George Kunda clarifies NCC 10-month extension

VICE- President George Kunda has said part of the 10-month extension of the National Constitutional Conference (NCC)’s sitting period approved by President Rupiah Banda in April has already been covered.

Mr Kunda said this in reaction to an NCC delegate who wanted to know why NCC chairperson Chifumu Banda had said the extension was for 10 months while the president said it was for four months.

He said President Banda was merely interpreting the statutory instrument that was issued for the extension.

The vice-president said the NCC chairperson had explained that the NCC had already covered part of the period and the president was just interpreting the statutory instrument because there were other issues that came into play.

The NCC chairperson said that when Parliament started sitting from September 17, time for the NCC would not be assumed to be sitting.

He said time only ticked for the NCC when it was sitting adding that the same statutory instrument was only published in August.

When some members asked about the remaining days, Mr Banda said the NCC secretariat would handle the issue and explain to the members what the position was.

And most NCC delegates agreed that the number of Members of Parliament (MPs) should be increased to improve representation because some constituencies were too big.

The Willa Mung’omba draft Constitution under Article 159 proposed the number of elected MPs to be increased to 200 but Health Minister Kapembwa Simbao suggested that it should be increased to 300 so that each constituency could be divided into two.

Chongwe MP Sylvia Masebo said the increase to 200 seats was enough and Bweengwa MP Highvie Hamududu agreed saying some constituencies were too big resulting in MPs failing to cover all the areas.

Rev Fauston Sakala said the increment should not exceed 200.
Earlier the delegates adopted Article 158, which said Parliament should have power to summon and dissolve itself and that it should also have power to impeach the president.

But the vice president asked why the conference pick only the role of impeaching the president as opposed to other functions of Parliament.

He said that the article should be deleted to which Professor Patrick Mvunga agreed but after a heated debate the article was adopted.

And the article that sought Parliament to declare and ratify war was postponed so that it could be discussed together with the report from the executive committee.

  9. The MPs do not represent people in the constituents. The constituencies and elections have just become ways of making sure that the national cake is shredded( yes shredded) regionally. Elections must be about choosing people who can advocate for regional development. The current number of MPs is more than enough. Change will only come if the cabinet is chosen from outside parliament.

  13. THE history of the Zambian legal profession in the 21st century would be incomplete without the mention of George Kunda, the new Legal Minister & Vice President of Zambia.

    History would indeed be incomplete because of his immense contribution to the profession through the Law Association of Zambia (LAZ) and through practicing for the past 20 years.

  15. Mr Kunda is the man who firmly held to the position of LAZ chairman for four years from 1996 to 2000 when he stood down. Mr Kunda was born on February 26, 1956 in Luanshya of a miner Njanamo Kunda and Eginala Mwelwa who hailed from Serenje’s Musamani village where they now live.
    He is the first born in the family of nine. It was once a properly balanced family of five boys and five girls but unfortunately one of his brothers died.

  27. It will be better for Parliament to summon and dissolve itself this will make parliament a strong institution ogf governance.
    Increasing elective seats from current 150 to 200 is most welcome. There are some big constituences such as Kasempa, Mwinilunga East, Solwezi Eastm, Masaiti etc just to mention a few should be sub divided. This will make it easy to campaign and cover by MPs once elected. Yes parliament should have wide powers which includes impeachment of a seating President. In this case they will kept on their toes and will not breach the constitution. Declaring War should not be left in the hands of the President alone. Where the Military want to pursue certain areas of interest, they may manipulate the seating President. Japanese case WW II . It should declared by Parliament

  29. Regardsing the article, MPs should also seek to have a say on the Loans our govt obtains. Parliament should ratify them so that we dont end up with national debt like the $6bn we saddled for years. Thank God for HIP but we must control our borrowing now. Parliament, please hear hear hear.

  33. I just asked about teeth, because its surely not hereditary is it? And also its insanity in this type of mordern society to have 6 children. How can you look after 6 children and give your children a better life than what you had?, Atleast thats should be the aim, in the 21st Century 3 kids is more than enough, but the going rate is 2 and thats it. Unless you earn £40 000 equivalent its so unfair on the children. Family planning and men should go for a vasectomy and i believe in zambia it should be preached more so (a form of castration of men so they spit blanks) I am having one child thats all.     One way to know is to list down possible causes.

    Going by general trends in Zambia, politicians’ lifestyles and the picture of the late on LT (Teta near his Pagero) where he looked so thin, it is possible that he died of HIV/AIDs.

    Many people have died of HIV/AIDS, including many relatives of ours. So It’s no stigma thing any more.

    Mr Kunda has also experienced the dark side of his politicial career and he cites the serious accusations levelled against him and the Mwanawasa Government as the most trying time but he could not stand up to defend himself in the midst of all that even when he knew deep down that he was innocent.

  42. “I was bound by the leadership ethics as well as the oath of secrecy not to divulge information that may jeopardise State security. As a lawyer representing the State as my client, my hands were tied I had to protect its interests and that is what we were taught at the law school,” he said.

  43. It is not his first time to handle dual responsibilities in the Government.

    He previously held the position minister of Justice as well as that of Attorney-General, an action that triggered a lot of controversy in certain circles.

    Mr Kunda recalls that period as the most challenging time of his political career because the Government had to tackle the issue of the Constitutional Review Commission, the presidential petition, the removal of the immunity for former president Frederick Chiluba and the impeachment bid on Dr Mwanawasa.

    Again, he was appointed to serve as minister of Justice, this time with added responsibility.

  69. Mushota your comments on Zambian Men are born out of a frustration and self imposed importance that many Zambian men have witnessed from those girls who came first into UK. They will not respond when you greet them. When they see you doing well and going out with a girl from another country , they start calling you names.
