal Party (UFP) to gain universal suffrage in 1963.
UNIP and Kaunda led the independent government while Nkumbula left the alliance in 1964 and the ANC became the official opposition.
In 1999, six small parties Zambia Democratic Congress (ZDP), Agenda for Zambia (AZ), Zambia Lima Party, National Citizen’s Coalition, National Party and the Labour Party came together and formed the Zambia Alliance for Progress (ZAP).
At the launch Dr. Guy scot pointed out that: ‘’The ruling party is using its incumbency to the fullest, so working together is the only way we can beat Frederick Chiluba and his party the MMD.’’.
Labour party chief, Chibeza Mfune stated that; ‘’It is no longer good to go into an election divided. Election results have shown that although the total votes for the opposition is good or better than the MMD, the opposition loses because they stand as individual parties.’’
However, leadership wrangles quickly broke the alliance and constituent parties retreated to their old parties. ZAP however continued to exist under the leadership of Dean Mungomba.
Later Dean joined forces with Benjamin Yorum Mwila and his Republican Party to form Zambia Republican Party (ZRP). Mwila outmanoeuvred Dean and he retreated to his ZAP party. Mwila retained leadership of ZRP.
Many alliances, electoral pacts and mergers have occurred and have failed to make significance difference.

resident Rupiah Banda’s government appears a besieged one. His handlers are not helping matters. There is saying that ‘’A President is as good as his aides.’’.
His enemies are campaigning against him from all fronts. His enemies have alienated his government from donor support. Some donors have withheld funding or are slow to release money.
And local revenue collections have hit an all time low since 1994. In his submission to the Parliamentary Committee on Economic and labour affairs, ZRA chief, Chriticles Mwansa stated that his authority is facing serious revenue collection challenges. He said that revenue collections will have negative impact on government expenditure.
Mwansa regretted that ZRA had under collected revenue from all tax types in company tax, with-holding tax, property transfer, trade taxes, PAYE, and consumption taxes such as VAT blaming it on the global financial crisis.
Mwansa gave a bleak outlook for the rest of the year as the revenue collection was going to be below target performance. He stated that revenue from the mining, tourism, export and manufacturing sectors which used to be favourable was now not promising. Mineral royalty Tax had dropped from K41billion to K15.2 billion.
The political crisis is artificial and created by his enemies using clever tactics. Banda has to attend to the political situation in the MMD and the country. His presidency is beginning to appear a besieged and difficult one dodging crisis after crisis…

As for the “special relation“, what I have gathered from well placed sources in the MMD is that President RB Banda is a close friend of Dora Siliya’s father. If such is true, then I do not see any problem with president HH’s statement.

All that the PF is doing is to convince its cadres to rally behind the man of the moment president HH. Remember that Luapula PF and UPND members have already indicated that they will support whoever the PACT will field for Zambian President elections as candidate.

Even information like the PF-ULP coalition fielded most of the former UPND senior members as PF MP candidates is missing.
This creates a lie that PF alone move from being a smal party to become the largest opposition party. Thus, let honesty take root so that Citizens are fed with credible data.

From my own experience as a medical personnel, most mothers who give birth out side hospitals delay at home. Some travel to hospitals when the birth canal is completely open for the birth of the baby. Ideally the woman should be admitted early in order to monitor progress of labour.
