Zambia is in Dire Need of a Mineral Asset Valuation Code to Prevent Overpricing or Underpricing of Mining Assets

Mining valuation can simply be defined as the placement of a currency value on a mining asset. It tries to answer the question of “what is the value of the mine” or “what is the mine worth?” Consequently, mine valuation must encapsulate the value of surface and sub-surface infrastructure.

In the recent past, several jurisdictions have developed professional codes to standardize the field of mining asset valuation, these include, VALMIN code from Australia, CIMVAL code from Canada, and SAMVAL code from South Africa.

These codes classify the valuation approaches as income, market, and the cost approach. The application of any of these methods on a particular mining asset depends on the phase of the project, availability of information, and nature of the valuation. The objective is not to arrive at a particular value but to narrow down to a range of values. Therefore, multiple methods must be employed to achieve this.
There are several purposes for undertaking mineral asset valuation. These include:

(i) Trading purposes of these assets in the international market place;
(ii) Taxation purposes; and
(iii) Financing purposes.

It is important to note that if the reserve/resource statement is unsound or the exploration data does not reflect the potential of the property, the resulting valuation could be meaningless. In other words, this means an erroneous estimate of reserves or resources as an input parameter will translate into garbage out in terms of the estimated value of the mine. Therefore, a mineral asset valuation code should be applied in tandem with a mineral reserve reporting code.

Despite a 100 years of mining it is unfortunate that the country cannot boast of its own mineral asset valuation code and a mineral reserve reporting code. Crafting these codes will avert a situation where our mining assets continue being overpriced and underpriced to the detriment of the state. When our mines were privatized the citizenry felt and continue to feel at a loss because the assets were underpriced. Secondly, in the case of of the acquisition of Mopani Copper Mine by ZCCM-IH it is debatable as to why a cost approach to mine valuation was used. This approach merely looks at the historical, current and future cost of a mining asset. It fails to account for reserves, production profile and other fiscal terms of the project. The question that is to be answered is whether this approach to mine valuation is the best when valuing production properties like Mopani? The best-known method of valuing mineral production properties is the income approach particularly using a Discounted Cash Flow (DCF) analysis. This approach valuates the mineral reserves/resources and takes into considering the cost, production profile, and the fiscal regime in application over the life span of the mine.

The trend of undervaluing and overpricing of mining assets will continue in perpetuity if the country does not craft its own mineral asset valuation code. This does not involve reinventing the will because the Government can easily fine-tune and adopt one of the international codes and pass it into law. When this is done the country will have proper guidelines on mining asset valuation. This is a matter that the Centre for Trade Policy and Development (CTPD) has been advocating for over the recent years. The Centre also calls for Government to craft mechanisms that establish the authenticity of the deposited geological information by mining houses as this will translate in estimating the true worth of Zambia’s deposits in any future transaction.

High Court Dismisses Vedanta Injunction to Block Restructuring of KCM

Konkola Copper Mines (KCM) Provisional Liquidator (“PL”), Milingo Lungu, informs that the High Court yesterday 1st February 2021 dismissed the court case and further discharged the injunction which was obtained by Vedanta Resources Limited on 18th January 2021, in which it sought to stop the ongoing restructuring and reorganization of Konkola Copper Mines Plc

High Court Judge W.S. Mwenda dismissed the matter with costs to be paid by Vedanta after she said in the ruling that the filing of the injunction was irregular.

In view of this latest ruling, Mr. Lungu wishes to update employees, business partners, the nation and all KCM stakeholders that the restructuring and re-organization of the company, as announced on 28th December 2020, will now continue without any constraints.

He said that the Human Capital Management (HCM) department will resume the distribution of letters of employment offer to employees, who will be employed by either the Konkola Mining Resources Limited or KCM SmelterCo Limited and that other relevant departments and functions will proceed to effect their respective and appropriate actions regarding the restructuring.

The PL noted that, “After the dismissal of the injunction, Management expects employees to continue with the spirit of safe and hard work, and commitment to uplifting KCM to become a major global copper producer. We expect all employees and our business partners to adhere to safety protocols that are in place because Safe Production is the hallmark of our focus to improve production and operational efficiency.

Mr. Lungu further noted that the restoration of KCM’s technical health remains the key objective to which all efforts must be directed, and that this will increase efficiency and business opportunities, as well as asset and resource optimisation in the restructuring of the mine.

Zambia should get rid of defamation law: It undermines free speech

Is defamation law helping Zambia? No doubt Zambians find it difficult to give an honest answer to questions like this.

Nevertheless, closely analyzing defamation law in the country, the most honest answer to the question is no, defamation law is not helping Zambia.

Defamation law tampers with free speech. In other words, it makes people afraid of saying what they want to say. Especially that most defamation cases in the country involve President Edgar Lungu.

It is very possible the fear of being misunderstood and ending up being arrested is making people find it risking to freely debate questions related to defamation in the country.

It may sound like endorsing insulting language against the president for saying this: Defamation law seems to promote unnecessary arrests in Zambia.

Too many citizen arrests have never helped to build a good image for any country in the world. Especially when the arrests are associated with free speech.

Just learned that police in Solwezi, Western Province have arrested two gentlemen, Victor Sankisa and Nicholas Sankisa of Kazomba compound for allegedly using insulting language against President Edgar Lungu.

It is not stated what Victor Sankisa and Nicholas Sankisa said about the president. That should not be the main concern. The question that everyone should be asking is, are defamation arrests helping to build the country’s positive image?

Meanwhile, evidence shows that most comments that the Patriotic Front (PF) government claim to be insulting are not insults but misunderstood socially accepted sayings.

Last year the United Party for National Development (UPND) President Hakainde Hichilema “pamunyoko” comment was received as an insult by the PF government only to find out later that it isn’t.
Because of that, Victor Sankisa and Nicholas Sankisa’s arrest deserve close attention. Every Zambian has the right to say what he/she wants to say. Unfortunately, defamation law undermines that.

Unsubstantiated witchcraft allegations land 4 siblings in police cells

Police in Isoka district of Muchinga Province has arrested four people for burying a corpse of a deceased female in front of her brother’s house on suspicion that he bewitched her.

Muchinga Police Commissioner Lizzie Machina confirmed the development to ZANIS saying the four suspects spearheaded the burial of Micah Nalwimba in front of her brother’s house.

Ms. Machina disclosed that the four suspects buried the deceased after accusing their elder brother of killing her through witchcraft.

She said calling someone a witch is an offense hence she instructed her officers to appended the suspects.

The Muchinga Police Commissioner explained that the deceased person was working in her field when she suddenly collapsed and was rushed to Isoka district hospital where she eventually died on January 28, 2021.

She added that acting on unsubstantiated allegations, the deceased’s siblings, together with other unknown people, vented their anger by digging a grave and burying the body in front of their elder brother’s house.

Ms. Machina stressed that police shall not sit idle and watch innocent elderly citizens being named as witches or wizards, a situation that sometimes leads to murder.

The incident happened on the January 30, 2021 at about 10:00 hours at Malale village in Isoka district.

Stardy Mwale’s firm fails to complete construction of a Maternity Annex at Kabushi Clinic, nine years on

The construction of a Maternity Annex at Kabushi Clinic in Ndola by Stardy Construction, a company owned by Permanent Secretary at Cabinet Office Stardy Mwale has not been completed, nine years since the contract was signed.

Stardy Construction was awarded a K1.6 million tender to construct a Maternity Annex at the clinic in 2013 and the project was scheduled to take 18 months but it remains unfinished nine years later.

Official records from the Ndola District Medical office confirm that Mr Mwale’s firm was paid the full contact sum.

In November 2019, Mr Mwale had to apologize to President Edgar Lungu and First Lady Esther publicly after media reports exposed the delays in completing the project and promised that it shall be completed and handed over in a matter of days.

But a check on the project by Kabushi Member of Parliament Bowman Lusambo over the weekend revealed that the project has still not been completed.

Mr Lusambo expressed deep disappointment over the failure to complete the project saying it was hampering government’s developmental agenda.

He has since tasked officials from the Ministry of Health to explain why it has allowed what he called nonsense to continue regarding the project for several years.

“This is unacceptable. What we know is that the contract period was a mere 18 months but nine years later we are still discussing the same issue. Now I want to find out why our Annex Building remains unfinished when our neighboring constituency Bwana Mkubwa had a similar project completed and handed over by the Minister of Health himself,” he said.

Mr Lusambo said Kabushi constituency is a growing area with a growing population which needs a functional Maternity Annex to service the expectant mothers.

Micho: We Were Second Best Against Morocco

Milutin Sredojevic says his Chipolopolo team was second-best against CHAN defending champions Morocco in Sunday’s humbling 3-1 quarterfinal loss in Douala.

Ten-man Chipolopolo, who had defender Zachariah Chilongoshi sent-off inside the opening 20 minutes of the first half with Morocco leading 2-0, made a third successive CHAN quarterfinal exit on January 31 to suffer their worst loss in the competition to date.

“You know that we have played against a team from a country where two teams Wydad and Raja Casablanca were in the semifinals of the CAF Champions League and whatsoever, this is a pure reflection of their football,” Micho said.

“It is means that we need to work hard and rise above and be in the group stages of the Champions League and then on the Chan to expect beyond quarterfinal.

“On the other side I really wanted to go all the way but realistically speaking despite stretching all human and sport limits I need to be sincere and to accept despite players giving everything unfortunately we could not reach beyond this stage. This is the reality.”

With those Micho’s words, the defeat comes barely two months before Chipolopolo host Morocco’s neighbours and defending AFCON champions, Algeria, during the week of March 22 in a must-win penultimate Group H qualifier.

Fallen Mighty Continue To Stutter in Division One

Mighty Mufulira Wanderers have continued with their stuttering form in the 2020/21 FAZ National Division 1 campaign.

Wanderers forced a goalless draw against Zesco Malaiti Rangers in the weekend round 15 match played in Lusaka.

This was the legendary club’s sixth draw of the season.

Wanderers are seventh on the table with 21 points, 10 behind leaders Kansanshi Dynamos, after 15 matches played.

Mighty are seeking a quick return to the FAZ Super Division after suffering demotion during the 2019/20 season.

Meanwhile, City of Lusaka are back in the top four following a 2-1 win over Muza FC.

The win pushed Ya Moto to number three with 29 points after playing 15 matches.

The enemies of Michael Sata accuse me of putting him and the Patriotic Front in power in 2011. They are not right; they are wrong.

I don’t deserve that much credit. It wasn’t possible for me to make Michael win those highly contested elections. Michael’s political journey started long before I was born. He was a top trade union leader, freedom fighter, businessman, councilor, governor of Lusaka, minister of state, minister of local government, minister of health, minister without portfolio, secretary-general of MMD without any participation or influence from me.

Michael started the Patriotic Front without me. How can one sensibly try to credit me with making Michael, making him president of the Republic of Zambia? Michael was destined to be president of this country – it was just a matter of time.

For me the story of my association with Michael isn’t difficult or hard to tell because it isn’t fiction. It isn’t something I have to make up; it is my reality. I was insulted, humiliated and abused with him by people who are today enjoying the power he won for them.
When something comes from the heart, it has to be real.

The Michael I knew was a decent human being whose stance on various issues was known. He had a good sense of self-image that’s why he would relate with people from all sorts of backgrounds. He was also able to make decisions right or wrong. He was not vengeful and made peace quickly.

He didn’t claim to be what he was not – no posturing, pretence or hypocrisy. He showed his emotions whenever he was angry or happy. You didn’t have to guess about him. He was a real human being – with all the defects or frailties of a normal human being. He was real, so real – so creative. I miss him.

If supporting him, being his friend and brother was wrong, then I don’t want to be right!

Zambia Police arrest 2 females for indecent assault

Police on the Copperbelt province have arrested two females for allegedly indecently assaulting a 17-year-old girl by inserting a round bar in her private parts.

Zambia Police spokesperson Esther Katongo said in a statement to the media that Jacqueline Nanyinza, 27 and Catherine Mpamba 28, both of Chipulukusu compound in Ndola were arrested for indecently assaulting a 17-year old girl.

Ms. Katongo explained that the two are alleged to have indecently assaulted the teenager on Saturday, January 30, 2021, between 09:00 hours and 18:00 hours as they accused the victim of flirting with Jacqueline’s husband.

She said the women are purported to have enticed the victim to accompany them to Catherine’s house where she would be given some wigs to plait her hair.

“It is alleged that whilst there, she was beaten, undressed and photographed whilst naked and that the duo inserted a round bar into the victim’s private parts and scorned her,” Ms. Katongo said.

She said the victim later reported the matter to the police and the accused persons are in police custody awaiting court appearance.

Meanwhile, police in Lusaka have arrested one suspect and are looking for the other suspects believed to be on the run in connection with the murder of Terrence Mutale and assault of one other person in an incident which occurred in Kanyama compound.

Ms. Katongo said the incident happened around 15:00 hours on Thursday, January 28, 2021 when two groups of unruly persons clashed along First road, off Mumbwa road during a funeral procession.

She said initially, a report was recorded as unlawful wounding and the two victims were taken to Kanyama Level one Hospital for treatment.

But later, Mutale, who had sustained multiple head and body injuries, was referred to UTH where he died on January 30, 2021 around 11:00 hours.

She said an investigation into the matter led to the arrest of a female adult aged 52 whose identity has been withheld but of old Kanyama compound and a manhunt for other suspects has continued.

Mine Suppliers want the law through SI to force Mining Firms to give Big Contracts to Local Players

The Association of Mine Suppliers and Contractors has appealed to government to enact into law the Statutory Instrument (SI)on local content to give local suppliers leverage for bargaining business opportunities in the mines.

Speaking in an interview with ZANIS in Kitwe yesterday, Mines Suppliers and Contractors Chairperson Augustine Mubanga said government should sign the SI for the local suppliers to also benefit from the current high copper prices on the international market.

Mr Mubanga noted that at present, due to the non-existence of the SI in place when mines go through challenges the powers that be tend to over-look the plight of the local suppliers and contractors.

“We are hoping that within this first quarter of the year, the SI on local content must be signed by the Ministry of Mines as this will give us leverage to bargain for contracts in the mines and also protection as it will give us a framework and basis for us to engage both the mines and other stakeholders,” he stated.

And when contacted, Mines Permanent Secretary Barnaby Mulenga said his Ministry is awaiting the Ministry of Justice to finally complete the process of enacting the SI into law.

“We are waiting for the ministry of Justice to finish the process of preparing the SI, they haven’t finished the process, that is what we are waiting for,” Mr. Mulenga said.

Once enacted, the SI on local content will ensure that local suppliers and contractors are given a significant value of business contracts by the mines.

And Mr Mubanga further called on the Ministry of Commerce, Trade and Industry to take a keen interest in the value of procurement transactions that take place in the mining sector to ascertain where the value goes.

He noted that most of the business transactions are given to foreigners and in the end the real value of these transactions goes outside the country.

Meanwhile, the Association has projected a positive business year in 2021 as a result of the acquisition of Mopani mine by government.

Mr Mubanga urged government to resolve the issues regarding Mopani Copper Mine to ensure increased production for the mine so as to benefit from the high copper prices with the suppliers enjoying the spill over benefits.

He noted that 2020 was a challenging year as it mainly consisted of battles between government and Mopani as the latter was insisting on putting the mine on care and maintenance which he said disadvantaged the suppliers.

“Now that Glencoe has handed over the mine to government, we expect that ZCCM-IH will start running by ensuring that the mine becomes productive, increase its production and begins to meet its obligations,” Mr. Mubanga said.

He also urged government to settle the issues surrounding Konkola Copper Mines to ensure that the mine begins to operate at its optimum capacity.

Fuel Shortage that had hits parts of the Country ease

Government has expressed happiness that the fuel shortages that hit Monze District and other parts of Southern Province has since been addressed.

Speaking during a brief tour of filling stations in Monze District to check on the fuel situation, Minister of Energy Mathews Nkhuwa was pleased to note that the fuel shortage has been addressed and that all districts in the province are stocked with adequate fuel.

Mr Nkhuwa noted said government was deeply concerned with the fuel shortages that hit most parts of the country and disclosed that remedial measures have since been put in place to ensure uninterrupted and constant fuel supply.

Mr. Nkhuwa also appealed to Monze District Commissioner to alert government of any looming fuel shortages by constantly engaging owners of all the three filling stations in the District.

“It is nice to hear that there are no more fuel shortages here. Southern Province was hard hit by fuel shortages and that is why we took a tour to ascertain what was happening and we are happy that the challenge of fuel shortages is now over in the province,” said Mr. Nkhuwa.

“I want to appeal to you District Commissioner to be proactive to engage these owners of these filling stations from time to time and equally important actively coordinate with my office to avert another fuel shortage which affects economic activities,” he added.

Mr. Nkhuwa further pledged government support to private sector engaged in the construction or exploration of energy such the Kalahari geothermal power plant under exploration at a cost of about K90 million in the Lochnivar National Park Monze District.

The Minister noted that geothermal energy is stable power unlike wind or solar energy and that government desires to see the successful completion of the plant expected to generate 15 Megawatts once operational soon.

He further said the government would support all cascading geothermal energy uses such as the proposed industrial park that would use energy from the plant once operational.

And Monze District Commissioner Munachoongo Muleya has confirmed a stable flow of fuel at most filling stations.

And Kobil filling station Manager Mr. David Musonda has appealed to the government to allow for the construction of more filling stations to meet the growing demand for fuel in the District.

He said the two existing filling stations were old and had inadequate capacity of less than 200,000 litres to meet the demand and that such poses a challenge to have buffer stocks in case of prolonged fuel shortages.

Monze District experienced a shortage of both diesel and petrol for close to a week forcing some motorists to fetch the commodity on the black market at exploitative prices.

Luanshya council gives land to teachers

Over 800 teachers in Luanshya District are set to benefit from a Land Empowerment Memoradum of Understanding between the Luanshya Municipal Council and the Ministry of Education in Luanshya district.

Ministry of General Education Permanent Secretary Jobbicks Kalumba and Luanshya Mayor Nathan Chanda signed the agreement which is expected allow teachers acquire affordable and decent housing at flexible payment conditions in Luanshya.

Dr Kalumba commended the Council and the district Education authorities for the initiative that was embraced by the two parties.

“Empowering citizens with land is the best incentive that government can offer to citizens, I want to thank the council and the DEBs for this initiative and I want to see this spirit spread to all districts countrywide” he said.

Dr Kalumba urged heads under the ministry of education countrywide to emulate the milestone set by Luanshya Municipal Council and the district Education Secretary.

“Land is one of the most important securities every citizen needs and also the best empowerment a government can give to citizens, which provides a sense of ownership, enhance patriotism and hard work and is a motivation to teachers to go an extra mile in their delivery of education service,” he said.

He said the MOU was a true government commitment to uplifting the standards of its citizens

He urged teachers not to resale the land that will be given to them by the local authority but regard it as an inheritance for future generations.

And Luanshya Mayor Nathan Chanda said the MOU is partnership which will serve as a milestone to future land and other empowerment programs between the local authority and Civil servants.

Mr Chanda disclosed that the partnership will allow teachers to pay statutory plot premiums in installments, while land development can commence.

“It is a milestone culminating into a series of partnership meant to enhance a suitable land acquisition and decent housing,” he observed.

Mr Chanda indicated that the MOU was in line with the National Housing Policy as well as the Patriotic Front manifesto which both entails providing decent accommodation for all by 2030, in line with the Vision 2030 and the 7th National Development Plan.

Luanshya District Commissioner Patrick Maipambe noted that the MOU will not only uplift the standard of living but will also serve as a motivation factor for teachers.

“This gesture will not only uplift the living standards but it will also empower teachers for life and help them to remain focused in delivery of education services,” he added.

Speaking at the same occasion, Luanshya District Board Secretary Chilombo Kabwe said empowering teachers with land will mitigate social challenges such as accommodation.

“This agreement came from the realization that teachers were failing to acquire land due to various social challenges such as loans among other issues,” he noted.

Luanshya has a total of 1,900 teachers spread across the district.

Western province record high murder cases

Justice Etambuyu Zimba has bemoaned the high number of murder cases in Western Province.

Lady Justice Zimba said the province recorded 11 murder cases out 31 cases that were cause-listed during the 2021 High Court session.

Speaking during the 2021 ceremonial opening of the Mongu High Court Criminal Sessions, Lady Justice Zimba pointed out that previous statistics revealed that most of the murders arise out of petty differences at drinking places.

She has since implored families, the church and traditional leadership to assist in reducing the crime levels in the province.

The Lady Justice called for concerted effort in fighting crime and not just law enforcement organization alone.

Lady Justice Zimba further stated that this year, 15 cases were carried forward from 2019 while 255 new criminal cases were filed out of which 180 were cause-listed and 173 disposed of while 97 were carried forward to this year.

She reiterated the Judiciary’s commitment to dispose of cases timely but that most of the time challenges hinder the quick disposal.

She cited inadequate court infrastructure and overcrowding in the correctional facilities as among some the challenges.

Meanwhile, Western Province Minister Richard Kapita who graced the function took note of some challenges and pledged to address them.

Mr. Kapita said government has started addressing the challenges by constructing a house for the resident Judge at Kasima area as well as the Juvenile cells at Mongu Correctional facility.

President Lungu mourns with bereaved families

President Edgar Lungu is deeply saddened by the deaths of Supreme Court Judge Elizabeth Muyovwe, Chief Chibesakunda xl, Mr. Timothy Walamba, Mr. Augustine Seyuba and many other citizens who have passed on lately.

President Lungu has described Judge Muyovwe as an experienced and accomplished Judge who contributed immensely to the Judiciary.

President Lungu notes that Judge Muyovwe was an experienced and accomplished professional and an expert in jurisprudence whose expertise will be missed by the legal fraternity.

“On behalf of the Government, the people of Zambia and indeed on my own behalf, I wish to express my sincere condolences to the bereaved family, the Supreme Court and the entire Judiciary on the death of Judge Muyovwe. We share your grief during this difficult time and we beseech the Almighty God for comfort and fortitude. May the Soul of Judge Muyovwe rest in peace,” President Lungu says.

And President Lungu says the death of Chief Chibesakunda XI is a big loss not just to the Bisa people but the entire country.

The President said his administration worked well with Chief Chibesakunda XI, and shared the same vision of developing the rural areas of Zambia.

Meanwhile, the President has hailed Mr. Walamba for his contribution to the welfare of miners when he was a vibrant unionist.

The President said Mr. Walamba equally served the country with dignity when he served as Zambia’s High Commissioner to Ghana under the Patriotic Front administration.

“The Government, the people of Zambia and I mourn Mr. Wayamba. To the bereaved family, our hearts are with you in this time of sorrow. May God Almighty grant you peace as you mourn, May His Soul Rest in Peace,” the President said.

And President Lungu has described the death of Mr. Seyuba in South Africa as another big loss to the country.

“His wealth of experience, particularly in public relations and marketing was exceptional and cannot be forgotten,” the President stated.

The President mourns with all those who have lost their loved ones in this difficult period of Zambia’s history blighted by the COVID-19 pandemic.

ZAMRA investigates defects on recalled Cevite tablets

The Zambia Medicines Regulatory Authority (ZAMRA) says it has instituted investigations to establish the cause of the defects in the recalled Cevite Tablets bearing batch numbers 0371572 and 0372251 that was imported by Shalina Pharmaceuticals (Z) Limited.

ZAMRA has further stated that the quality analysis of the product is on-going and the public will be informed of the outcome in due course.

Speaking in a press statement issued to the media yesterday, ZAMRA Senior Public Relations Officer Christabel Mutale says the Authority has since quarantined all batches of Cevite Tablets at Shalina Pharmaceuticals (Z) Limited and is in constant communication with the company to monitor the recall process.

Ms. Mutale has since advised members of the public to report products which may be exhibiting signs of deterioration to the Authority for further investigations and appropriate regulatory action.

ZAMRA has further called upon all license holders to adhere to Good Distribution Practices (GDP) and monitor products in their possession at all times.

Cevite Tablets are used for Low levels of vitamin c, Scurvy, Vitamin deficiency and other conditions.
