Government has engaged the United Nations to seek clarification on whether the UN Security Council’s resolutions on Libya have an effect on LAP Green’s investment in Zamtel.
The UN Security council has passed a resolution to freeze asserts which are owned by individuals in the government of Libya following the uprising in the North African country.
Lap Green which holds 75 percent in Zamtel is owned by the government of Libya.
Finance and National Planning Minister Situmbeko Musokotwane has told parliament that the Ministry of Foreign Affairs has already gotten in touch with the UN on the way forward.
Dr Musokotwane says government will ensure that operations at Zamtel continue, pending response from the UN.
He says the objective of the UN Security Council resolution aim at blocking monies that may be remitted to support the violence against Libyan civilians.
He points out that Zambia has taken the stand because it wants to fully comply with the UN resolution

The Lap Green investment in Zamtel is impacted by the sanctions in so far as no new investment will be allowed from Lap green and no dividends will be paid/repatriated to the Lap Green investment fund.
From an operational perspective therefore, if Zamtel is self sufficient in terms of working capital then there should be no problem. If there are any capital investments awaiting funding from the investment fund, then these will have to stall.
The Zambian has to divest the Lap Green Investment ( i.e. give Ghadaffi his money back) or they will be in breach of UN sanctions. There is no distinction between Ghadaffi and the Libyan Soverign wealth fund. This is the approach in all countries were the fund invested e.g. UK, Pearson, Owner of Financial Times.

If the bid for Zamtel had been handled professionally, considerations for the Political Risk that came with the investment could have been addressed. The Zambian government should think long and hard about whether it gets investment at any cost, even from countries with very shoddy human rights and no democracy (China included!)
