Government grabs a hammer mill from persons with disabilities

THE Government has repossessed a hammer mill from persons with disabilities in Kabwe after they failed to utilise it for the intended purpose.

The hammer mill was donated in 2013 with the aim of assisting the disabled in income generating activities. However, the machine has not been used and it is currently in an insecure place leaving the Government with no option but to withdraw it.

Kabwe District Commissioner Patrick Chishala said when he made an impromptu visit to the site where the hammer mill that he was disappointed with the situation.

“I am disappointed that you people have failed to utilise this hammer mill and it’s not even secure here, I am withdrawing it with immediate effect. You will have to submit strong reasons why Government should not give it to other groups that need support’, Mr Chishala said.

He warned that all other groups who received equipment through the Government empowerment programmes would be visited to establish if the machines were being used to improve their welfare.

Mr Chishala wondered why the group did not get back to his office to engage him on the challenges they were facing to ensure that the hammer mill was utilised to their benefit.

“During the hand over at my office you people assured me that the equipment was going to be operational in Kasavasa.

“However, I later came to learn that the hammer mill was in Highridge and I began to worry and suddenly I learnt that it is in Lukanga where we have found it,” he said.

He was not happy that people did not care that the Government resources were going to waste when there are people out there needing such empowerment.

Meanwhile Kabwe Disability Business solution chairperson Godfrey Mulenga charged that they were duped by some organisation that promised them land at the time of hand over of the machine in 2013.

Mr Mulenga said the withdrawal of the land earmarked for the hammer mill in Kang’omba frustrated the whole plan leading to the current situation.

“There was an organisation that was dealing in disability issues, so they assured us of land in Kang’omba but there was a controversy over that piece of land in the whole of 2013.

“The owners grabbed it from that organisation which forced us to start looking for an alternative
land,” he said.

CEEC to setup 90 new factories in 42 districts

THE Citizens Economic Empowerment Commission (CEEC) is set to finance the setting up of 90 new factories in 42 districts across the country.

CEEC director general Likando Mukumbuta said the decision was aimed at promoting diversification and providing a strong foundation for industrialisation in Zambia.

Mr Mukumbuta said in an interview that the factories would be involved in the manufacturing of various products.

“We are excited about the National Budget because it will help us with our aim to spur industrialisation in Zambia. We are going full scale in setting up the new factories in 42 districts,” he said.

Mr Mukumbuta said the Budget announcement by Finance Minister Alexander Chikwanda last Friday would help in wealth creation because it focussed on economic diversification.

He said the Budget provided opportunities for his organisation to boost growth of upcoming industries.

Mr Mukumbuta said small and medium enterprises had been offered opportunities for growth because the budget focussed on economic diversification.

Meanwhile, MMD Chilanga Member of Parliament Keith Mukata has said that the National Budget was a robust one that focussed on economic diversification from copper.

Mr Mukata who is also Justice Deputy Minister said economic diversification was long overdue and the economy needed to refocus on agriculture and rekindling the small medium enterprises.

He however, noted that the onus was on Zambians to participate in economic diversification.

“We need to match the talk by all of us doing our part. We need to diversify the economy because that is the way to go,” Mr Mukata said.

He said he was happy that the National Budget had given incentives to the agriculture sector because for Chilanga district had huge
potential for agriculture.

GOVERNMENT has summoned millers to justify why they have gone ahead to increase the price of mealie-meal despite an assurance that they would not.

Minister of Agriculture Given Lubinda said in an interview in Lusaka yesterday that although Government would not dictate the price of mealie-meal, millers should justify why they have gone ahead to increase the price of the commodity before discussing the proposal.

“I have summoned millers to my office and we are having a meeting tomorrow [today] so that they can explain why they have gone ahead to increase the price of mealie-meal.

“We have indicated that Government will not dictate the price of mealie-meal because it is running a liberal economy, but we want the millers to explain why they have increased the price of the commodity before giving satisfactory reasons,” Mr Lubinda said.

He said Government is not satisfied with the reasons that the millers have given to increase the price of mealie-meal because they are not genuine.

Meanwhile, Millers Association of Zambia (MAZ) president Allan Sakala said millers would only issue a comprehensive statement after meeting Government today.

And a Zambia Daily Mail survey conducted yesterday revealed that the price of mealie-meal has been increased by between K10 and K15 per 25-kilogramme bag of breakfast meal.

A check at Lusaka’s Chilulu market revealed that a 25kg breakfast meal of Simba and Star Milling is pegged at K85 while a bag of roller meal costs K65.

At Shoprite in Lusaka’s Chilenje township, a 25kg bag of National Milling breakfast meal is K72 while at Pick ‘n’ Pay in Woodlands, a 25 kg bag of Star breakfast meal is pegged at K79.

At Melisa Supermarket in Kabulonga a 25 kilogramme bag of Pembe breakfast mealie-meal was fetching K80 while Superior milling was pegged at K75.

Meanwhile, Finance Minister Alexander Chikwanda has warned milling companies against exploiting Zambians through unjustified increases in mealie meal prices.

Speaking during the Deloitte Budget Breakfast in Lusaka, Mr. Chikwanda also said the 2016 National Budget was not easy to put together owing to conflicts between available resources and required expenditure.

He said government has pegged its expenditure at 53 billion kwacha against available revenue of 42 billion Kwacha.

Mr. Chikwanda stated that government will borrow more externally than internally to finance the gap.

He is also concerned that Zambia has remained an expensive tourist destination which has affected growth of the sector.

Mr. Chikwanda said government has focused on tourism as one of the sectors targeted for diversification of the economy.

And Delloite Chief Executive Officer Chisanga Chungu has observed that factors leading to the current economic challenges including a slump in copper prices and power outages are likely to continue in the short term.

And an economist from South African Kay Walsh has observed that copper prices have between 2014 and 2016 registered a 25 percent decrease.

Ms. Walsh said this coupled with low water levels in the Kariba dam which has affected hydro electricity generation have led to government revising its Gross Domestic Product -GDP- focus for 2015 from 7 percent to 5 percent.

9 People die from Traffic Accidents over the weekend

Nine people died over the weekend in separate road traffic accidents which occurred in Southern, Northern, Lusaka, Central, Muchinga and Eastern Provinces.

In Lusaka, two pedestrians died on the spot while one sustained serious injuries in an accident which happened along los Angel’s road, opposite Kanyama Police Station.

The accident happened when the driver of Mitsubishi Rosa registration number BAA 4104 driven by John Mende aged 33 of John Leing Compound lost control of the motor vehicle due to excessive speed hence hit the pedestrians who were walking off the road.

The deceased have been identified as William Maya aged 15 of Kanyama Compound and Sara Mwale aged 17 of Makeni Villa while the injured is Lazarus Mwamba aged 16 years. The bodies of the deceased are in UTH mortuary.

In southern Province, one person died while another was left with injuries in an accident which happened on Great North Road, seven Kilometers South of Zimba Town.

The accident happened when driver of Toyota Harrier registration number BAB 2516 driven by Liu Kikila aged 32 was overtaking on a hill and later collided with an oncoming International Truck registration number ABQ 6075 which was being driven by a Zimbabwean national, Njabulo Mpedzisi aged 39.

The deceased, only identified as Lily was a passenger on the truck while the passenger on the Toyota Harrier Huxiaoqin Sichuan aged 22 sustained a fractured left hand and is admitted to Zimba General Hospital.

In another accident which happened in Southern Province, a male juvenile aged two died in an accident which happened in Mukuzo Wangombe Police Camp in Livingstone.

The accident happened when driver of a Toyota Corolla registration number AJB 8448 driven by Moses Ndopu aged 24, due to inexperience went to hit into the pedestrian who sustained head injuries and died upon arrival at Livingstone Hospital. The body is in Livingstone Hospital Mortuary.

In Muchinga, two people died on the spot and three others were injured in an accident which occurred at Mukoto area along Mpika – Kasama road.

The accident happened when a motor vehicle Toyota Ipsum registration number ACX 5998 driven by Francis Mubanga aged 42 with five passengers on board lost control of the vehicle and overturned off the road.

In Eastern province, Gilbert Mwandila, 64 died on the spot while two juveniles aged 13 and 15 sustained serious injuries when the driver of an ox-cart lost control and hit into a tree.

The accident happened at Kaweche village, Chief Mphamba in Lundazi District.

In Central Province, a passenger on motor vehicle Toyota Allex registration number ACX 3839 died on the spot in an accident which happened at Natuseko primary School in Kabwe.

The accident happened when the driver of the motor vehicle lost control of the vehicle due to excessive speed and in the process hit into a tree. The driver is admitted to Kabwe General Hospital while the body of the deceased is in Kabwe General Hospital Mortuary.

President Lungu launches FISP e-voucher

Government has released funds to support farmers to buy inputs of their choice from registered agro-dealers under the newly launched Electronic vulture voucher system.

President Edgar Lungu announced in Mbabala in Choma district during the launch of the Farmer Input Support Programme (FISP) Electronic Voucher system that the treasury has released funds required to enable farmers buy inputs.

President Lungu said the launch of the e-voucher system will enable funds move instantly to the agro-dealers to support farmers’ access inputs.

The e-voucher system will target 241,000 small scale farmers in 13 selected districts during the 2015/206 agricultural season.

The Head of State said government intends to roll out the e- voucher system to more districts in order to cover more beneficiaries in the 2016/2017 agricultural season and beyond.

The president encouraged all beneficiary farmers to take advantage of the new system to purchase inputs of their choice in a timely manner and improve agricultural productivity in the country.

And Agriculture Minister Given Lubinda said the e-voucher system which was conceived a long time ago has been operationalized under the Patriotic Front government.

Mr Lubinda said government came up with the e- voucher system in order to respond to farmers and stakeholders who wanted the system implemented.

He commended all the Agro-dealers and stakeholders participating in the piloting of the program for their concerted efforts which have enabled the programme to be implemented in 2015/2016 agricultural Season.

The Minister appealed to agro-dealers to charge reasonable prices for inputs so that farmers can afford.

He said government will put more money in the e-voucher system so that farmers on the system should not be disadvantaged by the increase in prices of inputs.
And Zambia National Farmers Union President Evelyn Nguleka praised government for launching the e-voucher system which she said will improve productivity in the agriculture sector.

Dr. Nguleka said the launch of the e-voucher system is testimony of government’s commitment to developing the agriculture sector through the use of technology.

She said the PF government deserves commendation for implementing the e-voucher system which all past governments had failed to achieve.

The launched was attended by Members of Parliament and District Commissioners from districts that are piloting the programme, farmers and other stakeholders.

Baluba miners on forced leaved will be paid their full salaries-Kambwili

Chief Government Spokesperson Chishimba Kambwili has assured miners at Baluba mine in Luanshya that they will be paid their full salaries and their arrears this month end.

Speaking when he addressed hundreds of workers who gathered at Shaft 28 in Mpatamatu area today, Mr Kambwili said CNMC Luanshya Mine is obliged to pay full salaries to the over one thousand workers it has placed on forced leave.

He disclosed that Konkola Copper Mines and Mopani Copper Mines were paying their workers full salaries while on forced leave and he wondered why the Chinese-owned mine was paying the workers 900 kwacha per month.

The Information Minister has told the miners that they will soon receive letters from management over their full salaries but he has warned that if the mine does not oblige, government will impose penalties.

Mr. Kambwili told the miners that the mine misinformed government that it was sending its workers on forced leave because of electricity shortage.

The Minister explained that when power supply was restored to the mine, the company failed to call back the workers saying they were also affected by the falling copper prices.

And officials from various mine unions were booed as Mr Kambwili left them to address the miners.The union leaders later asked the ZNBC Crew to leave the scene.This annoyed miners who immediately dispersed saying they wanted their complaints to their unions representatives captured on camera.

Finance Minister Calls for Austerity Measures by the Treasury

FINANCE Minister Alexander Chikwanda has called for austerity measures by the treasury and controlling officers in an effort to maintain the budget deficit at lowest minimum.

Mr Chikwanda noted that the projected 3.8 budget deficit in the next year’s national budget would only be attained with fiscal discipline by the treasury.

The Minister was speaking on Zambia National Broadcasting Corporation (ZNBC) Sunday Interview programme on Sunday evening.

Mr Chikwanda projected a budget deficit of 3.8 percent when he presented the K53.14 million national budget. The projected deficit is surprisingly low in comparison to 4.6 projection he made for 2015 which has risen to 6.9 percent.

“The 3.8 percent is our target, and the treasury has means of controlling expenditure excesses. It calls for a lot of toughness on the part of the treasury; if you want to be popular don’t be finance minister.

“For instance, I travel when it is absolutely necessary, because if I travel as a minister you give me US $500 per diem per day at the current exchange rate that’s K6,000 so you pay (salaries for) two people from that,” he said.

He said there should be morality in the manner government officials travel to save the scarce resources.

Mr Chikwanda noted that some expenditure had not been properly accounted for when people travelled abroad.

He reiterated that prudent public financial management was indispensable in the country’s prevailing economic environment.

Apart from cutting down on unnecessary travels, Mr Chikwanda said controlling officers would be put to task on any expenditure that was done beyond the budget.

He said it would be a misdirection of public funds for controlling officers to direct money to travel expense which was meant for other services in their ministries and institutions.

“All of us in Government we are very much aware about the cost implication of travel,” added Mr Chikwanda who said he refused to attend the IMF and World Bank annual meeting in Peru because the budget was too high.

The Finance Minister however, assured that the country’s economy was still intact despite the currently hardships it was going through.

He said the agriculture sector, fisheries and forests would drive the Government diversification following the current challenges that had affected the mining sector.

Zesco United have refused to blame their Barclays Cup exit on the absence of their three major players.

The record four-time winners failed to defend the Barclays Cup after losing 1-0 to Green Buffaloes in the semifinals at Nkoloma Stadium in Lusaka on Sunday.

Missing from Zesco’s lineup was goalkeeper Jacob Banda, defender Dauti Musekwa and striker Wintson Kalengo who has scored 16 league goals and is favourite for the 2015 golden boot.

The trio was away in Abu Dhabi on Zambia duty to play a friendly against Egypt on the same date that Chipolopolo lost 3-0.

“We missed them and the coach as well but but that is life. But those that were there did their duty for the club,” Zesco assistant coach Tennant Chembo said. who was also standing in for George Lwandamina who was at tge helm of Zambia in the UAE over the weekend.

“It is just a minor setback and we have to regroup. We believe and trust in the boys they have a strong mentality. I think we will rise to occasion in the remaining three games in the league despite failing to defend the Barclays.”

Zesco have at least got the league title mathematically in the bag on 63 points and cannot be overhauled by second place Zanaco thanks to the formers superior goal difference with three matches to spare.

Teenager convicted of defiling 2 girls

A 17-YEAR-OLD boy of Chingola has been found guilty and convicted of defilement of one girl and indecent assault of two girls – all on the same day.
Chingola magistrate Shadreck Chanda convicted the juvenile after finding him guilty of one count of defilement and two counts of indecent assault.
Particulars in the first count are that on April 23, this year, in Chingola, the teenager allegedly had unlawful carnal knowledge of a girl aged six.
In the second count,  while in Chingola, the juvenile allegedly indecently assaulted an eight-year-old girl.
And in the third count, the juvenile is alleged to have unlawfully indecently assaulted a girl aged eight.
When the offender first appeared for mention, he denied all the charges and trial commenced.
During trial held in camera, the six-year-old girl told the court that the juvenile had sex with her after sending her friends to buy fritters.
“He sent my friends to go and buy fritters and asked me to remain behind. He then covered my face, undressed me, and had sex with me. When my friends came back, he sent me with my friends to buy ice-block, and he remained with my other friend,” she narrated.
All the victims’ testimonies were similar and they identified the juvenile as the one who sexually harassed them.
In defence, the offender said on the material date, he was molding bricks near the stream when he saw the three girls in the area.
He told the court that he sent the girls to buy fritters and they came back to inform him that there were no fritters and that after that, they went away.
The teenager’s mother was allowed to defend her son, but she said she was not around when the boy allegedly abused the girls, therefore could not know if her  son committed the crime.
“I find you guilty and convict you accordingly. From the evidence on record, it is not in dispute that you met the three girls and sent them to buy fritters. Age of a victim in cases like these is an essential ingredient, and by looking at the victims, no-one would dispute that they are less than 16 years.
“The medical report confirmed that the hymen was broken. The prosecution has proved its case beyond all reasonable doubts. I therefore find you guilty as charged.
Mr Chanda adjourned the matter to October 13 for a social welfare report.

UPND president Hakainde Hichilema says he is not a sadist to celebrate the crisis the country is going through as he is also feeling the pain because his businesses have been affected by the economic challenges the nation is experiencing.

Mr. Hichilema said it was therefore unethical for the Patriotic Front government to unleash cadres to suggest that he was celebrating the challenges the nation was experiencing.

He said it was painful to see how the economy of the country was collapsing with little being shown as commitment to address the problems the nation was facing by those in leadership.

But PF secretary general Davies Chama has charged that Mr Hichilema was too desperate to go to State House and was using every opportunity to undermine Government, even where circumstances did not demand.

He said it was one thing to render advise to the Government and another to perpetuate negativity through inteprete language that suggested that those in power and their policy advisers were incompetent and ill informed.

The PF, he said, had a formidable team that would ensure a return to power with a landslide next year.

“Don’t hate me for speaking out on the ills of government, Zambia is bigger than the Patriotic Front and Zambia is bigger than HH, bigger than anyone of us politicians,” Mr. Hichilema in an interview.

He said it was unreasonable for the PF leadership to despise him whenever he raised issues when taken into account they could be of value to the governance of the nation.

“How do you help a government which is not ready to listen? Today the leadership will say this when they don’t mean it and if you criticize them they unleash cadres on you to insult you and say all sorts of things about you and accuse you of many things,” he said.

Mr. Hichilema said Zambians have reached a level where they were looking for leaders who had plans and solutions to the challenges the nation, especially at the time when the world was facing serious economic difficulties.

He said it was high time the leadership in the PF realised that things in the country were not alright and there was need for reorganization in the manner they governed the country.

Fred M’membe, Nchito Opposed to DBZ application to consolidate case

Fred M’membe of the Post Newspaper and the Nchito brothers have advanced technicalities to oppose an application by the Development Bank of Zambia to consolidate its case in the recovery of K14million they borrowed through defunct Zambian Airways.

They claim that the DBZ application by writ of summons and statement of claim were defective because:

-the demand was statute barred
-The original loan agreement was not effectual
-Piercing the corporate veil was unprocedural

Central to their opposition is the argument that the application and therefore demand is time barred because it comes six years after the circumstances that brought about the claim.

They therefore feel that the DBZ application to introduce more defendants, expunge evidence, remove corporate veil and making fundamental changes to the case were time barred.

They have also argued that vital elements of the agreement that were a pre-requisite to the agreement, regarding the buy back of shares were not fulfilled thereby invalidating the entire loan agreement.

They have therefore opposed the amendment of the writ of summons and statement of claim which would among other things make M’membe, Nchima Nchito and former DPP Mutembo Nchito personally liable for the loan by virtue of their directorship of Zambian Airways.

They have argued that the corporate veil should not be lifted because the procedure used was “starling” and that it was time barred.

They are arguing that a clause in the facility agreement, exonerates them from the debt, because at the time the loan was being negotiated the buyback facility in Clause 7 had not been full filled.

“The plaintiffs were advised that the contract would not be effectual unless the conditions precedent specified under clause 7 of the facility agreement were fulfilled or settled; this has has been the Defendants’ defence all along and this defence is fortified by the due diligence report.” They have argued in the affidavit in opposition.

“It is trite that even before the question of lifting the corporate veil arises, there must first liability on the part of the company. In this case however, the cause of action relating to the debt that the plaintiff against Mines Air Service Limited is statute barred. Without that liability on the part of Mine Air Services, there cab be no question of the proposed 3rd to 7th Defendant paying the proposed 1st Defendant’s debt.”

They have further said that “The plaintiff(DBZ) is now attempting to change its cause of action and expunge evidence which exonerates the Defendant. This is not only unlawful; it smacks of conspiracy to defeat the course of justice.”

The trio have refused any attempts to prove they were liable and required to honour the terms and conditions of the K14 billion loan they acquired for the operationalization of Zambian Airways.

In a defendants skeleton argument in opposition to the plaintiff’s application to add parties and for leave to re-amended statement of claim filed before the Lusaka High Court, the trio alleged that the law of limitation restricted such action as addition of new evidence after the expiration of six years from date on which the cause of action accrued.

Nchito said the excepted portion of the statute of Limitation premised on a simple contract that it could not be brought to court if six years had elapsed since the commencement of such a matter.

They argued that by way of summons to, inter alia, join Mine Air Services Limited, Zambian Airways Limited, Fred M’membe and Nchima Nchito, SC filed on July 31, 2015, more six years after the plaintiff commenced the action, the plaintiff wanted to amend its Writ and Statement of Claim by adding new claims.

“Is it lawful to join parties to an action by amending pleadings in such a manner that the effect is to commence actions on issues that are statute barred?

“This is by virtue of the British Acts Extension Act, Chapter 10, and Volume 2 of the Laws of Zambia. The Limitation Act in Section 2 provides in part, thus’

“ ‘2(1) the following actions shall not be brought after the expiration of six years from the date on which the cause of action accrued, that is to say: (a) Action founded on simple contract or tort,” the affidavit explained.

“In this case, any alleged breaches of contract or tortious acts on the part of the intended defendants could not have been committed after January 13, 2009 and therefore any actions against the said intended defendants could not be brought to court after January 13, 2015,” Mr Nchito added.

They have also questioned the legality of an action of amending a Writ and Statement of Claim by adding causes of action, which could affect the existing defendants when such causes were state barred.

The defendants have also advised against plans to expunge documents from an earlier submission which they suspected could be for the purpose of finding them liable notwithstanding existing evidence.

They explained that the legal due diligence to be expunged was part of sworn evidence submitted by then company secretary Andrew Musukwa, that exonerated the defendants and the plaintiff’s attempt should not be allowed, adding …”that the Legal Due Diligence is one of the documents which exonerate the Defendants and the Plaintiff’s attempt to expunge the said document not be allowed”.

The court case involving President Edgar Lungu’s Special Assistant for Politics Kaizer Zulu has been discontinued.

According to court papers this morning, the state has discontinued the matter after receiving instructions from the Director of Public Prosecutions chambers not to proceed.

The matter has been discontinued due to insufficient evidence.

Mr Zulu, 43 a civil servant of Lusaka’s Woodlands area, was facing two counts of threatening violence and failing to take precaution against injury.

Last week, Enock Kavindele junior withdrew the Criminal complaint he filed with the Police against Presidential Political advisor Kaizer Zulu which followed a shooting incident at Chrismar Hotel.

Mr. Kavindele 42 made the withdrawal in an application before Lusaka principal resident Magistrate Mwaka Mikalile this morning.

He told the court when the matter came up for trial that he and Mr. Zulu have decided to put the past behind them as brothers.

Mr. Kavindele said his decision to withdrawal the matter is without any coercion stating that as a Christian, forgiveness forms the basis of his beliefs.

Magistrate Mikalile however, only granted the withdrawal of the first count that of threatening violence.

The second count of failure to take precaution against causing injury could not be withdrawn because it is solely up to the State whether to withdraw or not.
