Government threatens to start revoking operating licenses for public bus operators violating COVID-19 Guidelines

The government has threatened to start revoking operating licenses for public bus operators who do not adhere to the standard operating procedures for public transport.

Transport and Communications Minister Hon Mutotwe Kafwaya says the guidelines should be followed without fail by players in the public transport sector.

The Minister said this when he checked on compliance levels by bus operators to the anti-COVID-19 measures as he also distributed copies of the new standard operating procedures to all the bus stations in Lusaka.

He said there will be no excuse for the bus owners who fail to follow these guidelines since they have been given copies of the standard operating procedures as they do their business.

Hon Kafwaya said bus operators should ensure that their busses have hand sanitizers to be used by the passengers and that bus drivers and conductors on the other hand should ensure that all passengers are wearing face masks correctly.

“Wearing a face mask in busses is a must. We should not allow anyone without a face mask to jump into the bus. So what we are talking about in the standard operating procedures is basically the expected conduct while on the public transport, ” he said.

He encouraged the traveling public to practice what he termed as ‘respiratory etiquette’ while on the bus.

ZICTA fines all the three mobile phone companies K5.4 million Kwacha for poor quality of service

The Zambia Information and Communications Technology Authority (ZICTA) has fined all three mobile phone companies operating in the country a combined 5.4 million Kwacha, for the poor quality of service.

This is after AIRTEL, ZAMTEL, and MTN were found liable for failure to adhere to the quality of service guidelines, issued by the regulatory authority.

ZICTA Corporate Communications Manager, Ngabo Nankonde has confirmed the punitive measures in a statement to ZNBC news issued in Lusaka today.

Airtel has been fined 4.8 million Kwacha, while ZAMTEL has been fined 450,000 Kwacha and MTN has been fined 225,000 Kwacha.

Ms. Nankonde says the fines were imposed on the companies on August 26, 2020, and they have been given a period of 7 days in which to pay.

She has reiterated that ZICTA will continue to conduct quality of service inspections, adding that mobile service subscribers are encouraged to report any poor quality of service.

Oliver Saasa’s alarming statement about Mopani takeover by force by force is malicious and extremely worrying

Minister of Mines and Minerals Development Honourable Richard Musukwa has challenged stakeholders in the Mining sector to be truthful.

Mr. Musukwa says alarming statements by Economist Oliver Saasa that Government intends to take over Mopani by force are malicious and extremely worrying.

The Minister says Government is negotiating the way forward with Glencore on how best the state can buy shares which Glencore holds in Mopani Copper Mines.

He says Expropriation occurs when Government takes over property from private hands for the benefit of the people but this is not the case at Mopani.

“Negotiations are ongoing and dialogue has always been key, we cannot use force, we Govern based on the rule of law,” the Minister said.
Mr. Musukwa adds that the Ministry is in receipt of a letter dated 13th July 2020 from Glencore which clearly shows that talks have been on going.

“If Glencore wrote to us through ZCCM-IH and we responded how is that expropriation? The statement attributed to me in the daily tabloids by Professor Saasa is not true,” stated Mr. Musukwa.

He further said it is sad that an academician who is supposed to be professional has chosen to mislead the masses using falsehood.
Economist Oliver Saasa has accused Government of taking over Mopani using expropriation in some sections of the media.

FDD President Edith Nawakwi has declared that she will not apologise to UPND leader Hakainde Hichilema for calling him “a criminal who personally benefitted from the privatization programme.”

Mrs Nawakwi said she is ready to commit contempt of court on the matter should Mr Hichilema decide to sue her for defamation.

Ms Nawakwi, who was Finance Minister in the MMD government at the time of privatization of Zambia’s national assets, has insisted that no one is going to shut her up for demanding that Mr. Hichilema explains his wealth, which she alleges was due to his failure to declare interest during the privatization process, which saw him benefitting personally when he was engaged to serve the interests of government.

She said in an interview with Hot FM that no one was going to shut her up for calling Mr Hichilema a criminal.

“I don’t apologize to criminals, whether he is alleged or in fact under investigation. It will never happen now or in future,” Ms Nawakwi said in response to demands by Mr Hichilema, through his lawyer Mulambo Haimbe, that she retracts and apologises for calling his client a criminal.

The lawyer further made demands of $3 million from Ms Nawakwi for damage done Mr Hichilema’s reputation and legal costs incurred so far.

However, Ms Nawakwi has said she is prepared to commit contempt of court as she will not yield to any of the demands made.

“It will never happen now or in future. I am really excited that one Hakainde Hichilema wants us to unmask the myth of his so-called wealth. What he is doing is an attempt to create a High Court file and then once we try to comment, they say sub judice and contempt of court. I want him to know that we are prepared to commit contempt of court. No one is going to shut me up,” Ms Nawakwi vowed.

Shepolopolo Heading To South America For Friendly’s

Shepolopolo has secured two friendly dates away in South America against Chile.
Bruce Mwape’s girls will face Chile in Santiago on November 28 and December 1.

This will be Shepolopolo’s debut meeting against a non-African opponent and will be using the friendlies as preparations for their rescheduled 2020 Olympic Games Women’s football tournament campaign in Japan.

“We are happy to announce that we have organized a high profile match for our senior women national team with Chile. We believe that this will give the team a taste of high profile opposition as we will be flying the continent’s flag in Tokyo,” Football Association of Zambia General Secretary Adrian Kashala.

Chile have invited Zambia for the two friendly games to test themselves against African opposition before facing Cameroon in next February’s two-legged 2020 Olympic Play-off qualifier.

Last March, Shepolopolo beat Cameroon 2-1 in the final leg to qualify to the Olympics on away goals rule after 4-4 on aggregate result.

Ndola youth football Coach Brian Phiri says the recent formation of the Zambia Under-15 National Team should be centred on player development.

Chipolopolo U15 is scheduled to compete at the 2020 Eight-Nation Vlatko Markovic Invitational Tournament that Croatia will host from September 21-28.

Coach Chisi Mbewe’s side is also expected to participate in the proposed Cosafa U-15 competition later this year.

In an interview, Phiri, the coach and director of Madalitso Sports Academy, described the formation of the Under-15 team as long overdue.

“For the first time in history FAZ has done the right thing by forming the Under-15 National Team,” Phiri said.

At the Croatia tournament, debutants Zambia have been drawn in Group B against Romania, Bosnia and Herzegovina and North Macedonia.

“Let’s not focus on winning, we have to focus on building the best national team that we can send to the World Cup,” he said.

“Let them pick the players aged 13 or 14 and those players in the next seven or ten years to come will become good players,” Phiri said.

UPND is ready to bite the bullet and die for Mr Hichilema should PF arrest him-Mwaliteta

The UNITED PARTY FOR NATIONAL DEVELOPMENT in Lusaka through its provincial Chairman Obvious Mwaliteta has dared the Patriotic Front to go ahead with its suspicious plans to arrest President Hakainde Hichilema over the false allegations that he sold the country’s public assets.

In an apparent response to Forum For Democracy and Development leader, Edith Nawakwi, Mr. Mwaliteta said it was senseless for Ms. Nawakwi, who led the process as Minister of Finance, to concentrate on the privatization issue when the country was going through economic turmoils that require level-headedness.

He said there was no need for Nawakwi to continue barking over privatization when information regarding those involved in the issue was in the public domain adding that it was surprising to note that the opposition leader failed to provide such information to the task force instituted to investigate such issues under the Mwanawasa administration.

Mwaliteta has since warned that the UPND was ready to bite the bullet and die for Mr Hichilema should the PF proceed with arresting him as revealed by Information and Broadcasting Services Minister, Dora Siliya in a statement on Tuesday.

“If Ms. Nawakwi is looking for information on those responsible for the privatization of state parastatals, which she spearheaded as Finance Minister, she must check out the Report that was issued on the matter in 1999. And if you (PF) think that you will touch HH and that we will allow you, it won’t happen. We are ready to take the bullet”, said Mr Mwaliteta.

Meanwhile, the United Party for National Development in North-Western Province have pledged to stand with their leader Hakainde Hichilema on allegations being peddled against him by Forum for Democracy and Development leader Edith Nawakwi.

And the UNPD leadership in the province have accused the ruling Patriotic Front of hiding in FDD leader by peddling accusations that Mr. Hichilema sold national asserts about 27 years ago during the privatization era.

Speaking at a media briefing held at the UPND Secretariat in Solwezi, UNPD Provincial Chairlady Ireen Apuleni, Provincial Youth Chairperson Bruce Kanema, Provincial Information and Publicity Secretary Emmanuel Samampimbi, Provincial Chairperson for politics Hon Stafford Mulusa, and Provincial Chairperson Col Gladson Katambi(retired) vowed that they will not keep quiet and allow their party leader Hakainde Hichilema to be accused of things he did not even do.

The five top leaders say their leader is innocent and it is unfortunate for Ms. Nawakwi to peddle lies against him.

Col Glandson Katambi (retired) said that as a Party they want peace to continue in the country and accusations against their leader may bring chaos in the country.
Mr Katambi says the accusations will not disrupt their ambitions of mobilizing the party in readiness for the 2021 general elections.

Meanwhile, speaking earlier, UPND Provincial Chairperson for politics Hon Stafford Mulusa who is also Solwezi Central Member of Parliament urged party members not to lose focus because of lies being peddled against Mr. Hichilema.

“For me I don’t blame Edith Nawakwi, I blame the PF failures. It is PF which is using Edith Nawakwi” Hon Mulusa said.

“It is PF who wants to divert the people’s attention from real issues and we are not going to allow that. Nawakwi is a non-issue in this country and we all know where she is coming from” he added.

Honorable Mulusa said the privatization matter is not an issue to be discussed now because it is not worth discussing, adding that if it was an issue to be discussed, Presidents who have served before President Lungu would have taken interests in the matter a long time ago.

Hon Mulusa further said it is unfortunate for Edith Nawakwi and her sympathizers to question the UPND leader Hakainde Hichilema where he got his money from.
He has boldly said that Hichilema is a clean man with viable businesses in the country.

Hon Mulusa said Nawakwi has just been put in front to start the fight.

however, he says that Zambians have decided to vote for Hakainde come 2021.

“We have all agreed, including reasonable PF members in the Province. They are saying that come 2021, we are removing PF government in power” Hon Mulusa.

He further urged party members not to allow themselves to be distracted by Edith Nawakwi and the ruling Patriotic Front but set their eyes on the ball for victory in the 2021 general elections.

The public Must Use Point of Sale Machines for paying Fines and Other Traffic-related Offences-Kanganja

The Zambia Police has urged Traffic Police officers on the Copperbelt to sensitize the public on the importance of using Point of Sale machines for paying fines and other traffic-related offences.

Inspector General of Police Kakoma Kanganja says it is time that the Police service clears the bad public perception that it is corrupt.

He said this in Ndola during the rolling out of the use of point of Sale Machines on the Copperbelt, North-Western, Luapula, Muchinga and Northern Provinces.

Mr. Kanganja said the implementation of the programme means that the police service will have no contact to cash transactions, a development that will help clear the bad public perception about the service.

And Ministry of Finance Accountant General Kennedy Musonda said the rolling out of the use of the point of sale machines has taken away the temptation of possible corrupt practices by police officers.

He said the implementation of the machines is an important milestone that will also reduce audit queries in the auditor general’s report.

Meanwhile, Copperbelt Deputy Police Commissioner Boniface Namuswa disclosed that the Provincial Traffic division collects about 200,000 Kwacha per week from the general public.

He said the rolling out of the point of sale machines will effectively increase the collection of the much-needed government revenue.

Former Finance Minister in the MMD government Dr Katele Kalumba says Zambia has investigative wings of government capable of investigating the role UPND President Hakainde Hichilema played in the privatization exercise.

Dr Kalumba said the matter of Mr Hichilema’s involvement is of public interest and that answers ought to be provided to the questions from Zambians about the sale of state assets.

Dr Kalumba, who featured on Hot FM’s Red Hot Breakfast said the Zambia Police Service, the Drug Enforcement Commission and the Anti-Corruption Commission can handle the matter without unnecessarily spending additional resources on the investigation process.

He said he does not support calls to institute a Commission of Enquiry on the issue especially that Zambia has a number of economic issues required attention.

On the insinuations that government officials were sleeping during the privatisation process, Dr Kalumba said nobody was sleeping and “nobody was awake than others”, but emphasised that privatisation is a moral question that demands a “yes or no” answer.

When reminded that Mr Hichilema has decided to remain mute on the matter and instead is demanding $3 million from FDD leader Ms Edith Nawakwi who challenged him to explain his role during the privatisation programme and how he personally benefited from it, Dr Kalumba said the public has a right to seek Mr Hichilema’s answer as a government consultant.

He stated that government officials relied on the advice of experts engaged by the Zambia Privatization Agency and that consultants had a duty of care to protect the interests of the nation.

“Zambians are just demanding for answers from Mr Hichilema. No one is out to kill him. The questions are simple in the case of Intercontinental Livingstone Hotel, did he declare interest before advising the government on this transaction? If he didn’t, then it becomes a moral and possible criminal issue.”

Meanwhile, Deputy Chief Whip Tutwa Ngulube has said that UPND Leader Hakainde Hichilema has a duty to explain his role in the privatisation of national assets.

Mr. Ngulube said that Mr Hichilema has for years been calling on others to account for their actions and that it should not be difficult for him to do the same.

Mr. Ngulube said that if Mr Hichilema does not account for his actions, Zambians will have no choice but to take what Forum for Democracy and Development -FDD- leader Edith Nawakwi said as the truth.

Mr. Ngulube told ZNBC news in Lusaka that anyone who seeks public office should be ready to account for their sources of wealth.

He said accusing the Police of trying to arrest him is one tactic the opposition leader is trying to use to avoid responding to questions that have been asked by the FDD President regarding his role in the privatisation of national assets.

And, Nominated Member of Parliament Raphael Nakachinda says the government should be decisive and investigate if there was misconduct on the part of the UPND Leader when he took part in the privatisation of government assets.

Mr Nakachinda said that if serving Ministers can be made to account for their action by the Anti-Corruption Commission (ACC), Mr Hichilema should not be treated differently.

He told ZNBC news that Mr Hichilema will do well to offer an explanation so that the matter can be put to rest and has since commended government for releasing the financial intelligence Centre (FIC Report, adding that much as the report contains information, which is not fully investigated, its release shows that government is fighting graft.

Governmen’s Disaster Unit says it will empower RAMCOZ Retrenched Miners to alleviate their suffering

Disaster Management and Mitigation Unit (DMMU) National Coordinator Chanda Kabwe has said that Government will empower ex- Roan Antelope Coppermine Limited (RAMCOZ) retrenched miners and dozens of displaced residents of Luanshya as a way of alleviating their suffering.

Speaking when he paid a courtesy call on Luanshya Mayor Nathan Chanda at the Civic Centre, Wednesday, Mr Kabwe said Government was aware of the ex-miners’ suffering after the privatisation of the Coppermine by their former employer RAMCOZ.

The DMMU National Coordinator announced that plans were underway to empower the families who have been displaced in Luanshya’s Kawama area and those whose houses collapsed during the last rainy season in Roan’s Pama Church will be assisted with building materials, cement and roofing sheets.

Mr Kabwe explained that DMMU was working in close collaboration with the Offices of the Mayor and District Commissioner (DC) in Luanshya to come up with mechanism which will see to it that the examiners, who did not benefit from land were assisted and that the displaced and those who had their homes collapse were assisted with building materials to construct new homes in the quickest possible way.

Mr Kabwe, who also handed over assorted face masks to the Office of the Mayor and DC at the Civic Centre said Government was determined to see to it that all Zambians regardless of their status in society were reached and helped in preventing contracting Covid-19.

Luanshya Mayor Nathan Chanda thanked DMMU for the timely intervention aimed at addressing the plight of the displaced Kawama Township residents who became homeless after someone emerged and claimed ownership of their land on which they had built their houses.
He said some Roan residents whose houses collapsed during rainy season were assisted with lands to build their houses by the Luanshya Municipal Council but most of them lack building materials.

Mayor Chanda said the move by DMMU to work with the the authorities in Luanshya to empower the remaining former miners who were left out on the list of the Government donated farm land in Luanshya and other towns Copperbelt towns was commendable.

The City Father explained that the people of Luanshya were among the most affected victims of the mismanaged privatisation of the country’s mining sector.

He thanked President Edgar Lungu through DMMU which falls under the Office of the Vice-President for demonstrating commitment to address the plight of disadvantaged Zambians through the numerous donations to the people of Luanshya and the Copperbelt in general.

Luanshya District Commissioner (DC) Patrick Maipambe said government workers in Luanshya were committed to seeing to it that issuance of National Registration Cards target of 18,000 was achieved and so far, 10,000 have been issued in the district.

And DMMU has donated 50,000 face masks to Luanshya District with a call on resident to adhere to total compliance to Covid-19 regulations and the Public Health Act to prevent the spread of the deadly respiratory disease.

It was MMD Leaders Like Edith Nawakwi that Messed Up Privatisation

Ever since HH took the plunge into the murky waters of Zambian politics, he has had an albatross tied to his neck, threatening to drown him completely save for his boldness, courage and determination. Perhaps this is the reason why he stands out as a successful businessman and accomplished farmer amongst his peers. You gotta admire the man!

Going by the sentiments of many an electorate ‘pa ground’ disenchanted with the current state of affairs, the gates to plot 1 Independence Avenue seem to be wide open for the opposition. Shushushus tell the President the truth…………or maybe you’ve already done so, hence the sudden desperation on the part of those in leadership.

Anyway……….of the whole pack of individuals jostling to have a feel of the inside of State House including Edith Nawakwi herself, HH stands a better chance of dislodging Edgar Lungu from power. But instead of having been marketing herself to the electorate, Nawakwi elected to go to sleep. But now that the sweet aroma of State House is around the corner, Nawakwi suddenly staggers out of slumber and sleepwalks into a popular radio station and goes to town smearing the character of the UPND leader!

In the recent past, politicians of different hues and shades have taken turns to assassinate and impugn the character of HH – preaching to the gullible ones that he stole from government……..nay, sold the mines!

Nawakwi should be the last person to apportion the blame on HH for the botched privatization exercise. Privatization was a brainchild of MMD government where Nawakwi served as a senior cabinet minister – ascending to the portfolio of minister of finance at one point! They are the ones that stripped our nation of her prized possessions. As Francis Kaunda aptly puts it……….they gave away ‘the family silver’ due to selfishness and greed on their part!

A great man once said, “If you want to hide something from black people……put it in a book!”

I have just concluded reading ‘A Venture in Africa’ by Andrew Sardanis of the famed Chaminuka. The book candidly offers a rare glimpse of the shenanigans that panned out during the privatization programme. The name of HH doesn’t popup anywhere! You can even go to Chaminuka and ask Sardinis if you want, HH had a very limited role to play in privatization and now the likes of Nawakwi want to take advantage of the fact that many Zambians have no time reading books and mislead the people for political expediency. Don’t you have any sense of guilt or shame madam?

On page 228 of his book under the chapter “Ten Wasted Years” Sardanis reveals that one of Chiluba’s tactics was to bypass the Zambian Privatization Agency by appointing, in March 1997, a new team named ‘the GRZ/ZCCM Privatization Negotiating Team (PNP); under the chairmanship of Francis Kaunda (the erstwhile ZCCM chairman whom he had unceremoniously dismissed in 1991, before he even took the oath of office). Was HH a member of PNP? Nawakwi answer this question!

The book further goes on to disclose that by the end of 1997, Luanshya/Baluba mine was put under the hammer! Now this is where the plot thickens.

Bids for Luanshya/Baluba mine had been received and evaluated, and the Zambian Privatization Agency had started detailed negotiations with First Quantum before the so called PNP came on the scene. It’s clear even to a fool that PNP had ulterior motives! It demanded revised bids, as a result of which Luanshya was dubiously awarded to the Roan Antelope Mining Corporation (RAMCOZ) a new Zambian company owned by an Indian metal trader, Gokul Binani.

Fellow citizens you ought to read and read and read to grasp the depth of crooked of these former MMD leaders. Someone has somehow tipped Binani about the contents of the favourite bidders, First Quantum. Binani simply made adjustments to the First Quantum’s winning bid – this is how they presented it (with First Quantums bid in brackets): cash $35($34) million, new equity investment $21.7 ($20) million, commitment for new investment $69($70.4) million, contingent investment $103 ($26.3) million, ZCCM participation 15% (17.5%).

This proved to be a ‘neck to neck’ outcome, except for the very nebulous $103 million ‘contingent investment’ that Binani stuck to the tail of his offer. First Quantum was furious and threatened to sue the Zambian government! This was to be the genesis of woes for Luanshya mine.

The liquid problems at Luanshya surfaced soon after the RAMCOZ take over, amid rumours that that the copper proceeds were not being received regularly. But the government bent over backwards to keep it going, ordering ZANACO to grant additional facilities ignoring huge arrears. At one stage the government even contemplated diverting a World Bank facility intended for mineworkers’ retrenchment to RAMCOZ.

In the end ZANACO decided enough was enough and appointed a receiver which in this case happened to be Grant Thornton. Unfortunately, it was too late for this intervention. RAMCOZ was already looted to the core and what was left of it was a mere shell that no serious investor worth their salt would be interested in.

Ensure Government gets value for money on goods and services procured-President Lungu appeals to procurement officers

President Edgar Lungu has appealed to public procurement practitioners in the country to ensure that Government gets value for money on goods and services procured.

The Head of State noted that Government and other spending agencies procure goods and services in large quantities hence the need for procurement specialists to be responsible, prudent and professional as they expend public funds.

President Lungu said this when he met members of the executive of the Zambia Institute of Purchasing and Supply (ZIPS) during a courtesy call at State House on Wednesday.

This is according to a press statement issued to ZNBC news in Lusaka by President Lungu’s Special Assistant for Press and Public Relations Isaac Chipampe.

The President said there is need for both public and private procurement practitioners to adhere to prudent procurement practices.

“The nation is at a critical moment faced with inadequate funding in the midst of myriad competing needs hence the need for prudent public procurement in order for Government to attain the 7th national development plan and other development targets,” said President Lungu.

The President assured that Government is committed to ensuring that challenges in procurement are dealt with accordingly.

And ZIPS President Chibwe Mwelwa acknowledged the important role the public and private procurement plays in national development.

Mr Mwelwa appreciated President Lungu’s “Value for money” role for the procurement sector and called for serious inspection of procurement activities in all private manufacturing plants including mining companies to avert loss of taxes by the government.

He recalled that Government announced wide ranging austerity measures whose implementation and success depend heavily on the procurement process.

Zambia Institute of Purchasing and Supply (ZIPS) has since proposed to President Lungu to appoint a Permanent Secretary to be In Charge of Procurement as this will anchor the procurement function in Government and ensure that the public and private sectors add value to the nation’s economy.

Bishop John Mambo has said that the ruling Patriotic Front (PF )government must not be allowed to camouflage its failures using the tired narrative of accusing an innocent citizen whenever it is about election time.

Reacting to revelations made by FDD president Edith Nawakwi against UPND Leader Hakainde Hichilema, Bishop Mambo said that the accusation against Mr.Hichilema having amassed wealth during privatization has been recited time and again and yet no action has been taken against the accused.

“Surely if this not witch-hunt against a political opponent by those in government, then what is it?

“We do not think that it is right for government to join those throwing stones at a citizen who whose firm was hired to carry out the work as assigned to him by government,” he said.

Mambo added that it is therefore regrettable that the government, instead of clarifying the position, has decided to inflame the accusations against HH and the handling of the privatization process.

“It would appear as though this issue is a well calculated scheme than genuine concern by those in power.

“Those that come to equity must come with clean hands. While government officials are asking HH to account for his wealth and role in the privatization process, which is honestly a fair question, those calling for accountability must be reminded that they have not themselves explained to citizens how they suddenly become rich after assuming public office as soon as 2015,” he added.

He said in this regard, as Chikondi Foundation, challenge the head of state to explain to the public how he managed to grow his net worth from about 2.1 million Kwacha to about 22 million Kwacha within one year.

He added that it is his organization’s view that the President acquired his wealth while occupying a public office and naturally it would be within acceptable parameters to assume that the President acquired his wealth using a public position.

“We also call on Zambian citizens not to lose sight of the fact that those in national leadership are the ones responsible over national resources and assets and have a duty to inform citizens what plans they have to make their lives better.

“Dwelling on non-issues such as privatization will not b create jobs, put more money in the pockets of citizens and lower taxes as promised by the PF regime,” he added.

HH Demands 3 Million Dollars from Nawakwi for Defamation Over Privatization Claims

Opposition leader Hakainde Hichilema has demanded that Edith Nawakwi retracts and apologies within 24 Hours for calling him a thief and pays him 3 million dollars as compensation.

Mr Hichilema also wants the text for Ms Nawakwi’s apology to be approved by his lawyers Malambo & Co.

He also wants the FDD leader to put it in writing that she will desist from making the defamatory statements or any similar statements going forward.

“This details that our client has incurred and continued to incite great expense both locally and internationally in order to mitigate the harm that you have caused to him. Our client places the cost of the foregoing, which includes legal costs incurred thus far, at the conservative sum of US$ 3,000,000 which our client hereby demands from you. Our client is amenable to, receiving reasonable proposals as to how to intend to settle the said sum.”

RE: DEFAMATION OF CHARACTER – YOURSELF AGAINST MR. HAKAINDE HICHILEMA

The captioned matter refers. We, together with the law firms copied here, act on behalf of Mr. Hakainde Hichilema (“our client”) and have been instructed to write to you as we do below on his behalf. Kindly note our interest in that regard.

Background

  1. On 27th August 2020, you featured on a radio program entitled “the Hot Seat” hosted by Zachariah Chavula on Hot FM Radio Station which was also broadcast on Kwithu FM Radio Station (“the program”).
  2. It is our understanding that the above mentioned radio stations enjoy immense and widespread coverage in Zambia and beyond, not only by reason of the radio broadcasts they transmit, but also because of the internet and other platforms via which their signal and broadcasts can be monitored from anywhere in the world.
  3. Our instructions are that during the program, and subsequently thereafter on other forms of media including Zambia National Broadcasting Corporation Television, you made false, malicious and defamatory statements (“the defamatory statements”) against our client whose aim, purpose and effect was, inter alia, to expose our client to hatred, contempt and ridicule; to embarrass him in the eyes of the general public; to lower our client’s reputation in the estimation of right thinking members of society; to cause him to be shunned and avoided; and generally to create an impression in the minds of the global community, given our client’s international repute as a businessman and politician, that our client is a thief and/or a person of miscreant behaviour who does not respect the rule of law or deserve to hold public office as President of the Republic of Zambia, for which our client aspires.
  4. Consequently, our client has suffered irreparable damage to his reputation, severe embarrassment, harassment, hatred and ridicule in respect of which our client has instructed us to seek reparation from you as we do here below.
    Particulars of defamatory statements
  5. Without limiting the generality of the foregoing, and whilst our client’s right to make any or any further claim against you, in relation to your recent conduct towards him remains fully reserved, our clients instructions are that the defamatory statements were to the effect that:
    1. Our client is or was at the material time a criminal;
    2. Our client involved himself in theft and corruption by alienating a house located on Serval Road in Kabulonga, Lusaka (which you purport belonged to Lima Bank) to himself as liquidator of that institution;
    3. Our client involved himself in undisclosed illegality regarding the receivership of RAMCOZ; and
    4. Our client abused the privatization process in general and in particular with regard to the transaction for the sale of the assets of Mosi O Tunya Intercontinental Hotel in Livingstone and related assets which you allege that our client “sold to himself”.
  6. As alluded to above, the allegations contained in the defamatory statements are devoid of any truth. They are malicious and aimed at damaging our client’s hard earned reputation as an astute businessman, as a person worthy of holding office as President of the Republic of Zambia and as a law abiding and God fearing citizen of Zambia, and the world at large, quite aside from being a clear violation of his guaranteed human rights.
  7. The defamatory statements were made without due regard for the true factual position regarding the subject matter thereof and in contumelious disregard for the law.
    The allegation that our client is a common criminal
  8. As you are aware, our client does not have any criminal record nor has he involved himself in any criminal activity. Should you fail to meet our client’s demands below and should this matter proceed for determination by a Court of competent jurisdiction, you will be put to strict proof on that allegation. Allegations relating to acquisition of property on Serval road in Kabulonga
  9. Contrary to your false and malicious allegations, our client has never been a liquidator of Lima Bank nor has he ever purchased any property from Lima Bank in liquidation or otherwise.
  10. Had you cared to take keen interest in events as they truly transpired, it would have come to your knowledge that while the Lima Bank liquidation commenced in 1997, the property in issue was acquired by our client in 1995 a good two years prior to the commencement of the liquidation process. Cleary your allegations are false and malicious in that regard.
  11. Your allegation to the effect that our client involved himself in theft and corruption is therefore baseless and a purely malicious falsehood.
  12. In any event, it is trite that any citizen is entitled to buy leasehold property in Zambia together with any unexhausted improvements thereon. Our client is no exception.
  13. Had you exercised even the barest precaution in discharging your duty of care towards our client, you would have conducted a search at the lands and deeds registry to ascertain the true position before uttering the defamatory statements.
  14. You may be aware of the age old principle that he who alleges must prove.
    Allegations relating to the Receivership of RAMCOZ
  15. You are aware, and the records will show, that our client was never involved in the privatization of RAMCOZ which was sold by Government to the Binani Group of India in 1997 for a consideration of
  16. Subsequently, upon failing to meet its financial obligations to ZANACO, RAMCOZ was placed under receivership in 2000. The appointed receiver manager was Mr Christopher Mulenga and not our client.
  17. The receivership process was undertaken in accordance with the law and reports rendered to the appropriate stakeholders. Our client is not aware of any criminal complaint having been made against the receiver manager, Mr Christopher Mulenga, in relation to the receivership.
    Allegations relating to abuse of the privatisation process
  18. All records relating to the sale of the assets of Mosi O Tunya Intercontinental Hotel in Livingstone and related assets are a matter of public record and will show that, in so far as our client played any role in that process, he did so within the confines of the law.
  19. Moreover, we are aware that the Zambia Privatization Agency (“ZPA”), and ultimately Government, like any other seller in a transaction for the sale and purchase of assets, is obligated to, and did, conduct a due diligence exercise on all potential buyers of privatization assets.
  20. The foregoing therefore entails that at all stages of the transaction for the sale and purchase of the privatization assets, the ZPA was fully informed on all material particulars of potential buyers, especially such material particulars as were already in the public domain.
  21. You may also wish to note that the sale of Mosi O Tunya Intercontinental Hotel and related assets to the successful bidder has greatly benefited the people of Zambia as it is one of the few success stories of the privatization exercise, contrary to the innuendo created by you in the defamatory statements.
  22. Your allegations of improper conduct on the part of our client (to the alleged detriment of the people of Zambia) are, despite their malicious venom, therefore baseless both in law and in fact.
    Particulars of harm caused to our client (inter alia)
  23. Irreparable damage to our client’s reputation given that you purported to make the defamatory statements from an informed position in your capacity as a former Minister of Finance worthy of being believed on that score.
  24. Aggravated damage to our client’s reputation owing to the malice and venom with which the defamatory statements were made and published to a global audience of several million people.
  25. Mental distress, anguish and torture.
  26. A stain on our client’s candidature for President of the Republic of Zambia in so far as the defamatory statements cast aspersions against our client to the effect that he is not a fit and proper person to hold the highest public office of the land.
  27. Harassment at the hands of overzealous state operatives that have declared their intention to maliciously prosecute our client on the back of your defamatory allegations as evidenced by the press statement recently issued by the Chief Government Spokesperson to that effect.
    Our client’s demands
  28. Our instructions are therefore to demand the following:
    1. A detailed and unreserved retraction and apology from you to be published in like manner and with equal prominence to the defamatory statements, the text of such retraction and apology to be approved by us;
    2. That you undertake in writing to desist from making the defamatory statements or any similar statements going forward.
  29. While our client recognizes that your actions have caused him irreparable harm that cannot be atoned for in monetary terms, you will note that he has been put to great expense and inconvenience on account of your conduct.
  30. This entails that our client has incurred and continues to incur great expense both locally and internationally in order to mitigate the harm that you have caused to him. Our client places the cost of the foregoing, which includes legal costs incurred thus far, at the conservative sum of which our client hereby demands from you. Our client is amenable to, receiving reasonable proposals as to how you intend to settle the said sum.
  31. 31. Our client’s rights however remain fully reserved.
  32. Save as stated in paragraph 30 of this letter, our client further demands, in view of the pressing nature of this matter, that you address his demands within 24 hours hereof, that is to say by no later than Thursday 3 rd September 2020, failing which our client will be constrained to take out proceedings before an appropriate forum so as to protect his interests.
  33. Should our client be forced to do this, it will be without further recourse to you and at your cost.
  34. Kindly note that owing to the public nature of your actions towards our client, we have been instructed to, and do hereby, avail a copy of this letter to the media for their information by way of a press statement.

Zambia U15 Receive Group Draws For Croatia Tournament

Chipolopolo U15 know their group stage opponents at the 2020 Eight-Nation Vlatko Markovic Invitational Tournament that Croatia will host from September 21-28.

Tournament debutants Zambia have been drawn in Group B against Romania, Bosnia & Herzegovina and North Macedonia.

Chisi Mbewe’s side will face North Macedonia in their first game on September 23 followed by Bosnia & Herzegovina and later play Romania on September 25.

Playoffs for the bottom two classifications for the tournament will be played on September 27.

Group runners-up will play for bronze while the leaders will meet in the final.

Chipolopolo coach Micho has helped overseeing the regional selection process over the last two weeks.

The invitation is part of the Memorandum of Understanding signed between FAZ and the Croatia Football Association headed by 1998 FIFA World Cup star Davor Suker.
