A case in which a South African national is alleged to have defamed President Levy Mwanawasa failed to take off this morning because of the on going strike by judicial workers.  Â
Brandon Childs 22, an employee for RJ Southerly Contractors, contracted by Mopani
Copper Mines, Mufulira Division is alleged to have insulted and passed disparaging remarks against Mr. Mwanawasa in April this year.
Childs, a Kitwe resident was arrested by police and charged with defaming the head
of state contrary to provision 65 of the penal code.
He was later released on police bond but Police withheld his passport, work permit
and national identity documents.
The foreign national has not appeared in court since his arrest in April.
Mufulira Resident Magistrate, Edison Tembo assured ZANIS in his chamber that the
cases was coming up in court today but workers talked to said they have not prepared
the court for the case due to the strike.
District Prosecutors Officers were this morning found adjourning the cases to later
dates while local magistrates were working from their chambers.  Â
Mr. Tembo said the situation is normal and all the workers have reported for work.

Defamation case anyone insulting the highest institute of our nation has to face trial and if found guilt he must face maximum imprisonment. I dont really understand the rational behing such a piece of legislation.Defaming the President? What really doe it mean? If you call FTJ kafupi its defamation but its a fact he is short. There is nothing like being a Zambian or a foreigner when it comes to wrong doing. The law does not segregate. It is simple and straight forward that defaming the head of state in Zambia is an offence contrary to provision 65 of the penal code. So let this chap childs 22 be tried. May be even those that come to deposit insults on the blog against other bloggers will learn a lesson from it. Those supporting Childs are the ones that support bad language on this blog. And again, these failures of cases to take off due to this and that are the ones that lead to congestion in prison.　Fellow Judiciars, please go back to work so that this young man can be prosecuted. When you are a foreigner you are exempted from participating in critical matters of the hosting country. A situation I think is made clear when obtaining one’s work permit. It would have been better if we knew exactly what BRANDON CHILDS said. We would then be in a better position to judge more objectively.As it is now, all we are doing is speculating.
Having said that, i wish to state that there is a lot (in terms of conduct and behaviour) that locals expect from a foreigner, and CHILDS is not an exception.

Insulting the head of state cannot be condoned. But let’s hope the police have done their homework and have a solid case on the guy.
