Kunda speaks out

MINISTER of Justice, George Kunda, has assured the nation that the proposed constitutional conference will not depart from the Mung’omba Constitution Review Commission (CRC) recommendations.And Mr Kunda said the CRC erred when it recommended that a constituent assembly (CA) should have final and binding decisions above Parliament.

Speaking on a Zambia National Broadcasting Corporation, Fifth National Development Plan radio programme on the subject: “The constitution and its impact on national development,” Mr Kunda was concerned that some people had not read through the CRC report.

He said the CRC was alive to the fact that legislative powers should not be given to the CA.

Mr Kunda explained that although the CA could be vested with legislative powers by amending Article 62 of the constitution which vested legislative powers in Parliament, there was no need to give a new body such powers for the sole purpose of coming up with a new constitution.

“The constitutional conference which we are going to create will have the characteristics of enabling people to debate the constitution thoroughly with the purpose of reaching consensus. The constitutional conference cannot make law,” Mr Kunda said.

He said the CRC made a mistake when it recommended that the CA would make the final and binding decision on the contents of the constitution.

The minister said two constitutional lawyers; professors Muna Ndulo and Patrick Mvunga also made this observation.

He said the supremacy of Parliament must be preserved.

“Indeed Parliament is supreme because it is vested with that supremacy by the constitution in Article 62. The people of Zambia created the constitution and (with) this clause, we can’t go anywhere else,” Mr Kunda said.

He explained that a national referendum was mandatory if article 79 of the constitution was to be changed.

“Professor Mvunga has said if the constitutional conference will do the same thing that the constituent assembly will do then well and good.

The constitutional conference is consistent with the CRC recommendations,” Mr Kunda said.

He said the Oasis Forum must convince politicians that their position on the constitution review process was the right one.

But Oasis Forum spokesperson, Musa Mwenye, argued that the CA provided the necessary safeguards against possible manipulation of the content of the constitution by politicians.

He argued that the difference between a constitutional conference and the CA in the manner the Zambia Centre for Inter-Party Dialogue (ZCID) had proposed it was that members of Parliament could change what the people recommended.

Southern African Centre for the Constructive Resolution of Disputes executive director, Lee Habasonda, was concerned that the constitution review process seemed to be driven by political parties.
Mr Habasonda said this had been done in the past and the results were bad.

ZCID spokesperson, Newton Ng’uni, said there was need to avoid a situation where Parliament was challenged because members of Parliament would not be comfortable if their powers were taken away.

  1. Now we can certainly see what this govt is up to, a CC
    which ONLY INVOLVES POLITICIANS as against a CA which will involves people from all walks of zambian life, to make a final determination of our constitution! In simple words, the same bunch of politicians that make up parliament to draw up our constitution on their own! Something that brings up the question of, do they zambian people have much confidence in this parliament or those before it, the capacity to deliver? I think not, hence the clamour by the civil societies & the church & all those indidviduals that have contributed to the various constitution review commissions to have the Constitution tabled to a CA WHICH WILL BE REPRESENTATIVE OF ALL ZAMBIANS & not JUST THE POLITICIANS!! So like we have already said to your mouthpiece – Mulongoti, KUNDA have some RESPECT FOR ZAMBIANS at least for once, stop cheating about silly none existent problems – CA is not about a new Legislative body, but a new Constitution!!

    Many questions have arisen and beg to be answered from statements such as yours.
    Please educate me on the following regarding a constituent assembly.

    1. How will it ensured that a CA will be representative of all 11 million Zambians better than parliament.? Is it that each family will have to send a member to seat on the CA.

    2.Will membership to the CA be electable or by appointment.If eclectable what will be the qualifications.If by appointment,who will be the appointing authoroties.

    3.What will be the format for adopting the resolutions and passing them into law.
    4.What will be the duration of the CA

    5. Who will be the abitar in case of disagreements WILL BE THE A

What we have on the scene are factionists freely squirming for survival through the media. And that is democracy at play. Thus, your baseless dreams too, like many politicians on the scene are sufficiently consistent with our national system of democracy firmly fostering the free speech edicts of a progressive age.

    The Constitutional change is a national consensus issue long reached. From the nonentity to the present Government officials, a decision for a new constitution has been unreservedly reached unless you show me a Zambia objecting to it. The issue at hand is that I don’t buy into the baseless Mbozi (33) assertion that opposition to the 100,000 persons’ submission to the Mung’omba CRC recommending a CA or CC is criminal come 2011.That is a baseless emotion driven on fallacy without legal precedence or moral platitude the progressive and sober Zambians could ever buy. Zambians are very sober on national matters. There is no illegality in opting for either of the alternative road maps. Democracy creates sufficient space, diversity and leadership positions. You cannot hold leadership at Gun point by saying out of the alternatives, “if you don’t go by the recommendations of the 100,000 Zambians that submitted to the CRC out of the national population of 12,000,000 plus Zambians, you will be subject to criminal charges come 2011”.That is malignantly emotional and worst order anarchy indoctrination typical of doomsday punditry time always writes off. If MMD plays its political pones smart in a democracy, who am I to truncate their reign??? I neither eulogize nor buy into the regrettable euthanasia of baseless hope for unjustified regime change predominant among those driven by mob psychology.

Demagogy is a strategy of obtaining power by appealing to the gut feeling of the public,usually by the powerful use of RHETORIC and PROPAGANDA.Any person who uses this kind of method is called a DEMAGOGUE and George Kunda fits right into this definition.#1 BAUZE is right on the money and I am afraid this whole constitution review process in turning out to have been a futile exercise.When we go to the archives and check the Mvunga and Mwanakatwe reports, we`ll notice that the problem has always been adoption and enactment of the constitution review report.I thought that this would be different because we have a lawyer for president but any independent thinkers will observe that it`s the same old story.

  8. CORRUPTION is real in Zambia and the country should not relent in fighting it, outgoing French ambassador to Zambia Francis Saudubray has said.

    And ambassador Saudubray said his dream is for Zambia to implement the decentralisation policy.

    During the French National Day which fell on Saturday, ambassador Saudubray said like in most countries in the world, corruption was real in Zambia. He said Zambians should be courageous, ambitious and have independent legal systems to fight corruption. He hoped that the country would not relent in fighting the scourge.

    “It is not because a former president has been condemned, in a civil case by a British court, that everything has been solved. Corruption is real in Zambia, like in most countries in the world. It eats up public funds, ruins investment opportunities and compromises development,” he said.

    Ambassador Saudubray said he dreamt of a decentralised Zambia.

    Zambia has so far undertaken four Constitution Reviews beginning with the Mainza
    Chona Commission of 1972, the Mvunga Commission of 1990, the Mwanakatwe Commission of 1993 and the Mungomba Constitution Review of 2003. In all these efforts, the question of constitutional legitimacy has been a critical issue of which in some other terms according to RUFQUA, the pipo in power are now using the rule of fixing “to fix or to be fixed” (cold play band has a marvellous song called I’ll fix you)

    In Zimbabwe, Mugabe’s government has amended the constitution adopted at independence 17 times and all those times they only suit Mugabe.

    The late Kapwepwe said to the pipo of Zambia and I quote “Africa Twasebana”(shame upon Africans) when KK introduced one party system in Zambia. In 1981, the senior citizen Alias Chipimo was detained by KK when he said and I quote “until they receive a bullet in the head that’s when they will cease to be African leaders”

    Ba Joze- you must be a challenged person looking at your line of thought. What facts could you enumerate here from Mbozi # 30 to base his criminal charges rhetoric on those that have opted for the CC instead of the CA? Show me the legal basis or moral ground that is in contravention of the Democratic process or consensus based decision. How many people has Zambia got? How many of the legible votering age Zambians were those that submitted? How many submitted to the Mung’omba CRC to represent a national voice? What percentage to the population is that? Does recommendation mean consensus vote? On Elias Chipimo senior you are a disgrace while on your “Satanic verses” you call the “RUFQUA”I have long understood your source of confusion. Its spiritual in a supposedly Christian nation.

    NAIROBI (AFP) – Authorities in the Kenyan capital began enforcing a ban on smoking in public places on Wednesday as Nairobi became the latest world capital to reject its harmful effects. Smoking has been outlawed in restaurants, bars, offices, public buildings, markets, malls and theatres a year after the Kenyan High Court blocked the measure.
    Offenders face fines of up to 3,000 shillings (45 dollars) or six months in prison.
    Nairobi mayor Dick Wathika urged bar and restaurant owners to create designated areas for smokers as the ban took effect on Wednesday.
    “We will move with speed to enforce the ban … You will see our officers busy marking areas so that we are able to provide smokers their (smoking) zone,” Wathika told reporters.
    “You are free to challenge us,” in court, he added.
    A smoking ban is already in effect in the Rift Valley town of Nakuru and the port city of Mombasa.
    Last year, the high court blocked the implementation of a nationwide ban introduced by the government, pending the outcome of a lawsuit filed by Kenya’s tobacco growers.
    Smoking provides the Kenyan government with around five billion shillings (74.6 million dollars, 55.5 million euros) per year in taxes, but costs five times as much in disease, disability and death, according to official figures.
    Kenya is Africa’s second country to introduce a partial smoking ban after Tanzania, which banned smoking in many public places in 2003.
    Norway, Italy, Ireland and Britain are among a number of European countries to ban smoking in the workplace and confined public spaces like restaurants and bars.

  15. I have to concur with Mbozi as well. There is a growing perception that the constitution making process is being hijacked by politicians for their own selfish ends. Zambia is not the first country to make attempts at constitutional reforms. People’s original assumptions that having a lawyer at the helm would usher in a new era of enlightened politics were clearly misplaced. Kunda reminds me of Prof. Jonathan Moyo of Zimbabwe. A brilliant law scholar, Moyo was appointed justice minister by Mugabe to give credence to a disastrous and repressive lagislative programme. He used clever language to defend the indefensible. He is now regretting it. LPM has on occassions used Kunda to try and explain the explicable. People still remember how Kunda was used to explain away the government’s decision to discontinue Kashiwa Bulaya’s case. This time Kunda’s intervention was designed to calm down things and clarify government’s stance. Unfortunately he was not all that impressive!

  16. The french ambassodor has hinted on some very important issues. Decentralization can be an effective system to take resources to all regions of the country. But as Kayata observes, politicians are dead scared of the consequences. If each province is given a fair share of the national cake, as should be, all the career politicians in Lusaka will lose their cutting power and employment. They will need to appeal to the regional base as opposed to state house. Pity we cant seem to get this to work.

  18. It’d interesting to see the implementation of the anti-smoking ban in Nairobi. The trouble generally is, the $75 million revenue is seen as a direct loss by the Min of Finance while the cost, though real, is fairly invisble to the bureaucrats at Finance. Would also be very interested to see how the Kenyans monetized smoking-related premature death to arrive at $75 million.

  20. If LPM has been sincere about constitutional reforms, he would have put in place some sort of compromise process by now. Frankly no one cares how the constitution is adopted as long as the process is NOT manipulated by MMD. It seems to suit LPM and MMD to drag the whole thing out indefinitely. There does not seem to any goodwill on the part of the government at the moment. LPM is probably hoping that the down-trodden people of Zambia will tire and leave him to create a constitution in his own ‘image’. Let’s not forget that the third term issue will be raised again. It’s just a matter of time. In almost every African country, the third term debate is perennial. What better time to raise it than when you are in the middle of a constitution review? Obasanjo tried to smuggle the third term clause into the new constitution but was thwarted by vigilant and patriotic Nigerian legislators.

  21. #18 If you equate the amount of money spend on health of people who have smoking related disease you see that that the govt makes a gain. Its a process which will only show results after a long period of time. Deaths will reduce the long run. Three weeks ago Britain passed the same orders. Germany is following any time. This includes also the smokes that vehicles produces. Now over CA and Kunda why are making things complicated. The reason a refrendum is required at certain stage is to involve everyone just like voting for MPs and State president.

KK was wamuyaya that’s when Chipimo made a living ststement “until they receive a bullet in the head that’s when they will cease to be African leaders.” In those days the same kind of oppression of pipo were spearheaded by Kamuzu Banda, Moi, Mabuto, Sheu Shangali of Nigeria just to name a few African Leaders.     HOME affairs minister Lieutenant Gener al Ronnie Shikapwasha yesterday advised people to have enough sex in their marriages to avoid temptations.

    And Lt Gen Shikapwasha said the government of President Levy Mwanawasa would not accept abominations such as marriage between relatives.

    Officiating at the graduation ceremony of pastors at Bible Gospel Church in Africa (BIGOCA) yesterday, Lt Gen Shikapwasha advised married people to have enough sex in their homes in order to avoid looking for it elsewhere.

    “If you are married, have enough sex in your home,” Lt Gen Shikapwasha said. “Don’t be a pastor who is too busy that you do not make love to your wife.”
    He al so encouraged the pastors not to speak words that would trigger sexu al feelings in other people in the name of chimbuya (cousinship).

    “Don’t speak words that will trigger sexu al feelings in another person,” Lt Gen Shikapwasha advised. “Stay away from casu al contact with the opposite sex.”
    He reiterated the need for m al e pastors to counsel men who had problems and fem al e pastors to counsel their fem al e counterparts as a way of preventing adultery.

    “If you are going to minister to a woman, let your wife be there, some say you can counsel a woman with the door open but you may not know when the devil will close the door,” Lt Gen Shikapwasha said.

    He advised the pastors not to give gifts to fem al es in order to prevent misunderstandings.
    “Don’t give gifts to fem al es, they will misunderstand you and when you give a gift to a man they will feel mellow,” Lt Gen Shikapwasha said.

    Lt Gen Shikapwasha, who led the congregation in worship songs such as Mwe lesa mwebaba and Tub al emye ba Yahweh, said he was a sinner who was thankful to God for what he had done in his life.

    On the recent incident where Lusaka man, K al ikonga Singogo, wanted to marry his niece Ngambo Kamawe, Lt Gen Shikapwasha described the situation as the worst form of perversion that could happen in any nation.

    “A nation which c al ls itself a Christian nation must rise to condemn this. Sodom and Gommorah was destroyed because of iniquities,” he said.
    He c al led on pastors to counsel the young man.

    “The devil has launched an onslaught on God’s people, people must help the least man to understand the way of God,” Lt Gen Shikapwasha noted. “How can we c al l ourselves a Christian nation when we al low people to sleep with their nieces? The government of President Levy Mwanawasa will not accept such abominations in this country.”
    Lt Gen Shikapwasha told the pastors to tithe to God and not love money too much.
    “Many men of God are wrecks because of the love of money. Tithe is the foundation of al l your blessings,” he said.

    On the constitution-making process, Lt Gen Shikapwasha said those who wanted the constitution to be adopted through a constituent assembly just wanted to make money through al lowances.

    “Those who are saying the Constitution must come through a constituent assembly just want money because it was suggested that those sitting would be given K500,000 per day,” he said.

    Lt Gen Shikapwasha encouraged people to debate the constitution-making process with a purpose.

    “Let nobody mislead you over the Constitution, President Levy Mwanawasa on his own volition said we needed a good constitution that will stand the test of time,” said Lt Gen Shikapwasha.

    And BIGOCA Bishop Peter Ndhlovu said his church would not take sides on any politic al events or disputes because they believed that God had given the church a mandate to bring reconciliation rather than to be partisan.

Anyone who anyone who will sitt on the CCB or CA should get on 5% to 10% of the amount the rest should be divert to Hospitals, Roads, education, communication. There is no time to play any leader who will misuse funds in anyway should be dealt with. Mutemba Nchito and AAC should also tell the nation how much money they have spent of the fight of corruption. Mumba Malila should lie open the London case has commulated. We want accountability and transparency.

    What most forget is that the more sex with your partner, the less affectionate you become towards them and build lust onto others unless a person is anti-social.

  35. Kayata .. the first step in decentralization or federalism is shifting of power. We have to give the president the Authority “powers” he needs to lead the nation. At the same time we have to strip the office of the president excessive authority he doesnt need while strengthening the local authorities by giving the elected representatives the authority they need to execute their functions. After this excercise we have to re-structure our tax system so that taxes dont have to make a round trip. A potion should be collected by the local authority. Amb Sausibury just hit the nail on the head. The word power should be abolished in reference to political office. A president is a servant of the people. What he gets on assumption of office is authority as enshrined in the constitution. We have got it all twisted in Africa. In the US or Europe politicians always address citizens as sir or mem (madam). Why ? because they understand who has the power. Its the people, the presida is a servant

  38. #2 Citizen, I hope and believe that the purpose of holding a refrendum implies that people of Zambia will take part by choosing people who represent them. These should be knowledgable persons not only lawywer. Its thru process that also the representatives will be chosen. A timeframe of less than two years should be enough to come up with a afted Constitution. A neutral person who is not partisan should be sort out among Zambians. Its unfortunate our white colour men has become corrupted and sold out. I stress appointment should be done by by the Zambian people thru the ballot.

  39. Ba Easy(39), what is a referendum and what is it’s purpose ?? I doubt it is to choose representatives but merely a constitutional right accorded to citizens to choose the direction of government over a particular issue.

  40. LPM has failed to provide proper guidance over the constitution making process because of his arrogance. He is now in his second term and we are still talking about the method of adoption and not the substance. The process was flawed from the very beginning because LPM thought he had the monopoly of knowledge on the kind of constitution Zambia needed. There was no need to start from scratch as if we were a country that had just emerged from a long and disastrous civil war. Once a constitution is in place, it develops and is improved upon by ammendments. If we wanted comprehensive changes, what should have happened is that LPM, in consultation with other stakeholders, should have assembled a team of experts to come up with a draft constitution based on the current one and recommendations of the previous constitutional review commissions we have had. There was no need for another commission to go round the country gathering views from people half of who did not even know what the process was about-just read submissions! The draft would have been a basis for substantive debate on the ammendments necessary to the current constitution. At that stage, we could then have started talking about the method of effecting those changes to the current constitution. This process could have taken less than 2 years. Zambia has been a peaceful country for over 40 years, with an undisturbed parliamentary system that, believe it or not, is the envy of some of our neighbours. But the current constitutional process has in my opinion, tarnished that image. Anyone getting to hear of Zambia for the first time would think we have just gotten independence!

    That said LPM, and Kunda have lost the credibility to give any kind of assurances over the process. Always take what they say with a huge pinch of salt.

    Kindly help me answer some questions on #2. I would like to be a proponent of the CA but would still prefer to be enlightened on some matters pertaining to CA.

  43. the say history does not repeat itself but its funny that LPM and kunda are repeating what happened in france 200 years ago.the zambian unlike the french of that time are very peaceful and would like to have a new constitution that will stand the test of time and will be fair to every one.however LPM and Kunda are taking the attitudes of zambians for granted.one day people will rise and the world will witness another revolution.so to LPM not all days are sundays one day you will remember the conflicts you have roused. matter of fact we are waiting for your term to end you have to answer for loss of money that government is loosing every day.

  45. In the ongoing Chiluba case… The government put the cart before the horse! Now they are in trouble!

    In non-legal lingo, the AG should have tried the cases in Zambia (which has a fully functional court system) and upon getting a guilty verdict apply to register it in the countries they allege Chiluba and crew laundered the stolen “Zambian” funds. Not the other way around.

    For heaven’s sake, Blair even cheered the proceedings and verdict while fugitives like Shansonga in his country!!!

  46. IG condemns unprofessional police officers

    July 16, 2007

    Inspector General of Police Ephraim Mateyo has condemned police officers who are alleged to have shared money recovered from an aggravated robbery.

    Mr Mateyo said an undisclosed amount of money was stolen during the same theft in
    which an Armcor driver was shot dead.

    Mr. Mateyo pointed out that he wished to reiterate his earlier message that he would
    not condone criminal activities by his officers whom he expected to act as role
    models in the community both on and off their line of duty.

    He said this in a statement released to ZANIS in lusaka today.

    Mr. Mateyo has since warned all police officers indulging in crimes to be ready to
    face the wrath of the law irrespective of their rank and status.

    Mr. Mateyo said the 10 police officers have since been nabbed while investigations
    have continued.

    Mr Mateyo expressed disappointment at such police officers who want to turn the
    police service into a laughing stock because of their unacceptable.
