Joseph Malanji to appeal the nullification of his election as MP

KWACHA CONSTITUENCY Member of Parliament Hon Joseph Malanji says the nullification of his seat is a temporal setback as he has instructed his legal team to appeal the High Court ruling.

Hon Malanji says he possesses the grade 12 Certificate as there is no way he would have successfully filed in nominations and contested the Parliamentary seat if he did not have it.

He said in an interview yesterday that the Court was categorical that the Electoral Commission of Zambia was in conformity with the electoral process.

“It’s unfortunate that we have to come to a level where we are right now. The Court has errored because it was very categorical that the Electoral Commission of Zambia was in conformity with the electoral process,” he said.

“And when we were in Court we had already passed the stage of eligibility. 14 days from filling in of nomination is the period allocated to address the issue of eligibility so how does it arise at this stage.”

Hon Malanji, alias Bonanza, said it was within the Court’s discretion to subpoena the Examination Council of Zambia and or the Electoral Commission of Zambia for validation.

“Am just coming from the Examination Council of Zambia to make sure that the documents availed to the Court are fresh as opposed to the ones I certified prior to the elections” he said.

“It is very unfortunate that we have to go through this part because the matter in Court was not about eligibility. It was about the alleged violence during the elections and not about eligibility.”

He charged that the question of the grade 12 Certificate only arose on the last day when winding up proceedings and he did not have a chance to get back to Lusaka to get his qualifications.

Yesterday Mr Malanji lost his Kwacha seat following the nullification of his election by Lusaka High Court Judge, Kazimbe Chenda observed that Mr. Malanji did not qualify to contest the Kwacha seat because he does not have a grade 12 Certificate as a minimum qualification.

Losing UPND candidate Charles Mulenga had petitioned against Mr. Malanji citing three grounds of electoral malpractice. Mr. Mulenga further contended that Mr. Malanji has no minimum academic qualifications to stand as a member of parliament as required by the law.

Delivering the ruling Judge Chenda dismissed Mr. Mulenga’s two grounds relating to malpractice on account of lack of merit.

Judge Chenda has however upheld Mr. Mulenga’s third ground that Mr. Malanji has no minimum qualification to contest parliamentary elections pursuant to article 70 sub-article one clause “D” of the constitution.

In another case, Judge Chenda has upheld the election of Tasila Lungu Mwansa as Chawama Member of Parliament. Judge Chenda ruled that Ms Mwansa was duly elected.

Ms. Mwansa was petitioned by UPND Chawama losing candidate Potipher Tembo. Other seats whose elections have been upheld are Matero and Mandevu.

In Kapiri Mposhi, Central province, United Party for National Development (UPND) cadres are rejecting the appointment of Mr.Fransis Hasalama as incoming Kapiri Mposhi District Commissioner because he doesn’t live in the region.

The Cadres are demanding the appointment of a local person who better understands challenges in the district.

Their demand is an anticipated one as it aligns with president Hakainde Hichilema’s constituency budget implementation plan.

“No one will be given a contract to do a job in Mufulira who come from Lusaka. No one.” President HH said during a conversation with a reporter at Kenneth Kaunda International Airport before taking off to the United Kingdom for the COP26 at the begging of this month.

According to president Hakainde, contracts for developmental projects will be awarded only to people who reside in a constituency to help empower residents in each constituency.

In short, HH is saying a person who resides in Mwinilunga cannot apply for a contract in Nakonde or Chipata.

Cadres are saying a person who lives in Mumbwa, Lusaka, or Kitwe should not be appointed as DC for Zimba or Petauke.

Clearly shows that the cadres and president Hakainde are demanding the same thing. Waiting to see if Mr. Hasalama will lose his appointment.

There is a possibility the incoming Kapiri Mposhi District Commissioner lied to the president about his residence.

Whether Mr. Hasalama lied about his residence or not, if he has no dirty record, he deserves the appointment. Under One Zambia One Nation, his residence has nothing to do with his service to the nation.

Zambia is strong because every Zambian is accepted everywhere in the country. Making residence a factor in Zambians service to the country will undermine that.

A few weeks before the August 12 election a video went viral. The first and former Zambian President Kenneth Kaunda, may his soul rest in peace, was shown warning Zambians about HH.

In the video, the former president describes the UPND president as a danger to unity. The wind of change was too strong for people to pay attention to the video.

Now the video has started making sense. Especially if one pays attention to what is going on. If a person who lives in Mumbwa, Lusaka, or Kitwe cannot be appointed as DC for Zimba or Petauke, that is taking the country in the opposite direction of One Zambia One Nation.

It is no more One Zambia One Nation if a person who lives in Mwinilunga cannot apply for a contract in Nakonde or Chipata.

Every Zambian belongs everywhere in the country.

Unsafe abortions still high in Zambia

A Study by the Zambia Association of Gynecologists and Obstetricians (ZAGO) has revealed that Zambia records a relatively high rate of unsafe abortions which stands at 7 per cent per annum.

The study has also revealed that Copperbelt Province has a higher rate of 14 per cent which is twice higher than the national rate.

Presenting the study findings in Kitwe today, ZAGO President Swebby Macha said the abortions are more common in high density areas.

Mr. Macha who was represented by ZAGO Vice Publicity chairperson Mwansa Lubeya said the study which was conducted on 364 women in Lusaka and Copperbelt between July and August 2021 revealed that the scourge continues to be high due to ignorance on the legal framework on abortion services in the country, fear of stigma from the community and lack of money to access proper abortion services among others.

Dr. Macha said the study further revealed that women use a wide rage mechanisms to aid them conduct the abortions within their communities which include herbal concoctions, sticks and other sharp objects.

The study also highlighted challenges such as insufficient manpower in health facilities, stigma from society that regards health officers as murderers, inadequate professional skills among health staff and lack of public awareness among members of the public as some of the reasons contributing to the low turn out to health facilities by women in need of abortion services.

The association has since recommended for intensified public sensitization on the legal abortion services availability in the country

CEC to increase power capacity for its Riverside solar plant

Copperbelt Energy (CEC) has signed an agreement with Sinohydro Corporation Zambia Limited to increase the capacity at its Riverside Solar plant.

Speaking during the signing in ceremony held in Kitwe yesterday, CEC Chief Executive Officer Owen Silavwe said the upgrade will increase the plant’s power generating capacity from 1Mega Watt to 34Mega Watts with an annual energy output of 56.5Gwatts.

Mr. Silavwe said the project which is valued at US$19.2 million will significantly see an increase in the generating capacity of the solar power plant.

“The Engineering Procurement and Construction (EPC) contract that we are signing yesterday with Sinohydro Corporation Zambia Limited relates to the expansion of CEC’s flagship Riverside 1 Mega Watt solar PV plant, the upgrade will increase the plant’s generating capacity from 1Mega Watt to 34Mega Watts with an annual energy output of 56.5Gwh,” Mr Silavwe said.

He said the project will be complete in the fourth quarter of 2022 and will primarily involve the installation of over 61,320 solar panels and the construction of two 11kV transmission lines.

Mr. Silavwe said the project was in pursuit of CEC’s goal to contribute to the global energy transition agenda while supporting the national agenda and aspirations for a diversified energy mix based on renewable energy sources .

He said CEC will through this project achieve optimal land use as the scheme will sit on the company’s existing land next to the 1MW plant in the wayleave reserve area which is land reserved specifically for purposes of expanding power infrastructure to meet the growing demand.

The CEC head said the expanded project will see the company contribute to the national generation portfolio between 150 to 30 0Mega Watts of renewable energy.

Meanwhile, Sinohydro Chief Executive Officer representative, Si Yang said the project is important in optimizing power generation.

“We have collaborated in Solar Energy which is important for optimisation of Power generation, structure, stability of national power grid as well as the impact of climate change, we will try our best to support and work with the local communities during the period of the project,” Mr Yang said.

In 2018, the energy company commissioned its one megawatt project at the Copperbelt University (CBU) as a way of diversifying to other sources of energy.

UPND Challenges Youths urged to be innovative

United Party for National Development (UPND) Secretary-General, Batuke Imenda says youths have the solutions to challenges they are currently facing and has urged them to be innovative.

Speaking when he launched the UPND National Youth and Sports Development Policy Framework in Lusaka yesterday, Mr. Imenda said the UPND government has prioritised education in the country as it acts as an equaliser in ensuring that young people are empowered to come up with innovations that will contribute to job creation the country.

He said government is alive to the challenges faced by youths in health, education, inadequate land ownership, lack of credit facilities, early marriages and unemployment and has expressed hope that the policy framework will be effectively used to benefit all Youths.

“If there’s anything this country knows is going to workshops and come up with very beautiful documents that will never ever see the light. I hope this particular one will be used or being promoted by your committee to ensure that the Youths really benefit from the actualization of this framework” he said.

Mr. Imenda further called on the business community to provide employment opportunities for youths stating that the private sector has a greater potential to create more jobs in the country.

And speaking at the same event, UPND National Youth and Sports Committee National Chairperson, Prudence Chinyama said the policy framework document seeks to address the identified mismatch between the skill needs of industry and what is supplied from the vocational and tertiary institutes and that the Committees mandate is to ensure that you Youths are equipped with employable skills at different levels of the economy.

Ms. Chinyama said the implementation of the policy document is expected to loop over the red tape between youths and government agencies as it builds institutional capacity to implement the action plans at all levels as enshrined in the UPND manifesto.

She said the framework is expected to be replicated in all districts of the country and address the needs of all the Youths irrespective of their social, cultural, religious and political backgrounds in order for it to be successfully implemented.

“We are alive to the fact that our Youths are from various social, cultural, religious and political backgrounds. Therefore the success of this policy framework and its implementation shall depend on the ability to manage and address the Youths needs without being selective nor segregative” she said.

Meanwhile, youth representative Mwangala Sipuma said young people are the potent power to the development of every nation and that the Zambian young people are ready to engage with government and provide entrepreneurship and employment opportunities for Youths.

Help grow the economy, Newly appointed Permanent Secretaries challenged by President Hichilema

President Hakainde Hichilema has appointed and sworn in new Permanent Secretaries, Special Assistants to the President and one national coordinator.

The President has challenged the newly sworn-in appointees to deal with the issue of debt burden to help grow the country’s economy.

President Hichilema further urged the newly appointees to reign in on government expenditure and public expenditure where he said buying of things are way above the true cost.

“It is you who is going to stop that so these two is in four parts. Fertiliser too much bleeding there. Blood oozing out of that valve. Fuel procurement some of you have been in government for many years and you know what I’m talking about,” he said.

Mr. Hichilema also implored the new senior government officials to work together and resolve the issues of expenditure in infrastructure development.

He added that that is what the people of Zambia who voted them in power want so that savings can be created for them and passed on to the education sector for their children.

“General procurement, everything is ten times the price,” he said.

And the Head of State indicated that government is re-looking at tendering processes to correct the wrongs that were being committed in the process that almost destroyed the country and its people.

“Please take the messages straight from here that this is the expectation so always know and implement as you take up your new offices,” he emphasised.

The President further urged newly appointed State House legal advisor, Christopher Mundia to make sure that that tender projects do not take long to get cleared so that revenue is created as well as jobs for the people.

“Legal Advisor, when we have a project on a table we want to clear it in a couple of weeks not months, why? Send it away, let the investment come in, domestic, region, foreign so that we can create an extra job,” the President said.

Mr. Hichilema emphasised that it is important that the newly appointees take their roles with full recognition of the obligations that are placed on them by the people of Zambia.

“We are coming in to work for the people of Zambia. So I wish to draw that linkage so that every day we go to the office, every day we have challenges about issues in the office, we must remember that it is the people that we are saving not ourselves,” he said.

And President Hichilema urged the newly Permanent Secretary for Technical Services in the Ministry of Health, Professor Lackson Kasonka to carefully look into the purchasing of drugs.

“Professor Kasonka how we buy the drugs in that Ministry going forward it will show that we are doing it for the people because otherwise, we would never buy expired drugs. So how did that happen because there were other interests before the people of Zambia and the people of Zambia have great trust in you. That’s why you are coming through as Permanent Secretary having gone through a lot in that Ministry,” the President noted.

President Hichilema said the appointment of Prof. Kasonka gives the country an opportunity now to rewrite how business is done in the ministry.

The President said a lot of issues have been tackled which have been bleeding for too long in the country’s administration and the health sector is one of them adding that he believes that the new Permanent Secretary is equal to the task.

“A health nation is a productive nation so we are proud of you,” he said.

And Prof. Kasonka noted in an interview that there is a lot of work to be done in the Ministry of Health to make the nation healthy and grow the economy.

The Permanent Secretary said he has been in administration before and that his appointment will be a continuation but at a higher level with more responsibility than before.

Those sworn in include Joseph Lungu as Special Assistant to the President Policy Compliance, Christopher Mundia Special Assistant to the President Legal Affairs, Margaret Miyoba Permanent Secretary Public Service Management Service Division (PSMD), Ndiwa Mutale Permanent Secretary Parliament Office, Office of the Vice President, Chembo Mvula Permanent Secretary Administration Ministry of Foreign Affairs and International Cooperation and Isabel Lemba Permanent Secretary International Relations, Ministry of Foreign Affairs and International Cooperation.

There is no need to make political statements around death-Nakacinda

Patriotic Front (PF) Member of the Central Committee in charge of Information and Publicity Hon. Raphael Nakacinda has castigated some political players for politicizing the death of Kabwata Constituency Member of Parliament Hon Levy Mkandawire.

Hon Mkandawire died yesterday after being hit by a car at his house.

Following his death, several political statements and articles have emerged with regards to the matter in question.

Among the articles is the one which was posted on Kodimuziba Facebook page accusing Mr Antonio Mwanza, the party’s MCC of having said the death of Hon Mkandawire is an act of God, fighting for the PF of which Mr. Mwanza has since refuted.

And speaking when he featured on Phoenix’s “Let the People Talk” program, Hon. Nakacinda lamented that Zambians have degenerated culturally with regards to respecting the departed.

“What is saddening is that I think from yesterday when that incident occurred we seem as a people to have degenerated in terms of our culture. The respect that we accorded the departed seemingly is not there.

The attempt to politicize everything before we could even get to understand what was going on, the police are working, the comments from all the political groupings, whether it’s the Patriotic Front, the UPND, they are very unfortunate including other political parties,” he said.

“I mean this is a father, a husband, a grandfather, I think we need to have empathy and think for a moment how the children are feeling, how the wife is feeling, how the grandchildren are feeling, the immediate family and of course the community that is being served.”

Hon Nakacinda stressed the need for people to put “politics aside and just look at this good human being” who offered himself to serve the people.

“And I think as politicians we need to try and provide leadership. On behalf of our party leadership, we want to say to our members, there is no need to make political statements around death…I think it is important that we mourn with the Mkandawire family, we mourn with the UPND,” he said.

Former Kabwata member of parliament Hon. Given Lubinda has sent the message of condolences to the family of late UPND member of parliament Hon. Levy Mkandawire.

In an interview, Hon. Lubinda said the death of Hon. Mkandawire brings sorrow and sadness to him.

Hon. Lubinda said he knew late Hon. Mkandawire when he served as councilor in Kabulonga.

He said late Hon. Mkandawire was an exemplary leader and sad that he died in an unfortunate circumstance.

” I mourn with the family of late Levy Mkandawire, member of parliament for Kabwata constituency. I have known levy for the last six years, having worked with him at the Lusaka city council when he served as councilor for Kabulonga ward and I was a member of parliament for Kabwata constituency. I knew him as a humble gentleman and very soft-spoken and extremely jovial. He was also a very loyal person to authorities,” he said.

“His demise brings sorrow to me and many who knew him especially that he died in an irregular circumstance. He was involved in a car accident right in his yard and sad that he died two weeks after social media had rumored that he had died. Unfortunately, he died without providing leadership which he had promised the people of Kabwata which is very sad,” He said.

Hon. Lubinda has since called upon electorates especially PF members to allow that late Mkandawire may have a dignified funeral.

“And also I urge the UPND members to allow the people of Kabwata from across political divide to mourn in an environment of sobriety and mutual respect,” Hon. Lubinda said.

Bowman Lusambo and Joseph Malanji’s Elections as MPs Nullified by Lusaka High Court, Miles Sampa Survives

THE Ndola High Court has nullified the election of Kabushi Member of Parliament Bowman Lusambo on grounds of electoral malpractices.

In this matter, United Party for National Development (UPND) losing candidate Bernard Kanengo petitioned Mr Lusambo of the Patriotic Front (PF) citing malpractice before and during the August 12 General elections.

Lusaka High Court Judge Edward Musona sitting in Ndola nullified the seat stating wide spread violence noting that Mr Lusambo did not disassociate himself from his militia group known ‘the Nato Forces’, which was attacking the electorates.

“I am satisfied that the respondent had knowledge of the violence and his alibi regarding the violence episodes which were successfully challenged by the petitioner,” judge Musona said.

During hearing of the petition, Mr Kanengo narrated to the court how he went to hide at a mosque after the respondent’s supporters known as the Nato Forces searched and chased after him as he ran for his dear life with Mr Lusambo and his Nato Forces in hot pursuit.

The Petitioner said he was dissatisfied with the Electoral Commission of Zambia’s declaration of Mr Lusambo as the winner of the August 12 parliamentary seat for Kabushi Constituency because he breached the electoral code of conduct.

The UPND candidate also told court that the Nato Forces poured hot porridge on his supporters in Masala.

“On July 17, I was informed by Robson Kapambwe and Andrew Mulenga on how they were attacked by the Nato Forces. The people were assaulted after the attackers saw them putting on UPND regalia,” he said.

But Mr Lusambo who is popularly known as the ‘bulldozer’ dismissed thhe allegations that he bribed choir groups stating that he has between 2015 and 2021 attended over 40 churches in his constituency in his capacity as area lawmaker.

“As an Mp, my job is to interact with the people and being a Christian my Lord, from 2015 to date, I have visited more than 40 churches and I have interacted with congregants including choir members, ” he said.

Mr Lusambo further dismissed allegations that his agent, a Mrs Nyirenda rounded up UPND members and treated them to a banquet of food.
He described the allegations that he gave a group of young men K4000 and also promised them slug dumps once they voted for him as total imagination and fabrication.

“On the material day, I was in Lusaka preparing campaign materials for our party on the province,” he said.

And The Lusaka High Court has also nullified the Kwacha parliamentary seat held by former foreign affairs minister Joseph Malanji.

Meanwhile, the Lusaka High Court has dismissed the election petition by losing UPND Matero constituency parliamentary candidate Tom Michelo.

Mr. Michelo had petitioned the election of PF Matero Member of Parliament Miles Sampa alleging that he had engaged in electoral malpractices thereby rendering the election not free and fair.

Rendering judgment in the matter, High Court Judge Derrick Mulenga dismissed the petition on the basis that the petitioner failed to prove the allegations leveled against the respondent.

Judge Mulenga says the petitioner failed to meet the threshold required for an election to be nullified.

And speaking to journalists shortly after the judgment was delivered, Mr. Sampa described the whole process as emotional especially because he was accused of beating up voters when he was the victim.

Meanwhile visibly annoyed UPND members accused the opposition PF of having placed cadres in most government offices, hence the unfair outcome of the petition.

The National Biosafety Authority GMO foods seized from Shoprite

The National Biosafety Authority (NBA) has destroyed various food products containing Genetically Modified Organisms which were seized from Shoprite outlets worth over K16,000.

NBA Communications Officer Sandra Lombe explains that while the products that may have contained genetically modified organisms were seized from Shoprite stores and Melisa Supermarket in Lusaka, only those products seized from Shoprite were destroyed.

Ms. Lombe says the products were placed on the market without prior authorization from the authority.

She says during the spot and compliance checks the authority discovered that the two stores were trading in some products which may contain GMOs that were not assessed for their safety prior to being placed on the market, thereby contravening the Biosafety Act.

Ms. Lombe says the authority, at Shoprite Cosmopolitan Mall, seized various soup products and snacks that may contain GMOs.

There was rampant misuse and misdirection of Covid-19 resources-Auditor General

The Audited Report on utilization of Covid Resources as compiled by the Office of the Auditor General has revealed glaring misuse and misdirection of public resources.

Auditor General Dick Sichembe says the report is not impressive as rampant misuse and misdirection of Covid resources have arisen.

Dr. Sichembe is saddened that those who were supposed to rise to the occasion to utilize resources and save lives of people affected by Covid-19, took advantage of the situation and helped themselves to Covid resources.

He says his office has finished the process of auditing the last part of the utilization of Covid-19 funds and will likely release it around December 15th.

Dr. Sichembe was speaking in an exclusive interview with ZNBC News in Lusaka.

The Auditor-General said the findings of the report will be shared with the nation as the procedure will be followed of sharing it with the President and Parliament for debate.

Dr. Sichembe said the public will be well enlightened on the extent of the misuse of Covid resources when the report is released.

Vice President Mutale Nalumango Apologies for the detention of Former Defence Minister Davies Chama

Vice President Mutale Nalumango has apologized to Parliament after initially suggesting that the charge of attempted murder facing former Defence Minister Davies Chama was a non-bailable offence.

The vice president was responding to a question by the leader of the opposition in Parliament Brian Mundubile who wanted to know why the Police have continued to detain suspects for a prolonged period against the President’s pronouncement that no one will be detained for more than 48 hours for bondable offences.

The Vice President said she had consulted and that she was guided by the relevant people that the offence of attempted murder was available.

Mrs Nalumango said she was not ashamed to admit the omission.

Mr Chama has been in Police detention for the last six days for a case of attempted murder committed during a by-election in Mulobezhi constituency in 2015.

Unbeaten GBFC Host Konkola Blades

Green Buffaloes are sure of staying top of the FAZ Super Division table when they host Konkola Blades on Saturday in Lusaka.

Buffaloes have a three point lead over second placed Nkwazi going into Saturday’s Week 12 lunchtime encounter at Nkoloma Stadium.

Coach Justin Chinama’s unbeaten Soldiers have 25 points from 11 matches played.

Promoted side Konkola are placed 12th on the table with 11 points after playing ten matches.

It is unlikely that Konkola will trouble Buffaloes, who are coming from a 1-0 midweek victory over Kafue Celtic.

At the same venue, Nkwazi will be out to maintain second place on the table as they visit Red Arrows at Nkoloma Stadium.

Nkwazi are confident after thumping Zanaco 2-0 in midweek action.

Eleventh placed Arrows have 13 points, nine behind Nkwazi, after 11 games played.

FAZ President Andrew Kamanga has responded to former Zambia republican president and FAZ life member Rupiah Banda’s sentiments about Football House in the aftermath of Chipolopolo’s 2022 Qatar FIFA World Cup qualification flop.

RB, in an interview journalist Kennedy Gondwe after Zambia’s 3-1 away loss to Tunisia on November 16, said Kamanga should take an introspection of their list of failures during his reign.

“Following recent comments by former President Rupiah Banda on Zambian football in which he spoke about the senior national team’s performance, his desire to see certain individuals involved in football decision-making and other aspects of the game, I will, in due course, out of respect to the former president, seek audience with him to exchange views on the matters he touched on,” Kamanga said.

“I wish to reiterate that I have only full admiration for him as a father figure, former President of the Republic, and former vice chairman FAZ, chairman of Zambian Soccer Fans in the seventies and he has personally on occasion been a source of advice and wise counsel.

“The executive committee of the Football Association of Zambia remains open to all advice and counsel from stakeholders who seek the betterment of Zambian football and continue to maintain an open-door policy.”

Green Buffaloes Retain FAZ Womens League Title

Green Buffaloes have successfully defended the FAZ National Women’s League with three matches left in the season after Thursday’s 5-0 win over Nkana Queens in Lusaka.

Buffaloes have won this season’s title under a new format branded the FAZ Women’s Super League.

In the Week 24 fixture at Green Square Ground in Lusaka, striker Theresa Chewe registered a hat-trick with Captain Joanna Benaya and Natasha Nanyangwe contributing a goal each.

Chewe has scored 27 goals, five behind leading scorer Grace Chanda of Red Arrows.

Buffaloes coached by Charles Haalubono have an unassailable lead after collecting 59-points, eight ahead of second placed Arrows, who have played one more game than the Zambia Army side.

Meanwhile, Nkana remain bottom of the table with six points from 23 games played.
