The Lusaka High Court has thrown out the application by Matero Member of Parliament Miles Sampa seeking an injunction to restrain Defence Minister Edgar Lungu from being declared the President of the Patriotic Front.

Lusaka High Court Judge Isaac Phiri dismissed the application by Sampa filed yesterday before Judge Mungeni Mulenga and referred to Judge Phiri this morning and stated that the action was an abuse of the court process.

The Commerce Deputy Minister sought an injunction to restrain Edgar Lungu from assuming his position until his complaint was addressed.

The development follows a consent judgement that declared Lungu as the lawful PF President yesterday by Judge Mungeni Mulenga but was however allocated to Judge Isaac Phiri.

Mr Sampa yesterday filed summons in the High Court seeking to declare illegal the election of Minister of Justice Edgar Lungu as the ruling party’s candidate in the January 20, 2015 presidential election.

Mr Sampa, who is Deputy Minister of Commerce, Trade and Industry, further wants the court to declare the November 30, 2014 PF General conference which elected Mr Lungu null and void.

He is also seeking an order of interim injunction to restrain Mr Lungu, who is also Minister of Defence, from holding out as president of the party and presenting the certificate of adoption to the Electoral Commission of Zambia (ECZ).

    • Scott is terribly off and has lost all his mojo. His obsession for impunity on the rule of law, democratic order of our country could plunge Zambia in total despondency. His disrespect and incorrigible hatred is unbecoming. No doubt its time he is relieved in national interest. We have retired too many Zambians in national interest on much weaker grounds than the evidently inimical misconduct of Scott. The Man is under a dangerous act of coercion with enemies of our national state security and peace. He is not worth plunging our country in chaos for. We better sacrifice him than risk Zambians. It’s now over to the judiciary, State security apparatus and patriots. Enough is enough; it’s time to stop him either way. All outfits, Charge!

      Lungu has been labelled a villan throughout this case and yet for those that have cared to read bewteen the headlines and understand the PF constitution, it has been clear that he has been on the right path and playing by the book. He had support from MP’s, MCC members and the very f00lish PF grassroots but some media houses including ZWD did not want to accept the democratic rights of the Kaponya’s.
      They villified Lungu and out call PF cadres into Lungu’s camp. MP’s were after Jobs as if those others were not. Court decsions in his favour were only so because of Willie had paid the Judges. Please please…follow the rules and be objective…Justice prevails..

In the mean time, offer to start campaigning for EL in key areas. Once the electorate sees your charisma and passion, it will be forever etched in their memory for the next elections which is in about a year and a half. Trust there is nothing that EL will do in a year and a half that will make people vote for him in 2016!

What hypocrisy is this? The justice system is beyond rotten & decomposed.

If anything, they still have time to hold another convention. However, greed has got the better of them. Both conferences were not legal and do not hold weight. While these chaps keep fighting and bruising each other’s egos, HH is gaining momentum at a steady pace. If they cannot come to an agreement amongst themselves, then how will they manage affairs of the nation?   12. It will be a good battle between HH and Edgar. I see Edgar fighting a mountain of obstacles all the way. The forces are from within the party as well as international. The test for the voters is choosing betweeen during quality and emotions. I am still, however, surprised why some sections of society are going for Lungu, or perhaps this defines the poor choices we have always made as a country (poor choices = poor country).

  13. I have come to the painful realisation that as a nation we could actually be very wealthy if we declared ourselves ” A Circus”. I mean there is confusion everywhere, even worse so at the courts of law. Imagine how many spectators we could bring in everyday because we have drama of all kinds at every turn.
    i) ruling parties have 2 of each position i.e presidents, secretary generals you name it….Even Noah could have found this scenario puzzling.

  37. This matter is still before the courts. The only ruling we have so far is on the injuction that Sampa was seeking. The legitimacy of Edgar lungus nomination is still in question. Niether one of these jokers can claim the PF presidential candidacy. The courts will order a new convention or ask the PF to nominate a candidate through another process. Without GBM PF is history and that’s where this headed. PF is Done.

  43. What a beautiful day! Edgar Lungu is the best candidate for HH and RB. I would hate it if it was Miles Sampa who cannot sale anywhere. I am sure both RB and HH have strategies, effective strategies, to bury the dead PF for ever by beating their most preferred candidate. Can HH or RB fail to beat Lungu in Chawama,to kill him completely? We don’t need them if they can’t. The aim of any strategy they come up with should be to save Zambians of Lungu and his PF criminals criminals using democracy not pangas and ensure Zambia can reclaim itself again.   46. The Past news toilet is something to watch. They never cease to amaze. Barely a few days or few weeks ago they were vilifying the “tribal Bemba clique” led by GBM. Today GBM makes it to the Past’s front page in a favorable light all because he is in Scott’s camp. We know that the Past has long lost its morality and integrity, but now we discover that for Mmembe there is always a lower level that he can sink to. We can assure Mmembe and his Past that they still have some good crying to do before we finish with them. I hope that they still have tears otherwise they will be made to cry blood from their eyes.

  47. Last week I went to buy newspapers in town. The Times, Daily Mail and Daily Nation had sold out by 12:00hrs, but the Past were still a big heap. Then the vendor made a comment that “the paper without a market is the Post”, in Bemba you can imagine how amusing that is.

    Yesterday when I published a leaked letter to the president alleging presiding Judge in the injunction case had been well ‘taken care of’ and that the outcome was already known, I was showered with unpalatable responses devoid of any intellectual content. I also highlighted the fact that court process would therefore just be an academic exercise. Then, true to my word, the court ruled in favour of Edgar Lungu.

    It is common knowledge that Edgar Lungu in his injunction sued the PF secretary General as the first defendant (then Bridget Attanga) in an effort to disrupt the legally convened general convention after his fraudulent attempt to be elected party president.
