Why is Dr. Chilufya’s case in Court, Judge asks ACC Investigations Officer

A witness has told the Lusaka Magistrates Court that the total assets for Health Minister Chitalu Chilufya were more than the assets that he is accused of having obtained illegally.

Chipampe Manda, an Investigations Officer from the Anti-Corruption Commission (ACC) said that he came to such a conclusion after analysing Dr. Chilufya’s sources of income.

He informed Lusaka Chief Resident Magistrate Lameck Mwale that he had access to Dr. Chilufya’s bank statements and that of his businesses.

Mr. Manda said based on this, he did not believe that Dr. Chilufya had committed a crime by acquiring the property that he is accused of.

It was at this point that Magistrate Mwale asked the witness why the matter is in court.

This is in a matter where Dr. Chilufya is accused of having been in possession of property suspected to be proceeds of crime.

The witness said contrary to the allegations, there is no evidence that Dr. Chilufya possessed three million Kwacha cash and that he bought Sparks Guest house for himself.

Mr. Manda also said Dr. Chilufya had been running Samfya Marine as a tenant even before he bought it.

The court was also informed by the witness that Dr. Chilufya , through Henry Courtyard Hotel in Mansa, had obtained loans way back before he was arrested for wrongdoing.

Mr. Manda said Henry Courtyard also had the capacity to buy Sparks Guest House.

During cross-examination, the witness agreed that Dr. Chilufya had obtained a 15 million Kwacha Loan from the Development Bank of Zambia (DBZ) and the Citizens Economic Empowerment Commission (CEEC).

The witness said there is also no evidence that Dr. Chilufya possessed 200,000 dollars cash as per indictment.

The ACC investigations officer further stated that no one ever saw the alleged 200,000 United States dollars and that the allegation does not exist.

In this matter, Dr. Chilufya is represented by Tutwa Ngulube and Jonas Zimba.

  1. Nothing surprising… We know the fellow will be acquitted. What do you expect when the head of state is supporting the accused and refuses to even have him step down from his position to pave way for PROPER investigations.. PF is pathetic, period!

  4. I am also confused? Who investigated Chilufya? Is it not the ACC? Who took the case to court ? Is it not the ACC? Who is Chipampe? An investigating Office at ACC? Who is the prosecutor??? I am confused????? or it is a case of misreporting bt Lusaka Times?

  5. As I have always told people, put evidence where your mouth is. You cannot bring serious allegations without solid evidence. That is not how a court works, May be in upnd kangaroo courts. A law needs to be introduced which convicts false allegations of corruption because such allegations can damage someone reputation and even their mental health. For example I still have a myriad of allegations against me without evidence. Just today the upnd diaspora watchdog are alleging I have not paid some workers from a certain security company which I apparently own. Kz

  8. Am also confused why an investigating officer who is supposed to prosecute the corrupt person so that he can be found with a case to answer, is actually acting like he us an accused’s witness. He has become very unfriendly to the state as a witness. I was thinking b4 you arrest an individual, you are supposed to believe that the accused has some reasonable case which would be answerable in a court of law. But in this case it would appear the opposite is true.

    2. I am told by the ACC that he was arrested warned and cautioned after an investigation.
    Who did the investigations ?
    3. According to ACC the accused has not committed any crime. Why is he arrested and in court today ?
    I can smile corruption in the whole issue. Above all ACC owes me as Zambian an apology and the whole ACC deserves dissolution .
    Can the appointing authority immediately dissolve ACC jt has failed to perform according to our expectations.

  11. What nonsense is this .The investigating officer going to say the guy is innocent ?why did this case proceed to trial in the first place ?This is clearly stage managed and these people are amateurs when it come to this .Really we all know where this is headed .

  12. That ACC officer is a hero. Well investigated, we have never heard of Minister with loans, except Chilufya and Maggie.
    Chilufya is a free man.
    It is him now to root out thieves from Ministry of Health.

  13. This is another master class from Lungu; you should be mental to expect ACC to seek justice for the tax payer.
    Their role is to cleanse CRIMINALS under PF. Where on earth does a minister remain in office while being investigated by his employers. To make matters worse is escorted to court by fellow ministers.
    Anyway it’s rush hour, they need a candidate.

  14. The Judge asked a very good question. If ACC believes Chilufya did not commit a crime, why is he in court? Appearing in court while someone is still clinging on to his government position! What a useless country! These Vampires hide in the name of obtaining loans. September 2021 come fast so that these vampires start scampering in different directions.

    Are you freaking kidding me? The guy giving against himself and his employers… granted the case was built on the evidence gathered through his investigation. Was this the prosecution witness or the accused’s? Unbelievable!

    Is this what they call ‘juju’ in Zambia or the classic case of the powerful tempering with witnesses because he has not been stood down? Oh dear! What a failed project this thing called Zambia!

  23. Why don’t you wonder how someone who sold mines and other Zambian Enterprises to himself on a song is there and enjoying the loot and no one takes him to court .
    This guy never got a loan from nowhere but all of a sudden he became so rich beyond measure and fails to even say a word of how he amassed those riches.
    Looking at the man at the centre of the court there is enough information pointing to how he acquired the said asserts, if he got a loan of that amount of money how can he fail to buy such asserts.
    The problem with us Zambians is we judge people before they are in court , and yet we all know that everyone is innocent until proved guilty by the courts of law.

  25. Public arrest. We the public should arrest both Dr Chilufya and the witness Chipampe Manda and make them explain how they want to fool us. If Dr stole he should be prosecuted. If he didn’t we will have to deal with Manda for lying to the public

Hw can a prosecutor who knows wht they doing take a witness like that to court? A witness for the prosecution is there to make the prosecution’s case.

  29. I am also wondering why this case is in court when the prosecution is the opposition, the DPP is the opposition and the defence is the opposition? May be this case is in court because all Zambians are stupid except the PF and their leaders. Let me end here before I insult the naked dogs.

  30. Lets not shoot the messenger, Chimpampe has no common sense and his ‘boss’ is ok with it, went ahead and hired him as investigator. You can only work with what you have. Lungu only has a pool of Ba Kaponya to pick ministers from, thats all he has at his disposal. He even said i have no vision, i will drink with KZ and just chill and get paid, kwasila.

    You will find that kansi Chipampe has been stealing ink and other stationery from the office and the boss knows but lets live because he is going to be useful in some way.
    Money is not the only possession that these crooks have but they own people too. Chilufya has Lungu by the amatole.

    Speaking during the Luapula Province party mobilisation launch which was broadcast on Prime TV, Mwila said Luapula Province should save ministers and members of parliament from going to prison.
    “Here in Luapula, we have a lot of support. We have 100 per cent support, but you bring five constituencies with 90,000 votes. We said this way back that this is a weak case by ACC like Amos Chanda case of stealing a pantry $11000, school kids can do better than this even they can cross check the contracts of those HENRY companies of his with GRZ, they can pin him for abuse of power. If no civil servants have been arrested or talking and Chilufya has the backing of the useless President and still comes in his office then you are not going anywhere with this case. Chilufya will be cleanse off corruption and will never be arrested again

  42. The ACC doesn’t mind bringing its own name into disrepute. Why rush to court with a witness like this? I believe there are senior investigators at ACC. The prosecutor did not even prepare the witness.

  46. The problem l see, is that everything is seen as politics, the ACC arrested and took the Minister to court based on rumours and accusations without proper evidence. Am not in politics but I see it is becoming a norm in Zambia that a politician in Government cannot build, buy asset, open businesses or do any kind of investments or if they do then there corrupt. Based on the rommours the ACC acted to investigate the Minister, which they have done, got access to all his accounts, bank transactions, analyse all his incomes and businesses and they have made that information available to us the public, please it’s an opportunity for everyone avail the ACC with the information which you have if truely have information and evidence to prove the Man guilty of Corruption, we shouldn’t just…
