MMD will not replace Rupiah Banda as its presidential candidate-Nyangu

The ruling Movement for Multi-party Democracy (MMD) says it is illogical for anyone to suggest that the party should find a replacement for President Rupiah Banda as presidential candidate in the forthcoming general elections.

MMD Deputy National Secretary Chembe Nyangu says there is no point for the party to take such a step as President Banda was legally adopted and endorsed by the convention which is the highest decision making body of the party.

Mr. Nyangu says it is worrisome that the opposition Patriotic Front has started coming up with gimmicks when it has realized that it has already lost the elections to the MMD.

In an interview with QFM, Mr. Nyangu has accused the PF of trying to find a weaker candidate to face in the forthcoming general election as it has realized that president Banda is a saleable and winning candidate.

The MMD deputy national secretary says the MMD will remain steadfast and will not to give the PF any chance by bowing to its demands.

Recently, the opposition Patriotic front advised the MMD to find a replacement for president Banda as presidential candidate for the forthcoming elections noting that president Banda is not eligible to stand for presidency as his parentage is questionable.

And The Civil society Election Coalition 2011 says justice should prevail on the concerns raised on the eligibility of president Rupiah Banda to stand in this year’s election.

CSEC 2011 representative Lee Habasonda says the coalition will follow the matter with the interest it deserves because it borders on the republican constitution.

Mr. Habasonda adds that the judiciary should ensure that the eligibility of the republican president in the forthcoming election is treated with the seriousness it deserves.

In an interview, Mr. Habasonda adds that the issues surrounding president Rupiah Banda%u2019s parentage should not compromise the holding of free and elections.

He further states that the coalition wants to see Zambia hold free and fair elections without any pending issues.

  5. Well, if Mr. R. B. Banda is not allowed to stand on account of being barred by the Constitutional requirement, then you have no choice but to find a replacement, Mr. Nyangu. Remember that when Mr. Banda was took the oarth of office, he swore to ‘defend, uphold and protect the Constitution of the Republic of Zambia’. Now you are being made to swallow your own words. That is what happens when Constitutions are amended to fix certain individuals; you are now being given a dose of your old medicine. Epo mpelele!!

  21. I am disappointed with MMD’s defence of RB. I am not a lawyer but u cant argue that RB is qualified bcoz he’s served in other positions before. If u are caught stealing u cannot claim your innonce by saying that how come u were not caught last time u stole. THATS STUP1D!!

You made noise over the election date, and it was announced, now instead of just campaining, you are stuck on none issues…you know just as much as we all know, RB is Zambian and will be one of the candidates next month. Now all they need to do is bring solid paper evidence that RB’s father is Malawian, or that the mother is Malawian or Zimbabwean – this depending to what degree of Sata’s daily derangement! The current constitution states that the candidate shall be a Zambian with both parents being Zambian born in Zambia. It is the parents who should have been born in Zambia provided they do not register their child as non Zambian. Zambian citizenship is by birth or by decent.

  53. # 6 as far as i know the zambia contitution which MMD create says a presidential canditate need to a Zambia by birth and by decent. any child born outside Zambia cannot stand for presendent although they are Zambian citezen by buy descent. This is a seroius issue. MMD created this constitution and now it has come back to bit them. we should teach MMD a leasson next time they attempt to make a law they will think of the future. If RB’s parents are not Zambian by descent RB is not eligible to stand period.

No one denies that RB is Zambian but one of his parents wasnt and therefore on that premise he does not qualify to be the president of zambia. unless offcourse the constitution does not mean anything.     Your are missing the point. The constitution has stipulated what I might call a two-level qualification: the candidate must be Zambian AND BOTH HIS PARENTS must be Zambian!
    In other words, it is not enough for Rupiah himself to be Zambian; his parents also must be Zambian. So, is that the case with Rupiah?

  70. It sounds to me that Chembe is conciding that Banda’s parents are foreigners, although this is not the right time for PF to have brought up the issue. The threat in this case is Milton Phiri because he is the Guy at the centre of disclosure, he is the one who will file an injunction restraining RB to file for nomination. The MMD is wasting its time attacking the PF, they have to deal with Milton Phiri, coz the PF has just seen an opportunity here.

  72. Here is one legal issue I want guidance on. First of all I believe RB is legally Zambian – and I will not join time wasters and losers. Let’s assume that RB was not Zambian, but has served as President of Zambia – legally or otherwise, what is the legal basis for barring such an individual when he seeks re-election.

    • Adviser you suffer from “history erosion”. KK was barred from contesting in 1996 by the same constitution. What has changed for the same law is still applicable. Wake up my man swallow your pride and tell us where RB parents come from. Mind you RB was born in Southern Rhodesia now Zimbabwe…wapya munzi yaba.
