FORMER Communication and Transport minister, William Harrington has asked the Lusaka High Court to quash the decision of acting Chief Justice Lombe Chibesakunda to refuse to set up a tribunal to probe allegations that Tourism and Arts Minister Sylvia Masebo interfered and abused her authority in the operations of the Zambia WildLife Authority (ZAWA).
Mr Harrington has asked the court to instead order Ms Justice Chibesakunda to with immediate effect, appoint a tribunal to probe the various allegations against Ms Masebo.
He wants the court to order Ms Chibesakunda to reconsider the decision to refuse to appoint the tribunal in line with the provisions of the Parliamentary and Ministerial Code of Conduct Act.
Mr Harrington wants the court to declare that Ms Justice Chibesakunda was obliged by section 3 (1) and (3) of the Act to appoint a tribunal without setting along conditions after notifying the President and the Speaker of the National Assembly.
He said her demand to be furnished with further facts which would make up a prima facie case against Ms Masebo before she could appoint a tribunal was ultra vires to section 3 (3) of the Act and was therefore null and void.
He wants if leave granted, a declaration that such grant operates as a stay of the decision by Ms Justice Chibesakunda to refuse to appoint the tribunal and that the hearing be expedited.
Mr Harrington stated that on January 21, 2013 he in line with the Parliamentary and Ministerial Code of Conduct Act applied for the appointment of a tribunal by Ms Justice Chibesakunda to investigate allegations of interference and abuse of authority of office of Ms Masebo.
He said that in his letter of January 21, 2013, to her, he specifically alleged that Ms Masebo who is Member of Parliament (MP) for Chongwe interfered in the tender process by ordering the withdrawal of the list of successful bidders for hunting concessions in breach of the Zambia Public Procurement Agency (ZPPA) Act.
Mr Harington said that as if that was not enough, Ms Masebo announced the removal of senior ZAWA management officials from employment in breach of the law and further gave verbal instructions to ZAWA officers to hunt wildlife without issuing licences.
He alleged that Ms Masebo should be probed because she failed to report to government security wings that foreign registered aircraft were violating Zambia airspace to uplift wildlife species or government trophy.
Mr Hatington said that his move followed Ms Masebo’s decision on December 31, 2012 to announce that she had fired five ZAWA senior management staff of their duties because of irregularities in the Safari hunting concessions in various game management country-wide.

Whatever Mr Harrington did when he was a minister is not the issue here. He, like any Zambian has the rights to ask for a tribunal. Chibesakunda is stalling this process and doesn’t seem to be acting impartially. She has no right to put up the barriers she is putting up, which makes nonpartisan Zambians wonder what kind of justice is dispensed in Zambia. If the Judge Chikopa tribunal can be allowed to go ahead despite the disapproval of the Zambian masses, why cant we have this tribunal that Harrington is asking for?
