FORMER Zambia Security Intelligence Services (ZSIS) director general Xavier Chungu has gone home after he was discharged from the University Teaching Hospital (UTH) and met bail conditions in all the cases.

Chungu’s lawyer, Nicholas Chanda, said in an interview in Lusaka yesterday that his client was discharged yesterday and was recuperating from home after he met the bail conditions in matters involving theft by servant and another of forgery.

Chungu was admitted to UTH about two weeks ago following a surgical operation after suspected food poisoning.

“He is now at home because he met the bail conditions while he was still in hospital on treatment. He will be coming from home to attend the court cases,” Mr Chanda said.

Kabwe senior resident magistrate, Joshua Banda granted Chungu bail in his own recognisance pending judgment in a matter he is facing two counts of forgery and falsifying a document contrary to the laws of Zambia.

It was alleged that Chungu on dates unknown in 2003 forged passport number ZH 88471, purporting to show that it was issued properly when in fact not.

In the second count, Chungu was charged with falsifying a document contrary to section 352 of the Penal Code CAP 87 of the Laws of Zambia.

Particulars of the offence were that, Chungu on December 3, 2008 in Lusaka, knowingly and fraudulently presented the passport in question to Mary Bwalya, an immigration officer.

In another matter before chief resident magistrate Charles Kafunda, Chungu is facing169 counts of theft by servant contrary to section 272 of the Penal Code Cap 87 of the Laws of Zambia and judgment is due to be delivered on Monday next week.

  1. Finally he has canvassed to RBB. RB is the corruption promoter. How many prisoners are sick and are denied medical access? This is real nosense. this guys deserve no mercy at all

  2. When you eat poorly prepared or poorly served food you get food poisoning. The man is smart he ordered the said food from his homestead, consumed too much of it and got food poisoning. Got operated on. Gets bail after satisfying or bail conditions. Goes home. What next? I smell FREEDOM for Chungu.

  3. Chi LUPIYA BAMBA came to free the thieves like Kafupi, Chungu, Mabenge etc, please someone remove this thing before it takes the country 30 years backwards. it hurts to see such things happening, why did Levy has to go so soon…God help us…..

  5. How come these thieves, Chiluba and Chungu, are sickly. They thought they fooled Zambians but God sees and they are paying for for their various crimes. The stlen loot is proving bitter to them and their relatives.

  6. we know that this is serving us an example to the incoming plunderers. but look at the money the country has spent on this. as if he CHUNGU is going is going to pay back. why cant the law act quickly and bury this case so that the moneys involved is channeled to other developmental issues,like the mazyopa issue.

  8. There are 2 things here either Chungu has done his stage managed come back followed by a jail (detention) and now he has tasted freedom. The whole thing centred on late Levy and now that the man is no more anything can happen to these plunders. What makes these pipo in authority that Chungu wont flee. Something has gone wrong with prosecution of these plunders now they can walk with their heads up.

  9. Congrats Mr. Chungu for winning your freedom, its just fair that you defend yourself from home like the rest of the plunder suspects. I wish you well during your defence in the remaining cases. You have been a sacrificial lamb for too long while the chief suspect Mr. Chiluba is busy attending state banquets. All the best my big brother

  10. Chungu is former inteligence chief who has jumped bail before. Why grant him bail again? If he makes it this time, you will never catch him.

  11. Chungu deserves to be free especially that he is the former head of intelligence. I have never seen such stupidity where a person of chungu’s calibre is kept in prison. I notice that some low calibre writers agitating for incarceration of this man. Rupiah Banda is very loyal to Zambia, he can never unveil Zambia the Mwanawasa did. Mwanawasa sold all the sovereign assets to foregners who in turn gave kick backs to his family. Where on earth has such a thing ever happened? Zambia is still intact because of the services rendered by men of Chungu’s calibre. Ask KK or chiluba, they will attest to this.

  12. The question is, was he poisoned while in prison? I can’t imagine that any relative would bring poisoned food from home. If the food was not from home, why is the restaurant where the food was ordered from not sued? If the food was prepared in prison, I guess there are more people that were poisoned, not only one, Chungu. Or was it planned? I don’t understand this kind of innuendoes by judges and people in politics. The whole group will soon be free including Chiluba. This is just the beginning of freedom for all of thieves involved with Chungu.

  13. Is it zambian laws which are weak or our lawyers are not trained well to excute the laws? I wonder why Chungu is still given bail when he fled the country for some years when he first got bailed? I have got no kind words for people like Chungu. He probably knows how weak, corrupt and crazy RB is, thats why he came back to Zambian when ba Levy died. So many prisoners are sick and they are not granted bail only chungu why?

  14. #23 you should ask yourself why Chiluba’s trail is still going on. Ask yourself which politician (MMD) has been trailed and sentenced succesfull and sarved the whole full sentence in prison? who? This is nothing but window dressing and (God help us) I hope Zambians are not felling for it.

  15. When you look at the case of having a forged passports is not an issue for a Former Chief of Spies. It is normal of CIA, FBI, Special Branch to have as many passports as the countries one has or will operate from. These ‘passports’ are duly issued. I personally do not see the State getting a conviction on this one. Let Taks Force concentrate on economic plunder cases where the misuse of public funds can (with some ease) be proved.

  16. This is the only country where a ruling party which changes Heads of State peacefully ends up arresting its Service Chiefs. A country’s top spy operates like a witch and his men and women to operate efficiently do the same style. The issue of forging passport does not hold water its a cover up to clean the mess which has bin scattered all over the world. It will be difficult for our system to coordianate with others in the region and worldwide. Even pa ZIM despite all their huge problems they dont handle their spies like that. Chungu deserves freedom. In my life I cant allow my children and nephews serve the nation from that angle. Politicians have disgraced what colonilists and KK left in place. MMD self inflicting pain and disgrace.

  19. #27 We share the same thoughts.The intelligence systems of the world have committed worse crimes anywhere it he world but not even one person has been convicted.Look at he the KGB,CIA or MI6.As for forging documents it is a normal occurence when one works for the intelligence.I don’t know but the average Zambian is limited to information obtained from reading the Times of Zambia or Daily Mail.That is why some people appear to be shallow in their analysis.Umwana ashenda…has a lot of meaning to it not just moving to another area but to learn how people in other places deal with certain matters.Try to read and STUDY conspiracies like the origins of the HIV pandemic or Weapons of Mass distruction scandal and you will be amazed!
