MMD President Dr. Nevers Mumba has condemned the decision by the PF government to nationalize the Railway Systems of Zambia.
Addressing Journalists in Lusaka, Dr. Mumba said the policy of grabbing private enterprises will hurt the Zambian economy.
He said the decision to target some private businesses by the state will also erode investor confidence.
Dr. Mumba also observed that some of the decisions being reversed today were initiated during the time that President Michael Sata served in the MMD government.
He said reduced investor confidence will negate government’s efforts to create jobs and reduce employment.
This morning, in a national address on ZNBC TV and Radio, Finance Minister Alexander Chikwanda said cancellation of the RSZ concession agreement with immediate effect.
Government terminated the freight and passenger Concession Agreement with the Railway Systems of Zambia, and reaffirmed commitment to making Zambia, a destination conducive for genuine investment…
Finance Minister Alexander Chikwanda announced the Zambian Governments’ decision to compulsorily acquire the Concession Rights that were granted to the Railway Systems of Zambia in 2003.
He said the acquisition has been necessitated by mismanagement of Zambia Railways infrastructure and rolling stock, leading to deterioration of assets and resultant loss to the nation as a whole.
In a statement read on national television, Mr. Chikwanda affirmed that Government would ensure that it complied with the labour laws of Zambia in relation to the welfare of RSZ employees and will meet the obligations in relation to suppliers, customers, and other stakeholders.
“I would like to assure the nation and our partners in development that the Government remains committed to ensuring that Zambia remained a destination which is conducive for genuine investment whilst ensuring that the interests of the nation are not undermined by impropriety,” said Mr. Chikwanda.
The Minister listed the following shortcomings by RSZ;
a) Abandonment of the inter-mine railway network resulting in heavy inter-mine cargo moving by road;
b) High railway transportation costs resulting in excessive road usage for heavy cargo, and minimal or non-utilization of railway transportation;
c) Failure to meet minimum service levels for passenger freight despite being a beneficiary of a substantial Government subsidy;
d) Unacceptably high levels of derailments, loss of life and property leading to enormous cost to Government; and
e) Blatant disregard of the provisions of the concession agreement and unsatisfactory performance, resulting in great risks to the sustainability of railway transport in Zambia.
“The measure is necessary because any additional delays would result in further destruction of the railway assets, therefore making it more expensive for the planned upgrade of the railway necessary for it to meet regional and international standards,” said the Minister.
The Government has prepared resources for the continued operations and rehabilitation of the railway line, assured the Minister.
And Railway Systems of Zambia Managing Director Benjamin Even said his firm is still studying the turn of events and will respond in due course.

I implore the government to pass a regulation compelling importers and exporters to use the rail line as opposed to the roads on certain heavy goods.This will generate income for Zambia railways and reduce stress and damage to our roads.SA did it by regulating imported cars coming to Zambia and other countries moving on their roads.But the railway system should become efficient enough for this reversal to hold water.On a lighter note,has anyone noticed the lady in the picture?!!she is wearing a Uganda jersey!!.Was nevers supporting the cranes on saturday? Article 16 of the Zambian constitution as amended in 1996 provides as follows
“(1) Except as provided in this Article, no property of any description shall be compulsorily taken possession of, and no interest in or right over property of any description shall be compulsorily acquired, unless by or under the authority of an Act of Parliament which provides for payment of adequate compensation for the property or interest or right to be taken possession of or acquired.”
PF govt is within its rights if it has following this provisions but its a pity that the Minister did not mention an legal basis for their actions.
Nevers shut up. for the fact that this RSZ was working on a loss which resulted in not fulfilling concession agreements shows that RSZ investors didn’t have plan and vision how to run this zambian railways after they aquired it and it was not adding any value to our nation develoment. If you have been to zambian after Mwanawasa government sold zambian railways, the state of rail transportation is pathetic, such that mines have even stopped using rail transports to transport copper, instead they are now using heavy duty trucks to transport copper, a situation which is over using our poor roads and increase truck accidents. When RSZ came we expected to see improved rail transport system, making new rail lines around the country, but unfortunately they came and closed some rail lines.
RSZ was perfoming badly but goverment should have followed the law in addressing this matter. This course of actiontaken by the gvt is bad for the image of our country. Remember we need the eurobond and such matters can affect our quest for the bond.

Let the GOVT table the terms of reference for the Concession agreement so that we see that the RSZ had in fact fail to honor part of the Concession. Govt should find a an equity partner who would be more willing maintain help maintain upgrade the rail network and also make it more profitable.

Basically, they where just suppose to manage and maintain or improve/repair on behalf of the Govt. These guy where not providing any service to any company, apart from themselves. They have a copper mine in DRC and they used to transport their copper using this line, without replacing slippers (the line is in very sorry state, and govt will spend alot of money to repair it). As much as this move is welcome, government should now introduce windfall tax for mines because mines are using heavy duty trucks to transport their goods around the country and outside and constantly roads in zambia are damaged, so roads departments needs enough money to maintain these roads mining companies are using.windfall tax next please. Instead of entering into that LAP Green chose to sue GRZ, this caused GRZ not to proceed with compensation forensic exercise but wait for the case in High Court to be deposed off. The President can repossess land title, shares etc under our constitution so long as your are compensated. In its transport sector,no one benefited from RSZ.I can say i have benefited from Euro Frica services,Mazhandu etc but not RSZ.Let it be given to others who can work had for the Zambian masses to benefit from it.Nevers!!
