Ndola Magistrate charges Mpombo

The Ndola Magistrate Court has charged former Defence Minister George Mpombo with one count of issuing a dishonoured cheque amounting to K 10 million.

Appearing before Ndola Chief Resident Magistrate Kelvin Limbani, and facing one count of issuing a dishonoured cheque contrary to section 33 sub-section 01 of the National Payment Act of the Penal Code of the Laws of Zambia was George Mpombo 55, a farmer of 05 Katonte farms in Masaiti.

Magistrate Limbani said the facts of the offence were that on 18th December 2009, Mpombo with intent to defraud, issued a cheque to Colwyn Limited of K10million on an insufficient funded account at Standard Chartered bank which rendered it defraud.

When asked to take his plea Mr Mpombo pleaded not guilty.

Magistrate Limbani adjourned the case to March 17, 2010 for the commencement of Trial and March 5, 2010 for Mention.

The former Defence minister had initially preferred to have the deliberations of the Court proceedings translated in Lamba but failed due to non availability of a Lamba interpreter in Court,

The Magistrate further granted an application by Defence Counsel Bonaventure Mutale to dispense the personal attendance of the accused during Mention on March 5, 2010 .
He explained that the accused would be involved in Parliamentary duties since Parliament would be in session at that particular time, adding that the accused was an Area Member of Parliament for Kafulafuta constituency.

Magistrate Limbani further extended Mr Mpombo’s police bond.

    Pipo like you amaze me.Any one who has followed Mpombo will know that the man has himself to blame.Mpombo was probably the worst of the lot of the family tree.These pipo with Mpombo in the forefront were divided cabinet into one part family tree and the other for the rest.And when LPM died the family tree lost its clout and because Mpombo had dedicated himself to blind worship of LPM together with other members of the family tree they found themslves isolated.So there are no politics issues at play here it is merely Mpombo paying for his foolishness.And why does he now want to use Lamba in court what happned to his Grade 12 vocabulary.

  8. #8 Abwenzi – I fail to understand your reasoning. Even if Mpombo paid back the money, he had already broken the law. It’s like if you steal someone’s phone and then take it back, if that person is aggrieved they can still sue you for theft. That’s simple logic and that’s exactly the spirit of the law as stipulated in section 33 (1) of the National Payment Systems Act of the Laws of Zambia. Mpombo should not even seek sympathy by asking for a Lamba interpreter because now is the time for him to use those misplaced bombastic words.

Whilst in chipata as a Farmer, RB issued cheques that were dishonoured to a businessman of Asian origin.Instead of focusing their attention on how best to move the country in terms of attracting FDI,job creation,improving the drainage system in cities and towns,they are busy trying to get even with their colleague by bringing up such rubbish.There are similarities between Mugabe and Bwezani.Is it because they are both Zimbabweans by birth?Kapoko’s case happened on RB’s watch but look at how slow they’ve been on the case but how fast they,ve been on Mpombo.s case.Doen,t this tell you something aboutBwezani’s mindset?

    Am I the only one who has the feeling that this case is being blown out of proportion? A bounced K10 million cheque is pure trivia compared to some $60 million state funds that went missing by you know who.

    The important questions is how many defrauders are enjoying stolen money out there while this poor man is getting exposed over failing to pay his debt?

  11. Latcheting accounts and writing bad checks on a dry account is criminal tantamount to economic sabotage under the banking Act of the laws of Zambia. This a law which Mpombo wittingly sponsored and enacted in the house of legislatures at Manda Hill.With him he had moved 2 proposals in 2006 at the peak of his gloving vocation.

    (1)-His First proposed bill under Mwanawasa in 2006 was the Degree clause for Presidential candidates

    (2)-The second one was this Banking Act which went through into the laws of Zambia now challenging to stop latcheting accounts .He should revisit his bills.The Presidential degree clause is famously called the Mpombo Act.

    This knowledge is way beyond the ever busy insulting PF kaponyas

  14. Why is valuable court time being wasted when serious matters can be heard before over clogged court rolls. the money has paid the K10million he owes. Shouldn’t his bank where the account is held have taken measures regarding this issue. Am just worried police resources are being used to appease Mr RB on a score he needs to settle within his MMD

  16. Defence Counsel Bonaventure Mutale will now rip all the little money Mpombo is left with. the chap has less than K10m thats why the cheque bounced. Now all his NCC allowances, Gratuity and his little maize harvest will go to Defence Counsel Bonaventure Mutale. worse stil, a guity verdict will be read against him despite those huge amounts to the Defence Counsel Bonaventure Mutale. These Lawyers have no mercy for anybody. After the guity verdict, they will persuade him to apeal, after the apeal they will persuade him to file injunctions, all this time they will be sucking him till the last drop of his saliva. my advise to mpombo is as follows; Consult richard sakala before you pay Defence Counsel Bonaventure Mutale.   17. Imwe just because a person steals a car and only returns it when he hears the cops are on to him, does that mean he is not a theif?

    Although payment was done after Findlay reported the matter to the police, a crime was already committed, in terms of the National Payment Act. Whether payment was done is only a mitigating factor, and not a defence.

    Stop mixing politics with the law.

    If Mpombo had honoured the cheque, we would not be here, but because he failed to honour his cheque, as law maker he should have just said YOUR HONOUR AM GUILTY! GUILTY! GUILTY! However, please mitigate my sentence, because I paid the amount at issue upon hearing a docket was opened.

  22. Its not debatable, Mpombo has broken the law, and he cannot escape punishment. But this is such a trivial case for Plot 1, and the entire Judicial system to be involved in. The bounced cheque saga i believe was settled between Mpombo and Findley. I honestly don’t not think Mpombo intended to defraud Findley as stated by Magistrate Limbani. This case as definately been blown out of propotion as observed by Nina Chali and many others. Plot 1 must focus it’s attention on improving the lives of Ordinary Zambians. If only the President would exert the same pressure and effort to conquer his rivals for the betterment of Ordinary Zambians he would be my Man…

  26. Months ago I said the anger in Hon Mpombo would land him into problems. That spray of anger has touched many people who are out to settle scores with him. Before we realise it, he will have another case, then that will be the beginning of the end of his career as a politician.   28. #11, I have no issues if the law takes its course & applied fairly. The complainant accepted the money & withdrew the case after payment was made in cash.So police could have closed the docket. Speaking of fraud, RB’s wife continued to fradulantly receive a monthly salary way after she stepped down as a teacher after the husband moved to plot 1. If you want to know more why RB is clinging on to power, he was on the brink of bankruptcy thanks to late president Mwanawasa he was given a new lease at life. How many of his businesses bounced or failed to honour cheques? The man still owes ZRA millions in unpaid company taxes. That’s why insiders who know the Zambian Airways saga are using RB’s cases as precedents because the law shouldn’t favour the elite few. Wake up man these RB’s are…

    Is this playing to tribal sympathy? mmm. Very cheap! Lamba is not an official language and Mr Mpombo, former Defence Minister is not illiterate! But to prove ‘intent to defraud’ will be the sticking point in this matter. This is bad law and Mr Mpombo will be a free man soon. My quarrel with these ministers and former leaders is why do they get debts from individuals? This goes to probity in public office!

    It is not an employee’s duty not to receive payment. It is the duty of the employer to ensure termination of payment. If the employer finds that one has been paid erroneously, the employer has the right to demand back the money. On the othe hand, the fact that a payslip was issued does not mean that the teacher received the money! I was paid for 11 months after I left a certain ministry, but I did not receive the money because the bank account was disabled.

    You disappint me. There is no such thing as blowing things out of proportion when it comes to the law. The people blowing this out of proportion are the media. I only say that it is bad law because ‘intent’ is difficult to prove. Someone has to check the account to prove that Mr Mpombo ‘knew’ that there was no money in his account at the time the cheque was issued. The people blowing this out of proportion are the ones who are applying politics to it. As #16 Senior Citizen says, it was Mpombo’s act, so let him taste his own medicine. Sata was imprisoned without bail for motor car theft. These guys make the bad laws not knowing that they will the victims of the same some day!

Let us see how this trial goes. The list will be produced in due course. This is a political witch hunt but you will not succeed. The debt has been paid what next?

  35. This man is an MP and in his cinduct he must always show honor and integrity. That is why he is referred to as “Honorable”. This should serve as a reminder and lesson to all the people in public office that integrity, honesty and accountability should be principles on which these so-called lawmakers should abide by. Whether instructions to prosecute are coming from plot 1 or not, no one forced Mpombo to attempt defrauding his counterpart! Let the law take it’s course. No one should be above the law!

  36. Mpombo is finished. What will happen is that he will get a criminal record and therefore he will not be eligible to stand as an MP. He may not go to jail but he definately will get a suspended sentence and that will mean he is a convict.   41. RB’s role might not be easily seen but its the inuendos that stink. From what I hear the cheque was issued on the understanding it will be held until when the account is funded. There might have been a breakdown in communication and the cheque presented. The regular thing to do was the bank to close the account and since GM paid back the money immediately the matter should have been closed. I ask what I asked in another forum, which is lesser evil, someone dishonouring a cheque and paying back immediately or someone closing his companies without paying off his workers for decades? Bwezanis companies Allenwest and Robert Hudson still have to pay employees more than 10 years on. And he has the means now. Lets play a fair game. GM, I dont like your politics but I support your position
