THE Livingstone Magistrate’s Court yesterday discharged United Party for National Development (UPND) president Hakainde Hichilema in a case in which he was charged with proposing violence after the State decided to discontinue the matter.
Magistrate Chinkashi Chilingala informed Hichilema that the state had received instructions from the Director of Public Prosecutions (DPP) to enter a nolle prosequi against him pursuant to Section 81 of the Criminal Procedure Code Chapter 88 of the Laws of Zambia.
Mr Chilingala, however, told Hichilema that the discontinuation of the case does not stop the State from starting fresh criminal proceedings against him.
“I hereby discharge you accordingly, you may stand down,” Mr Chilingala said.
This is in a case in which Hichilema was facing one count of proposing violence.
Addressing journalists at the court premises, Mr Hichilema said there is need to review the justice system.

I do not believe the blame should be placed on Mutembo Nchinto. Sata and his Cadres are to blame for manufacturing and bringing weak malicious cases to him. I am sure he tells them behind closed doors that these cases are unfounded and are a shear waste of resources and time (His time and that of others). Stop this vindictiveness against opposition parties. This is exactly what MMD used to do. This is also what UNIP used to do. So we should not be Surprised that its happening again under a Sata who was a key member of both parties when they were in government.
Who makes the final decision to take matter to court? Is it the Cadres or the office holder at NPA?
Nolle presequi because the state had a bogus case to begin with? Zambia has a thoroughly politicized judiciary.

The true judge against whatever is happening to the people of this country is God. I think God had a reason to let Sata win the elections so that they can learn a lesson out of their blind loyalty and following. Everything that God the creator allows, happens for a purpose. Just look at the way GBM is being humiliated by the same party that he served diligently. Can someone point out to say there is democracy in the PF ? Even the infighting within has a lot to tell that the party is charaterised with confusions and dictatorship tendencies.

I think they should amend the law to introduce some intermediary stage between police detention and court process, because, at the moment, the prosecutors are caught between the law against detaining people without trial and trying people on cases that are not thoroughly investigated; resulting in such stupid Nolles.
Nchito is doing FINE, he knows PF has already lost Popularity. Read in between lines THEN u will understand Politics well.

Interesting how Zambians can get fo-oled most of the time. I would not be surprised to wake up on morning and realise that Kabimba and Nchito are undercover UPND members.
Based on our records, the only cases our current DPP has managed to win are Masumba, Muteteka and General Kanene. The rest have been nolle prosequi
