UPND plans to demonstrate on Wednesday against acting Chief Justice Lombe Chibesakunda

THE United Party for National Development (UPND) says the police have no option but to allow them to demonstrate on Wednesday against the continued stay of acting Chief Justice Lombe Chibesakunda.

There had been demands from a cross section of society for Ms Justice Chibesakunda to step down including the Law Association of Zambia (LAZ) which had gone to the extent of calling for extra ordinary meeting to discuss the matter.

But government through Justice Minister Wynther Kabimba maintains that Ms Justice Chibesakunda was holding the office legally.

UPND Secretary General Winston Chibwe said the police had no option but to allow them to demonstrate because theirs was a peaceful way of reminding Ms Justice Chibesakunda to exit the office which he alleged she was holding illegally.

Mr Chibwe yesterday confirmed that his party had notified the police about its intention to demonstrate adding that with or without police’s blessings the opposition political party would go ahead with the demonstrations.

He said the party had already done its part of notifying the police as required by law and all what remained was to wait for the response.

He said his party had resorted to demonstrations because Ms Justice Chibesakunda had ignored other options of pushing her to step down.

When asked what the party would do if police advised against the demonstration, Mr Chibwe said ” yes we expect a response and they have no choice because we will go ahead with or without their advise since we have already notified them.”

  1. FIRST AND FOREMOST BOTH LAZ BANDA AND THE OPPOSITION ARE ON ONE SIDE, THAT’S PROBLEM NUMBER ONE. SECONDLY WHAT LAW HAS BEEN BROKEN BY HAVING AN ACTING CJ IN OFFICE? SIMPLY QUOTE THE LAW THAT WILL HELP. UPND JUST WANTS TO FRUSTRATE GOVT. PROGRAM BECAUSE THEY HAVE SEEN THAT THE GOVT. IS DELIVERING, IT WILL TAKE TIME BUT WE’LL EVENTUALLY GET THERE. SOME OF THE PROBLEMS WE ARE FACING IF MMD WERE SERIOUS COULD HAVE SOLVED THEM IN THE 20 YRS THEY WERE IN OFFICE. THAT’S WHY I GET PUZZLED BY PEOPLE THAT GIVE MULTIPLE CHOICE QUESTIONS OF PROBLEMS THEY THEMSELVES SHOULD HAVE RESOLVED WHILE IN POWER.

      Are you dreaming or not? Why should the law be interpreted in favour of the ruling party all the time. If MMD did that, PF would not have come to power at all,just remember that. Even Sata knows how impartial the judges were in MMD. Now that he is in power he wants judges who he can control directly and thats how come Chibesakunda is acting despite constitutional breaches.

      The real issue here is, why have some one in the office of the CJ when she was clearly rejected by the MPs in parliament. Apart from that the law clearly stipulates that a judge shall act as CJ only for a period not longer than 6 months. If you know how to count ,then this makes two offences committed by the president in breach of the constitution of Zambia.

    • The law requires that once somebody has been appointed for the Chief Justice position by the president, the appointment must be ratified by parliament. By appointing Chibesakunda in an acting capacity means that the national assembly can’t approve or disapprove her appointment.
      What the president should do is submit her name to the national assembly and if she is rejected the president should then come up with a different name which will also be subjected to similar procedure. Chibesakunda is a ‘permanent’ acting Chief Justice making her illegitimate thereby compromising the independence of our judiciary system.

      Are you also endorsing the breaking of law the by the president and his party? If that is the case then why should non PF citizens obey the law?

      What you two guys are on about is a poisonous recipe for more and more anarchy in our lovely peaceful mother Zambia.

      Some of us will not stand by and watch our constitution being raped left ,right and centre by the PF bafoons. Any one who abrogates the dictates of the Zambian constitution is worse than dog faecal matter.

      I pit you poor useful *****s who cant even use a single atom of the your brain to know that what PF is doing is wrong.

      You are supposed to provide protection and guidance to the peaceful protesters and not attacking them.

      It is clear to me that you have become the agents of this evil regime, but for what honestly, when you cant even afford to feed your families well. Your pay has been halved in real terms because you can only to buy half what you used to buy in MMD. You struggle to even claim your operational allowances and very soon all that will stop as the PF says its part of your regular jobs.

    • No you won’t because the international community are within Zambia already to watch how PF ‘s Police Force will kill/maim Zambians for exercising their God given rights to hold peaceful demonstrations.

  2. But what is so difficult about reversing decisions? I thought govts are put in power by people in democracies and the govt ought to listen to people. What is so special about this individual? She can be sent to a Zambian High Commission (in a Commonwealth country) or an Embassy (in a non-Commonwealth country). She will be happy, I am sure, since she is such a valuable and special Zambian. Others are fired for the smallest offences. I really find this whole issue hard to comprehend.

    advise your petty under5 leaders to find something usefull to do than engaging themselves in acts of terrorism,distabilisation, time wasting ll be dealty with severly.
