   Dr. Kambwili is charged with defamation of the President contrary to Section 69 of the Penal Code Chapter 87 of the Laws of Zambia.

16. A term is 5 years, in the event of the death or incapacitation of the incumbent if three (3) or more years are left then whoever takes over he/she is deemed to have served a term. But if the period left to complete the term is less than three (3) years then the term is zero consequently the swearing aspect is also zero. The twice swearing in only refers to the terms of three (3) years and above. The sworn in twice only kicks in when the term periods are three years and above. ECL served only 1 years 6 months of the period left by MCS (MHSRIP). The Concourt has no choice but to rule in favour of the incumbent.
