Don’t cause alarm over FJT’s London High Court judgment – Malila

ATTONERY General Mumba Malila has questioned the motive behind groups agitating over registration of the judgement of a London Court in a civil case brought against former President Frederick Chiluba as the matter is before court.

Mr Malila said there was no need to raise alarm over the matter because the Government was already a step further and that the case was already before the courts of law to determine registration of the London High Court judgment.

In an interview in Lusaka yesterday, Mr Malila said it was wrong for any individual or organisation to start pressurising the courts on the matter because it was still going on.

Some civil society organisations and individuals have continued to agitate for registration of the judgement and alleging Government interference in the recent acquittal of Dr Chiluba in the criminal case.

Transparency International Zambia (TIZ) is on behalf of 17 other civil society organisations currently circulating an invitation letter for a Press conference tomorrow where Dr Chiluba’s acquittal, the question of appeal, the registration of the London Court Judgment and the restoration of his immunity are issues lined up to be tackled.

“There is no need for any person to start pressurising the courts over the London judgment case because as Government we have gone a step further by having this matter registered, so the best those wishing to hold such gathering can do is to rescind their decision,” Mr Malila said.

He explained that the Government was waiting for a date to be set by the Supreme Court following some preliminary issues raised by the defence and called for calm.

He said if some sections of society were not clear over the matter, they should consult his office.[quote]

And Home Affairs Minister Lameck Mangani said any attempts to hold gatherings related to the London judgement would be regarded as prejudicial and questioned the motive behind such an action.

He said while the Government acknowledged the freedom of assembly, association and expression, it was wrong to misinform the public by making them believe that the matter was not before the Zambian courts anymore.

“I think the law is very clear and we are not going to allow people who deliberately want to cause anarchy in the country and my appeal to those planning to hold such meetings is that they should be patient and wait for the courts,” he said.

He said the Government was concerned about the conduct of some NGOs. He said the Government was not against criticism provided it was genuine and that it was aimed at the development of the nation.

The civil society includes TIZ, Caritas Zambia, Non Governmental Coordinating Council (NGOCC), Women for Change, Foundation for Democratic Process (FODEP), Southern Africa Centre for Constructive Resolution of Disputes (SACCORD), Evangelical Fellowship of Zambia (EFZ) and the Citizen forum among others.

  5. Yes laws are there to be followed but are they being followed? The man was found guilty so why wait and yet our law(s) have a provision for registration? Has the legal language become hard to comprehend? Perusing of the laws pertaining to registration shold have been done before and during trial.   6. The Civil Society will should read between the lines the comments from the Attonery General and Home Affairs Minister. Their attempt is as bad as trying to grow hair on an egg. It doubt if the Govt position on FTJ will take another direction. For now I will wait and see the influence thier gathering is going to generate. The whole matter has taken political dimensions and it will be difficult for GRZ to bend further. There both good and bad lessons to be learnt from from FFTJ’s case.

  7. People have the right of association and this right is there so that governments don’t do everything on their behalf.
    As attorney general why dont you empower the people to do that which is legally right so their rights and freedoms are not interfered with. A true Zambian leader is a leader with the ability to give people their independence in the way they want their justice administered. Discussions are necessary, whether on this case or on others and, if these demos and debates lead to the amendment of current legislation even better.
    You will agree with me that Zambians since Chiluba as president have been liberated and want to have a say in the way the three arms of government work. Please just provide non-violent procedures its for you its for the people.

GRZ has not been clear on the steps concerning the registration of the case Vs FTJ.Now that there is pressure it is possible for GRz to cheat Zedians that the case has been registered and yet nothing has been done.So let the concerned organisations hold meetings or press conferences so that we the people are kept informed.GRZ is very late to keep us updated in this issue and moreover the courts are being run by RB and his manions

FTJ was taken to the london court over corruption by the late LPMs who died after a reoccurrent brain stroke, He was found guity by the late Judge smith who died of a heart attack, the case was being registered in the zambian courts by the late judge Japhet banda who died in a road accident at the time of these events the chief of police who was a member of the task force by virture of his office was Wazakaza nguni, he died in a road accident. its not clear which judge is currently handling the matter if any. President chiluba is a former president and an evangelist, he has repeatedly pronounced that he is a prophet standing on solid rock and that whoever fights his Godly ways shall be crushed. It is yet to be known whether his prophecies are true or are yet to occure

Japhet Banda was to take this court to be registered but he died. so the case is still not registered because they are looking for a judge to take on this case and i thought hamaundu was given this case but still the courts are full and they are still trying to find space for this case. anyways, malila twaliku chongele nomba twa chongolola.

The reason is simply that Zambians do not have confidence in our judiciary anymore due to the Chiluba aquital debacle.   20. 18 Al Capone Chiluba is not as Zambian official, he is simply a Zambian thief. The fact that some that stolen money is stashed in the UK gives them every right to try him. There are money Laundering laws in place in every developed financial system and when these are broken, there are penalties. In the area of anti money laundering and fraud prevention, there is a process known as sanction checking. This applies even in Zambian Banks, and it’s basically a check of people listed internationally that banks should not deal with. I happen to work for a Bank in the UK and i inputted Chiluba’s name in the system we use. He came up with a very red flag and warning. He is listed with all his children and associates eg Chuungu etc and banks are advised not to to do business with them. So keep

  24. On average most of the bloggers on LT are dull. My best suggestion is that you guys create a COURT and appoint judges so that this matter can be put to rest. There is no country in the entire world where its people could be allowed to talk to much shit like in Zambia. Its high time sanity came back to this country. There is a serious abuse of FREEDOM. Why can’t we reach a stage where we could start addressing issues from a more mature standpoint.   40. Simon#44 Im interested in question2. There is a simillar case involving Retired General Funjika vs The People. He was jailed for receiving graft form Mr Rathi of £15,000 to pay for his children as an inducement. Gen funjika was even ordered to pay back the money by Jones Chinyama. Now Rathi’s judgemt is coming on November 9. He (Rathi) is the person the gave Funjika the £15000. Is he going to be aquitted also? Lets wait for that day. If he will not be aquitted then our courts are no based on precedence but favour. Alcapone please ANSWER QUESTIONS especially number 2.

The current position is that the government has applied for the judgment to be registered in the Zambian courts but the defence have challenged it. As in the recent case where FJT was acqiutted this one may also take seven years to conclude. Unfortunatekly that is the law as it stands. The civil society has all the information and should not pretend to be ignorant. All that they are looking to do at all costs is to pressurise the judges to rule in their favour, otherwise their sources of funding (donors) will dry up. Nkani za pa Zed, one’s pocket is more important than national inyerests, otherwise how will they build that mansion or buy that latest Pajero?

The aquital of Chiluba has far reaching implications on a number of cases, some still in the courts, and others who will now feel they should appeal since Chiluba is suppossedly innocent. Mulongoti put it very plainly that it was a politically convenient decision. That is against the constitution! If RB wanted JTJ free, he should have let the courts conclude without interference, and then pardon him using his constitutional powers. Does no one advise him? RB and Co. think that Chiluba can deliver Luapula province to them during the elections. It is surely a marriage made in hell.

  80. here are various documents circulating the Net which claim Chiluba was a victim of a plot concocted by the British to overthrow and persecute him. Well whether this is true or not, to me and most of the people in Zambia Chiluba is just a thief. It is doubtful that any knowledgeable person, except for conspiracy theorist, cranks and of course fabricators of stories on behalf of thieving ex-Presidents, really thinks Britain, France, the US, Germany, Sweden, Norway and Ireland have time to waste plotting against a sometime, rather mediocre past President of a small insignificant country in Africa. Chiluba was just a simple middle class accountant at Atlas Copco in 1991. Today by lifestyle and by any measure he is a millionaire. A dollar millionaire.

  81. Chiluba has hidden his assets using Pablo Escobar or Don Corleone methods. As for failing to trace ownership of any assets of Chiluba’s well we can give examples. Horizon house in Kabulonga was probably Frederick Chiluba’s. However tracing the ownership proved to be a real hassle with investigators coming up against shell companies owned by lawyers in Panama and the Cayman Islands. This is a typical ploy employed by drug traffickers, criminals, money launderers and other dubious characters. This is true. No-one came forward to claim ownership of Horizon House except some Panamanian lawyer known to represent mobsters, tax evaders and other persons of dubious repute who is using a power of attorney provided by a shell company in a country known to shelter such persons of low repute.

  82. Horizon House was Chiluba’s. This is a 99% certainity. If he bought the building from genuine gotten funds why the hide ownership ? Unless of course the source of funds is less than salubrious. This is typical of the trickster and twister of the truth, self confessed political engineer Frederick Chiluba.As for his acquittal, unfortunately it is an acquittal by technicality and not a clean acquittal. O.J. Simpson was acquitted because of sloppy police work and careless handling of evidence. However everyone knows he did it and unlike Chiluba he has kept a low profile and has not offended people by proclaiming his so called innocence. The prosecution mishandled the case and OJ went free he was innocent because the law will only take away youronly when the evidence is clear and untainted.

  83. In Chiluba’s case procedural issues got him off. Not proof of his innocence. If he was sued under the less strict laws of evidence of a civil case, he would have lost like he lost in London and despite the slurs made by Chiluba’s team against the judge, this judgement still stands. The law firm that facilitated Chiluba’s shenanigans appealed against being lumped together with other crooks involved in these truly nefarious activities and won the appeal. Chiluba and company have not appealed. The reason is simple they would lose.bbb

  84. In Zambia Chiluba has still not stood trial nor has he yet been acquitted for:-

    1. Carlington Maize Deal US$ 8 million
    2. Arms for Katebe Katoto deal US$ 20 million
    3. Cobalt and Copper dealings at ZCCM unreconciled account and disappeared cash proceeds amounting to millions of dollars
    4. Breaking his oath and endangering the security of the country by revealing State secrets which actually may have cost him his Presidency or even life if the Solo coup had succeeded. Chiluba was literally cowering under his bed while soldiers rampaged through Arrakkan barracks. His short sighted and misguided revelations which were treasonous as they revealed information which put the nation in danger back fired as he now had no means of escaping from State House.

  85. Its intrestesting that its actually the government that are agitated wit the whole Chiluba issue, i have just realised that even the attoney general knows something here. The case wont go anywhere. The London court Judegement was said to have been registered 14 days after the London Judgement but its taken over a year. Indeed people can wonder as to whether its trully before the courts. RB is president therefore we will see a situation where it the London judgement will be thrown out of court saying the London court has no Jurisdiction in Zambia and bla blah blah. Thats like whats will happen.

  86. 5. Illegal arms, diamonds and fuel deals with UNITA which endangered Zambia and caused Angola to threaten war and resulted in 8 bombing around Lusaka by Angola as a veiled threat. Chiluba nearly led us into a war because of his greed and love for shady deals. Angola wrote a letter which according to sources had him literally shaking in his boots. Angola nearly went to war and by all measures Zambia would have been beaten easily if it had happened.
    6. The mishandled deal which caused Zambia to lose some of its top of the line Mig-21 fighters which to this day are held in Israel. Once the commission was chewed our aircraft were either handed over or seized by IAI in Israel.

  87. 7. ZAF Mi-8 helicopters which were in perfect working condition and only had time expired parts. These choppers ended up in private hands and reputedly to add insult to injury were later hired by the Un to ferry Zambian troops on peacekeeping duties in Sierra Leone and Darfur
    8. Sale of arms specifically ZU-23-4 Shilka, ZU-23-2, ZU-57-2 anti-aircraft guns to UNITA and SPLA from stocks held at 25 LAD Regiment and Lusaka Ordnance Depot
    9. Disposal of the Challenger 601 Jet which is now flying in Texas for which Xavier Chungu was detained when he carried millions of dollars in a briefcase like a common drug dealer. Where that money went Chiluba and Chungu never explained. Instead we now lease a jet from Execujet.

  88. 10. Insider dealing and bid rigging of the Roan assets of ZCCM in the ill fated RAMCOZ saga
    11. Unexplained deductions from UN peacekeeping allowances were the root cause of the Solo coup. Chiluba and Co were reputed to have siphoned off these deductions. Zambia normally has a battalion of troops on UN peace keeping duty. They get paid about US$1000 per month. Half of this was being deducted and collected from the soldiers. This meant roughly US$325,000 per month was being deducted from these soldiers and these funds were landing in someone’s pockets. This went on for years until the Solo coup.

  89. Furthermore Chiluba’s morals do not stand up to examination and are simply not up to the standards of a God fearing Christian. Namely:-

    1. Chiluba smokes dagga. ZAF pilots were once sent on an urgent mission on a a Bell 205 chopper to go and pick up an urgent parcel from Chiluba’s childhood friend. The parcel was 100% high quality Malawi gold marijuana.
    2. Chiluba drinks alcohol. Several intimate associates reveal he drinks crystal champagne, Blue label and Laphroaig whisky.

  90. 3. Insatiable sexual appetite. Not content with stealing and committing adultery with his acquaintances wife (Eddie Mwanza’s wife) Chiluba was seen on several occasion at the home of several attractive middle aged women driving himself in his gold BMW. Apparently one lady that turned down his advances was rewarded with a diamond studded gold bracelet as a consolation prize. His close friend Robinson Mwansa facilitated these nocturnal adventures by lacking out certain areas of Lusaka where Chiluba was meeting these women. Several times Kabwata and Libala were victims while Chiluba went to his rendezvous with a very attractive vivacious resident of Libala opposite the NIPA complex along Burma road. Two of his aides almost blew the plot when looking for chicks for the boss at a college

  91. 4. Bizarre public behaviour. Singing songs about how bachelorhood had confused him dismayed his minder obviously the dagga he had smoked before the rally was of too high quality and resulted in unexpected results.
    5. What is his real name. People who knew Chiluba before 1966-68 claim he went by the name of Titus Mpundu. Vigorous searches of his alma mater where he was expelled for beer drinking and dagga smoking in 1961 or 1962 and not for leading a demonstration have been unable to find any Frederick Chiluba enrolled during the period of 1957 to 1963 despite several searches. Former schoolmate and house mate John Chinula who knew how this name was changed was deported and died stateless and a pauper in Malawi to stop him revealing the truth.     6. Vindictiveness and abuse of office to avenge perceived wrongs. Dean Namulya Mung’omba was tortured and raped in prison on Chiluba’s orders and contracted TB and other diseases that resulted in his early demise. Cuthbert Nguni was tortured to death in the concocted Zero option plot on Chiluba’s orders. Kenneth Kaunda was arrested and held for 6 months for treason that never was with not a single witness nor a single shred of evidence when Chiluba lashed out blindly after the Solo coup attempt. Princess Nakatindi Wina suffered in order to humble her for her perceived arrogance during the same charade.

  93. Bomb disposal expert Ordon Ngoma died at Lusaka international Airport in unexplained circumstances during the concocted Black Mamba scare. Other experts had questions. If he was supposedly defusing the bomb why was he dressed in a suit and tie and carry a loaded pistol ? Why was the airport not evacuated while he carrying out this so called bomb defusion ? Expert opinion was he was planting the bomb when it went off probably on the orders of Frederick Chiluba through his intelligence chief Xavier Chungu. Archie Mactribouy was hounded until he died destitute, mentally unstable for having the temerity to be allegedly his wife’s boyfriend.

  94. . Even his ex wife Vera Tembo could not be allowed to find love and re-marry like Chiluba had done. Her proposed nuptials were torpedoed using Chiluba confidant and hatchet man Vernon Mwaanga. While everyone thought Vernon was rigging elections in Malawi, he was also on express orders of his boss making sure Vera did not become Malawi’s first lady.

  95. As for his service chiefs who have ended up convicted for their various peccadilloes and scandals well let us see:-

  96. These are common criminal offences and unfortunately these gentlemen left a trail which a blind man could follow on dark moonless and starless night. No one compelled them to steal. And when they were caught they had their day in court. They unfortunately lost their cases and as they had no friends to subvert judges and change verdicts.

    Dear Mr. Rupiah Banda, Mr. Chiluba and their PR minders should not insult our intelligence. Chiluba should quietly go away and enjoy his ill gotten monies. He should not flout his tainted so called innocence and have these Dickson Jere authored spin articles spread on the net. That whole crisis was Kafupi and Chungu’s making. How many Angola’s died because of Mr Chiluba? How many Congolese have died because of Mr Chiluba and most importantly, how many Zambian’s have died because of Mr Chiluba? No more weeping under the carpet for us! Btw. It is the criminal matters that you are found guilty and in civil the burden of proof is based on the balance of probability whereas in criminal litigation its beyond all reasonable doubt.   109. IS IT TRUE?
    FTJ was taken to the London court over corruption by the late LPM who died after a recurrent brain stroke, He was found guilty by the late Judge Smith who died of a heart attack, the case was being registered in the Zambian courts by the late judge Japhet Banda who died in a road accident at the time of these events the Chief of Police who was a member of the Task Force by virtue of his office was Wazakaza Nguni, he died in a road accident. It is not clear which judge is currently handling the matter if any. President Chiluba is a former President and an evangelist; he has repeatedly pronounced that he is a prophet standing on solid rock and that whoever fights his Godly ways shall be crushed. It is yet to be known whether his prophecies are true or are yet to occur.
