Dr Kalumba granted K500 million bail

The Lusaka Magistrate Court has granted convicted former finance minister and MMD National Secretary Katele Kalumba and three of his co-convicts K500 million bail each.

High Court Deputy Director of Court Operations Edward Musona sitting as Magistrate, granted Dr. Kalumba, former Finance permanent secretary Stella Chibanda, former Access Financial Services Directors Aaron Chungu and Faustin Kabwe bail in their own cognizance with two reputable working sureties each.

The K500 million bail conditions also apply to each of the working sureties for the convicts.

Magistrate Musona granted the quartet bail when the matter came up for bail application hearing in chambers today.

And Ms Chibanda’s lawyer Nicholas Chanda confirmed to journalists that the convicts have been granted bail worthy K500 million each.

The convicted have since been ordered to surrender their passports to the clerk of courts.

On Wednesday, Mr. Musona convicted Dr. Kalumba together with his co-accused on corruption charges and sentenced them to five years imprison each.

The corruption charges relate to the irregular payments made to US security companies Systems Innovations and Wilbain Incorporated amounting to US$20 million.

  1. OK may be if he put it at 1bn maybe they would have opted to stay in jail….imagine K500m u can buy a house but then these produced the cash out rightly? that should tell u something.

  2. From this case, we can tell the hardcore criminals and others who were just used. The others paid back what they are allerged to have stolen. The hardcore never accept they are thieves just like ba mudala ba Kafupi.

  4. Can some one tell me how many times has Faustin Kabwe been jailed ? The appealls will take forever Just look at Regina we are going on to two yearsl plitalala. What joke !!

  5. Oh no Kaka is going to vanish now. These people will never stay in jail as they have so much money which they obtained through corruption and it is the money t5hey are using to stay out of jail. Damn the appeal is gonna take many years and Kaka is not going to face the wrath of the prison conditions. Sh*t money talks!

  6. Their freedom is short lived that is why we need strong leaders who can speed up the process. Let them exhaust all the appeal channels and once supreme rules that will be the end of the chapter. We saw the same with Richard Sakala until angena mundende – jail. Our judicial system really needs to be independent. Most MMD f.u.c.k.e.r.s. claim there separate but every one with sight can truly see the long hand from the ruling part, a big link for sure

  8. I think GRZ needs to build a new prison for politician and also hike the bail fees so that these people are caged. Simple, if i am in cabinet i will steal enough to cover my bail and steal some more!! New prison please with all the internet and everything else apart from freedom!

    Hard labour and civilised routines should also be included!

    As one person here has mentioned, where did these four guys get K500m each? Says a lot, doesn’t it? So, let’s not be such sea-gulls who do not discriminate between real food and junk – when we learn to respect our mentality, then maybe the system will be more cautious and stop the :o) As it is, bane, they manipulate the show to mesmerize the @-)@-)@-)@-)

  11. What system allows one to post bail after judgement has been passed. I am not a lawyer but wouldn’t it make sense that one be allowed to roam free on bail only if one has been accused but not tried in court and subsequently found guilty? And how is Katele not a flight risk given his record of having tried to leave the country for fear of facing trial in the past. I ask these questions not that I am puzzled, but to see what those that understand the law and the purpose it serves have to say. Was the man tried and found guilty or was he accused, then arrested and is awaiting trial?
    We are a lawless nation, and like a a toothless lion in the wild we will continue to watch others eat while we sleep on empty stomachs. ‘Uku ku buta bane’.

These people had stolen millions in dollars so K500 million kwacha is nothing that just translates to approx.$100,000 dollars.Remember the Money chiluba claims is his or was his in zamtrop account, those are the same deals or the kinds of money these chaps possibly have but certainly not those small amounts mentioned in courts.Stella was even over heard at one of the social gethering boasting saying ” if you are not a billionaire in Zambia then its not even worth living”.Look this corruption went on for a every long time.:o

This is just a political gimmick to win people’s heart that they are fighting corruption, we know you guys, and I know it’s MMD NEC to pay for this bail because they need Kalumba for the convertion. Banda cannot allow Kalumba to go through this when just yesterday he was making a decree that Banda was the only presidential candidate for MMD in 2001 and that all those aspiring are wasting their time. Dora was scot free who can you cheat.

  15. The level of ignorance on this site supprises me. Appeals are a right in all civilised countries and will normally come with bail unless your charge you are given in unbailable( like murder, treason, theft of motor vehicle , drug trafficking etc in Zambia)

  16. As much as it was well expected it is done. There is no need to even withdraw their passports for they can easily exit to neighbouring countries on foot. kumwense u just step on those lonely stones pa kashiba and you are in Saire and another easy route is through pa musonda falls. been there and seen it all. they are using their birth rights well(appealing). One day like some blogger above has said, options will varnish and bell will be held and head. When one door is closed a window is opened.

  17. Here is the perfect timeline of events here: 1. Katele knows Nchito is a damn good prosecutor and he’s not gonna let him off the hook. 2. Katale starts hero-worshiping RB so he could pull the dirt trick he did on ka chiluba’s case. 3. RB realizes it’s not gonna work; Katele is too healthy and can’t feign illness to delay the case. 4. RB dismantles Task Force but to his chagrin Nchito still makes tremendous break throughs in his prosecutions: nails down Regina, former military bosses and so on, even ka chiluba’s case clearly shows he is guilty. 5. RB “kills” ka chiluba’s case. 6. RB realizes Nchito has made headway on Katele and fires him, later fires Mangani for not letting him know Nchito has nailed Katele. 7. RB tries to corrupt Musona but Musona can’t take it and…

  18. 8. RB consults ka kunda on the way forward but kunda is too ill to think. 9. Katele thinks he has been dribbled but RB consoles him that he should appeal to high court and RB will then do the Dora trick and get Katele off the hook. 9. RB and ka kunda are optimistic that since Nchito won’t be prosecuting this time, they can just pull out a Nolle through Mchenga and Co. 10. Meanwhile, RB intimidates Musona and Katele et al., are granted bail. 11. RB tells Katele to work his ass off to make sure he is re-elected in 2011 so he can set him free for ever (hoping 2016 won’t come).

  19. We know if RB wants them to walk, they will walk. Zambia will never see that money and these scums of the earth will not pay a dime in restitution. What NEW regulatory procedures are in place NOW to make sure its not easy for thieves like Katele to steal from the people so easily? That is the critical issue here.

This doesn`t come as a surprise. “The chickens have some home to roost.” While it’s pay back time for chiluba, by stamping vigorously for his savior, RB for being let scot-free, on the other hand , to be let-off –the- hook by having his case overturned by the appeals court, Katele will be made to pay upfront to his would be redeemer, RB by working vigorously at rigging the elections

  21. If a suspect hires Nicholas Chanda to represent him in court, chances are high that that person is either desperate, or he committed the crime, or he will lose the case. Wasn’t it Chanda or his friend by a similar name who represented that ZEGA chap who was given a few days imprisonment or optional K5M fine for that huge consignment of cannabis a few years ago? Before that chap was convicted the lawyer issued a statement to the effect that he had instructed his client to plead guilty because “he knew what he was doing”. Shortly after, the accused was given a ridiculous sentence which suggested that the lawyer had bribed that female magistrate. And we never heard of that lawyer in legal circles anymore, quietly sorted out by the Court hierarchy.

The 500million is not paid to anyone,it will only be paid if the convicts jump bail,the person who signed on their behalf will be made to pay that money,the person who signed for them has to make sure that they (convicts/criminals) are available and reachable at all times,,,it is just surety that the convicts/criminal the chief executive of mmd dr katele kalumba does not do a runner

  25. All of us if we were in katele’s shoes would have applead. Yalizanda mu kaliati! Only disapointing thing is that Nchito and Nkole won’t be there to hammer them, thanks to a certain old man. Kavwipi has landed many pipo intrabo including the wife he grabbed from a Ndola man.

  26. # 20 it is called bail pending appeal. You can ask for that when convicted. The most the magistrate can do to is to have Katele and company surrender their passports. If Katele decides to bolt after that then another offense would have been commited. # 25 i like your geography of that part of the world. # 32 RB did stop the states appeal against FTJ in effect determining that FTJ wont be convicted.

  27. its a sad story for mother zambia .katele has a record of running awy from the law before .does this not became a reason from refusing katele bail .the point is ,the justice system seems to work well for the zambian who have money .in anycase what do u expect from corrupt country like zambia where u have to loook hard to find a tarred road.

  28. This case involving Dr Katele Kalumba is the most confusing to say the least, first he went underground but kept his parliamently seat. Then when he resurfaced there was so much drama.This case might not end….african science at work

  29. # 40, the judicial system in zambia does not seem to favour those with money as you say, BUT IT HIGHLY FAVOURS, GIVES PRIORITY TO THOSE WITH MONEY, no money you go to prison, with money you hang around with appeals until the Lord Jesus returns.

  31. Ladies and Gents, what will change all this mediocrity of the Zambian judicial system is a change of the whole system (government) not a change within the system. That calls for a revolution or bloodshed. Zambia will never change through a ballot but a bullet will do, I should suggest. Because it’s like these fools have kept us captive for too long. When our people are dieing of poverty out there, someone is busy manipulating the government organs, which in essence are suppose to help people (Zambians) come out of their penury. One day, just one day, I dare you! Zambia will be set free from the hands of these old, finished maggots who can’t even think. Talking about katele’s case is even not necessary. Let us just focus on how we can change the whole system.

  35. How can you post bail after a conviction? unless they appealed the case and were given a bail after that.But that still would take a while, someone explain to me.

    The Tory-Liberal Democrat coalition has suffered a major blow as David Laws resigns from the Treasury over expenses abuse allegations.

    The Treasury Chief Secretary became the new Government’s first casualty after it emerged he had channelled tens of thousands of pounds in public money to his long-term partner.

    In a statement at the Treasury, Mr Laws said: “I do not see how I can carry out my crucial work on the Budget and spending review while I have to deal with the private and public implications of recent revelations.”
