Magistrate Banda orders Mutembo Mutembo to release RB passport

Former President Rupiah Banda will today attend the inauguration of Kenyan President elect Uhuru Kenyatta after Chief Resident Magistrate Joshua Banda ordered that his passport be released.

There were strong moves by the state through Director of Public Prosecutions Mutembo Nchito to block Mr. Banda from flying to Nairobi by refusing to release his passport.

By lunch time Monday, Mr. Nchito had ignored requests from Mr. Banda’s lawyers to have their client’s passport released.

Quick action by Mr. Banda’s lawyers who made a quick application to the Magistrate forced the state to release the passport.

The former President is now scheduled to leave for Nairobi tomorrow morning.

A source in Mr. Banda’s office confirmed that the former President is preparing to travel today morning.

“He is set to leave the country early morning although he may miss the actual event because he may get there late, he is still attending the inauguration,” the source said.

Meanwhile, Republican Vice President Guy Scott has arrived in Nairobi to attend the swearing-in ceremony for Kenya’s fourth President Uhuru Kenyatta today.

Dr Scott arrived yesterday at the Jomo Kenyatta International airport at 17.30 hours local time accompanied by First Republican President Dr Kenneth Kaunda and Finance Deputy Minister Miles Sampa.

The Vice President was received at the airport by Zambia’s High Commissioner to Kenya Mary Zambezi, her deputy Kenneth Kunda, First Secretary Political Administration Mumbi Phiri and other members of staff from the Zambian mission.

The Kenyan President-elect Uhuru Kenyatta, 51, son of First President Jomo Kenyatta will be sworn-in tomorrow at the Moi International Sports Complex in Kasarani, Nairobi following his election victory on March 4, 2013.

The ceremony will be attended by 54 Heads of States and Government who have already started arriving in Nairobi.

According to the official programme for the installation and inauguration released by the Kenyan government, the ceremony will start at 10:00 hours local time characterized by various performances from local art groups.

Out-going President Mwai Kibaki will hand-over power at the swearing-in procession which will be presided over by the Chief Justice and President of the Supreme Court of Kenya Dr Willy Mutunga and the Chief Registra of the Judiciary Gladys Shollei.

After the swearing-in ceremony, the Heads of States and Government will attend a state luncheon at State House to be hosted by new President Uhuru Kenyatta.

Mr Uhuru won the March 4, 2013 elections with 50.07 percent on the ticket of the ruling National Alliance Party beating his closest rival Raila Odinga of the Coalition for Reforms and Democracy (CORD) who polled 43.2 percent in an election which recorded an 86 percent voter turn-out.

The victory for Mr Uhuru, eliminated the possibility for a run-off with his main rival Odinga although he petitioned the results in the Supreme Court for alleged flaws but the bench upheld the election of Uhuru in a March 30 judgment declaring him as Kenya’s fourth Republican President.

  1. I really do not see the importance of RB attending this function and if he will miss the inauguration, why travel anyway? Isn’t he using taxpayers money? If this old man jumps ship, the judge should be held accountable. There are a whole lot of people langusihing in Zambian jails on flimsy charges who are denied even the privelege of attending their children’s wedding or funeral and here comes the biggest plunderer still enjoying his full life. The law in Zed is not applied fairly. I am of the strong view that RB should not have be allowed to travel since he is a person of interest who might jump bail with his crooked lawyer called Amsterdam.

  24. The passport was part of the bail conditions, what has changed to warrant any change in the conditions of the bail? Zambian judiciary is becoming a joke, people are jumping bail with the help of these corrupt judges. How many times have we heard of foreigners jumping jail and run to other countries and RB’s son is a fugitive, how can we trust him? RB will jump bail if given any chance to leave the country, he is always complaining that he is old, do you think he fancy the prospects of spending time in jail?
