Some employers not remitting contributions to NAPSA

The National Pension Scheme Authority (NAPSA) has bemoaned the poor compliance by employers in registering their eligible employees to the Authority.

NAPSA Director of Contributions and Benefits Yollard Kachinda says the non remittance of pension contributions is threatening the long-term financial sustainability resulting in the Authority failing to fulfill its obligation of paying the retires.

Mr. Kachinda pointed out that NAPSA is mandated to administer and enforce provisions of the National Pension Scheme Act of ensuring that employers comply with the provisions of the Act.

Mr. Kachinda was speaking in Lusaka today when he officiated at the Prosecutors’ One-month Course held at the Zambia Institute of Advanced Legal Education (ZIALE).

15 prosecutors from NAPSA and one from Ministry of Labour and Social Security are under-going a criminal and evidence procedure course aimed at educating employers to be remitting contributions of its workers to the NAPSA.

He disclosed that more than 200 defaulting employers were prosecuted from across the country.

And speaking earlier, ZIALE Deputy Director Rodgers Chibuye said his organisation welcomes partnerships in exposing those not remitting workers’ contributions to institutions such as NAPSA.

  1. Thank God that they are taking this seriously. My poor grandfather died a poor man after being a school teacher because of the pensions scandal in the 90s. Now if only our government could take the issue of social welfare and support for aged and disabled citizens as a serious concern. But what am I saying? maybe not in my life-time, definitely not in the next three years anyway!! U can see how even if people are poor here in Europe, there is always some money to buy food (or beer hehe). At home, if you have a disability, you are really depending on the charity of your relatives. Lets hope a new govt in 2011 begins to take these things in stride.

  2. It all goes down to the wire, employers have laid off most of their workforce. No one is employing,most of us have migrated. Create jobs and your coffers will fill up! Zambias GROSS NATIONAL HAPPINESS(GNH) is at zero! Worse still, one cant afford to die! Its a worst case scenario!

The other thing that NAPSA should consider is to reduce the maximum amount that employees pay which is the same amount employers pay or keep it the same for some years. at the moment the maximum amount payable per month is terms is K 304,898. With hash economic conditions in the country Small organisations are forced to employ people whom they can pay low salaries so that they can pay low NAPSA as employers. To make matters worse this amount (that is the ceiling amount) is increased every year-in the first quarter although the percentage rate (5%) has been the same for some years.
    On the other hand other employers should evade the payments deliberately without the employees knowing.

Does really come as surprise that people are opting out of making contributions when you consider the fact that pensioners are reduced to destitutes come time to collect their money.Why pay into a non-functioning system that cannot guarantee you your pension, when you can put aside the same amount of money per month and place it in a savings account?

Another leader from Zambia is borrowing a page from Odinga manual on how to destabilize a country with populist ideas.Mr Sata the populist is on record for saying he wont accept the results if he loses. He is already spreading fear that his opponent is planning to rig the elections and asked his supporters to be vigilant. In other words protest in violence or what Raila calls fight for democracy.

  10. I don’t think its in the national interest that we should be subjected to sad headlines such as the one above. I would appreciate if the title was ” Employers prosecuted for not remmitting funds to NAPSA”. The point is that Kachinda knows what the problem is and he has the tools to prosecute these employers. Just go ahead and do your job instead whinning about it in the paper.

    you are very right, the govt must to start to care for its people otherwise Zambia will be traded to unforeseen circumstance that will destabilize that most beautiful country. The republic lost the election this time because they had 4gotten about the people who voted them in. when the poor cry and God hears then from, strange things start to happen to leaders (politicians)…..Look what happened to Chiluba and his friends….these people have robbed the country. With their Children in diaspora…while the poor have no such opportunity, let us watch out!

  14. Checking NAPSA compliance is one of the easiest of undertakings. All one needs to do is visit a company and inspect their NAPSA returns. For most companies, the whole process is completed within a matter of minutes. That’s all the evidence you need so I suggest the NAPSA prosecutors should get on with their jobs and bring non-compliant employers to book.

  15. My uncle died in 2003 and was contyributing to LASF – he was working for the Council in Luanshya.

    We have tried to claim the K7m from this pension scheme and each time we go there we are told there is no funding from the government.

    It is now difficult to get this money because workers at LASF don’t even know whether funding will ever be there.

    God help us.

We know NAPSA has deep pockets that is why they have been talking about building complexes in Lusaka and investing in Cell Z. They don’t even do any real work these lazy chaps. They just collect money from the hard working Zambians in employment.

  18. NAPSA gives problems paying retiress, this institution should be replaced with a more effective one. Why should someone wait till 45 years to claim. Even after you have proof that you are not working and not have no income, they still tell you to wait till 45. This is crazy. We need an institution like the UIF in South Africa which pays you as soon as there is proof that you are not working.

    All the money they collect is for thir salaries and allowances, this is unacceptable.

  19. NAPSA is a shame. Even if one stops contributing claiming your monney is a nightmare as you are told until you retire from active employment and moreover the money is meant for your children. It is really a disgrace and may the Lord help us.

  20. From most of the comments posted so far under this topic, it only shows that there is VERY little understanding of how a pension system functions. Please Zambians let us take interest in understanding this very important topic. Don’t wait till you retire to get to appreciate the system In some countries its a priority topic which can even cost a political party an election. So google PENSION or search wikipedia!

  23. Employers are a problem when it comes to paying out cash balakwata akaso, however, we employees are also a hindrance to our own good future because we do not care. If your employer pays without deducting NAPSA or PAYE u praise him. Sometimes we confuse NAPSA & PAYE by thinking its all tax to govt. NAPSA deduction is your money and it will be paid back to you at an appropriate time. We have that right to go any NAPSA Office and demand our statement and check whether Mr Employer remits our contributions as it is deducted on our payslips. If the employer is found wanting report to NAPSA, thats why its those prosecutors are being trained.

  24. Its better not paying NAPSA than Paying NAPSA and in the end I die without enjoying the money I saved as pension, if we have to wait for the government to fund our pension then were do they take our contribution. Can this NAPSA issue be an option to an individual.

  25. Ministry of Labour should step in,all those companies which are not remitting to NAPSA should be proscuted.
    If the companies go under,what happens to the employees?Please policy makers,lets enforce the laws to safeguard our employees from selfish employers.
    Labour commissioner and your team of inspectors do something.This is a serious issue.

  26. #31 I agree with you but yet again even the NAPSA officers are a broblem, sometime back I went to NAPSA to check for my statment and I was shocked that my employer has not been taking my contribution to NAPSA for quiet sometime but meanwhile they do deduct on my payslip, now when such incedence happen and reported to NAPSA are these people not surppose to make a follow up on such issues.

  27. The time when i was studying employment and Labour laws,i thought Ministry of Labour has put measures in place to safeguard the employees.Zambian laws on employment are very weak and some investors are taking advantage to exploit our human resource.
    What has gone wrong with Ministry of Labour?Please employ alot of inspectors to inspect these companies

  28. #32 we all gonna die! That is a FACT. The problem is that no one knows when that will be. What would happen if you thought you would dies before retirement but end up living on up to RB’s age? If a contributor dies, pension schemes give SURVIVORS Benefits to qualifying dependants, so they won’t be left behind with nothing. By the way, NPASA is a very new scheme and very few people have started receing pensions. Most problems you’re brining up are from NPF which was a totally different arrangement!

  29. The Ministry of Labour has over the pat few years tried its best to streghthen its capacity by recruiting graduates. Unfortunately, it cannot return them because of the poor government working conditions. This is a common problem in government Ministries which do not have ‘other opportunities’ for making money other than just waiting for a K1,400,000 at the end of the month. Other Ministries like finance, agric etc. keep graduates because of many w/shops and travels.

  31. #35 Frank Talk you are right on NAPSA Staff but I think its not every one with that attitude. We should not forget to play our part because NAPSA also survives on our contributuons.

    On your question on # 40: The many Pension Schemes in Zed now but allow me to stick to statutory ones only ,ie, NAPSA, LASF, Public Pension and MUkuba.
    Mukuba Pension is for miners mostly those from KCM and MCM. LASF is for Local Authorities & Utility Companies like ZESCO & water, Public Pension is for Civil Servants. NAPSA is private sector, some govt employees, miners (except those at KCM and MCM).
    In my view I think Mukuba should close & transfer members contributions to NAPSA.

  32. whatever anyone can say – napsa is still in dire straits – its annoying for one to fight for money that was faithfully contributed to a scheme – i thought these monies are supposed to be re-invested in instruments available on the market – pipo are tired of waiting for their money after retirement – the apathy should serve as a wake up call to the institute – its even better to have own pension schemes than rely on govt initiated one becoz they have failed – period.

  34. Has NAPSA taken the time to look at practices of its own employees? Stories of NAPSA inspectors cutting deals with eployers to overlook non-compliance have been heard. So NAPSA should not just blame employers but should also investigate their inspectors and those found wanting should be made to pay up and jailed, not just warned or dismissed. Social security is not a matter to be taken lightly. Employees should also develop a culture of planning for their retirement and not just rely on unreliable NAPSA.

  35. #40 I am afraid the answer to your question is very long because of the many excemptions that Chiluba gave to investors in the mining sector. Other than that, the establishment of NAPSA has also not been well understood and received even by pension experts. Lots of politics cooking in the pension industry on this issue. To cut long story short, NAPSA is a scheme for all workers in Zambia. Mukuba is supposed to be a supplementary scheme for workers in the mines.

  36. 43# Please don’t be cheated that Mukuba is doing better. It is not. The sad thing is pipo don’t get what they deserve – they get less because most of them don’t know how to calculate.

    A friend retired four years ago it took him a long time to get his contributionss. And when he got it was in bits and pieces.

    These pension schemes are okay but the employers and the pipo working in these schemes are not honest.

  37. Contd. from 50. I don’t want to go in details but i would end by saying the pension system in Zambia is still in some kind of a mess which require a strong leader who will undo it. As # 48 as said, people should be encouraged to also make their own savings to supplement what they will get from NAPSA. But how do you save if your salary is not even enough to see to the end of the month? Its tuff pa Zed! K1.5m Salary, K1m rent, K1.7 basic needs basket etc… result of this is nchekelako mentality!

  38. Let me change the topic.I feel Magande who has been negotiating on behalf of the government for funds,would have been maintaned. With the global financial crisis,already the tourism sector has started feeling the impact. As the number of tourists visiting Zambia has reduced.A larger percentage of Zambia,s budget is dependant on donor funding. But with the financial crisis globally,i can forsee a reduction of foreign aid to african countries. And Zambia is not exceptional,i can therefore the government reducing expenditures on a number of sectors come next year.It is unfortunate that RB could not yied to people,calls to reducing on the number of ministers. Because the government wil stil have to spend huge on these ministers.And mind you copper prices have reduced on the international market.And Zambia,s economy has been doing better because of copper.That is why am saying,at such a critical moment we needed an experienced finance minister,Magande to continue.

Everyone who works and does not die before 55years will retire. Hence this is supposed to be the hottest topic. Hotter then getting the politicians we are passionate about into statehouse.   41. What is actually sad is that some employers deduct all statutory funds from employees salaries and yet they do not remit those funds to ZRA and NAPSA. I quit from a reputable radio station whenI found out that my boss then was using the NAPSA and ZRA tactic to enrichen himself. I say employees must make sure their employers are doing the needful. what was even more annoying is that the labour office, NAPSA and ZRA acted as though there was no problem when I went to complain. A serious strategy is required to make the whole thing operate properly.

  47. The NAPSA issue reminds me of something I have always wanted to find out about the Zambian Labour Laws. Guys, is it legal for a company not to pay Stand-by allowance and Over-time? Stand-by is whereby one knocks off from work but should not leave town, but make themselves available in the event that they are required at work.

    Some new mining companies in Zambia do not pay these allowances for the reason that they have not yet started making profit, or are not yet in full production.Guys enlighten me.

  48. I`m interested there`s a lot of articles on casino gambling. There are different methods, tactics, strategies, algorithms of counting, calculations and so on.
    But these items are only heap of ads and i don`t want to analyze them `cause i don`t have any basic knowledge. It`s useless. Estimation i think will be wrong.
    Is there anyone here who is interested in such topic?
    I`d appreciate someone`s explaining to me is there any systems or strategies, what are they (what approaches or concepts lay in basis) and in which casinos could they be applied to?
