Learn from Mpombo’s arrest – FPP

Share

George Mpombo

The Forum for Progressive Politics (FPP) has advised Zambians to learn a lesson from the arrest of former Defence Minister George Mpombo, by police in Ndola, for allegedly issuing a K10 million cheque on an insufficiently funded account.

FPP Secretary General Charles Kafumbo says Mr. Mpombo’s arrest should be an eye opener to many Zambians who are in the habit of issuing cheques on insufficiently funded accounts.

Mr. Kafumbo told ZANIS in an interview in Lusaka today that the arrest of Mr. Mpombo will serve as a deterrent to other would be offenders.

He said it is unfortunate that the former Defence Minister issued a cheque on an insufficiently funded account to Colwyn Limited owned by Ndola businessman Terence Findlay.

In January this year, an accountant from Colwyn Limited reported Mr. Mpombo to Police for issuing a K10 million cheque to the company on an insufficiently funded account.

Mr. Mpombo was arrested on Tuesday and has since been released on police bond with two working sureties. He will appear before Ndola Magistrates Court tomorrow.

  1. politics aside and truth be told, mpombo was wrong! he is a law maker who should have known that issuing a cheque on an insufficiently funded account was criminal.

  2. Ba Mpombo na imwe ni chani kanshi ! Why did you do that ? If you did not have enough cash; you should have borrowed it from me to avoid the embarrasment you have caused. You did not check well how much money you had in your account prior to the issuance of the cheque ! You are a wise man; I beleive. The next time if you do not have; talk to FTJ, maybe he can help. Chinani kalifya maningi. Anyway; you are just ” Human “.

  3. This is the case any where in the world, Infact in most countries[Zambia included] you are blacklisted and fined very high charges. The problem i have with the rules in our beloved country is that these regulations are selective. A number of business houses have complained of cheques issued to them that bounced upon being presented, major reason insufficient funds. Unless this rule is applied without prejudice it serves no purpose!

  4. Why did FPP comment. And why go to interview FPP over a bounced cheque. Dont these things happen all the time in Zambia? Is Mpombo the 1st one, for him to be the example for the rest of Zambians?

Sounds like mere politicking to me. Who are these FPP?

  5. let the law take its full course. no one is above the rule of law. only problem is here is this looks like a political case in the sense that mr mpombo is being pursued after settling issues with the creditor.

  6. Sata and Mmembe have all but run away with lambas openly wherever you go dishoring him that George Mpombo is not one of them but a settler on the lambaland from Luapula who has not yet accounted for the stolen 1000s of hectares of land he illegally glabbed from peasants farms in Chief Chiwala sold out. On the other hand, the people of Luapula are saying during his gloving years to Mwnawasa, he dishonored and insulted the people of Luapula as thieves. Now even his insults, sponsors of subversion against citizens’ constitutional institutions of power and indeed his dictionary rehearsed bombastic word are nowhere to show up and help spair him from this shame. Its has just been discovered that baillif are lining up and the Ministry of Lands is also getting impatient on the past due land rates.

  7. This is a lesson that lives that evolve around insults or too preoccupied with subersion are useless, disorganised, fantasized and always crime inclined. They talk big go for far fetched materials when they have plan ending upto into economic conmen.

  8. A look on his trousers tells a story of a man in dirty that the thick skin mantra he has been totting about that he is.

  11. This is laughable but sad for a man suddenly know for tow things: mouth diarrhea and Gloving. Why is President Mpombo looking like a cornered over indoctrinated insurgent from Sata and Mmembe madrasa-schools of terrorism?

  12. :d/Nuetral says:

Veteran, You got your job from GRZ not because you are competent but because you are the biggest ass licker. You remind me of people like Fines Bulawayo. You blog like somebody suffering from chronic verbal diarrehea, without thinking before you blog.We expect to move our country forward by sharing good ideas.I don’t care who rules zambia as long as there’s vision, seriousness and commitment.Look at Brazil and her achievements under President Lula and yet he never went to secondary school.RB can have 10 degrees, one of which is marrying his own grand daughter but that doesn’t grant him leadership qualities

  13. Patriot,20% of the zambian population has access to electricity, 68% of the population lives under the poverty line,50% of the budget is funded by the Donor Community. This clearly shows why people with your mindsets are to blame for such facts.46 years of independence we do not even have a zambian company that can make a needle.Instead of blogging at the expense of the taxpayers at the embassy in usa,get your ass out and start marketing zambia for FDI

  14. #21 “50% of the budget is funded by the Donor Community” – please substantiate your claims – especially with the recent budget cycles.

  15. If it was here in USA Mpombo would have been behind bars and charged with fraud by now , coz he knew that there was no money in his account and he went ahead writing the cheque which he knew very well that it would bounce. Learn from this sure.

  16. How come a ZANIS report sounds like it was written by a kindergarten kid? Why not give a few facts to put the whole issue in perspective, like the number of cheques that bounce in the top 4 banks in Zambia per day, for example vs the number of people arrested per day (or per year) for such offences.

  17. Patriot and your fellow ass licker Veteran, you live in the states and I would have thought you would have learnt by now how democracy works. There are members of congress who are democrats and they freely oppose some of the policies the president wants to put through but they are not expelled from the party.Unlike zambian political parties where everything is Yes Bwana.Govt comes to a standstill each time Bwezani is going somewhere because all Govt Ministers, Security Chiefs have to line up at the airport to wave good bye to him.Can you see that happening in america or the uk?Keep on licking Bwezani’s ass and one day you’ll be Deputy Ambassador

  18. In the Uk it is not a crime to have a cheque bounce. However, most banks will charge a customer a fee of £30.It’s normal to have “unclearde funds” in ones account but should you want your funds cleared by express, there’s a fee of £15.Mpombo’s case is coming from state house via the DPP.Why should the DPP order the police to open the docket when itwas closed? I am reminded of Chansa Kabwela’s case8-|

  19. How many people or indeed companies issue cheques that bounce? Thousands. Why go for Mpombo? A rotten rat somewhere.

  20. #22,when you have a chance please go through the budget speech by the Hon Situmbeko Musokotwane.Out of the 20% of the entire zambian population with access to electricity,3 % are in rural areas.40 % of the water in southern africa is in zambia and yet we rely on rainful for our agriculture and you have a president asking the population to pray for rains just before the last planting season:x:-?

  21. i smell punani somewhere. effinshi ifi? but mpombo nayena should know that money talks. where is all the money he was earning?? busy buying fake goat skin shoes.=))=))

  22. #26 Neutral – You have a point. Bouncing a check is not a crime. The Bank slaps on some fees and the two parties involved sort through the mess. with it.

Also ba Mpombo were you still expecting ministerial kickbacks in your account?

  23. #26 Neutral – You have a point. Bouncing a check is not a crime. The Bank slaps on some fees and the two parties involved sort through the mess.

Also ba Mpombo were you still expecting ministerial kickbacks in your account?

  24. I wonder how many Zambian have issued NSF cheques. This is simply being vindictive. I don’t think this man should have been arrested. If Chiluba can get away with stealing Millions, why go after someone who wrote an NSF cheque for $3000 and which he has paid after all. SHAME SHAME

  25. Clearly the man is being victimized because of his political position. A bouncing check is no crime. A fee is normally sufficient to cover the transgression. There have been many occasions transactions have ‘bounce’ on my account. If I was in Zed I would be a criminal. Get real and let the man go. He has an important task to complete:d/

  26. Rupiah Banda is too petty and shallow minded. The case will just be dismissed, i guess a number of our judges are smart and cannot entertain such rubbish .

  27. I know it’s an offence to do what he did, but never heard of anybody that was arrested over it. Government checks bounce, too – or, used to, when i was there, amnd Chiluba had withdrawn everything from the BOZ, as he embarked on his errands.

  28. LT you are doing a commendable job suppressing peoples opinions. This behavior should be encourage by all mentally challenged people. RB is doing such a commendable job, he should be awarded a noble prize for leadership. The world can learn from us on how to mismanage affairs. Thanks to your hard work RB and your gang of harebrained, we are headed in the right direction, backwards!

  29. #33 Bingo you are right on. Instead of making criminals out of hard working citizens, a fee should be sufficient. This is what is done in the West. Only if one is bouncing a cheque deliberately which is difficulty to prove. There would be millions jailed every year in North America if that was the case. I volunteer for a soccer association, and every year we get 10 or so NSF cheques and we just charge them a fee. Banda be reasonable. I refuse to call him RB because this makes sound like he is cool and educated. He has been through formal education by he is still backwards.

  30. If the fee bounces, then slap another one and so on and so forth. Good thinking.By now Mpombo would have been owing trilion kwacha due to accumulation of fees due to non payment of fees

  31. Many people in Zambia bounce checks..Oh many people in Zambia cheat on their spouse..should we all do the same…shallow reasoning. ..No excuse for breaking the law especially if you are a law maker. A leader should know the law better and uphold it at all times

  32. I’m not saying it is right to issue fake cheques but is it really tantamount to theft? It could be that there are just not enough funds on the account at the time of issuing the cheque but a few days later. At least in Germany this is not an offence at all and it happens everytime.

  33. #26 a friend who worked in a Zambian Bank for more than 10 years told me that it is a criminal offence to issue a cheque to be drawn from an insuficiently funded account. This is according to the Zambian Law, if it is not a crime in UK it is fine for them but this is Zambia. We should not easily confuse politics and crime. The fact that there have been many cheques bouncing elsewhere as suggested it should not give anybody leverage to turn a criminal case into politics. Poor Bwezani is drawn into every situation even for things that he has nothing to do with. This scenario has been created by the populist politicians and the sensational reporting by the so called independent media. By now all well meaning Individuals (Zambians) know that behind the so called independent media there is a…

  34. [-(8-x8-xThis is pure politics. The case was settled but someone has reopened it.Let us see how Findlay will act before the court. It is like the Government has too much money to waste on useless matters.

  35. NEUTRAL
You’re my hero at least for the time being you’ve managed to put this low life called VETERAN in it’s place. Everytime i see his name on the blog i feel like throwing up. He’s the most disgusting thing ever

  36. Your reasoning always amazes me. Not in a good way, by the way!! Don’t you think the “degree of criminality” matters in law? If that wasn’t the case, plenty of Zambians would be doing hard time in prison right now. Not all crimes are punishable by “death”, neither are all killings “muder”!

Yes people cheat on their spouses and such, and no one is encouraging you, Mr. MMD Chief Bootlicker, to go out and cheat on your wife (if you are married that is,) or bounce a check. But to have the DPP personally issuing orders to arrest someone on a case that the local law enforcement authorities deemed not worth prosecuting and hence closed, should be worrying to everybody, including you, MMD–fimo–fimo!! Is the DPP getting instructions from somewhere else? That should be question!!

  37. 39, obviously the Germany law will be quite different from Zambias, as i am sure you appreciate by now. However, if you break it, the consequences could be similar. Please stop bouncing cheques, your argument that the balance got depleted between writing the cheque and cashing it would be laughably inadequate in court.

  38. In the words of the American broadcast journalist Edward R. Murrow, “A nation of sheep will beget a government of wolves”.Our lives begin to end the day we become silent about things that matter.”We will have to repent in this generation not merely for the hateful words and actions of the bad people but for the appalling silence of the good people. What we can learn from Mpombos arrest is the fact that he is just victimised. Findley, it is an un disputable fact that he is working very closely with the state. FPP if realy you need progrees in politics, you must condem this. This kind of hetrate will not take us any where.

  39. Its only in our country Zambia where this law is practiced issuing a cheque with red account it is a case.
Tell us other motives behind not over this issue.

  40. #28 Nuetral: Here is paragraph 79 for 2010 budget (and please squint thru to get your 50%):

    79. Mr. Speaker, the Government proposes to spend K16,717.8 billion or 22.5 percent of GDP in 2010. To finance these expenditures, the Government will raise domestic revenues of K12,107.0 billion representing 72.4 percent of the budget and expects to receive grants from our Cooperating Partners amounting to K2,426.7 billion or 14.5 percent of the budget. The balance of K2,184.1 billion or 13.1 percent will be financed through domestic borrowing of K1,487.0 billion and foreign borrowing of K697.1 billion.

  41. Latcheting accounts and writing bad checks on a dry account is criminal tantamount to economic sabotage under the banking Act of the laws of Zambia. This a law which Mpombo wittingly sponsored and enacted in the house of legislatures at Manda Hill. With him he had moved 2 proposals in 2006 at the peak of his gloving vocation.

(1)-His First proposed bill under Mwanawasa in 2006 was the Degree clause for Presidential candidates

(2)-The second one was this Banking Act which went through into the laws of Zambia now challenging to stop latcheting accounts .He should revisit his bills. The Presidential degree clause is famously called the Mpombo Act.

This knowledge far beyond the too busy to insult PF kaponyas

  42. Chimbokaila is never full house. olo izule bwanji , ngati wa chimwa , uzangena. George should have known better that what they where doing to others could also happen to him.
Bama kamba ati pala wavinamo , siya tivinemo naise.

  43. mmmmmmmm! Vertaran and senior citizen is happy to see Mpombo in the hell but we know Mpombo is not a fool there is something big coming out of that cell, wait and see.
Mpombo sory to be messed up like that you will soon come out of that place and your mouth will have no breaks and we shall hear what we want to hear.
    The game has just started.

  44. According to Mpombo’s earlier statement,he issued the cheque and made it clear that they should not deposit it untill a later date when he was sure the account would have had enough money to cover up the issued cheque,it was a post dated cheque, atleast according to Mpombo,,,we are all just speculating about this issue,,,one thing for sure, this is more political than just a case of bouncing a cheque

  45. Where is all this passion by some bloggers on Chiluba’s case? How ironic, different penalties because of status and some bloggers cheer on. I dare ask are all Zambian’s regarded equally in terms of justice/ i wonder…Mpombo’s case is a drop in the ocean to other corruption cases…but hey one rule for the elite of Zambia… What a shame.

  46. Thats what happens when the president is too childish. Findley was forced and threatened to report this matter to the police by RB. Its a pity that even after the post released this news that this was nothing more than dirty politics for RB, the president still goes ahead and orders the police to arrest the man. How low can the president sink! When is the president ever going to realize what his job duties are?

  47. Chiluba who stole from all Zambians, some people even died of hunger, lack of medicine while he went shopping with our money in Italy spends no time in jail. I beg everyone to never vote for RB, this guy is taking us for fools. We shall see who the fool is 2011.

YOU SHOULD HAVE BEEN THERE TO HEAR THE UN PRINTABLES THAT THEY SAID ABOUT MMD AND RB

  49. PEOPLE YOU HAVE TO LEARN TO SPEAK OUT SOMETIMES. THIS IS ALL A BUNCH OF NONSENSE ZAMBIA NEEDS TO RISE UP AND SHOW RB WHO’S PAYING HIS SALARY. THERE WAS NO NEED FOR MPOMBO TO GET ARRESTED. THANDIWE HAS BEEN GETTING PAY CHEQUES FOR A LONGTIME, WHY HASN’T SHE AND HER HUSBAND BEEN ARRESTED?

  50. #61 LT WHY ALLOW THIS FOOL TO CALL MPOMBO A FOOL WHEN YOU HAVE SAID BAD LANGUAGE WILL NOT BE ALLOWED? IS IT BECAUSE MPOMBO IS AGAINST RB? BE FAIR

  51. I agree Mr. Mpombo was wrong to have issued a cheque on an insufficient money account. He was wrong as a lawyer he out to have known this. However, I admire Mr. Mpombo for his appology. also I admire Mr. Mpombo that despite not being wealthy, he has not kept quite and just EAT as Minister of Defence but chose to condemn the MMD and later relinguished a No.4 position in the Land with all the benefits the office had. I truelly salute him for the caourage to speak out, many Zamabians could have continued to eat well and forget the suffering mases & be No. 4 in the Land. May God make it possible u not jailed. Thandie continued drawing a teacher salary despite being in state house & notlonger working, nothing done to her. Poor Zambia Sucks as a country.

  52. No. 56 Brilliant u spot On & No 65 Mpangula Spot on. Rules seem to be different for each citizen in Zambia. Zambians are docile biengs, we easily forget and continue our suffering. Why Mother Zambia Why? Mpangula once said Quote ” maybe cause we never fought for Independence, we are cowards. Chachacha was a fallacy as pipo cut trees to block ba Mwisa and run away that was not war” end of quote. I think we need War!!! I know it is costly to humanity but we need it to set the order in Zambia. Peace &Order to you all after the WAR!!!!!!

Dear impersonator is that Israeli flag? Let me put it in simple terms for you, if George Osborne bounced a check today he would be dealt with by the bank he’s aggrieved without Gordon Brown or the M5 knowing a thing let alone The Sun newspaper. Now don’t give me the crap that our are laws are different from the British because they are not. What is different is the AVERAGE IQ of leaders between the two countries. Whilst Brown would be looking at how to outsmart his opponent in terms of policies, our degree holder president is busy sniffing around for petty to stress his opponents. So Mr Impersonator is that still too difficult for you to decipher, please leave the ar$£ licking to maggots like SENIOR CITIZEN.

  54. Iwe ci SENIOR CITIZEN what’s your take about the girl in state house still getting a salary when shes not teaching anymore?

  55. #33 wikala kwi??you are the ignorant lot who are not abreast with the current zambian laws.Ba Mpombo made a mistake, elyo baleingila.I concur with #4.And ba #6 I hope that includes you.

  56. # 65 Mpangula Mputyu- Funny thing is Findley himself was arrested for having sexual relations with a minor. This came about the time he differed with Levy Mwanawasa. So Could it be the cheque thing was a trap by Findley to hit back at on LEGACIST called Mpombo. Even this chaps FFP can see this Argatha Christ Mystry unlesss they choose not to.

  57. Veteran and your fellow ass licker Patriot, please do not blog without thinking. Bar my professional ethics, do you know how many dishonoured cheques Bwezani Banda issued whilst in Chipata as a farmer? Do you know how many cheques King Cobra issued that were dishonoured whilst serving as a senior cabinet Minister in FTJ’s Regime? How honourable are both Bwezani and Sata when it comes to issuing dishonoured cheques?I am neither MMD nor the PACT. VJ is well known for issuing dishonoured cheques and having his homes repossessed but this doesnt make him a criminal 😉

  58. You do not apply a law in retrospect, when Bwezani was bouncing cheques in chipata, Mpombo hadn’t enacted the law that has boomeranged.

  59. Bouncing a cheque is an offence. Arresting someone for bouncing a cheque after they have made good is Zambian politics. Motivating an arrest from State House when your own personal companies (Allenwest and Robert Hudson) have for decades not paid people their terminal benefits and former employees are dying of hunger is more criminal. It is a question of morality. You cant be throwing stones when you leave in a glass house. It is not about when the law was enacted it is about the moral conscience for someone to celebrate a single opponent’s arrest when there is a multitude out there whose livelihood, or the lack of it, your are solely responsible for. And you appear to have forgotten about them altogether! Zambia and Africa will never move on for as long as we personalise politics.
