Saki urges FTJ to accept the London judgement and pay back the plundered cash

1003_zambia_02.jpgPresident of the opposition United Liberal Party (ULP), Sakwiba Sikota has advised former president, Frederick Chiluba to accept the London High Court judgment and pay back over US$40 million he allegedly misappropriated from Zambian government during his reign.

Mr. Sikota told the Zambia News and Information Services (ZANIS) in an interview
today that Dr. Chiluba’s attempt to defend himself now was totally misplaced.

He said Dr. Chiluba was accorded an opportunity to defend himself in the courts of law but he refused to so during trial.

“He should have done that in the courts of law, not now because the judgment stands
and it will be acted upon,” said Mr. Sikota.

Mr. Sikota, , who is a prominent lawyer,  said the former president should stop making attempts to explain the outcome of the London Court judgment as it was irreversible.

He said people in leadership should always be made to account for public resource and avoid plunder.

“Plundered moneys should be returned and put to good use,” he said.

About 20 days ago, the London High Court ordered Dr. Chiluba to pay back 85 per cent
of what he, together with nine other people, allegedly misappropriated from government’s ZANTROP account within a fortnight of receiving the judgment.

In another development, Dr. Chiluba, who collapsed in his bedroom at his Kabulonga
home yesterday morning, is still admitted to the University Teaching Hospital (UTH)
in Lusaka.

Dr. Chiluba’s Spokesperson, Emmanuel Mwamba, told ZANIS today that the former
president underwent several medical tests ever since he was admitted yesterday.

“He remains in hospital under observation. He underwent several medical tests but
the Doctors have not yet advised what the problem is, but it is related to his heart
condition,” Mr. Mwamba said.

Last year, Dr. Chiluba was diagnosed with a cardiac problem at South Africa’s Garden
City Clinic.

On March 20 this year, Dr. Chiluba again went to Johannesburg for treatment and
returned on April 24th.

Dr. Chiluba was due to appear before the UTH ad hoc committee of medical Doctors
next Monday, after the Lusaka Magistrate court ordered that it he acquires fresh reports to ascertain he was fit to attend court proceedings.

The former President, who is jointly charged with former Access Finance directors
Faustin Kabwe and Aaron Chungu, is still facing charges of theft by public servant in the Lusaka magistrate court, involving over US$500,000.

  1. Sikota stop advising,you are not his brother or lawyer,the man already knows that he’ll pay back the money, all your colleagues have to do is not waste time and follow correct procedures on how to effect the judgement,and if failure,think of what to do next.

Some of you pipo on this blog are talking heads I can not even imagin how you get access to the computer because you do not exhibit any intelligence at all.There is nothing wrong with saki comenting on chilubas case.Here we should trying to help chiluba to repent and ask for forgiveness and the pipo at large not to lay back and allow those entrusted with their wealth go about plundering without consequnces.Saki just like anybody should be allowed to express themselves freely.Infact saki is one of the fine intelligent pipo that we have though he made one political mistake by joining sata who everybody knew is an empty can that make too much noise.Saki we all make mistake but the worst is wrighting the wrong formula and after realising that you do nothing to change for the right one.Leave that lupen and join forces with right pipo.

  5. Kambilombilo (#5): thanks for summarising it. Every Zambian has a right to comment on issues that affect us. Chiluba made conscious decisions (not mistakes!)about how to manage national coffers. For that, he must be a man and answer in a court of law. Not allowing feigned illnesses or stress to get the better of him.

He campaigned for himself alone while Sata and group campaigned as a team. As a result, in Saki’s stronghold PF lost like no man,s business. Is this the kind of man you can give authority to comment on Chiluba. I doubt your credibility. The man who before the results of the elections were officially announced went straight and pronounced that he was goin to be the Vice President to Michael Chilufya Sata.Where is his intelegency? If he was inteligent at one time, I am sorry to inform you that the man is now dull and only survives on experience. Please do not follow suit.

FTJ is sick please the nation has the right to know who are these 19 who shared the cake alone at the expense of the starving Zambian child. Next time Sakwiba we want a full list of plunderers. They are mentioned including some solicitors in the UK. The document has 216 pages. Read and do not wait for Saki to tell you. He will end up telling you lies. Why do you trust him so much as if he is the one who passed the judgement. Supposing he is one of the 19 mentioned in the document, do you think he will be able to list the names that you are requesting. Wake up and be indpendent in seeking information.

    Do not worry. All I need is your email address. I can then send you the gross magins of my business. Otherwise on the brog it is too open and frail to the public. No amai nini. I worked with these guys in their country. For your survivor you need to have more than one job. That means working during day time and also in the night with limited time to rest. Only during summer holiday do you have enough time to rest. That risk you are talking about is really regretable. If the government machinery was serious, Zambian enterpreneurs were supposed to be working 24 hours this time without any fear of being attacked. This is why we say that developemnt can not be hindered by corruption alone. Corruption is one of the many factors. The other thing we need to concentrate on is to build capacity in the instituitons. Once we have formidable instituions in place, all the fears and risks will be of the past. Let’s look at this from the bigger picture point of view. Not corruption perse.

  15. It is amazing to see how politicians behave after drinking a cup of tea at state house. Sakwiba must really be the last one to condemn Chiluba because as a prominent lawyer he should be defending the sovereignty of Zambia.

    Where in the World has an African court ever passed judgement on a European leader? Please give us dates and the country where that occurred.

    Saki is becoming too ambitious.

Truly Zambian (#18), maybe you should begin by asking which European leader was ever accused of stealing money from his European country to buy properties in Africa and to pay Boutiques in Africa. Once you answer that question, it is easy to see why an African court may never ‘try’ a European leader on those grounds. Taking the Chiluba case to London has nothing to do with Zambia’s sovereignity. Remember that the accusations are that London and other cities in Europe were used by Chiluba and his co-accused to defraud the Zambian people. Taking the case to London makes it easier to enforce any judgement. On that score, I commend the Attorney General: it is easier to look at the evidence in London than in Lusaka and also the judgement is binding immediately in Europe. After the London judgement, Chiluba cannot dispose of any European property that is a subject of the London judgement. If the case was still in Lusaka, with Chiluba’s games, we would still be without any judgement.

  17. Mupundu #19, Firstly I will start with 400 years of slavery (1400-1800) when African men & women were ferried from Africa packed in boats like sardines. Do you know who was responsible for taking of 28 Million people against their will? Have African people ever received any compensation at all? Do you know who masterminded the murder of Patrice Lumumba – 1st Prime Minister of Zaire? Remember Zaire is potentially the richest planet on earth.

    Mpundu please name one African safe haven banking facility like Geneva? Are you telling me only African leaders have secret bank accounts?

  21. I have asked pointed questions on safe haven banking facilities in Africa. Secondly I asked whether its only African leaders who have secret bank accounts in Cayman Islands and Geneva. Do you know the value of those secret bank accounts? Again Kayata and Hey need analytical skills. Do you know for instance that the poorest country on the planet in 1952 was South Korea? Why have they developed? Who helped them?

    Don’t give me stories about the Japanese. I will listen to you if you give examples on Israel because they survived the pogroms of Hitler and formed a State in 1948. Nazis murdered Six Million Jews but Israel is 2nd to USA in terms of technological patents. Israel is a great democratic outpost. But again the question is who is helping the Jews develop?

  25. I concur with Kayata (#24) and still have problems make sense out of Truly Zambian (#25). Are you, #25, saying that because it’s not only African leaders with secret accounts in Safe Havens (Cayman Islands, Geneva etc), then we should let Chiluba and his co-accused scot free? Please, tell me that is not your argument!!! I think, when we talk of “emancipation from mental slavery”, the phrase was meant to include emancipation from a mindset that believes that one’s fate (our collective fate as poor nations) is entirely in the hands of others (West). As long as you continue blaming the West, forget about development. China, India, Vietnam, many Asian economies are looking up and there is nothing even the US can do to stop them. Why? Can you argue that they are being supported by the West? What is it that these people did that we as Africans are not doing collectively? I think part of the answer lies in how these nations took responsibility for their own destinies, not blaming others!

Mpundu(#30) you have a point there “not blaming others”,Africa has the most potential source of energy and water sources,but look at the situation,anyway….I too didnt manage to understand T.Z #25, what his argument is, but the reason why there is no “safe haven” in Africa like Geneva,is because of instability.Truly Zambian #25,in 1950-53,there was war in Korea,and that contributed to korea’s poor economy.It was trying to gain independence from Japan.The South Korean’s were helped by US & UN during and after the war.The US helped also Europe to recover after the world war.Those Jews who fled Hitler’s rule were recruited in the US army because they knew how to defeat Hitler,and the compesation they were given was the formation of a state in 1948 called Israel,else they were destined for Uganda,Africa.America is run by Jews and that will answer your question why Israel is second to America.

Although some of the wounds that Africa continues to lick today are self-afflicted, a significant part is engineered from outside. While I respect the observation of # 26, I totally disagree with his #19. Of course I would urge my Zambians and fellow Africans not to slumber into self pity, (#24) we can fight to liberate ourselves economically just as we did politically, even though that battle is still an ongoing one. Democracy, as President Chiluba put it, is not absolute. This, even Francis has acknowledged that is not as easy as it sounds.

  28. Today the world’s so called democratic countries are not “absolute democrats” as they so claim. If they were the UN would have one country one vote! London Metal Exchange was not going to be in England where the buyer and not the seller would determine the price! Failure to play according to the “referee’s rules” (the West) and not the rules of the game (democracy) would make your goods stockpiled, affecting your trade, plummeting your currency! Zambia’s, exchange rate favours those countries that can come and “rape” your country while you cannot do the same to theirs (unequal playing field). Whatever scale you could use it will never add up to see most mineral rich African countries with an exchange rate of $1:4,000 or more. This is by design. If certain people believed in democracy (majority decision), no veto powers could be allowed, the U.N. could not be monopolized by a few nations and vetoing should not be in a handful of some “chosen” people. Similarly, we do not have “Zambian or African interests” as our friends have “American interest, British interests or French interests,” which they will defend whenever yours come up against theirs. For this same reason IMF and WB give “Kaloba” for a purpose. I therefore, understand and support # 20’s call for need for emancipation of our minds. For your further reading I strongly recommend, “Confessions of an Economic Hit Man,” by John Perkins or New African Magazine.

  31. Great Britain is a beacon of justice both in Europe and the World. In UK once your case is before a competent court, newspapers do not comment on the matter until justice has been dispensed. But alas in Zambia people are called all sorts of names even when a case is before courts, this in turn puts undue pressure on Judges to side with stupid editorial comments. In some cases the UK judges have had to gag the press failure to which they will pay a heavy price. I can give examples if need be.

    FTJ & Co has been labelled robbers even before a criminal court finishes its business. I am sorry the judge handling FTJ’s criminal case in Lusaka courts is very timid in respect to POST editorials.

  33. Saki’s comment is just yet another of a vocal few who are bent on putting their names on the list of those wanting to be remembered that they are around in politics. Generally Saki is okay as an individual but I think he has missed a point here. He surely thinks because judge Bwana smith has said Chiluba should “pay back” its gospel truth and should be easily done that way? I think he would do well to be kind a sober. It’s unfortunate in this country there is this behaviour where pipo are “led by the smell of a carcass (in the name of Chiluba in this case)and dont want to be the last to grab a piece” in order to register their presence. Kalaki would call it typical “hyena-like” mentality. I hope he doesnt fall prey to the hate media trying to garner blind support from unsuspecting innocent individuals

  34. I want to correct the impression that I have agreed with the London judgement. I have not done so because of issues that border on sovereignty on the Zambian state. Gentlemen I value 24th October 1964.

We are still not yet independentmy friend,you are the people talking about Smith’s judgement and donor’s funding your budget,and everyday loans from China and everything turning Chinese in Zambia etc….Where is the independency? Been independent is to be free from all social,economical and political been.Independency (decolonisation) has been negative in Africa because of selfish leaders like Mugabe,KK,Nyerere,Mandela etc

  37. I have no doubt in the corridors of my heart that Chiluba abused the trust of the Zambian people. Although he refuses the authority of the London court, he has and cannot come clean, to the Zambian people over why huge chunks of money, from a state intelligence account were used as dish-outs to tailors in foreign countries and as stupendous gifts to his children. The legality of the fact that it is a London Court that has tried and convicted him must be a matter for legal professionals to guide us. I have not heard any robust challenge of the authority of the London Court from a lawyer since the judgement.
    Having said that, I have a serious problem with the intentions and actions of government over this case and judgement. The government has not come clean on why they have not executed the judgement – just a lot of smoke and hot air, but no action or substance. What does this mean about the uprightness and commitment of this government? Or are they simply wasting our time?
