MMD discussing with Opposition to avoid presidential by-elections

The MMD is talking to various political parties to find ways of avoiding a presidential by-election.

MMD National Secretary, Katele Kalumba, says this is because the exercise is expensive.

Dr. Kalumba said in Lusaka, Thursday, that it will be costly for the country to spend 400 billion kwacha on the by-election.

Dr. Kalumba, without naming the political parties the MMD has engaged, said the ruling party is discussing with Secretary Generals to look at available options.

He urged the opposition and Non Governmental Organizations with ideas on how the country can move forward without getting into an election to engage the MMD.

Dr. Kalumba called on stakeholders to think seriously on how the country can move forward as one family.

He however said the MMD is ready to go into the presidential by-election if money to hold the election is available.

Dr. Kalumba further urged stakeholders in the electoral process to be mindful that the country will be holding tripartite elections in 2011.

Zambia is expected to hold a presidential by-election following the death of president Mwanawasa on August 19.

According to the republican constitution, the country is supposed to hold a by-election 90 days after the demise of a sitting president.
And opposition United National Independence Party (UNIP) on the Copperbelt province says it is not ready to participate in the forthcoming presidential by-elections.

UNIP national revival forum chairperson for Copperbelt province, Dick Mbao said in a statement to ZANIS today that the party has no single leader with a mandate to represent or compete favourably in the presidential by election.

Mr. Mbao stated that it was premature for someone to stand as a candidate because the party was going through a reconciliation process.

He said the party was yet to hold its national congress to elect members of the central committee who then should decide on the candidate.

“UNIP is preparing for the presidential, parliamentary and local government elections in 2011 and not for a by election,” Mr. Mbao added.

He described the participation of his party in the November presidential by-election as irrational.

He said it would be a waste of the party’s resources to participate in the presidential by election.

UNIP national revival forum is a party faction headed by General Malimba Masheke, the former party secretary general.

The country will hold a presidential by election following the death of President Levy Mwanawasa last month.  The late Dr. Mwanawasa was put to rest yesterday at the Embassy Park in Lusaka.

Meanwhile, opposition Patriotic Front (PF) says it is now ready to discuss issues concerning the forthcoming presidential by-election.

Party Spokesperson Given Lubinda told ZANIS that the party was waiting until the late President Mwanawasa was put to rest to air its views on the forthcoming presidential by-election.

Mr. Lubinda said the party would soon call for a press briefing at which a comprehensive statement would be issued and all issues concerning the presidential by-election would be exhaustively discussed.

He said the necessity for a free and fair election would be articulated during the press briefing.

Mr. Lubinda added that the need to maintain peace before, during and after the presidential by-election would also top the agenda.

  1. And what are the altrnatives? What about the law which states that an election should be held within 90 days? What on earth is going on? Forgive me, but this is raising a lot of suspicions in my brain….

  2. This is why the constitution should be amended. The next time they make amendments, the Presidential Candidate should appoint their running mate before elections. When voting, we will vote for both of them. This can assist us in case the President is unable to perform or dies. Since both are elected, the Vice President will automatically become the President without wasting time and money like what is happening at the moment. Amending the constitution will not cost as much as holding elections every time a President is unable to perform or dies. I hope this can be taken into consideration.

  3. MMD are scared of loosing the Presidency. The constitution says within 90 days, the election must be held. All those people getting fat allowances must look at this to ensure that we do not waste resources in between the term of a candidate.

  8. I agree with almost everyone who blogged before me. Why have a national constitution if it cannot be followed. The govt just has to incur the expenses. By avoiding a by-election, they just want to comfirm, Ruphiah Banda.

    There is no excuse for not having a by-election. Hopefully, the opposition will act according to the constitution.

  10. Just a few days after LPM died, the govt announced that they had enough money to hold elections??? We are in this mess becoz our law makers always amend the constitution to suit the politicians and not the country as a whole. Accident, Death and sickness cannot be avoided therefore the constitution should clearly state what should be done when such things happen.The permanant solution is for the Vice President to be elected as well. Pls we have had enough tormentation, we would want to go through this once again.

I am not advocating for the man and I stand corrected but the current constitution demands that a Zambian president shall be elected and if the people (since its winner takes all) choose him, then he becomes the legitimate ruler of the nation.   38. The question of cost does not come into play when we are talking about the rule of law and foremost the Constitution, which is clearly spelt – within 90 days elections must be held. It does not say that “within 90 days elections maybe held”. That aside, Zambia’s cooperating partners have indicated in the past that they would assist the Zambian Government with grants to hold the Presidential By election – I stand to be corrected but the former British High Commissioner to Zambia was on record of saying Britain would assist.

    Anyway, how come the moral concious comes into play about the cost of the elections, which is stipulated by law, but no moral conciousness comes into play when it comes

There is nothing undemocratic about the MMD continuing until 2011 if only the other parties can agree and the constitution amended. Mandate to rule the country for five years was not only given to Levy as an individual but to the MMD as a party. Remember what happened in the UK when Tony Blair resigned. Goldon Brown took over withiout a by election because the Labour party had the mandate to rule for the whole term. If only the constitution can be amended, that would save us alot of cash.   69. The question of cost does not come into play at all, because the British government has pledged to meet the costs of the bye-election. Funds will not be made available for other projects if we bypass the constitution. It will be illegal not to have elections. even before the EU pledged to foot the bill, the Fin ministry assured us funds are there. There is no logic in the reasoning, soon we will hear there is no money for judges to hear cases so all accused persons will just be locked up. Or all appeals not heard.   70. No.59 your argument is misconceived. The system used here in the UK is different from the Zambian one. In Zambia, its direct representation hence you vote for the President (LPM) directly whereas in the UK you vote for a Party. Therefore, consent to govern in ZEd is given to a person and to a party in the UK. It follows that whoever the party chooses as its leader in the UK assumes the reigns of power as long as his or her party has won the majority of seats in the hse of commons. So Zambia can change the system in future if it wills but for now KU VOTA BEBELE.

It is the Zambian people that choose their president as provided for in our constitution. That is the Zambian democracy that most bloggers here understand. So Katele does not want that money to be spent, while government is ready to spend it. Britain and United Nations something have promised to fund the elections. The likley scenerio would be that the parties that are interested in fielding candiates would agree on only one candidate from one party to file his/her nomination papers.The rest from other parties would not. Such a one would then be declared unopposed by the learned chief Justice. There would then be no need for the elections. Shete, you are right that it is the parties to hold such discussions and not the government. It is the parties afterall that field presidential candidates. My only worry is the upholding of Levy’s legacy(fight against corruption, respect of the rule of law and above all, addressing the high poverty levels in the country) by whoever will be elected president. The constitution must be upheld, however in future we could explore the UK system where if the PM stands down or dies, his successor is chosen by his party from its elected MPs, i.e. no by-election for PM. Look at what happened when Tony Blair stood down and Gordon Brown took over! The UK is one of most democratic countries in the world and they have a system that avoids such disruptive by-elections because they essentially give a party leader the mandate to rule not an individual.
