MMD cadre jailed for 2 years with simple labour for manslaughter

THE Chipata High Court on Wednesday sentenced an MMD party official to two years in prison with simple labour for causing the death of a Patriotic Front (PF) cadre.

The accused, who is MMD Luangeni constituency youth chairperson, pushed the PF cadre out of a moving truck during last year’s presidential by-election campaign trail.

Appearing before High Court Judge, Philip Musonda was Allan Tonga, 37, a peasant farmer of Masiwa Village in Chief Saili’s area in Chipata District who was charged with one count of murder.

The case was later reduced to manslaughter by the court after the prosecution team applied for an amendment to change the charge to manslaughter.

Facts before the court were that the accused on October 29 during the presidential by-election campaign caused the death of a PF cadre, Chindao Msoni.[quote]

The court heard that the accused pushed Mr Msoni from a moving canter truck, registration number ABG 7344, which was going to Luangeni constituency.

One witness, Whyson Msoni who was on the truck narrated how his brother picked up a quarrel with the accused and how he was pushed out of the moving truck.

He told the court that the fight ensued between the two when the deceased had chanted a PF slogan in the midst of the MMD cadres who were on the truck.

The PF slogan angered the accused who threw Mr Msoni off the moving vehicle.

The deceased’s trousers belt got hooked into the truck and was consequently pulled by the truck for some metres.

The witness told the court that the people on the vehicle shouted to the driver to stop the vehicle but the accused ordered the driver to continue driving.

The deceased who sustained serious multiple injuries and bruises later fell off to the ground after the belt of his trousers that was hooked to the vehicle got cut.

He was picked by another car which was coming behind and was rushed to Mwami Mission Hospital where he died a few days later.

In mitigation, the accused who had pleaded guilty to the charge of manslaughter said he was a first offender and was remorseful for the act.

The accused’s lawyer, Stambridge Chilambo said his client was an HIV/AIDS patient and was taking care of 13 children.

He pleaded with the court to exercise leniency when giving out the sentence.
Mr Justice Musonda said he had taken into consideration what the accused had said in mitigation.

However, Mr Justice Musonda said Zambia was a peaceful and democratic country and everyone had the right to support the party of his choice.

“You should thank the learned counsel who has mitigated for you so well. Initially, I wanted to send you to 10 years in prison with hard labour in order to send a message that I do not condone political hooliganism, but because of your HIV/AIDS status and other factors raised in the mitigation, you cannot get a better sentence than this,” he said.

He said the two-year sentence was in effect from the day he was put in remand.

Indo Bank donates to first lady

Indo Zambia Bank has donated assorted items worth forty million Kwacha to first lady, Thandiwe Banda towards her charity works.

Indo Zambia Bank Managing Director, Satish Shukla says it is important for corporate organizations to support government’s efforts in mitigating the suffering of the vulnerable and less privileged in society.

Mr Shukla said the suffering of orphans and vulnerable children in rural areas is as a result of malnourishment adding that efforts such as Mrs Banda’s charity deserve support and encouragement.

He said, during the donation at State House, that Indo Zambia Bank is delighted to be associated with her charity works.

And receiving the donation, Mrs Banda said she is aware that the global economy is going through a difficult period and that the crunch has severely affected the performance of many companies.

She said despite the difficulties that the country is going through, Indo Zambia Bank has continued to render support to disadvantaged people.

The items donated include two hundred blankets, fifty mattresses and fifty bed sheets.
The first lady expressed gratitude to the bank for its continued support towards her charity work.

Mrs Banda appealed to corporate organizations to emulate Indo Zambia Bank in assisting the less privileged in the country.

RB is implementing Levy’s legacy – Pande

MMD Deputy National Chairman Kabinga Pande says President Rupiah Banda is on the right track in implementing the legacy of the late President Levy Mwanawasa.

Mr. Pande challenged the opposition to exhibit maturity and show leadership in their utterances.
He says the UPND/PF pact leaders are the ones inciting the Zambian people to turn against the government of the day.

Mr. Pande was speaking in an interview with ZANIS in Kasempa yesterday during the memorial of the late President Mwanawasa.

Mr. Pande, who is also Kasempa Member of Parliament (MP) and Foreign Affairs Minister said the pact is headed for doom and that the ruling party is not threatened by the formation of the Pact.

He said while government is concentrating on developing the country through various projects, the PF/UPND pact leaders;
Mr.Michael Sata and Mr. Hakainde Hichilema were busy criticizing government and the leadership of President Rupiah Banda.

Mr. Pande said Mr. Banda has keenly followed the legacy of the late president such as the fight against corruption and the strengthening of the governance system.

He said President Banda had implemented several development projects in North Western Province.
He cited some of the projects as the rehabilitation of roads, opening up of Lumwana mine and attracting more investors to invest in the province.

FRA buys only 13,000 out of 46,000 bags of maize in Kafue

The Ministry of Agriculture and Cooperatives in Kafue district says only 13,000 bags of maize have been purchased from farmers in the area out of the allocated figure of 46,000 to be bought by the Food Reserve Agency(FRA).

Kafue District Agriculture Coordinator John Hikanyemu has however expressed worry at the delay by the FRA to pay for the maize on time as indicated at the start of the exercise.

He says the delay in paying for the maize by FRA is discouraging farmers from bringing maize to the agency.

Mr. Hikanyemu said today in Kafue during a stakeholders meeting held in the office of the District Commissioner that the district has been subdivided into two zones namely Kafue and Lusaka west zones.

He said the five cooperatives sheds have been identified in Kafue whilst three are in Lusaka west.

Mr. Hikanyemu told the meeting which was also attended by District Commissioner Winford Ngoma that there was need for FRA to work out a fast paying mechanism unlike what was happening now.

He said whilst the district may have other buyers of the commodity, many farmers were more comfortable with government.

Meanwhile the Ministry of Agriculture says 10,500 small scale farmers are expected to benefit under this year’s fertilizer Support Programme.

He said the criteria of selecting beneficiaries will be done through respective agriculture block offices.

Mr. Hikanyemu said the process of scrutinizing cooperatives in the district has started so that no fake groups benefited from the programme.

Meanwhile, .Omnia Zambia Limited has started delivering farming inputs for the 2009/2010 farming season in Kafue district.

A check by ZANIS at the Omnia shed in Kafue today found trucks offloading 50kg bags of urea fertilizer.

Depot Manager Jones Musanya told ZANIS in an interview that the company has been assigned to deliver 814 metric tonnes of top dressing fertilizer and another 814 metric tonnes of basal dressing to Kafue district under this year’s fertilizer support programme.

He said the company is also to deliver 8,140 by 10 kg bags of seed to the district.

Mr. Musanya disclosed that a total of 8,790 bags of urea have since been delivered to the warehouse in readiness for this year’s farming season.

He was optimistic that the company would complete the exercise of delivering inputs to the warehouse in the next two months.

Mr. Musanya however expressed worry that the distribution of D compound fertilizer may be delayed because Nitrogen Chemicals of Zambia has not yet started production of the fertilizer.

He said at the moment the company was only stocking up top dressing fertilizer and had been told to wait for the D compound which is expected to come from NCZ.

Split of Agriculture Ministry worries-Principals of Agricultural colleges

Principals of Agricultural Colleges have expressed worry that the split of the Ministry of Agriculture in two ministries leaves them in a quandary as they do not know where they would belong and report to.

Speaking on behalf of others Mazabuka’ Zambia Institute of Animal Health (ZIAH) Principal Mabvuto Banda said todate no official communication has been made to inform them where the colleges would fall under following the split of the ministry.

Dr. Banda said this development has left colleges in a state of uncertainty adding that there is urgent need for the government to give guidance to all agriculture colleges.

Some Principles also started that the structure under which the colleges are operating does not exist adding that there is need for government to put place a deliberate policy that would formalise tha latter.

Deputy Minister in the ministry of Livestock Development and Fisheries, Albert Mulonga however could give a definite answer but assured the staff not to panic because government is seriously addressing the matter.

” Government is aware of the problem and is seriously looking at ways of addressing the problem,” said Mulonga.

Mr. Mulonga explained that at district level, respective districts would be headed by district veterinary officers while at the Province, Provincial Veterinary Officers will be in charge.

He said the split of the ministry will improve efficiency especially in the fight against livestock diseases.

The Task Force on Corruption has described the application by second republican President,Frederick Chiluba, requesting parliament to restore his immunity as premature and desperate.

Task Force Executive Chairman, Maxwell Nkole, says the former President still has several cases before the courts of law, which need to be cleared.

He told ZNBC that Dr. Chiluba should wait for the courts to clear him of the cases, which include his involvement in the $20 million United States dollars arms deal.

Mr. Nkole said the former President also needs to be cleared of the 8.5 Million United States dollars Carlington maize deal.

But Dr. Chiluba says parliament should restore his immunity because he has no pending criminal case in court.[quote]

He said through his spokesperson, Emmanuel Mwamba, that he is saddened that the Task Force wants to interfere with his request.

Dr Chiluba said he is surprised that the Task Force wants to bring up the issue of the Carlington Maize scandal which it has never investigated in the past eight years.

Parliament lifted Dr. Chiluba’s immunity in 2002 to pave the way for criminal proceedings against him.

Dr. Chiluba was on Monday acquitted of all charges of theft of public resources amounting to about $500,000 US dollars, after a protracted eight year legal battle.

And The National Assembly has confirmed receiving a letter from Former President, Frederick Chiluba, requesting parliament to restore his immunity.

Parliamentary Media Liasion Officer, Chikomeni Banda, says the speaker of the National Assembly, Amusa Mwanamwambwa, received the letter on Wednesday.

Mr. Banda told ZNBC news that the matter is receiving the attention it deserves.

He said the Speaker is currently studying the details of the letter and will react accordingly.

Dr. Chiluba’s lawyers have written to the speaker asking parliament to restore his immunity.

The lawyers say this is because Dr. Chiluba is not facing any criminal cases in court.

The Environmental Council of Zambia (ECZ) has arrested and charged Clean Shot Director, Sambi Mumba and Madison Insurance Company Cooperate Affairs manager, Natika Mpundu for illegally transporting waste.

ECZ Principal Information and Communications Officer, Irene Lungu said the duo is jointly charged for transporting waste illegally contrary to the Environmental and Pollution Control Act of the Laws of Zambia.

Ms Lungu confirmed the arrest of the duo in a statement released to ZANIS in Lusaka today adding that they would appear in court soon.

She said particulars of the offence are that on unknown dates but between 1st January and 14th August this year, Madison Insurance Company while acting together with Clean Shot Limited and others transported waste in Lusaka contrary to the provisions of the Environmental Protection and Pollution Control Act of the Laws of Zambia.

Ms Lungu said the duo did not comply with set regulations for transporting waste in order to maintain a clean and healthy environment.

She said ECZ recognizes the challenges local authorities face in management of waste adding that it is however important for industries to comply with set regulations to maintain a healthy environment.

Ms Lungu has since reminded companies to ensure that they comply with regulations governing the operation of businesses in the country.

ZESCO refuse to restore power to police houses in Itezhi-tezhi despite Minister’s assurance

Zambia Electricity Supply Corporation (ZESCO) Limited in Itezhi-tezhi has not restored power to the police camp regardless of the assurance given by home affairs minister Lameck Mangani that government would soon settle the bill.

In another development police officers in Itezhi-tezhi have welcomed government’s decision to start paying police officers allowances for settling their electricity and water bills, saying the move was long over due.

A check by ZANIS at the police camps in Itezhi-tezhi found that electricity supply at the camp was still disconnected after home affairs minister Lameck Mangani requested the company to restore power and water at the police camp on Monday, 17th AUGUST, 2009.

And Police officers interviewed by ZANIS said the move by the Ministry of Home Affairs to start paying them allowances for utilities was welcome, as it will save them from embarrassment and inconvenience each time there were disconnections of electricity and water supply.

“The government’s move to pay us allowances for electricity and water is the best that they have done because now we will be able to settle our utility bills on time and avoid embarrassments associated with power and water disconnections” said one police officer who sought anonymity

The police officers wondered why ZESCO in Itezhi-tezhi could not restore power in their homes for close to a month now despite the minister’s plea to restore power after assuring them that government would soon settle the huge electricity bill owed to the utility company.

“Our friends in the Copperbelt and Lusaka had their power and water restored after the minister requested them to do so but we are still wondering why Zesco in Itezhi-tezhi cannot do so here” said one of the police officers.

When contacted for a comment ZESCO referred all queries to their superior offices in Choma.

On Monday this week government announced that police officers will from next year directly pay police officers allowances for the settlement of their electricity and water bills to save them from being disconnected from water and electricity supply.[quote]

Home affairs minister Lameck Mangani was reported as saying the move to pay utility allowances to police officers would be introduced in the next budget and that it was aimed at ensuring that police officers took the responsibility of paying for their bills instead of being inconvenienced over long-standing government bills.

Mr. Mangani further said the Home Affairs Ministry had entered into an agreement with the utility companies to re-connect water and electricity power to the affected police camp.

Meanwhile ZESCO in Itezhi-tezhi has postponed the planned mass disconnections of power supply to defaulting government ministries and house tenants due to lack of police manpower to help in the exercise.

Acting Itezhi-tezhi District Commissioner Hampende Hichilema confirmed the postponement to ZANIS today.

President Rupiah Banda expected in Northern Province tomorrow

President Rupiah Banda will tomorrow leave for Northern Province for a two day working visit where he is expected to commission the recently constructed Kalungu Bridge in Kasama.

This is according to a press statement released to ZANIS in Lusaka today by the President’s Special Assistant for Press and Public Relations, Dickson Jere.

Mr. Jere said President Banda will, while in Northern Province also inspect the Kasama-Mbala and Mpulungu Road which is being rehabilitated.

The President is first expected to pay a courtesy call on Paramount Chief Chitimukulu of the Bemba people at his palace before embarking on his official programme.

President Banda will be accompanied by Tourism Minister Catherine Namugala, Agriculture Minister Dr. Brian Chituwo and Lands Deputy Minister Michael Mabenga who is also MMD National Chairman.

Mr. Banda and his delegation will hold meetings with Church leaders, headmen, and senior MMD party officials in the province.

He is expected to return to Lusaka immediately after completing his scheduled programme.

Chief Mwanachingwala wants her grade 11 soon to be wedded daughter to continue with school

Chief Mwanachingwala of Mazabuka has differed with school authorities at Konkola High School following the alleged expulsion of his 18 year grade 11 pupil daughter he has planned to marry off to a named teacher at a basic school.

The Chief told ZANIS in Mazabuka yesterday that he has no regrets for taking such a decision because his daughter is ripe for marriage.

He charged that both education and school authorities have no moral right to cancel a wedding ceremony that has been set for 30 August,2009.[quote]

Chief Mwanachingwala said the wedding would be graced by the Catholic church clergy at Chikuni Mission in Monze District.

The Chief questioned why school authorities decided to expell the girl before the wedding took place.

He challenged the education and school authorities to interpret what the new policy on girl child education states in regard to girls who become pregnant while at school.

” This is nonsense, my daughter is not pregnant and the wedding does not mean she will be staying with her new husband who is equally a teacher. The education policy encourages girls who become pregnant to continue with school after delivering,” said Chief Mwanachingwala.

Chief Mwanachingwala further said he had officially invited Mazabuka District Commissioner, Tyson Hamaamba to be the guest of honour at the wedding.

Mazabuka District Education Board Secretary, Darius Kaluba refused to comment on the matter, saying he could only do so at an appropriate time.

Faustin Kabwe and Aaron Chungu granted bail

A LUSAKA magistrate’s court yesterday granted bail of K100 million each to two former Access Financial Services (AFS) Limited directors, Faustin Kabwe and Aaron Chungu.

Ndola High Court deputy registrar, Jones Chinyama, granted the duo bail pending trial in chambers after considering their bail applications.

Magistrate Chinyama said the two convicts should provide two working sureties each in the sum of K50 million in their own recognisance.

He also ordered the duo to ensure that they surrendered their passports to the clerk of courts.

The duo was jointly charged with acquitted former president Frederick Chiluba but had their charges substituted from theft by public servant to that of being in possession of suspected stolen funds.

FORMER Republican president, Frederick Chiluba has written to Speaker of the National Assembly, Amusaa Mwanamwambwa to restore his legal immunity following his acquittal in the case of alleged theft.

Dr Chiluba’s spokesperson, Emmanuel Mwamba said in an interview yesterday that the former president had written to the Speaker through his lawyers requesting Parliament to restore his immunity following his acquittal.

Dr Chiluba argued that the removal of his immunity seven years ago was not infinite and added that the scope was limited to prosecution for offences alleged by his predecessor, Levy Mwanawasa in his address to the National Assembly on July 16, 2002.

Dr Chiluba said now that he had been cleared of criminal allegations brought against him by the courts of law, there was need to restore his immunity.

He has further asked the Speaker of the National Assembly to immediately convene a special session of the National Assembly to table the matter.

The session should consider restoring his legal immunity as the purpose for which it was lifted has been fulfilled by his acquittal.

He requested that should the Speaker find it difficult to call the session at short notice, the matter should be tabled before the standing orders committee.

The committee would in-turn report its decision to the National Assembly for ratification.

Simeza, Sangwa and Associates said in a letter to the Speaker that since Dr Chiluba had been cleared of all allegations following the acquittal, there were no criminal charges pending against their client in any courts of law in Zambia.

“Our reading of the National Assembly resolution together with Article 43 of the Constitution would appear to suggest that the removal of our clients immunity was not infinite,” the letter says.[quote]

Ndola High Court registrar, Jones Chinyama, sitting as magistrate in Lusaka, on Monday cleared Dr Chiluba of all six counts of theft involving about US$500,000.

Parliament in 2002 lifted Dr Chiluba’s immunity for offences alleged to have been committed in his 10-year reign.

Former Mineworkers Union of Zambia (MUZ) general secretary, Ernest Mutale separately described the acquittal of Chiluba as a great relief and urged Zambians to respect the judgment.

Mr Mutale said it was surprising that some people were against the acquittal and wondered why they should be questioning the judiciary.

A local non-governmental organisation, Authentic Advocates for Justice and democracy praised Dr Chiluba’s acquittal and called for expeditious restoration of his immunity.

Mwense Member of Parliament, Brighton Chongo congratulated Dr Chiluba on his acquittal, saying the court’s decision was well deserved.

He said the people of Mwense where the former president hailed were happy that he had been cleared and urged all sectors of society to accept and respect the court’s ruling.

ZESCO shutdown rescheduled

The Zambia Electricity Supply Corporation (ZESCO) has rescheduled the shutting of generator number one (1) at Kafue Gorge power station to the end of September.

ZESCO Senior Manager for Marketing and Public Relations Lucy Zimba said the shut down which was scheduled to take place from August 17 to September 2 for a period of 17 days will now take place at the end of September.

Ms Zimba said the shut down was meant to facilitate generator efficiency tests that were to be conducted by the contractor as part of the contractor’s obligation under the Power Rehabilitation Project recently completed at the Kafue Gorge power station.

Ms Zimba said this in Lusaka today in a press statement made available to ZANIS.

She explained that the shutdown of the 165 Mega Watts (MW) generator will result in a national power supply deficit of up to 100MW during peak hours daily and necessitate increased load shedding.

She further explained that the postponement of the shutdown was as a result of an unexpected high increase in power demand resulting from economic activities, increased irrigation of winter crops among many other economic activities.

“Having consulted our customers, ZESCO has decided to postpone the shutdown of generator number one at the Kafue Gorge power station to end of September 2009”, Ms Zimba said.

Ms Zimba last week announced that the power utility company would on Monday August 17 shutdown Generator number one at the Kafue Gorge power station for a period of 17 days.

The shutdown was to facilitate generator efficiency tests that were to be carried by the contractor.

Lions terrorising Isoka villagers

Three lions are reportedly terrorising villagers in two chiefdoms of Isoka district in Northern Province.

Isoka District Commissioner (DC) Henry Mukungule confirmed the development to ZANIS in an interview today and named the two affected chiefdoms as chief Mweniwisi and sub-chief Mwenitambo of Mpungu ward in Isoka east constituency.

Mr Mukungule said the beasts have so far killed eight herds of cattle in chief Mweniwisi’s area and one in sub-chief Mwenitambo.

The DC has since appealed to the Zambia Wildlife Authority (ZAWA)to quickly dispatch officers to crop the beasts before they start attacking people.

Mr Mukungule said villagers in both Mweniwisi and Mwenitambo were now spending nights in their kraals in a bid to protect their herds of cattle.

Chief Mweniwisi also confirmed the development to ZANIS in a separate interview. He said the presence of the lions in the areas, had led to people’s movements being restricted as they feared for their lives.

People should be happy for Chiluba – Fr. Mpundu

Former Lukulu Catholic Church Parish Priest, Father Godfrey Mpundu has expressed happiness at the acquittal of former Republican president Dr. Fredrick Chiluba.

Father Mpundu told ZANIS in an interview in Lusaka today that Dr. Chiluba had suffered enough during his trials, adding that it is now time for him to enjoy his freedom as a citizen of this country.

He called on all the Zambian people to accept the decision made by the Judiciary in good faith.

Father Mpundu stressed that people should be happy for the former president, as the decision made by the Judiciary will bring relief and joy to Chiluba’s family members and friends.

He appealed to all peace loving Zambians to respect and accept the decision made by the judiciary as the people entrusted with the laws of the land.

On Monday, Magistrate Jones Chinyama acquitted Dr. Chiluba on all charges of embezzling public funds amounting to US $500, 000.
