Ex-Kitwe DC Adds Voice to Miseshi Stadium Land Saga

Immediate past Kitwe District Commissioner Binwell Mpundu has warned against the planned selling of the land housing Miseshi Stadium in Mindolo, Kitwe.

Uncertainty has surrounded the future of Miseshi Stadium, which was previously owned by ZCCM, as the private owner seeks to sale the land housing this sports infrastructure.

Currently, FAZ Copperbelt Division 1 side Miseshi Blue Stars are using the same stadium as squatters.

“Let us all get involved in helping resolve this impending sale because the consequences may be dire. My appeal to the local authority and the Stadium owner is to sit down for a win-win situation as the stadium remains the only facility in Miseshi used for recreation and recreation,” Mpundu posted on his face book page.

“When I was serving as DC for Kitwe myself and Mayor Christopher Kang’ombe had a meeting with our elder brother Mr Chibwe who had initially entered into a transaction to buy Miseshi Stadium from the original owner who bought the stadium from ZCCM.”

“The agreement from the said meeting was that the local authority may have to enter into an agreement to find alternative land for the owner of the stadium who had intentions of turning it into a garage for trucks so that the stadium then can be owned by the council,” Mpundu said.

“I am therefore disturbed to learn that plans to sell the stadium have advanced owing to the fact that Mr Chibwe backed off from the transaction noting the community interests in the matter,” he said.

Miseshi Stadium was once the home of defunct Mindolo United – a club that groomed past stars Peter Kaumba, Brighton Sinyangwe and John Kalusa among them.

“We should also be reminded that this facility has produced great men and still remains a reservoir for talent especially football,” Mpundu added.

About 4,268 visitors accessed the Victoria Falls during Heroes and Unity holidays, the highest number ever recorded.

Livingstone Tourism Association Board Chairperson Rodney Sikumba said Sunday and Monday received 1,948 and 1639 respectively.

Mr Sikumba said the Livingstone Museum and the Mosi-oa-Tunya National Park had impressive numbers of 900 and 2,800 respectively.

“We the Livingstone Tourism Association would like to express our sincere thanks and gratitude to the people of Zambia that chose Livingstone as the No.1 Holiday Destination over the just-ended Heroes and Unity holiday period,” Mr Sikumba said.

Access Bank seeks to buy off Cavmont Capital

Access Bank Zambia Limited has announced that it has entered into exclusive discussions with Cavmont Capital Holdings Zambia Plc regarding a potential transaction between Access Bank Zambia and Cavmont Bank Limited.

The potential transaction relates to the sale of 100% of Cavmont Capital’s interest in Cavmont Bank to Access Bank Zambia.

In a statement from Lagos, Nigeria, Access Bank says there can be no certainty that a transaction will be agreed, nor as to the terms of any such agreement.

“The completion of a transaction would be subject to formal regulatory approvals. Access Bank will update the market as appropriate and in accordance with its’ disclosure obligations. Accordingly, shareholders are advised to exercise caution when dealing in Access Banks securities until a full announcement is made.”

Zambian fintech startup receives $1-million investment

Lupiya, a Zambian based microfinance startup has received an investment of $1-million from Enygma Ventures, a US venture capital (VC) fund.
Founded in 2015, Lupiya is an online marketplace for microloans.

It is a branch-less, innovative digital microfinance platform that leverages technology to make the process of borrowing simpler and easier so that people and businesses located across the country even in rural, remote areas can access financial services.
Loans are tailored to either personal, business, or for women.

The investment will enable Lupiya to further its goals in fostering financial inclusion through its service offered, with a focus on ensuring women are able to participate in the economy through its financial inclusion strategy.

The fintech startup is working hard to close the gap and provide access to financial services to all.

Evelyn Kaingu, CEO and co-founder of Lupiya expresses her excitement on receiving the investment.

“We are thrilled with this investment, it has come at the right time in the interesting financial climate many businesses are experiencing as a result of the Covid-19 pandemic,”

Statistics have revealed that an estimated 70% of Zambians do not have access to formal financial services due to lacking the necessary collateral required to secure a loan.

Lupiya’s goal is to provide this 70% of Zambians access to financial services by 2022.

Health Minister’s Corruption Case fails to take of as PF cadres Jam the Court Room

Minister of Health Chitalu Chilufya has appeared before the Lusaka Magistrate Court but could not take a plea. This was after Chief Resident Magistrate Lameck Mwale adjourned the matter due to unruly supporters who wanted to enter the court to offer solidarity to Dr. Chilufya.

Patriotic Front Structures and Members of Parliament had crammed the premises in the early hours today to offer solidarity, but the courtroom could not accommodate all, prompting others to wait outside.

Dr. Chilufya, who is also Mansa Central Member of Parliament, was accompanied by Chief Kalasa Mukoso of the Nakabende people of Samfya District, Chief Lukangaba, Chief Kalaba, and Chief Mibenge, some Members of Parliament as well as PF party members.

Dr. Chilufya is charged with four counts of corruption.

It is alleged that Dr. Chilufya was found in possession of property suspected to be proceeds of crime which includes 6 thousand shares in Samfya Marines and Tourism services Limited, Spark Guest House situated in Mansa among others.

After an investigation by the Anti-Corruption Commission, he was arrested and charged on June 24, 2020. The plea has been adjourned to July 16th, 2020.

The courts have since adjourned the matter to next week for the possible plea.

The Minister who was in high spirit being represented by Tutwa Ngulube and Jonas Zimba received blessings from traditional leaders and well-wishers as he left the court grounds.

People Declaring “No Go Areas” Should be Arrested for Breaching Article 22 of the Constitution-CiSCA

CiSCA Statement on the Possible Breach of Article 22 of the Constitution

The Civil Society Constitution Agenda (CiSCA) is greatly concerned with the non-arrest or censure of people declaring “No Go Areas” for fellow citizens contrary to the provisions of Article 22(1) of the Constitution of Zambia. Under this Article, all citizens of Zambia are free to move and reside anywhere in Zambia, and leave and return to Zambia freely and willingly without interference.

It is disturbing that despite this clear provision in the supreme law of the land, the Zambia Police Service have remained mute, unmoved, and unaffected by such public utterances.

Soon, the country may start witnessing political fights and violence in the so-called no-go areas for others as happened in Chingwere Cemetery in Lusaka yesterday, on 8th July 2020. The police will be overwhelmed with such incidents while hiding under the guise of “still investigating the matter” yet the instigators were left untouched and walking the streets freely.

The trend now emerging of police not touching ruling party officials breaching the law unless commanded or ordered to do so is clear display of the extent of the capture of the institution and the levels of partiality and selectivity in the application of the law. CiSCA calls on the police to be more impartial in the application of the law and arrest those that have openly declared certain areas No go areas for certain citizens in this country contrary to the law before lives are lost.

The declaration of no-go areas by some people associated with the ruling party is divisive and an Act of lawlessness and must be condemned in strongest term possible. We call on the Electoral Commission of Zambia (ECZ) to condemn this unconstitutional declaration of certain places as no-go areas for some citizens, as this has potential to skew the electoral playing field.

Further, some party officials and political commentators’ misunderstanding and misinterpretation of booing of elected political leadership as disrespectful instead of as a form of freedom of expression of dissatisfaction against an elected leader is extremely amazing.

Almost all presidents in Zambia, including the current one, were at some point booed by people when the people got fed up with their leadership deficiencies. It is for this reason that CiSCA finds it difficult to appreciate the hullabaloo that has associated the Monze booing of President Lungu. We also find the demands for apologies for the people of Monze to be misplaced, baseless and unfounded.

UPND Member Ackson Sejani says the opposition party will campaign in any part of Zambia and engage ruthlessly with anyone that will take the party on.

Mr Sejani says the UPND is no longer a minority party who must be intimidated by a few empty tins making noise.

He said the booing of President Edgar Lungu in Monze is the stuff politics is made of.

Mr Sejani said if the PF cannot stand this heat and the coming heat then they must throw in the towel and surrender.

“We have had enough of this nonsense”, he said adding that the Monze episode was good.

Mr Sejani said no stone was thrown but only a party symbol was flashed even after the most extreme of provocations, that of tearing down UPND bill boards, chitenges and other regalia.

He said the UPND only flashed their symbol.

“Contrast this with stones that fly when HH is on radio in some parts of this country. Compare this to the scenes that forced HH to scale the roof of a radio station in Ndola to escape lynching by armed PF thugs. Compare this to the scenes that saw Kambwili almost being hounded out of a radio station in Kabwe. Recall the scenes when PF hooligans almost dropped our chopper in Chinsali”, he added.

Mr Sejani said in all these incidents and many others, there has never been a voice of condemnation from PF Leaders and their clergy.

LAZ is compromised and reduced itself to an appendage of a legal department of a political party

Last week, The Constitutional Court dismissed a petition by the Law Association of Zambia -LAZ to have the Constitution Amendment Bill Number 10 of 2019 withdrawn from Parliament.

The Constitutional Court ruled that the petition by LAZ lacked merit because they did not show how Justice Minister Given Lubinda breached constitutional procedure when presenting Bill 10 to Parliament.

The Constitutional Court said it can not intervene in the matter as the arguments by LAZ did not show how the mandatory formalities as prescribed in Article 79 of the constitution, were offended by Bill 10.

LAZ was seeking a declaration that the government’s decision to amend the Constitution in the manner set in Bill Number 10 of 2019 is illegal.

In case you didn’t know, LAZ is an architect of Bill 10, they were the key participants at the National Dialogue Forum-NDF which came up with Bill 10.

In fact LAZ even warned political parties and all the citizens not to shun the Constitution-making process initiated by the NDF.

The question is why has LAZ u-turned; why is LAZ, which is supposed to be the crime-de-la-cream on legal matters taking USELESS and FRIVOLOUS petitions to court; Why is Mr Eddie Mwitwa and SOME of his colleagues at LAZ wasting the court’s time challenging Parliament to stop debating Bill 10 when they fully know that no one, not even the Court can stop parliament from passing Bills and enacting Laws?

You don’t need to be a lawyer, you don’t need to know Civics, in fact you don’t have to study SHOSHO STUDIES for you to understand that it is the right and constitutional mandate of Parliament to make laws.

Parliament ni Nyumba ya Malamulo, it is Ing’anda Ya Mafunde. The primary objective of parliament is to make laws. This is what the Republican Constitution says in Article 62:

1. The legislative authority of the Republic is vested in and exercised by Parliament.

2. A person or body, other than Parliament, shall not have power to enact legislation.

And Article 63 of the Constitution seals the argument, it says:

Parliament shall enact legislation through Bills passed by the National Assembly and assented to by the President.

And LAZ like everyone else knows that the Courts have ruled and ruled again on this matter; there is sufficient Case Law that has repeatedly stated that no one, not even the Courts can stop parliament from conducting its business. Examples of these rulings include the court judgments in the following cases:

  1. Nkumbula v Attorney General where the Court of Appeal had occasion to pronounce itself on the propriety of challenging proposed amendments to the Constitution.
  2. Hem Chandra Sengupta & Others v The Speaker of the Legislative Assembly of West Bangal & Others in which some parties sought to restrain the Chief Minister from pursuing a resolution approving the union
    of two States as well as to restrain the Union of India from bringing or initiating any bill or legislation in parliament for purposes of uniting the two States
  3. Re: Nalumino Mundia where the High Court was moved to quash the decision of the Chairman of the Standing Orders Committee to suspend a Member of Parliament from the National Assembly.

In all these cases, It was held that the court did NOT have the power to interfere with the exclusive jurisdiction of the National Assembly in the conduct of its internal proceedings.

The Courts ruled that Parliament enjoys exclusive cognizance over its internal proceedings. Hence, the Courts cannot interfere with the internal affairs of Parliament which it enjoys or has the Constitutional mandate or authority to legislate.

Clearly, even my grandmother in the village knows that it is the duty of Parliament to pass Bills and enact Laws so why could LAZ, of all institutions, embark on a vexatious and futile exercise to petition the Court to stop parliament from debating Bill 10 when they fully know that such a demand is unattainable at law?

The answer is simple, LAZ is compromised and it has reduced itself as an appendage of a legal department of a known opposition political party.

LAZ must redeem itself and recommit to its core values of being a professional corporate body as established in Act Chapter 47 of the Laws of Zambia and stop being used as a door mat of an opposition political party. Zambians want LAZ to be the torch-bearer of justice and the rule of law and not to reduce itself to a vuvuzela of an opposition political party.

Lastly, let LAZ elect a new Executive since the mandate of the current one expired a long time back. LAZ should be an example to all of democracy and good corporate governance.

President Lungu alive to Challenges facing growth of the creative arts industry

PRESIDENT Edgar Lungu is alive to the numerous challenges hampering the growth of the creative arts industry in the country.

Information and Broadcasting Services Minister Hon Dora Siliya says this is why the Government announced the setting up of a K30 million revolving fund for those in the sector.

Ms. Siliya says Government is currently working out modalities on how the K30 million will be disbursed to various artists across the country.

She says if well harnessed and supported, the creative arts industry has potential to create employment for many people especially the youth.

Ms. Siliya said this during a meeting with the Film Makers Guild of Zambia at her office in Lusaka today.

The Minister called on the private sector to join hands with Government in revamping the creative arts industry by offering financial support.

She said there was need for Zambian financial institutions to take a chance on Zambian filmmakers by coming up with financial products that would help spur the growth of the industry.

Ms. Siliya said in countries like India and Nigeria where the sector is a huge contributor to their Gross Domestic Product, financial institutions have played a center-stage role.

“There is need for all Zambians to come together and work on improving the film sector because this is a hanging fruit with potential to grow our economy,” she said.

Ms. Siliya noted that while Government has a responsibility to facilitate the promotion and growth of film in the country, filmmakers have an equally important role to play in telling the Zambian story.

“There are a lot of stories that you can tell about Zambia. We are tired of hearing stories about politicians, you have to think outside the box so that people can easily relate with their everyday life,” she said.

Ms. Siliya said as long as people do not accept the need to watch locally produced content, the industry will continue to face challenges of financing.

She challenged artists to organize themselves and avoid working in isolation for the growth of the industry.
Ms. Siliya said Government has built studios in all the ten provinces of the country in order to reduce the cost of production for artists.

Meanwhile, Information and Broadcasting Services Permanent Secretary Amos Malupenga advised artists not to despise humble beginnings.

Mr. Malupenga said artists should not feel discouraged when they have little capital but instead work harder in order to grow their businesses.

“You have to start from somewhere, all businesses start small. All you need is to have an idea, you need so little to make so much,” he said.

And Filmmakers Guild of Zambia vice president Chala Tumelo said the guild is ready to work with Government through intervention such as the formation of a positive economic relationship between film makers, advertisers and broadcasters.

Mr. Tumelo also stressed the need for capacity building for broadcasters to acquire local content using more profitable and sustainable models.

Speaking at the same meeting, a local film maker Wycliff Mwamba cited lack of financial support as one of the factors limiting the growth of the country’s film industry.

He said despite having good local content, many filmmakers were failing to make it in the sector due to unavailability of film tailored products on the financial market.

Medical Stores to separate from IDC

Medical Stores Limited is set to separate from the Industrial Development Corporation (IDC) and will be transformed into the Zambia Medicines and Medical Supplies Agency.

Medical Stores is one of the 29 State-owned Enterprises that were transferred to IDC in 2015 to be turned into profitable commercial enterprises.

However, IDC Group CEO Mr Mateyo Kaluba said after undertaking initial analysis of the companies, the mandate of Medical Stores did not resonate with that of the IDC.

“Its mandate is the procurement, storage and distribution of all essential drugs for Zambia’s public health sector, which is considered a public good. In that regard, that mandate could not synchronize with the mandate of the IDC,” he said, in remarks made on his behalf by IDC Chief Portfolio Officer Mr Henry Sakala at the inauguration of the new Medical Stores Board last Friday.

Mr Kaluba said, considering the mandates of the IDC and Medical Stores were at variance, it necessitated the separation of the company from the IDC and its conversion into a government agency.

With the passing of the Zambia Medicines and Medical Supplies Agency Bill of 2019, Medical Stores will be established as the Zambia Medicines and Medical Supplies Agency under the auspices of the Ministry of Health.

A new Board has since been constituted, whose key mandate is to ensure the successful transition of Medical Stores into the new Zambia Medicines and Medical Supplies Agency.

The new Board comprises:

• Mr James Kapesa (Vice Chairperson)
• Mrs Lizzie Mukwasa
• Mr Mulenga Muleba

UPND is the most violet political party in Zambia’s democratic history-Siliya

The PF Government has described the UPND as the most violent political party in the history of Zambia’s multi-party politics.

Chief Government Spokesperson Dora Siliya says the UPND has failed at every opportunity to condemn violence as evidenced by their Leader Hakainde Hichilema’s silence on the Monze Incident.

Ms. Siliya has since condemned the behavior of UPND cadres who booed President Edgar Lungu on his visit to Monze to launch newly built housing units for the Zambia Correctional Service.

She has since urged the security wings not to spare anyone that will be found harassing citizens for going to or passing through the Southern Province.

Ms Siliya has wondered why the UPND saw something wrong with President Lungu’s visit to Monze and decided to send cadres to jeer at him.

She said in a statement that despite Zambia being a democracy and Citizens have the right to freedom of expression and protest, this must be done in a respectful manner.

The Zambian presidency has been caught up in an embarrassing photo scandal after it admitted to using stolen photos and posting them on President Edgar Lungu’s personal Facebook page.

President Lungu had posted a photo showing works on the Mazabuka road which later emerged that they were stolen from Nigeria and President Lungu had to apologize and posted fresh photos.

The new photos were also detected to have been used by an Ethiopian road project in 2019, a situation which sent some social media users in Zambia in over drive to check the authenticity of other photos sitting on both the State House and President Lungu’s social media pages.

It was later discovered that another photo which President Lungu posted to depict the success of the Aquaculture project was also stolen.

Former State House Spokesman Dickson Jere has since called for the sacking of those responsible for managing President Lungu’s Facebook page.

“I rarely comment on the work of State House – media team – because I once served in that role and I understand the pressure and difficulties that come with those jobs. However, certain mistakes can never be forgiven. One such is this one where the Presidential handlers used picture of road construction from another country saying it was in Zambia! Just how?”

“State House has two full-time photographers backed by ZANIS team. How can one embarrass the Head of State in this manner and still keep the job? My brother Isaac Chipampe ought to be firm and make sure those running the Facebook page of the President are read a “riot act”.”

“My comment is actually triggered by the fact that I am a practicing Intellectual Property (IP) lawyer and one of the things we frown upon badly is plagiarism!”

He added, “You cannot use someone’s work without attributing it to the author. What if Zambia is sued???? This is embarrassing to say the least and will soon go viral on the international press. We need to respect the office of the President and maintain the required decorum.”

Mr. Jere said using someone’s picture from another country is simply unforgivable.

Patson Basks in Club Award Win

Patson Daka says the RB Salzburg 2019/2020 club player of the season award is deserved.

Patson took 69 percent of the popular online poll for the clubs’ player award after beating three other contenders.

The Chipolopolo striker’s 24 goals this term helped Salzburg retain the Austrian league title for a seventh successive season.

“It is always an honour and it means that people are recognizing my hard work and I am just humbled to be recognized. Whatever comes, all glory to God, so I think it is something that I deserve and it hasn’t come by mistake,” Patson said.

Did the PF sponsor the citizens? Did the PF apologize on behalf of the people?

With all the corruption and bad governance what does President Lungu expect from the citizens. Does he surely expect people to be throwing roses at his feet wherever he goes. If the Presidential handlers are lying to Mr Lungu that things are okay in the country and people love him, then he is headed for bigger shocks. This is the time for self introspection for the PF government, not time for making empty threats.

Martin Luther King Jr once said “The oppressed people cannot remain oppressed forever. The yearning for freedom eventually manifest itself.”The PF government has ruled this country using intimidation, oppression and suppression. The people of Zambia have not been a chance to speak or protest against bad governance. The angered is building up in citizens. Soon tempers will start Poppin up like popcorns because citizens have been pushed in the corner and they have nowhere to go anymore except to push back. Recently we saw youths in Lusaka protesting in the bush because they are sick and tired of the PF government stepping on their freedom of expression. This is what happened in Monze, it was the protest of the oppressed people. People who can no longer be allowed to express themselves freely in their own country.

PF has failed and citizens are free express their displeasure in a peaceful manner. We as Party shall not succumb to intimidations from the outgoing government. We also want to put it on record that we have no money to pay the people Zambia to rise against PF, the citizens are being incited by hunger and arrogant, corrupt and greedy individuals in government.

We shall overcome our oppressors and one day freedom is coming to Zambia. God bless the beautiful of Zambia.

Damiano Ready to Dialogue With FAZ

Banned football administrator Damiano Mutale has indicated that he is ready to dialogue with FAZ president Andrew Kamanga over FIFA’s threat to ban Zambia due to third party interference in the running of football affairs.

The controversial ex -FAZ member Mutale filed an injunction in court against FAZ in March over the legality of the 2020 FAZ electoral process.

However, FIFA has in a letter dated June 30, advised all parties to ensure the injunction that halted the FAZ elections be withdrawn from courts.

“FIFA has not addressed the letter to me. The letter has been addressed to Andrew Kamanga so it is up to him to call for a meeting,” Mutale said from the Copperbelt.

“Kamanga has changed the constitution and they also do not want other people to contest elections. All these issues are centered on Kamanga,” said the Director of Mufulira’s Damiano Academy.

“Withdrawing the court case is not a problem what we want is for Kamanga to call us for a meeting so that we can sort out issues. We are ready to sit down and dialogue,”

In a letter to FAZ dated June 30, 2020, FIFA warned that all concerned parties must withdraw the case and situation normalized from ten days of the date or Zambia will be banned after July 10 from all international engagements.
