Acquit me, Katele tells court as judgment day is set for May 26

MMD National Secretary Katele Kalumba has submitted that the case of corruption against him has not been made in terms of the law and appealed to the magistrate court to acquit him.

Katele and his co-accused persons have also urged the court to set them free because the prosecution teams had failed to prove the cases beyond any reasonable doubt.

This is in the case in which Kalumba and six others are charged with corruption involving overpayments to Systems Innovation and Wilbain Incorporated.

Others charged are former Ministry of Finance and National Planning permanent secretary Stella Chibanda, former Ministry of Finance director of budget, Boniface Nonde, former secretary to the treasury Benjamin Mweene, former chief economist Bede Mphande and defunct Access Financial Services Limited directors, Aaron Chungu and Faustin Kabwe.

Kalumba, who made the submissions through his lawyer Vincent Malambo stated that the case against him in terms of the law had not been proved and urged the court to set him free and that payments that were made to the two companies did not suggest that he was the one who facilitated them.

And former Access Finance Services (AFS) directors, Chungu and Kabwe also submitted through their lawyers John Sangwa before High Court deputy registrar, Edward Musona, who is sitting as magistrate that there was nothing to indicate that the prosecution was done in the interest of justice, law and order.

The duo said the court ought to dismiss the charges against them and that it would be gross miscarriage of justice if they were not acquitted.
Mr Sangwa submitted that there was no evidence from the proceedings to suggest that Chungu and Kabwe erected cottage for Mweene or corruptly gave a farm to Chibanda.

And Chibanda, in her submissions, also indicated that it was not up to a prisoner or an accused person to establish his or her innocence but that it was for the prosecution to establish whether she was guilty or not.

Through her lawyer Nicholas Chanda, Chibanda argued that there was no proof beyond all reasonable doubt that she committed the offences, which the prosecutions team were alleging and prayed that she be set free.

And Mweene submitted that there was no evidence to suggest that he was aware that the erection of his cottage was intended to do a favour to Chungu and Kabwe and that he did not see how the erection of the house was connected to the alleged corrupt practices of signing of contracts and authorisation of payments into the Zamtrop account.

Judgment has been set for May 26, this year.

  1. Katele you are not Smart!! You are a crook who thinks can manipulate everyone in Zambia. Your will come if not now. Any you can also be acquitted if Chiluba was, what about you. You are all criminals that make Zambia STINK. You dirty baggers. for God’s sake who are you to bar other candidates for self interest.

  2. Let him use his magic to be st free. His complicated science of hiding in the bushshould be explained. Alabi knows well about this magicians but he has compromised his presidency to some level of patronage. Surrounded by magicians/thieves/adulterers above all bootlickers, for this man we shall see, facing criminal charges and still functioning as party executive. ITZ comment.

  3. If the architect of the Zamtroop fraud (FTJ Chiluba) was acquited, the Kalumba and group should equally be acquited. Why can’t RB sort not this issue out?

Looking at the darkness behind him in the picture above, you can understand why he hates light because he is lucifer’s lieutenant, he is a vampire of not only our money but also our blood, the blood of the nation.   6. Mweene is charged with having an erection in his house? Mweene, just say yes you were aware of the erection but it is in no way, shape or form connected to the alleged corruption!

  8. yah justice yapa Zed is really questionable. Somebody says desagrees with the presidents governing and he is immediately sentenced while people steal tax payers money and years and years down the line, they are still enjoying freedom along with their stolen money[-(….katwishi mama

  9. What’s with the current image above? Please put up one from the period in question. i for one would love to see how innocent he looked the day of his arrest. I understand he was on a much needed vacation in the lands beyond with his super computer as the only point of contact with the rest of the world…dark dark world that it is. Oh please. Pictures!!!!!

  12. time is the great tool of justice. we will still revisit these cases even if they temporally acquit them. Lawyers should act in the best interest of the people. be like accountants for crying out loud. we just say its not true and fair even we audit the state house account period. whether the Govt wants to take action or not based on the audit report is another issue. bravo! Accountants! laywers i have lost respect for you guys! marabish!

WE ARE READY FOR ALL OF YOU WHO STOLE OUR MONEY.

  14. Why waste our time with such talk. We know that Kalumba with others are already acquitted since its RB and Kunda who are the courts. The time will come when the right person will let the courts free then the cases will find themselves in court once again the way Sata’s case is finding itself.
